HomeMy WebLinkAboutD_City's Request-HEX Extension Request-Grant Ave Townhomes November 7, 2022 Mr. Phil Olbrechts Hearing Examiner City of Renton 1055 South Grady Way Renton, WA 98057 SUBJECT: Request for Extension Grant Avenue Townhomes Preliminary Plat and PUD (LUA15-000885 and LUA17-000335) Dear Mr. Olbrechts, This office has received a request from the applicant (September 26, 2022) to extend an existing, approved Planned Urban Development and Preliminary Plat (File Nos. LUA15-000885 and LUA17-000335) for a period of one (1) year. The Preliminary Planned Urban Development and Preliminary Plat for the Grant Avenue Townhomes project was approved on May 31, 2016 and the Final Planned Urban Development was approved on August 3, 2017. In accordance with RMC 4-9-150G.1.b, the Preliminary Planned Urban Development and Preliminary Plat is valid for five (5) years and any extensions granted for the Preliminary Plat are also applicable to the Planned Urban Development. On April 20, 2020, the Renton City Council adopted an ordinance (Ordinance No. 5968) that temporarily extended the validity of certain permits by a period of six (6) months due to on-going construction challenges created by the COVID-19 outbreak. On October 28, 2021, the City approved an administrative one (1) year extension requested by the applicant pursuant to RMC 4-7-080L.2. The current Preliminary Plat would expire on November 30, 2022. Pursuant to RMC 4-7-080L.3, one (1) additional one-year extension beyond the one-year extension may be granted by the Hearing Examiner if the applicant shows need caused by unusual circumstances or situations that occurred during the prior extension period, which make it unduly burdensome to file the final plat. In the extension request the applicant identifies five (5) primary reasons why this project should be granted an extension, 1) Impacts of COVID-19; 2) Errors in the approved plans, 3) Errors in water line installation, 4) Potholing and design of utilities to cross Grant Ave., and 5) SEPA mitigation measures restricting the construction window. Item 1 is a consistent challenge not unique to this project, all constructions sites and businesses have been impacted by COVID-19 as such, the City Passed Emergency ORD 5968 granting an automatic extension for all land use permit including the subject project. The letter does not identify why COVID-19 was more impactful to their project than others and therefore does not meet the standard set for an extension. Items 2 – 4, are related to self Mr. Olbrechts Page 2 of 3 November 7, 2022 imposed errors either in their own design plans and/or construction, the applicant’s inability to produce high quality accurate plans and construction of a site pursuant to Renton standards necessitating redesign, re-review, and/or in field potholing, does not constitute an unusual circumstance or situation. In addition, the following items noted occurred prior to the beginning of the previous extension: • The water meters were originally designed to be outside of the public alley per City standards but were found in October 2021 to be constructed within the public alley. Within a week, the contractor was shifting the water meters to their approved location and elevations. No revised plans were needed for this adjustment. • The extension request refers to the redesign of the water meter locations and construction of the concrete boxes around the water meters. This was a separate incident that occurred in March 2021 when it was also found the water meters were not being constructed outside of the public alley and driveways which was caused by the encroachment of the building foundations that were not taken into account as part of the original design. The City worked with the applicant and approved a design adjustment to the meter boxes in April 2021 to address the conflict. • Through the review of the water meter location and elevations noted directly above, the City notified the applicant in April 2021 that the constructed buildings along the eastern most alley were higher than the original design and requested that the applicant review the grading of the alley. Following their review, the applicant submitted revised plans in mid-May 2021 to address the grading discrepancy and the revised plan was approved in early June 2021. • Pothole and surveying of existing utilities within Grant Avenue occurred in late December 2020 for the installation of the water main. At that time, it was found that there were multiple conflicts with the proposed water main locations and the existing utilities. The applicant submitted revised plans to address the conflicts and the City approved the revised plan in early January 2021. Please note that a survey of the existing utilities in Grant Avenue for the storm drainage connection was only required by the City after the contractor had damaged the existing pipe in April 2022 and it was found to be in conflict with the proposed storm water connection pipe. Plans for the revised storm drainage connection was approved in June 2022, less than a week after it was submitted. Item 5, which limits site grading work in the wet season is a mitigation measure applied to the subject project through the SEPA review process, this is a known condition that has been in place since project approval, therefore this does not meet the standards set for an extension. Of the five (5) items listed in the extension letter, none meet the requirements under RMC 4-7-080L.3 to grant an extension for this project. Furthermore, it should be noted that the applicant within the last year has prioritized construction of the building improvements resulting in very little progress on the civil construction permit improvements, which are required to be completed for final plat approval and recording. In addition, the project has been repeatedly interrupted by self-created construction and project management deficiencies as a result of priorizing building improvements (see enclosed construction inspection log). If the extension is granted, the city does not anticipate that the project will complete civil construction permit improvements within the next year unless the applicant is required to Mr. Olbrechts Page 3 of 3 November 7, 2022 prioritize completion of the civil improvements. Therefore, if the Hearing Examiner grants the extension, the City requests the following new and revised conditions be added: 1. New Condition 33: The civil construction improvements approved as part of the Civil Construction Permit (U16004475) shall be completed and approved by the Development Engineering Project Manager and the final plat shall be recorded with King County prior to construction of the remaining portion of the building improvements except foundation construction and those required to make the partially-constructed structures watertight as approved by the City Building Official. 2. New Condition 34: The applicant shall provide a detailed project schedule for the remainder of the work. The project schedule should include specific tasks, dates, and contractors utilized, and should be provided to the Development Engineering Project Manager by December 16, 2022. This schedule shall be adhered to and milesones met or the permit shall expire. 3. New Condition 35: Vehicular circulation route around the perimeter of the site shall be a private looped alley overlayed with a public access and utilities easement, in lieu of the previously-approved public alley. 4. New Condition 36: Applicant shall maintain an organized and clean site free of construction debris. If the site is not maintained in this manner, the permit shall expire. 5. The following condition is only requested to be revised to address the request to change the alley from public to private per the New Condition 35 requested above. Revised Hearing Examiner Condition #23: “The applicant shall revise the utility plan to relocate the sewer line from the pedestrian courtyard to the public private looped alley. Erosion Control ; There was a Hydraulic/Diesel fuel spill today at Grant Ave Townhomes. One of the dump trucks going down the North driveway ran over rebar that punctured the tank on the truck and began leaking. The driver put out absorbent pads and the contractor pushed material to keep the liquid from leaving the site. The amount spilled was approximately 5 gallons of diesel/hydraulic fluid. They have scraped off approximately 5 yards of material that they are placing on plastic, covering with more plastic, and will be removing with a vac truck tomorrow. The Superintendent has been told numerous times about having the cement concrete workers clean-up the rebar and debris from the roadways on site, but it has not been done. Also called Nathan at the shops to let him know and talked to DOE about the spill. Told DOE of the plan to remove the material and dispose of it and they were fine with that. Contractor continues working on buildings. They will block the roadway on the North side to prevent vehicles driving over the water line because it does not have the appropiate cover to protect it. I have told them this will not happen without certified flaggers and proper signage. Talked to Super about making sure our water main line has 3' of cover. They wanted to wait until the foundation next to the line was poured before adding material over the line. I told him that cannot happen as the trucks and equipment going over the water line could be damaged and that they need to survey in the cover to make sure it is adequate. Talked to COR water crew and they are going to place padlocks on all existing water meter setters so they cannot be accessed. Asked for the contractor to have their material engineer send in writing that the backfill material under the garage footing is acceptable. Patrick DeCaro 10/27/2021 Met with contractor on site and measured the bury depth of the meter setters to make sure in is within COR specifications. All boxes are good. Patrick DeCaro 10/26/2021 Did not see anyone working on site today when I arrived. Site Superintendent met me on site and we went and checked every meter setter installed. Half of them were still not within City standard. Also informed him to fix erosion control issues. 3:30pm- Contractor called and said he had adjusted all meter setters to the correct standard specifications. Will check tomorrow. Patrick DeCaro 10/25/2021 Arrived on site at 7:45am and contractor is starting to dig out the meter setter boxes so they can adjust the meter to the correct height inside the box. COR water manager on site to check progress. Informs the contractor they will need compression fitting on the back of the setter so the plumber can connect to it. Site superintendent left at approx. 9:30am to pick some up. Contractor started building the valve clusters that the COR water crew will use to cut into the city water main. I checked the meter setter heights at 12:30pm and found that 33 of the 36 were not up to specification. Asked contractor about it and they said they were not going to adjust them until the plumber shows up to install the tail piece to the setter. Contractor has left the site at 1:00pm. Cement concrete boxes have still not been built for some of the meter setters to be put into. (Pictures taken). Saw no plumbers or concrete workers on site. They are now trying to prep the line for pressure testing. Other contractor is excavating behind a hydrant for the installation of a wall. I told them that the area will need to be re-compacted because it is to close to the hydrant thrust block. Patrick DeCaro 10/4/2021 Contractor has tried to pressure test the water line for their own knowledge and pushed apart one of the water line joints. The trench was filled with muddy water so I told them they need to push a poly pig through the line again to make sure it is clean. They have poured 2 thrust blocks behind the hydrants at the bottom of the job site. Told them again to work on erosion control to cover exposed stock piles and place permanent winter erosion control throughout the job site. Patrick DeCaro 9/30/2021 Contractor did not work on site today. They told me concrete was coming between 2 and 3pm today to pour thrust blocks. I arrive at 2:45pm and no one was here. The concrete truck arrived at 2:45pm and pulled onto the site. I called the contractor, owner, and superintendent to see what was going on. They said the pour for today was canceled but no one informed me. I had to direct the concrete truck safely onto the roadway because no contractor was on site. Justin and I walked the site today and found a lot of deficiencies for the work being done. Sent the owner, super, and contractor an e-mail stating everything that needed to be done before they can proceed with the water line installation. Patrick DeCaro 9/29/2021 Contractor has tried to set up the pressure test of the water line. They have found that the gaskets in 2 of the hydrants were full of rocks and were damaged so the line would not hold pressure. They had to remove the hydrant thrust blocks to get to the gaskets. They have replaced the gaskets and will re-pour the thrust blocks tomorrow. They also have saw cutters on site cutting across Grant Ave S. for the water line installation. Walked around the job site and they showed us the problem as they saw it, which was they thought they did not have enough room to connect the side sewer before the foundation. We saw that the room is there but the garage floors have already been poured and where the plumber installed the ABS pipe is not in line with the mainline sewer tees. Justin gave them a few suggestions about how to fix it and told them to come up with a plan and let us know how they are going to address the problem. Sent Mr. Singh (Owner) an e-mail saying we are still waiting for the compaction test results. 11:00am- 2nd flagger shows up but does no have a Certified flagger card with them, tell him he can't flag here today. Contractor continues installing water main, blow-off assembly, and air vacuum. 12:30pm- Truck and trailer have been loaded and left the site. Still no material tester on site. 1:45pm- Contractor has completed the water main install to the right of way on the North side of the project. Backfilled except for the thrust block locations. Now working on installing a hydrant on the North side main. 2:15pm- Mr. Singh on site and I remind him that we still have no compaction reports for the job site. Gary says they want to pour the concrete thrust blocks Monday. I remind him we have no compaction reports and the blocks need to go against 95% compacted material. Tell him they can't backfill around the blocks until Tuesday and any erosion control they disturb will need to be replaced. 3:15pm- Hydrant on the North side of project is installed. Contractor is moving material away from the North side of the vault so the core drilling can work. He is going to widen the storm pipe access hole in the vault. 9:15am- Owner has 2 laborers on site to stack the styrofoam blocks on top of the vault. Contractor continues working with the core driller and has half his crew starting to install the water line blow off and vacuum assembly. 10:15am- Core drilling continues on the vault. 12:15pm- Core driller continues working on the vault. Crew working on the water line has had to stop because of lack of parts. They are now setting CB #8. Contractor is also backfilling the South side of the vault and compacting with a vibratory roller. Ask Gary and he said the material tester would be on site today. He also said a sweeper truck would be on site later. Laborers continue stacking styrofoam on the vault. 1:15pm- Core driller has completed cut through the vault. (Pictures). He told me he cut through 6+/- pieces of rebar when making the hole. Sent an e-mail to Scott Mitchell (COR Building Inspector) with pictures about them cutting through the rebar in the vault. 2:30pm- Contractor has completed installing the 12" storm pipe from CB #8 to the vault. 3:15pm- Contractor is backfilling and compacting on the North side of the vault which includes the new storm line that was just installed. Still no material tester or sweeper truck on site. 4:30pm- Still no material tester or sweeper truck on site. Roadway has track out from the job site. Left the site for the day. Patrick DeCaro 11/11/2020 8:00am- Contractor arrives on site with Gary, 1 operator, and 1 laborer. They are moving on site material so they can work on the storm and using a roller for compaction. No flaggers are on site. 9:00am- Contractor continues same work. 11:00am- Contractor continues same work. 2 flaggers arrive on site. I check and 1 has an expired card and the other one does not have his card with him. A truck shows up with foam for the vault but I tell him he can't unload because both flaggers credentials are no good. The truck leaves the area and parks off site. 11:30am- Owners Rep is trying to get more flaggers. Truck driver told me he has given the Rep 30 minutes then he will leave. 12:15pm- 2 Certified flaggers arrive on site and will use a single lane closure so the contractor can unload the truck. Contractor has dug down on the North side of the vault for the storm install and found that the vault opening will not work with the storm pipe. They are also pumping ground water from the excavated hole. Called Building inspector Scott Mitchell to let him know. 1:00pm- Contractor is unloading the Styrofoam for the vault from the truck using an excavator. (Video). 2:00pm- Completed unloading the truck and the flaggers have left the site. Styrofoam is in a pile on the front edge of the job site. (Pictures). 2:15pm- Gary just called and said they will have a core driller tomorrow morning to cut into the vault for the storm pipe opening. He tells me to look and make sure they do not cut into the rebar of the vault. 3:15pm- Sweeper arrives on site and is cleaning the roadway. 3:45pm- Sweeper is gone and have left the job site for the day. I call Mr. Singh (Site Owner) and inform him we still do not have any compaction tests for the vault backfill. 8:00am- Flaggers arrive on site. Only 1 of them has a Certified Flagging card so I tell the other they can't work until they produce a valid card. COR Locator on site painting out underground utilities. 8:15am- Trucks start arriving and are dropping the material on site because of the flagging issue. Another laborer and Gary arrives on site. 9:00am- Contractor is moving on site material down to the East side of the vault. 9:30am- 2nd Flagger arrives on site and he is certified. Gary just said we were correct and the plastic that was buried Saturday needs to be removed. They will did that out and backfill today. I have to leave site for other inspections at this time but will return. 1:30pm- Return to site and contractor is placing quarry spalls on the South side of the vault. Their roller has been broken down all day so they can't place and compact any material today. Asked Gary if the materials tester was on site and took some shots. He said the tester took some shots on the North side that is approx. 8-10 feet deep, and some surface shots at a few other places around the vault. He said he also took material to come up with a proctor for the test. Looks like a sweeper has made a pass throughout the job site. 2:30pm- Contractor continues installing quarry spalls on the South side of the vault with 1 operator and 1 laborer. 3:00pm- Sweeper on site cleaning the roadway. 3:30pm- Mechanic on site to work on roller, no one else is working. 4:00pm- Roller is repaired and contractor is compacting material on the West side of the vault. 4:20pm- Contractor has left the job site for the day. Patrick DeCaro 11/9/2020 8:30am- Contractor and Certified flaggers arrive on site. Flaggers ask for "Flaggers Ahead" sign which is not on site and said they will not flag until one is set up. Contractor sends someone to go get one. There is Gary, 1 operator, and 2 laborers on site. 9:15am- Contractor is moving material around the North side of the vault. 10:00am- Laborer returns with flagging sign. Trucks start coming in and delivering material that is being placed on the West side of the vault. Compacting with a vibratory roller. Asked if materials tester would be coming out and they said yes. No material tester on site. Contractor told me the materials tester never showed up yesterday and he did "Virtual Testing" by watching on camera the procedures used for compaction. 12:00pm- Contractor continues to place material on the West side of the vault, using a vibratory roller for compaction. Still no material tester on site. Asked them to remove the plastic erosion control sheets on the West side of the vault that is starting to get buried. Gary said the materials engineer told him it was ok to bury because it would act as a vapor barrier. I ask them for Certified Flaggers cards, they say they don't have them, so I tell them they can't flag the traffic. Issue a Stop Work Order on the site for traffic control and safety, also saying we need a meeting on site to discuss solutions. Talk to Justin and Bri, it is decided that we have a defined game plan for staging and trucking before materials can continue being brought to the site. Let them start back working on site only. He said he may be back later today or tomorrow. Patrick DeCaro 11/5/2020 Contractor arrived on site at approx. 7:45am. They have Gary (Foreman), 1 operator, and 2 laborers on site. They have started to backfill on the South side of the vault with quarry spalls, and the North side with quarry spalls and native material which they are compacting with a vibratory roller. Laborer is starting to remove the form nails that are sticking out of the outside vault walls. 9:00am-checked South side of vault and noticed they were backfilling over form wood and garbage so instructed them to remove trash from area before backfilling. Also told them the same thing for the East side of the vault. Scott Mitchell (COR Building inspector) arrived on site and I showed him the areas they were backfilling with the trash there. He also instructed them to remove it before more backfilling. Scott asked Gary about the mirror drains and when they would be installed. Gary said later today or tomorrow. Asked Gary about material tester coming to check compaction around the vault. He told me he didn't need to listen to Scott or I about compaction, only his Soil engineer. 10:00am-There are now only 1 operator and 1 laborer backfilling the South side of the vault with quarry spalls. 12:15pm-Notified Hakem (Owner Representative) that the nails are still on the South side of the vault where they are backfilling and need to be removed, per Scott. Operator and Laborer have left the site because the excavator they are using is not working well. They said Gary told them they were done for the day. Patrick DeCaro 11/4/2020 Arrived on site 7:45am. Truck and trailer blocking the road waiting by the entrance with no traffic control in site. Called Gary and told him we need traffic control. He arrives and has 2 workers with paddles to control truck traffic in and out. Asked about them applying for a traffic control plan and he said it has not been done yet. Told him he needs one ASAP. 1 truck and trailer is delivering quarry spalls which 1 operator is placing on the East side of the vault. There is a footing drain installed on the North side of the vault, but nothing yet on the East. I call Scott Mitchell (COR Building Inspector) to inform him of work around the vault .Contractor said the mirror drains will be installed to the outside of the vault on Thursday. I asked Scott if the form nails on the outside of the vault need to be removed before the drains are installed and he said yes. This has not been done on any side yet. Owner representative on site and I tell him about the needed traffic control plan. Heavy rain has caused dirty water to begin leaving the site. I tell contractor they need to fix problem. The operator digs a channel across the entrance and the workers place a straw waddle in the curb line to address erosion issues. Bob from PSE shows up on site at this time and tells contractor they should not be digging because their locates are out of date. They have not been renewed since March 1. Gary has left the site and leaves the operator and 2 workers to flag for the trucks that will continue to bring quarry spalls, which are now going to be stockpiled on site. The crew has a CASE excavator, a Hitachi excavator, and a dump truck and is performing dirt work on the northeast portion of the townhome plat. 1032: The inspector heads to another project. 1116: The sweeper continues working to clean up in the roadway. 1225: The crew is offsite and the dump truck and excavator are parked and shutdown; a chain is installed between the concrete blocks in the construction entrance. Met on site with Brianne (COR) and Rhohini (COR) to do an erosion control site walk through. We noticed a lot of things that were not in compliance with our erosion control specifications. Rhohini sent the owner and contractor a message that we need to meet ASAP on site to identify and resolve all the issues. Talked to them today and they said the material pile would be flattened on Monday and covered with Jute matting. Patrick DeCaro 1/4/2019 I went to the job site again today and found that the stock pile is still not covered, the pond is very close to overflowing, and the water leaving the site at the bottom of the silt fence tested at 70 NTU. When I was there the CECSL arrived and also took a water sample to test. He told me that the things he recommended in his Field Report were still not all done.
