AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, CHANGING THE
ZONING CLASSIFICATION OF CERTAIN PROPERTY WITHIN THE CITY OF
RENTON FROM SINGLE RESIDENCE DISTRICT (R-1) TO RESIDENCE
DISTRICT (R-2)
WHEREAS under Chapter VII, Title IV (Building Regulations) of Ordinance No.
1628 known as the "Code of General Ordinances of the City of Renton", as amended,
and the maps adopted in conjunction therewith, the property hereinbelow described has
heretofore been zoned as Single Residence District (R-1); and
WHEREAS a proper petition for change of zone classification of said properties
has been filed with the City Clerk on or about June 8, 1967, which petition was then
duly referred to the Planning Commission for investigation, study and public hearing,
and a public hearing having been held thereon on or about June 28, 1967, and the
Petitioner having duly amended his petition for rezoning, and proper notice of hearing
has been duly published and posted as provided by law; end said matter having been
duly considered by the Planning Commission, end said rezoning being in eerie mitt' with
the City's Comprehensive Plan and all parties having been heard appearing in support
thereof or in opposition thereto, NOW THEREFORE
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON AS
FOLLG IS:
SECTION I: The following described property in the City of Renton is hereby
rezoned to Residence District (R.2); the City Engineer and the Planning Director are
hereby authorized and directed to change the maps of the Zoning Ordinance, as amended,
to evidence said rezoning, as follows:
Lot 20; Nly 146' of Lot 21 & Wly Lot 22; Nly 136' of Ely
Lot 22 & Lot 23; Incl Sly 118' of Lots 4 & 5 less So. 20' of
Lot 4 & 5 for Street. All in Block 6, Plat of Earl ington.
(Located on 5th Ave. W. between Earl ington St. and Thomas St.)
SECTION II: This Ordinance shall be in full force and effect from and after
its passage, approval and legal publication.

Property in question is located in a predominately older single
family residential area. The property is to the rear of exist-
ing single family residences and has been relatively landlocked
or unusable due to the original platting of the land . The
Planning Commission in its review generally felt that the area
should be held to a low .density multiple use. In his discussion
with the Planning Commission, the applicant 'agreed to amend his
application to R-2 which would allow apartments' by special per-
mit , The Planning C-mmission recommended approval of the
amended application to rezone the property to R-2 . ' The pro- '
posed use would be in agreement with the Comprehensive Plan.

rezoning at this time would probably be questionable. The Commission

icke pointed out that R-2 zoning would present as .,many problems as
regards access to the- property - as R-3 .

It was- moved by Stredicke, seconded by Brower, that the application
be denied , as - itis - premature . , Motion carried unanimously .
Mr. , Stone suggested the Planning Department be instructed to notify
the applicant by letter of the action of, the Planning Commission as
well as her right of appeal .

The Chairman described the rezone. application. , The Planning Director
pointed out the., location , of the property on the zoning , map . , He stated
that the property is behind some existing single family residences and
that- the area, with the exception , of one apartment unit , is predominate -
ly single..family residential . He stated further that the area does have
some . development. problems in terms of topography_- of the area . Slides . of
the property were shown
Comments from the audience were invited. ' Mr . Delloso, the applicant ,
spoke on behalf of the. rezone . He stated that 40 feet of access from
5th Ave . . W, to the major portion of the property was available .
Mr . Harvey J . : Nelson-, an associate of Mr . Delloso; spoke,.on behalf of -
the rezone. . He outlined- his plans for an apartment - unit that .would
upgrade the area . .
Mr. Charles Taylor of 412 Thomas Street stated that . -.he-was very much
interested in seeing the area upgraded and was concerned that Mr . Del-
, loso make the .best possible use of the property . if:the rezoning were
granted.
Some discussion then ensued regarding the possibility of R-2 zoning
for the property which would allow apartments under. special permit
and,.would give the Planning Commission some control over the develop- .,.
ment of the property. The Planning Director stated the Commission , had
indicated its intention to hold the area to low density multiple use ,
and that the recommendation concerning the Butko :property close by was,
based on this
Stredicke asked the- applicant if he would accept R- 2 zoning . Mr. Del- ',
loco replied that he would. accept R-2 zoning on the whole property
in question. .,
Stredicke moved the hearing , be. closed, seconded by Stone, Motion
carried unanimously.
ACTION :
It was ,.moved by Stredicke; seconded by St,one,, that the Planning Com- ,
mission recommend , granting of R-2 zoning (amended by the . applicant
from R-4) on the - subject property as it agrees with the Comprehensive
Plan and forward said recommendation to theCity - Council for - approval . •

The Chairman described the rezone application. The Planning Director
pointed out the location of the property on, the zoning map and stated
the existing Comprehensive Plan indicates multi-family residential
but the Comprehensive Plan under study for revision cuts back this
area to single family residential use.

The Chairman described the application and indicated the applicant
had previously petitioned the Commission for R-3 zoning which had
been denied.

R-2 TO B-1; PROPERTY LOCATED VICINITY OF NE CORNER OF S . 2ND ST.,

The Chairman described the rezone, application and stated. that this.
is the third lot to be purchased by Washington Mutual Bank as a
part of the site of their new structure .
(g) MATHIESON, FLORENCE B. , APPL. NO. R-406-67, REZONE FROM R-1
TO R-3; PROPERTY LOCATED IN THE VICINITY OF THE NE CORNER OF
SUNSET BLVD. N. AND 116TH AVE . S . E.
The Chairman described the rezone application . The Planning
Director stated , that the property in question is adjacent the
convalescent home in the Highlands area and pointed out the loca-
tion of the property on the zoning map . Mr. Brower stated he felt
the Commission should get a statement from the Engineering Depart-
ment regarding Sunset Blvd. .. inasmuch as this street is the only
access to the property and is heavily traveled now ..
(h) DELLOSO, . DOMINICK, APPL. NO. R-407-67, REZONE FROM R-1 TO
R-4; PROPERTY LOCATED ON 5TH AVE. W, BETWEEN EARLINGTON ST. AND
THOMAS ST.
The Chairmandescribed the rezone application. The Planning
Director pointed out the location of the subject property on ,.
the zoning map . Stredicke stated , that the original Butko appli-
cation for Rr3 was denied because it did not conform to the Com-
prehensive Plan and yet this property is less than a block away
from the Butko property. The Planning Director stated that the .
applicant was advised that while the Comprehensive Plan indicates
multi-family residential use, rezoning to R-4 at this time would
probably be questionable; but the area might be feasible for low
density multiple residence use (R-2 , apartments by special permit) .
The Planning Director stated that the Comprehensive Plan is a plan
for_ 1985 and because a particular use is indicated on the Compre-
hensive Plan does not necessarily mean that use is feasible now..
We are trying to project land use into the future, and on a long
range plan the Commission has the right to interpret the question
of timing .

Denzer stated that the Comprehensive Plan is not a zoning ordinance
but a guide line for the Planning Commissioners .
Stredicke stated that he wished the Planning Director to inform the
Commissioners at the next meeting the date of the original Butko
denial and the reason therefor.
5 . ADMINISTRATIVE MATTERS
(d) FIELD TRIP--PLANNING COMMISSION . It was moved by Denzer,
seconded by Brower, that the Planning Commissioners meet at 8 : 30 A.M .
at the Park Avenue Restaurant on Saturday, June 24 , for the purpose
of conducting a field trip regarding new business above . Motion
carried unanimously.
(a) PROPOSED AMENDMENT TO H-1, _ RE HEIGHT RESTRICTION. The Planning
Director stated there is no height restriction in the H-1 zoning
district , and it has been suggested by the City Attorney - that the
Planning Commission prepare an amendment to the Zoning Ordinance
to correct this . The Assistant Planning Director stated Puget Power
in Renton Village may require a variance to the L-1 height restriction
as they felt it was possible that the L- 1 zone height restriction car-
ried ,on into the H-l . zone, and the City Attorney felt this question
needed clarification and possibly some action.
Some discussion then ensued regarding height restrictions in various
commercial and industrial zoning districts . At present there is no
height restriction set down in the , H- 1 zoning district . In the pro-
posed zoning ordinance no maximum height limit is imposed, but when
a building exceeds 45 feet in height , that portion of the building
above 45 feet shall set back one foot from each side and rear prop-
erty line for each one foot the building exceeds 45 feet in height .
The Chairman asked the Planning Director to work out some alternates
to the one-for-one 45 foot - height restriction.
ACTION RE COMPREHENSIVE PLAN HEARING :
It was - moved by Stredicke, seconded by Racanello , that the Planning
Department be instructed to give notification of a public hearing on
the revisions to the Comprehensive Plan to be held at 7 : 30 P .M. on
July. 19 , 1967 . Motion carried with Denzer dissenting.
(b) LAND USE PLANNING. INSTITUTE. The Planning Director stated that
both he and the Assistant Planning Director will attend some sessions
of this institute - and asked if any of the Planning Commissioners would
attend . Mr. Brower and Mr. Denzer indicated they wished to attend
Units B and F .
ACTION :
It was moved by Teegarden, seconded by Stredicke, that Mr . Brower be
authorized to. attend Unit B on July 24=25 and Unit F on August 7-8
of the Land Use Planning Institute to be held at. the University of
Washington. Upon indication by Mr. Denzer that he wished to attend
these same sessions , Teegarden amended his motion to include Denzer' s
attendance . Stredicke, seconded- the amended motion . Motion carried
unanimously.
(c) SST MOCKUP . FIELD TRIP . Sterling stated that two dates were
available during June for a guided tour, through the SST mockup--
June 26 and 29 . Some Planning Commission members stated they would
be unable to attend either date although they were all interested in
