The Act also requires that an EIS be prepared for all major actions significantly affecting the quality of the environment. The purpose of this checklist is to help the agencies involved determine whether o.r not a proposal is such a major action. Where explanations of your answers are required, or where you believe an explanation would be helpful to government decision makers , include your explanation in the space provided, or use additional pages if necessary. We are now in the process of shortplatting our lot 51 have found that the area in which we live has incorrect zoning for the size of most of the lots, The planning depart- ment has informed us.. that because of our shortplat division we must rezone, which envolves paying a fee of $106. We feel it was the city's responsibility to rezone at the time of incorporation to the same zoning that totally surrounds us. SUMMARY, OF REQUEST: Applicant seeks approval of a rezone from G to SR-1 for the purpose of future subdivision into smaller lots. SUMMARY OF Planning .Department: Approval RECOMMENDATION: Hearing Examiner: Approval PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on October 12, 1979. • PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was Opened on October 16, 1979 at 9:45 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. David Clemens, Senior Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: King County Assessor's Map • Exhibit #3.: Site Plan The Examiner inquired regarding the typical .lot size in the area of the subject site. Mr. Clemens reviewed location .of lots adjoining arid, surrounding the subject property which contain area ranging from 5,000 square feet to over an acre in size with an average of • approximately 7-8,000 square feet. The Examiner asked the applicant ,if he concurred in the recommendations of the Planning Department contained in Exhibit #1. Responding was: • Michael Baker 2109 Talbot Road South Renton, WA 98055 Mr. Baker indicated his concurrence in the report. Since there was no response to the Examiner's request for further testimony in support or opposition to the application, or further comments from the Planning Department; the hearing regarding File No. R-416-79 was closed by the Examiner at 9:52 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: • 1. The request is for approval of a reclassification of +.65 acres of land from G (General) to SR-1 (Single Family Residential) . • • 2. The Planning Department report sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43..21.C. , as amended, 'a Declaration of Non-Significance has . been issued for the subject proposal by Gordon Y. Ericksen, responsible official. ,- y • R-416-79 Page Two 4. Plans for the .proposal have been reviewed by all city departments affected by t e impact of this development. S. There was no opposition to the proposal expressed. 6. Adequate water service is available along Talbot Road South and will be furthe. 'upgraded in the immediate future. A sewer main is 120 feet to the west along 'Shattuck ,ve. S. The applicant has not been able to procure an easement across adjoining property to bring sewer service to the subject property. 7. The subject property contains a single family residence, an unattached .garage hich is legally nonconforming as to front yard setback, and another accessory bu lding The garage is 17 feet from Talbot Road South. The existing residence is approximaely 47 feet from the roadway. 8. The applicant proposes to subdivide the subject property into two lots if the rezone is approved and an application for short plat is pending (File No. Short Plat A17-79) . • 9. The Comprehensive Plan designates the area in which the subject property is located as suitable for single family residential development. •. 10. The subject site was annexed into the city by Ordinance No: 3316 passed on Ma 23, 1979. The current "G" zoning was applied at that time. 11. The area immediately surrounding the subject site is also zoned "G". SR-1 zo ing currently is applied_ to parcels north and west of the subject site. There is also a large area zoned SR-1 to the 'south and east of the site. G-9600 zoning al•.o is located south of the subject site. • 12. The actual lot sizes in the area vary from about 5,000 square feet to over an acre, but a predominant number of the lots are within the 7,000 to 9,000 square foOt ra ge. 13. The present requirements of the "G" zone include a 35,000 square foot lot siz- while the requested SR-1 would require a minimum lot size of 7,500 square feet. Th- subject parcel contains 28,280 square feet. CONCLUSIONS: 1. The proponent of a rezone must demonstrate that.the request fulfills at leas one of the criteria cited in Section 4-3014 which provides in part that: a. The site has not been considered in a previous area wide rezone; b. The site is potentially designated for the new classification per the Co prehensive Plan; or c. The area in which 'the subject site. is located has undergone signicant an. material change since the last analysis of the subject site. The applicant has demonstrated that the criteria enumerated have been met. 2. The area in which the subject site is located is designated in the Comprehen-ive Plan for single family development. The area is presently developed in single family use. The lot sizes are predominantly in the SR-1 range in size, that is 7,500 square feet. The reclassification of. the subject property would permit the division of 'th- subject lot into two lots which would be in character with the size of developed lot- in the area. • 3. The property was recently annexed to the city and has not been the subject •f any previous land use analysis and the current request appears justified in lig .of surrounding development. The rezone would benefit 'the public by providing .dditional area for potential development of single family housing without at the 'same time burdening the existing public services. • RECOMMENDATION: The requested reclassification from G to SR-1 should be approved. Change in Accident Letter from Beth Campbell , 4037 SE llth St. , reported being Report Requested struck by automobile in the crosswalk at Bronson Way and by Bicyclist Factory St. causing over $100 damage to her bicycle while she was knocked down. Because of the $300 minimum property damage clause in the State law that does not require an ' accident report to be filled out, Mrs. Campbell feels the City and State should request change in Motor Vehicle Collision Report No. WSP 161 (Rev. 9/77) to include all accidents involving motorists and pedestrians where any amount of property damage is sustained.
