•RMC Violation: RMC 4-5-050/4-5-060: No Building Permit
December 3rd, 2020: Code case was opened by Kevin Louder, who is no longer with the
city, the case was opened for numerous violations most noted for the building permit.
May 26th, 2022: Code case was taken over by Piero D ’Amore, who is no longer with code
compliance, the case was still for no building permit. Piero had sent out a Finding of
Violation with daily fines. Which were never appealed. Exhibit 2
July 7th, 2022: Piero D’Amore sent out an email to the property owner explaining that
they had $6250 dollars in fines and what was the status of acquiring the permit. Exhibit

July 11th, 2022: Email chain between the property owners designer and the city with
getting the proper permits and the violation resolved. Exhibit 4
July 27th, 2022: Email between the designer and the permit tech in regards to the
permit, and the information needed to complete the process. Exhibit 5
September 29th, 2022: Piero had researched whether the permit had been completed
and noticed the fees still need to be paid and the inspections needed to be done. Piero
sent out another Finding of Violation with a $250 dollar fine. Exhibit 6
October 14th, 2022: Case was turned over to Jason Churchill for the appeals process.
The city received an appeals letter from the property owner appealing the $250 dollar
fine. Exhibit 7
This case has been ongoing for nearly 2 years. The permits have been approved since
March 14th 2022. The city has tried to gain voluntary compliance with little to no
response. It is the city’s stance to wave the $250 dollar fine for the September 29th
2
Finding of Violation if the permit is paid for and the inspections scheduled and
completed.

examiner. Rick Lee is the Building Plans Examiner, and he can be reached at rlee@rentonwa.gov or 425 430‐7280. He is
familiar with the project and can answer the questions you have on what you need to do. From my understanding the
plans that were submitted say they are going to remove window and framing, but don’t tell us what they will be doing to
return that space to a covered deck. Rick can elaborate on that. When you are ready to submit the corrected

If the homeowner intends to return the structure to its original state he will need a Residential Alteration Permit,
Adriann please correct me if I’m wrong. There is also a shed that was added to the backside of the garage, attached to
the building. They will either need permits to keep it, or it will need to be removed as well.

Hello Piero,
After reviewing documents forwarded to me this afternoon, I would like to clarify the following with you and Adriann.
The original state of the house is shown below and I understood that the code violation was unpermitted enclosure of
the deck above the garage. If this is the case, then the home owner will need to EITHER remove the enclosure on the
deck and return the deck to its original state OR permit the enclosure per code requirements. The plans submitted under
the permit #B22001243 and subsequent review comments were a little confusing to me as it seemed to try to do both.
The home owner stated to me that he intends to remove the enclosure and return the deck to its original state. So my
question is: Do we still need a permit for removing enclosures? If so, a demo permit?

NOTICE OF RENTON MUNICIPAL CODE VIOLATION
The City has elected to establish a non-judicial hearing and determination system to enforce Renton Municipal Codes (RMC) civil code
violations. Therefore a code violation penalty, consistent with RMC 1~3~2.P is imposed, not including any costs, fees or assessments.
You may respond in the following manner:
I deny creating, permitting to exist, maintaining or failing to eliminate the violation(s) and I am requesting a hearing to contest this
Finding of Violation. Appeal requests must be received by the Renton City Clerk’s office within 15 days of the date of this Finding of
Violation. Please send me a hearing date. I promise to appear on that date. The administrator must prove by a preponderance of
the evidence that I committed the violation. I understand that under RMC 1-3-2.G that the administrator shall decide whether the
opportunity to be heard will be only in writing or in person, or both. The city is not required to call witnesses to testify at the hearing.
Pursuant to RMC 1-3-2.K, failure to attend the scheduled hearing makes the Finding of Violation final, and I may be subject to
additional costs if I fail to withdraw or resolve my appeal prior to the hearing date. I also understand that the city has not waived any
rights or remedies under the law.
I admit that I have created, permitted to exist, maintained or failed to eliminate the violation(s) and do not need or want any kind of
hearing. As a result, I have enclosed a check or money order (do not send cash) in the amount of $_________. I understand I am
