Public Safety / The Public Safety Committee report submitted by Chairman Hughes Committee ' recommended revision of the Taxicab Ordinance, 5-1912 - Taxicab ax�T—cab Zones, to establish one additional taxi zone at the northwest Ordinance corner of 3rd Street and Burnett Ave. , contingent with a telephone installation at that location. The committee further recommended referral to the Ways and Means Committee for proper legislation. MOVED BY HUGHES, SECOND SHANE, CONCUR IN REPORT. CARRIED. RECOMMENDATION: Hearing Examiner: Approval with restrictive covenants. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on May 15, 1980. PUBLIC HEARING: After reviewing the Planning Department report , examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 20, 1980 at 9:23 a .m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report. Roger Blaylock, Associate Planner, reviewed the report , and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: King County Assessor's Map Exhibit #3: Schematic Site Plan Exhibit #4: Cross Sectional Diagram Referencing Section 1 .5 of the Planning Department report , Mr. Blaylock corrected the number of anticipated traffic trips per day from 125 to 156. The Examiner informed the applicant that development of 26 duplex units on the subject site would require approval of a special permit by both the Examiner and the City Council in accordance with Section 4-708.2 of the Zoning Code. He also advised that Section 4-708 of the code requires a front yard setback of 20 feet and a rear yard setback of 25 feet. The Examiner requested testimony by the applicant. Responding was: James S. Fitzgerald P.O. Box L Kirkland, WA 98033 Responding to the Examiner's inquiry regarding concurrence in the Planning Department staff report, Mr. Fitzgerald indicated general concurrence with certain minor exceptions. He encouraged approval of the application, and noted that conditions recommended by the Planning Department would mitigate any adverse impact on the surrounding neighborhood. Mr. Fitzgerald referenced a memorandum directed to the City of Renton from May Creek Associates, dated March 31 , 1980, which delineates supporting circumstances for approval of the request. The Examiner advised that the memorandum is included as part of the record in Exhibit #1 . Mr. Fitzgerald also requested that the previous rezone request, File No. R-217-78, be entered into the record by reference. He reviewed background of the previous request for an R-3 zoning designation which had been denied by the Hearing Examiner on October 19, 1978, and reconsidered on November 7, 1978 in response to a request for reconsideration by the applicant. Mr. Fitzgerald indicated that following the Examiner's approval of the request to reconsider, the Planning Department had determined the necessity of an environmental impact statement in consideration of the requested R-3 designation. Following receipt of this information, the applicant withdrew the application due to the undesirability of the R-037-80 Page Two expense and delay of an EIS review. However, the record indicates the Examiner 's opinion that R-2 zoning is appropriate on the subject site, he ,noted. Mr. Fitzgerald reviewed the three criteria denoted in Section 4-3014 of the Hearing Examiner Ordinance, one of which must be found to apply in order to recommend approval of a rezone, and advised that the applicant far exceeds the minimum requirement in : 11 three criteria: 1 ) That substantial evidence was presented demonstrating the subject reclas. ification appears not to have been specifically considered at the time of the last area land use analysis; Mr. Fitzgerald indicated that the zoning, G-9600, on the site has remained the same since annexation in 1960, and no specific con. ideration of reclassification of the property has occurred since that date. 2) That the property is potentially zoned for the reclassification being requested , pursuant to the policies set forth in the Comprehensive Plan; Mr. Fitzgerald noted that the Planning Department had found that the proposed rezone to R-3 was consistent with the Comprehensive Plan, and because R-2 is a less in ensive use, it is clearly authorized by the plan. 3) That significant circumstances and changes have occurred in the area of he requested rezone since the last area wide land use analysis; Mr. Fitzge ald reviewed zoning changes in the immediate vicinity subsequent to annexation into the city, including reclassification of Parcels 184 and 193 from G-`600 to B-1 in 1969, and rezone of Parcel 185 from G-9600 to B-1 in 1970, properties immediately south of the subject site. He stated that across the freewa to the west, the site of Misty Cove Apartments was rezoned from G-6000 to R 4 in 1966, and the property to its immediate south apparently retained H-1 zo ing. Adjacent to the south and east of the subject site is county designated RM-1800, high density multifamily, property. On Parcel 183, a special permit was granted by the city in April , 1979 for fill and grade with plans of constructing a 100-unit motel complex on property due south of the freew-y interchange.. Mr. Fitzgerald noted that the above referenced changes are consistent with the city's Comprehensive Plan, which indicates commercial and business use of the area and medium density multifamily buffer in which the subject site is located around th= perimeter. He also advised that all utilities are available and in close proximity to the site, and improvement of Lake Washington Boulevard is scheduled on the Six-Y=ar Street Improvement Plan for installation of curbs, gutters, sidewalks, paving , d ainage and illumination, which will mitigate what minimal traffic increases would be generated by the project. Mr. Fitzgerald referenced several goals and policies of the Comprehensive Plan which are met by the applicant in his proposal , including: 1 ) prevent blight by protecting residential and other exclusive districts from the unwarranted infiltration of incompatible uses which would contribute to premature decay and, obsolescence, and prevent the development of orderly growth patterns; 2) increase community livability by improving environmental fact.rs which are closely related to the residential districts and other community areas; 3) pr.tect property values within the community for the benefit of its residents and propert owners through the effective control of land use and the enforcement and application of Building and construction codes; 4) promote the development of a viable, progressive commu ity which provides ample opportunity for citizen participation in a broad spectrum of activites; and 5) encourage the development and utilization of land to its highest and best se in such a way as to promote the best interests of the community and contribute to it, overall attractiveness and desirability as a place in which to work, shop, live and play. Mr. Fitzgerald concluded that single family residential development is clearly no appropriate use of the property, development of low density multifamily dwellings will minimally impact the existing neighborhood, and will , in fact, provide a buffer t. the residents to the east and north to increase community livability. He noted that he proposed zoning is a logical extension for orderly growth in the area and achieve. the social and physical amenities envisioned by the Comprehensive Plan. Mr. Fitzgerald indicated that the view from only one single family residence directly to the eas of the subject site would be impaired by the development, and the view is currently plocked by an existing knoll on the site. He also requested that the Hearing Examiner en er a finding that the proposed use is in compliance with all provisions and standards, and that the required special permit be granted pursuant to Section 4-708. The Examiner advised that his authority does not extend to approval of a request or special permit until proper application is made and the public hearing publicly a.vertised . Mr. Fitzgerald indicated that the applicant 's intent was clear in his request for 26 units on the subject site, and requested that the Examiner recommend that the special p-rmit be approved if it is determined possible. R-037-80 Page Three The Examiner requested testimony in support of the application. There was no response. He then invited comments in opposition. Responding was: Susan Rendahl 7805 113th S.E. Renton, WA 98055 Mrs. Rendahl referenced a letter and petition signed by property owners in the immediate vicinity of the subject site which had been submitted to the Examiner on May 19, 1980, and included in Exhibit #1 . She represented the residents in stating objections to development due to unstable soil conditions, inadequate roads, and existence of natural springs in the terrain. She advised that many residents in the area had constructed their homes on large parcels of land due to the instability of soil and the necessity to install provisions for drainage. Mrs. Rendahl referenced the Newcastle Community Plan, pages 10 through 15, which further delineates severe landslide potential in the area. She noted that although Lake Washington Boulevard is scheduled for improvement, its current condition would not accommodate traffic generated from the proposal as well as other property currently being developed in the vicinity. She felt that potential landslides which may occur as a 'result of the weight of the proposed development and removal of existing vegetation will also create hardships to the developer. The Examiner requested further comments in opposition. Responding was: June Huson 1130 S.E. 76th Renton, WA 98055 Ms . Huson was affirmed by the Examiner. She stated that her concern as the adjacent neighbor directly east of the subject site regards the method of construction and the proposed height of the structures which would obstruct the view from her residence. She noted that the site containing her combination residence/artist studio was selected because of its privacy and aesthetic location, and these aspects should be reviewed and considered prior to approval of a rezone of the subject property. The Examiner indicated that the submitted conceptual site plans are not binding upon the applicant at this stage of review, but the issue is whether the property is suitable for development of low density housing in an R-2 zone. Mr. Fitzgerald clarified that the site is relatively level in comparison with the steep hill directly to the east, and while the hill may have a landslide potential , the subject property levels out to a plateau. He advised that the Planning Department has analyzed the capability of the existing roads to accommodate additional traffic and has found that minimal impact will occur. Referencing Ms. Huson's testimony, Mr. Fitzgerald indicated that a substantial swath of vegetation currently blocks the view from the existing residence, and the applicant proposes to retain the trees along that eastern boundary of the site as well as along Lake Washington Boulevard. Ms. Huson clarified that the existing trees on the eastern boundary of the site are deciduous and provide a buffer from noise and light during the summer, but a view of the lake is enjoyed during the winter season. The Examiner requested final comments. Since there were none, the hearing regarding File No. R-037-80 was closed by the Examiner at 10: 17 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The request is for approval of a reclassification of 2.52 acres of property from G-9600 (General ; Single Family Residential ; Minimum lot size - 9,600 square feet) to R-2 (Duplex Residential ; Minimum lot size - 7,200 square feet) . 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. R-03/-o0 Page Four 5. All existing utilities are available and in close proximity. 6. The subject property is located at the northeast corner of the intersection of Lake Washington Boulevard and S.E. 76th Street . 7. The subject site was annexed into the city in 1960. A petition, filed in 1978, to reclassify the property to R-3 (Medium Density Multifamily) was denied by the Hearing Examiner and the request for reconsideration was dismissed in January of 19:0. 8. The site has varying slopes ranging from 6% in the north to 14% near the south property line along S.E. 76th Street. Runoff on the site is medium, and the erosion hazard is moderate to severe. Development plans for such slopes would be subject to review and approval of the Public Works Department. 9. The site is covered with dense ground cover and there are stands of deciduous trees. scattered throughout the site. 10. There are two existing single family dwellings and an accessory structure on the site. 11 . There are scattered single family residences located north and east of the subject site. A large apartment complex is under construction in King County south-ast of the subject site. South of the subject site, adjacent to S.E. 80th Street and Lake Washington Boulevard, a permit to allow fill and grade was approved within the last three months '(Sea-Belle Properties, File No. SP-402-79) . Similarly, a permit to fill and grade was approved in 1979 on Parcel 183 (File No. SP-321-79) to allow proposed construction of a motel complex. 12. Zoning in the areas adjacent to the subject property is a mix of residential, commercial and industrial . The residential consists of a mixture of G-9600, the subject site's current designation; G-6000 (General ; Single Family Residential ; Minimum log size - 6,000 square feet) northwest of the subject site; R-4 (High Density Multifa ily) to the west; and RM-1800 (King County High Density Multifamily) to the southeast. There are B-1 districts (Business/Commercial ) south of the subject site and a newly rezoned B-1 parcel southeast of the site. H-1 (Heavy Industry) zoning is located along the lake southwest of the subject site. 13. The site i,s located at the extreme north end of the city and lies adjacent o I-405. Lake Washington Boulevard, a major arterial , forms the western boundary of he subject site. Lake Washington Boulevard is scheduled for improvement under the Six Year Street Improvement Plan. Included improvements will be curbs', gutters, sidewalks, drainage and lighting. S.E. 76th Street, forming the southern boundary of the prope ty, beg'ins climbing off of Lake Washington Boulevard and is underlain by springs in the area. 14. The Comprehensive Plan designates the area in which the subject ,property is located as suitable for the development of medium density multifamily housing. The R-• designation is generally consistent with low density multifamily .housing. 15. The previously denied rezone to\ R-3 was disapproved as premature and incomp-tible with the surrounding development. The Hearing Examiner indicated that R-2 4oning would be more compatible with surrounding uses. 16. The 2.52 acre (109,771 square feet) lot as zoned would permit approximately eight to ten 'single family homes if the parcel were subdivided. The proposed zoning of R-2, without subdivision or special permit, would permit the establishment of on= duplex unit. Routine subdivision, if approved, would permit the establishment of -pproximately 12 duplex units on 7,200 square foot lots. A special permit with City Coun• il approval would allow the establishment of up to 27 townhouse units on the subject property. 17. The applicant has submitted a conceptual site plan which indicates that the applicant intends to proceed by special permit and proposes to establish 26 units on 'he subject property. The plans are conceptual and do not bind the applicant to those -pecific plans. 18. The maximum development of the subject site under the proposed reclassifica' ion would permit the establishment of approximately 27 units which would have the pot:ntial of increasing the number of residents by approximately 68 persons; the school .ge population by approximately six students; and the number of vehicle trips b approximately 162 trips per day. 19. The legal notification indicated only that a rezone request was to be heard on May 20, 1980. There was no indication in that notice that a special permit to establish townhouses would be .heard at the hearing. 20. The establishment of the permitted duplex structures on the subject site ha the potential to block the views of adjacent property to the east . The Plannin'� Department R-03, .;O Page Five recommended that the height of the future structures be limited to 25 feet in order to mitigate the impact of the greater intensity duplex development on the adjoining single family properties. Similarly, the Planning Department recommended buffering these properties to the east with at least a 20-foot setback requirement. Section 4-708(4) (b) requires a minimum 25-foot rear yard. Depending on the designated frontage of the property, the rear yard could either be along the north or east property lines of the property. CONCLUSIONS: 1 . The proponent of a rezone must demonstrate that the request is in the public interest and will not impair the public health, safety and welfare in addition to compliance with at least one of the three criteria listed in Section 4-3010 which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. The applicant has demonstrated that the necessary criteria have been met to permit the reclassification of the subject property. 2. The Comprehensive Plan designates the area in which the subject site is located as suitable for the development of medium density multifamily housing. The applicant . has proposed low density multifamily zoning for the subject property in order to create a less intense buffer between the single family housing directly north and east of the subject site and the higher intensity development and 1-405 west of the site. 3. In a previous application and respective analysis, the Hearing Examiner indicated that R-3 zoning was too intense for the subject site but that R-2 zoning with certain restrictions could be made compatible with the site and surrounding development. The applicant's proposal as conditioned below will permit such integration of the proposed R-2 zoning and the adjacent single family areas to the north and east. 4. The R-2 zoning requested by the applicant is generally more compatible with the surrounding zoning and development than that suggested by the map element of the Comprehensive Plan. The R-2 would be less intense and would prevent the intrusion of incompatible land uses into the area in which the subject property is located (Page 17, Comprehensive Plan, Objective No. 1) . The R-2 zoning would also protect property values within the community through effective control of land use ( Ibid, Objective No. 4) . The textural guidelines of the Comprehensive Plan along with sound land use principles support R-2 zoning rather than the more intense R-3 zoning. 5. A number of the parcels which are compatible with the zoning of the subject site have been recently rezoned or been the object of further development procedures such as special permits for fill, and grade. These include the Pickle rezone, the rezones of Parcels 184, 185 and 193, all to B-l ; the Misty Cove rezone to R-4. The special permits to fill and grade were recently approved for Sea-Belle Properties and the Austin Company. The construction of the large apartment complex in King County just. south of the subject property has recently occurred. This 'indicates that the area has undergone significant and material changes in the recent past. 6. The proposed rezone is also compatible and consistent with the changes which have occurred in the area as enumerated above. Further, the proposed rezoned property will serve as a buffer between these more intense uses and the single family uses north and east of the subject property. 7. The topography of the subject property is irregular and unless specific concern and consideration is given to the topography, view blockage, noise and other physical encroachment will occur if development on the subject parcel proceeds under the .R-2 zoning. Therefore, in order to mitigate these problems, the imposition of a height limitation and setback buffer for development on the subject property is appropriate. The Planning Department has indicated that a 25-foot height limitation would protect the easterly properties from view blockage and the encroachment of the more intense R-2 property. Similarly, a 25-foot setback which would be required as a rear yard in the R-2 zone (Section 4-708(4) (b)) could also achieve the necessary separation and avoid the impacts of intense development along the east property line. , a R-037-80 Page Six 8. Pursuant to Section 4-708(4) (a) , a front yard of at least twenty feet is required in an R-2 zone and it would be appropriate to maintain that setback along Lake Washington Boulevard, a heavily traveled arterial . Also, maintaining the western property line as the front of the subject property would be consistent with designating the eastern edge of the property as the rear yard for setback and buffering requirements -s indicated above (Conclusion No. 7) . 9. The legal notice of a public hearing to consider a zone change on the subject property was insufficient to apprise the general public of a further hearing to permit the establishment of townhouses on the subject property pursuant to the special permit procedures of Sections 4-708(3) and 4-722(B) . Therefore, the applicant will be required to apply for a special permit under separate application and a public hearing will be held to determine the appropriateness of the request. RECOMMENDATION: The City Council should approve the reclassification of the subject property from G-9600 to R-2 subject to the following restrictive covenants: 1 . That no building o,r structure exceed a height of twenty-five (25) feet; 2. That a twenty-five (25) foot rear yard setback be maintained along the eastern property line pursuant to Section 4-708(4) (b) ; 3. That a twenty foot (20) front yard setback be maintained along the western property line adjacent to Lake Washington Boulevard pursuant to Section 4-708(4) (a) . ORDERED THIS 2nd day of June, 1980. We represent the immediate property owners and members of the community that would be most affected by the proposed intensification of the land use. We, for the most part, have been present at the other hearings concerning the proposed rezone of this parcel and made what we feel were very significant and important points as to our objections to situations which have not changed and will not change in the future. Our objections are based on the very principles of the County' s Comprehensive Plan that we as community members relied upon when we purchased or built our present homes . The subject property is steep and of seijere landslide potential (Newcastel Commu- nity Plan, pgs . 10 through 15) which causes the property owners on the upper adjacent property great concern. We also have a totally inadequate road system, in particular the steep hill known as S.E. 76th, which by the county's own admission is impossible to keep in good repair due to the unstable soil conditions and natural springs on the hillside. Related to this is an already overburdening traffic condition that has produced a serious accident potential on the very narrow existing roadways of which a further intensification would be intolerable. Although this property is in the City of Renton it is surrounded by, and adjacent to, land that is presently in the county whose land use is governed by the comprehensive plan currently in effect. There is adequate zoned property in the immediate vicinity that is undeveloped at present, in addition to development that has CITY OF RENTON/Fred Kaufman May 15, 1980 Page 2 taken place that will surely have an adverse impact on the traffic and overcrowding conditions already existing. We are very much opposed to increasing zoning that would allow a further deterioration of the immediate community. This parcel was denied a rezone at a previous hearing and since then the community has been able to review the Newcastle Commu- nity Plan which reconfirmed past studies indicating the extreme danger of soil instability on the subject property and the entire hillside area. The entire area is classified as a class III severe landslide hazard area. The very policies of King County Comprehensive Plan, which must be considered in this case, call for these areas of landslide potential to be left undeveloped or at the very most developed in a way to allow. for very low intensification of land use. Many of us in the community have built our homes on large parcels of an acre or more because of the soil tests and drainage problems, and secondly so that future problems associated with overdeveloping of this type of land would not occur. In summary, let us say that the undersigned members of the commu- nity are confident that the previous denial of the rezone was a correct decision and hope you will consider our objection, to this present rezone as valid and proper. HISTORY/BACKGROUND: The subject site was annexed to the City by Ordinance #1823 dated April 21 , 1960 . An application to rezone the property to R-3, Multiple Family Residential was denied by the Hearing Examiner on December 19 , 1978 after holding public hearings on October .10, 1978 . The file was finally dismissed on January 21, 1980 . D. PHYSICAL BACKGROUND: 1 . Topography: The site rises from west to east with slopes varying from 14% near the south property line to 9% in the middle portion and approximately 6% in the north. 2 . Soils : Alderwood gravelly sandy loam , 6-15% slopes , (AgC ) . Permeability is moderately rapid in the surface layer and subsoil and very slow in the substratum . Runoff is slow to medium and the hazard of erosion is moderate . This soil is used for timber , pasture , berries , row crops and for urban development . Bellingham silt loam, less than 2% slopes (Bh) . Permeability is slow, runoff is slow., and the erosion hazard is slight . This soil is used mostly for pasture and a few areas are used for row crops . Kitsap silt loam , 8-15% slopes (KpC) . Runoff is medium and the erosion hazard is moderate to severe . . This soil is used for timber and pasture . 3 . Vegetation : The site consists primarily of fairly dense low ground cover in the form of scrub brushes and grass . Stands of deciduous trees are also scattered throughout the site . 4. Wildlife : Existing vegetation on the site provides suitable habitat for birds and small mammals . 5 . Water : Some standing water was observed along the southern boundary of the subject site at the time of posting on May 6 , 1980 . 6. Land Use : The land use of the site consists of two existing single-family residences and an accessory building . To the north and east are scattered a few single family dwellings . The property to the south remains largely undeveloped . FAI-405 is located to the west of the subject site with a mixture of residential and industrial uses to the west of the freeway. E . Recreation : Kennydale Lions Park is within 14 miles to the southeast of the subject site and the North Highlands Park is approximately 22 miles to the southeast while Lake Washington Beach Park is within 21/2miles to the southwest . However , the proposed future development of the site will cause an increase in storm water runoff, traffic movement , noise levels , and disturb soil and vegetation . 2 . Population/Employment : Construction of the 26 townhouse duplexes would increase the area population by approximately 65 persons . 3 . Schools : Approximately 6 additional pupils may be expected to inhabit the units , if approved . This will not significantly impact area schools . 4 . Social : Increased opportunities for social inter- action may result with development of the subject site . 5 . PLANNING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING : MAY CREEK ASSOCIATES , R-037-80 MAY 20 , 1980 PAGE FOUR L . PUNNING DEPARTMENT ANALYSIS : 1 . The proposed rezone is consistent with the Comprehens ve Plan which designates the site as medium density multiple family and commercial . 2 . The proposal is generally consistent with the existin'! zoning to the south (i .e . B-1 , City of Renton .Tract 185 ; also B-C , Community Business-King County, for Tract 182 and RM 1800, High Density Multiple Family , King County , for Tract 167) . Tract 168 located east of the site within King County is zoned RS-9600 or equivalent to the zoning of the subject site , and is presently used as single family residential . During the last two years since the public hearing considering the rezone to R-3 , the property within the vicinity has been undergoing modifications in use . Tract 185 has recently received a special permit to allow filling and grading for future commercial development . To the southeast of the site a large condominium complex has been constructe• on Tract 166 and farther to the south the rezone request by Lyle Pickle to rezone a parcel of propert to B-1 is presently under consideration by the City Council . 3 . Although the Comprehensive Plan would appear to suggest that an R-3 zoning classification would be appropriate for the site , the facts remain that the area is still developing and that increasing the density as originally proposed in 1978 would still be unappropriate . The present proposal to develop the site with 26-units is basically a 45% reduction from the original proposal of 47 units . This reduction in density would appear to protect the existing single family residential development in the vicinity of the subject site . Objective No . 4 of the Comprehensive Plan Ladd Use Report of 1965 , page 17 states that "property values should be protected within the community for the benefit of its residents and property owners through effecti e control of land use and enforcement of building construction codes . " In 1978 the Hearing Examiner decided that the proposed development of 47 units was in conflict with this objective in that it appeared to be premature and create too high of a density adjacent to established single family residential . This was also supported by Objective No . 6 which encourages "the development and utilize ion of land to its highest and best use in such a way as to promote the best interest of the community and contribute to its overall attractiveness and desirability as a place in which to work , shop , PLANNING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING : MAY CREEK ASSOCIATES , R-037-80 MAY 20, 1980 PAGE FIVE 1 . That substantial evidence was presented demonstrating the subject ' s reclassification appears to not have been specifically considered at the time of the last area land use analysis and area zoning ; or 2 . That the property is potentially zoned for the reclassification being requested pursuant to the policies set forth in the Comprehensive Plan and conditions have been met which would indicate that the change is appropriate ; or 3 . That since the last previous land use analysis of the area zoning of the subject property , authorized public improvements , permitted private development or other circumstances affecting the property have undergone significant and material change . In 1978 it was determined that the property was potentially zoned as set forth in the Comprehensive Plan ; however , the development was premature because of the lack of City services and the existing develop- ment in the area . The present application has shown that the reduce density is more appropriate in buffering the existing residential uses and that sewer and water are available to the site . Therefore , . the reclassification request appears to be appropriate . 5 . The site contains a considerable number of significant trees along the Lake Washington Blvd . N.E . frontage and for the length of the eastern property line . These should be retained as much as possible as part of the site development . The Comprehensive Plan Land Use Report , 1965 , page 11 , states that "residential development may be successfully planned to take good advantage of the amenities which such locations often provide . Natural features such as rock outcroppings , streams, stands of native trees , and views often available from these locations should be used to greatest advantage . " The schematic design landscaping plan has been. presented for the proposed 26-unit development . It appears to, take advantage of the natural vegetation along both Lake Washington Blvd . and the eastern boundary of the property . However, specific care should be taken in insuring that the project is enhanced by such vegetation and any supplemental vegetation added . 6 . The anticipated traffic from the project does not appear to significantly impact either Lake Washington Blvd . N .E . or S . E . 76th Street . At the present time Lake Washington Blvd . has a right-of-way of 80 ' which would be sufficient for the expansion of the arterial as the area to the northeast develops . Only possible design problem might result from r 1111 PLANNING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING : MAY CREEK ASSOCIATES , R-037.-80 MAY 20 , 1980 PAGE SIX 7 . The applicant ' s conceptual site plan as submitted appears to show a conscious effort to reduce the density from a maximum allowable of .75 units under the Comprehensive Plan to 26 units . In addition , provides adequate setbacks to all property lines to assure that the project does not create an environ mental intrusion into an established residential area . The specific refinements of the plan concerning the landscaping buffer can be evaluated at the time of building permit application . Detailed review of landscaping and site plans by the Hearing Examiner appear to be unnecessary because of the applicant ' s reduction in development intensity from the original application in 1978 . 8 . The applicant will have to add the necessary water lines and fire hydrants to meet the fire code and provide all necessary storm drainage and utility lines as specified by the Public Works Department . These can be accomplished at the time of building permit application . 9. The applicant has submitted elevations of the subject site in an effort to show that the project will not block the view of single family residences to the east of the subject property . The site plans propose building clusters of two units with attached garages so that the actual construction does .not create a solid view obstructing wall . The slope of the site and the adjacent property to the east provides sufficient height so that the single family residences will be able to see over the proposed development , if the structures have a maximum height of 25 feet to the top of the roof. The property is approximately 2 . 52 acres. The legal description is listed in the application. The existing zoning is G-9600, and the requested zoning is R-2, medium density, multifamily. The proposed use of the site is to construct a 26-unit townhouse complex. Under the Renton Municipal Code, a proponent of a rezone must clearly. show that the proposed change is appropriate and timely. The applicant firmly believes that both elements are met in this request. In 1978, the applicant made application for a reclassification of the subject property to R-3 . After a series of hearings, it was determined that an environmental impact statement would be required on the assumption that the maximum density permitted by an R-3 zone would be utilized by the applicant, of somewhat in excess of 70 units for the project. However, the applicant was only requesting some 50 units . The applicant decided to not pursue the R-3 request any further at that time. In that previous application, the Planning Department in its preliminary report to the Hearing Examiner and its addendum to the preliminary report firmly recommended an R-2 zoning classi- fication. Pursuant to the Renton Municipal Code, in order to reclassify property, the Hearing Examiner must find one or more of the following provisions are satisfied: (1) That the subject reclassification was not specific- ally considered at the time of the last comprehensive plan land use analysis and/or zoning application, or (2) That since the last previous comprehensive plan analysis of the subject property, public improvements and private development affecting the subject property have undergone signifi- cant and material change, or (3) That the property is potentially zoned for the reclassification being requested pursuant to the comprehensive plan policies and conditions have been met indicating the change is appropriate. The applicant far exceeds the minimum requirement in that all three of the above requirements are met, not just one. t4141/ Subject Reclassification Was Not Specifically Considered At The Time Of The Last Area Land Use Analysis And Area Zoning The subject site was annexed to the City on April 21, 1960. At that time, it was zoned by the county as G-9600. The City did not change the zoning classification at the time of annexation. The zoning designation has never been changed since the property was annexed, and the City has never specifically considered the propriety of the zoning classification until the previous application was made. In 1965, Renton adopted a comprehensive plan. At the time of adoption of the plan, no request has been made to rezone the subject property. Thus, there was no specific consideration of reclassification of the property at that time. The Proposed Rezone Is Appropriate According To The Goals And Policies Of The Comprehensive Plan In the Planning Department' s preliminary report, it found that the proposed rezone to R-3 was consistent with the comprehensive plan. R-2 is a less intensive use and thus is clearly authorized by the comprehensive plan. As stated above, the Planning Department favored and recommended an R-2 designation. Significant Circumstances And Changes Have Impacted The Property Since The Last Land Use And Area Zoning As stated above, when this property was annexed by the City of Renton, it retained its original county zoning of G-9600. Several parcels in the immediate vicinity, when annexed, also came in with a G classification. However, many zoning classifi- cation changes have been made, In 1969, parcels 184 and 193 were reclassified from G-9600 to B-1 by Ordinance No. 2487 . In 1970 , parcel 185 was reclassified from G-9600 to B-1. Those parcels to the immediate south of the subject property. Across the freeway, in 1966 , the strip of land where the Misty Cove Apartments now sit was rezoned from G-6000 to R-4 . The property immediately south of the Misty Cove Apartments apparently retained its zoning of H-1, heavy industrial . These zoning changes are consistent with the comprehen- sive plan and indicate the changing nature of the area. A physical inspection of the subject property in its immediate vicinity provides ample evidence that the development of the area indicates proper circumstances for a change in the existing land use and zoning classification. All existing utilities are available to the site and in close proximity, including sewers, gas, and water. Additionally, Lake Washington Boulevard is scheduled under the 6-year transportation improvement program for such improvements asdrainage-, paving, curbs, sidewalk, illumination and channelization. This will eliminate potential traffic problems caused by an increase of residents in the area. South of NE 44th Street a large steel building has been erected. Across the freeway, immediately west of the subject property, is a large log processing operation. To the north of these commercial operations, there is a large apartment building. The proposed use of the subject property at a density rate of 11 units per acre would be entirely beneficial to those currently residing in the few existing single-family residences to the east and the northeast. This project will provide an excellent transitional barrier and buffer to the commercial uses presently on property to the south and west. It provides a noise buffer to the residents, has minimal environmental impact, and would be vastly more esthetically pleasing than any possible commercial use. The topography indicates steep hills, so there is virtually no chance that any views of the residences on the hillside would be affected. A townhouse development would be entirely appropriate on this type of parcel at this time. The design, landscaping and amenities of such a project would all serve to enhance the property values in the area. The previous rezone application was approved by every city department except the Planning Department. The Planning Department, as stated above, did approve an R-2 classification with the development by special permit. This is what the applicant is seeking. The proposed use of the property would meet the following community goals and objectives as stated in the comprehensive plan: 1. Prevent blight by protecting residential and other exclusive districts from the unwarranted infiltration of incom- patible uses which would contribute to premature decay and obsolesence, and prevent the development of orderly growth patterns . 2 . Increase community liveability by improving environ- mental factors which are closely related to the residential districts and other community areas. 3 . Protect property values within the community for the benefit of its residents and property owners, through the effective control of land use and the enforcement and application of building and construction codes. 4 . Promote the development of a viable, progressive community which provides ample opportunity for citizen participa- tion in a broad spectrum of economic opportunities, social achievements, educational attainments, physical development, and political activities. IMO 5 . Encourage the development and utilization of land to its highest and best use in such a way as to promote the best interests of the community and contribute to its overall attrac- tiveness and desirability of a place in which to work, shop, live and play. (2) Potential adverse traffic impacts in the area in light of the lack of full street improvements for Lake Washington Blvd. in the subject area, and none are expected for between 4 and 6 years. (3) Adverse land use impacts of a use of this intensity introduced into this sparsely developed area. (4) Noise impacts of FAI-405 and Lake Washington Blvd. along with the necessary mitigation. Measures , if any , that could be taken to prevent or mitigate the environmental impacts to .such an extent that the lead agency would withdraw its' declaration of significance and issue a ( proposed/final ) declaration of non-significance : Reduction of residential density to R-2 (11 units per acre) and retention of natural amenities and 'other development techniques to mitigate the above impacts.
