N. and 7th Ave. N. The Chairman described the rezone application. As the Commissioners were entirely familiar with the property and the area, showing of slides was dispensed with. Moved by Stredicke., seconded by Denzer, that the hearing be closed. . Motion carried unanimously. The Chairman described the rezone application. Slides of the property were not shown as all Commissioners were familiar with the property. Mr. J. David Jensen, the applicant, displayed his proposed plan of development, and explained the . rezones requested and the reasons therefor. Stredicke stated he felt the Commission should not grant any more business zoning in that area for speculative purposes. Mr. Jensen stated he needed the additional business zoning in order to proceed with leases in the proposed shopping center, and that he could not negotiate leases with prospective tenants unless he could show that he, had the proper zoning. Discussion followed concerning the proposed development; proposed street in the area; and clarification of the R-3 and B-1 zones. • The Commission generally felt opposed to granting additional B-1 zoning in the area unless Mr. Jensen could show he- had firm commit- ments for the property. With reference to theR-3 requested, Mr. Jensen- stated, it would be necessary for him to know the Commission' s" decision this evening as he was working with a time stipulation con- tract for purchase ofthe property and if thatportion of the rezone request, were continued, his- option would expire before the matter could be brought, before' the Commission again. Moved by Stredicke, seconded by, Ross, that the hearing be closed. - Roll call votewas requested, with Commissioners voting as follows: Denzer- - no Ross - .no Forgaard - no Sterling - no Mola - no Stredicke. - aye Motion lost. Moved by Sterling, seconded by Denzer, that the Commission close` the hearing on the R-3 portion of the application and continue the hearing on' the B-1, portion of the application for 90 days. The area is predominately single family residential (although the Comprehensive Plan shows the area as multi-family residential ) . New homes are presently being constructed westerly of the proposed site. It is felt that the proposed rezone request, while in accord with the Comprehensive Plan, would have. detrimental effects on the adjacent and surrounding properties. Petitipns in opposition to the rezone request have been received. Commission Comments: Commission members felt the area was basically single family residential and that multi-family use would not be desirable in the area. Recommend denial . It is generally felt that in view of the plan submitted, such proposed development could be initiated without the additional zoning at this time. The applicant has indicated he feels justified in requesting additional business zoning comparable to that located westerly of his property which would permit a more reasonable use. The present rezone request is basically the same request originally presented to the Commission when the property was rezoned approximately one year ago and was cut back at that time to a combination of business and multiple residential zoning. Commission Comments: Commission members, generally felt that additional information would be desirable to. justify, the request. Most members felt that additional B-1 zoning in this area at this time was somewhat questionable. 5..
