The request is for reclassification of +.61 acres of land from R-3 (medium density multifamily) and L-1 (light industry) to B-1 (business) to permit the construction of a' retail shopping center. f, 2. The Planning Department report sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal will have to meet the required setbacks,' lot coverage and height requirements of Sections 4-711 (Business) and 4-716(b) (1) (Highway Restrictions) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The subject parcel is located just south of the intersection of South Grady Way and the Benson Highway. The parcel is approximately 40 feet below the grade of the Benson Highway and is effectively landlocked. The proposed access to the subject property is via the Atlantic Services property to the north. 9. The proposed rezone to B-1 has been requested in order to develop the subject parcel in an, integrated proposal with the Atlantic Services property to the north. The Atlantic Services property has also requested a rezone to B-1 and that request, pending before the City Council, has received :a positive recommendation from the Hearing Examiner (File No. R-363-79) . 10. The site was part of the original plat of the City of Renton. The current zoning, B-1 and R-3, was applied at the time the city initially zoned property under the 1953 Zoning Ordinance. , 11. The Comprehensive Plan has designated the area in which the subject property is located as suitable for the development of light industrial uses. Also the map for this area shows a mixture of uses converging in this area. 12. The site ,with the exception of the steep bank along the Benson Highway is generally level. The site is vacant and covered with a combination of vegetation and asphalt paving material. 13. The subject property is surrounded by a variety of zoning categories including R-3, S-1 (single family residential) , L-1 and B-1. The lot to the north with which the. subject lot is proposed to be developed has requested reclassification to B-1 and ' this request_ is pending the execution of restrictive covenants dealing with setback requirements. 14. it does not appear that this site has been considered in any previous land use or zoning analysis since the adoption of the Comprehensive Plan. 15. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application,. and fie d checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on October 9, 1979 at 9:55 a.m. in the Council Chambers of th- Renton Municipal Building. . Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing ,Examiner and the applicant had received and xeviewei the 'Planning Department report, and the report,was entered into the record as Exhibi #1. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting other specified requirements. CONCLUSIONS: 1. The applicant for a rezone must demonstrate that the requested reclassification c•mplies with one of the criteria enumerated in. The subject site is potentially designated for the new classification per the ' . Comprehensive Plan; or . c. The area in which the subject site is located has undergone significant and ' material change since the last analysis of the subject site or area. ' . "r The applicants have demonstrated that the requested rezone ,is in the .best interes•s ' of the public and meets the criteria listed above. - 2. The proposed rezone would reclassify.the subject property into one zoning cateogr rather than its present dual classification of R-3 and L-1. The applicant propos:s to integrate. the subject site in the proposed retail shopping center being developed by Atlantic Services on land it has requested be reclassified B=1, and it would ' 'therefore be logical to unite both pieces of property into one B-1 category. • 3. .Only a small portion of the subject site is in each of its present zoning categor'es • and use Tor either residential or industrial purposes is limited. Howeve , the B-1 zone requested is more in keeping with the shopping center the' applicant 'ntends to develop on the subject property. 5. The area surrounding the subject site includes the Central Business District and n area of single family residential development. The proposed B-1 zone would be mo e . in character with the actual uses of the surrounding properties than an L-1 zone and would provide more benefits for the residents of the area. The proposed rezo e would serve the public interest and the City Council should approve the requested change from L-1 and R-3 to B-1. 6. The City Council has requested,the execution of covenants to provide a 20-foot se ack between all structures and Main Avenue S. (the Benson Highway) for the Atlantic Services property and because the subject property is proposed to be developed • simultaneously with the Atlantic Services property, that same requirement should be . maintained for the 'subject•property. Rate Increase Letter from Thorun Robel , 3606 Meadow Ave. N. , represented Opposition to Puget Power customers and asked the support of the City in Puget Power opposing a fuel adjustment rate raise(every two months) which has been requested by Puget Power. The letter explained that the Washington State Utilities Commission would hold a meeting in Olympia 11/29 to consider Puget's request and asked the Mayor and City Council to join in opposition. The letter explained Puget will ask for another increase in January, that they have announced a moratorium on building nuclear plants and the ratepayers are requesting a moratorium on rate increases. Mrs. Robel was present and explained 36% increase will be asked by Puget on the 29th and another increase in January and asked that the City Attorney be sent to represent the City and citizens opposing rate increase. Lenas Westman, 19415 143rd P1 . SE, quoted Seattle Times newpaper article that the purpose of the increase was to establish climate to attract future bond buyers not to meet current expenses. Upon Council inquiry, Finance Director Marshall noted 25% increase was established in the Mayor's Preliminary Budget for electrical power. No Council action was taken.
