Prosecuting Attorney, submitted draft of a statute regulating the dissemination of indecent material to minors and suggested the City enact such legislation in Renton as had been done in New York. Moved by Morris, seconded by Perry, to refer the matter to the Law and Ordinance Committee and the City - Attorney for preparation of proper Ordinance. Moved by Perry, seconded. by Grant, to include amendment for referral to the Mayor's Youth Guidance Committee. The amendment carried and subsequently, the original motion as amended. Letter from the Renton Lions Club requested No-Fee Permit for "White Cane" Fund Drive in Renton on May llth to support sight conservation program. Moved by Shane, seconded by Delaurenti, to refer the request to the Police and License Committee with power to act. The motion carried. City Clerk Nelson reported receiving applications for Fireworks Stands for the 1968 Fourth of July holidays as follows:; The Kennydale Lions Club; . Nesika Chapter, O.E.S.; Kiwanis Club of Greater Renton; (per Ace Fireworks), Ace Fireworks for themselves; V.F.W. of Renton; Emblem Club; Renton Jaycees; Explorer Post 4.93, Boy Scouts and Renton Lions Club. Letter from the Living Memorial Association of Kennydale advised that the membership had voted to retain the property for community center purposes and the offer of donation to 0 the City for park purposes was hereby being withdrawn. Petition signed by approximately 250 persons urged the Council to consider opening the City Library and recreation facilities on Sundays. Rev. Jones, and Mrs. Fred Hanis, Library Board Pres., requested immediate transfer of funds in amount of $3,000.00 from surplus revenues in the Library Fund, unto Budgetary Account 1610/110 Salaries and Wages to provide funds for an additional typist in the cataloging department. Moved by Delaurenti, seconded by Maxin to refer the request to the Law and Ordinance Committee for proper Resolution. The motion carried. Letter from Manio Phillips, 221 Airport Way, requested waiver of rezone procedure to al- low rezone from GS-1 to SR-1 without delay, or for prior building permit issuance to allow construction to begin on residence, in the 600 Block of llth Place South on Talbot Hill. Discussion ensued regarding justification of Council initiation of the matter and timeliness of the application,and problem in the sub ject area with zoning status since annexation was discussed,which is to be remedied by the Comprehensive Plan and prior attempts to rezone the area in general which were nul - fied by budgetary cutback during budget hearings were noted after which, the pending motion carried. Letter from W. B. Gillespie, Chief Engineer, Flood Control Division, Office of the King County Engineer, submitted proposed agreement for third phase of Revetment work on Cedar River bank stabilization program in the vicinity of the library and civic center site. Cost of this phase is $5,000.00 which funds have been budgeted. Moved by Garrett, second by Maxin, that the Mayor and City Clerk be authorized to execute the documents. Carried. Letter from Mrs. John R. Newell, Clerk for the Session of St. Andrew United Presbyterian Church, advised of April 28th meeting of the Church and vote to communicate to the City concern and interest in Open Housing for.the City of Renton. The City was urged to pass such legislation at an early date. Moved by' Perry, seconded by Schellert, to refer the letter to the Committee of the Whole. Carried. Moved by Shane, seconded by Bruce, to recess. Carried. After the recess, roll call was taken with all Councilmen present as previously listed. Rev. Allen Marshall, St. Anthonys Catholic Church, in clarification of press statement quoting Mr. Bob Wray, advised that he had discussed the matter with Mr. Wray and while the church does not get into politics it is very interested in the rights of all people and does back civil rights also backing legislation on its this also being his personal conviction as well. (Talbot Hill) Gentlemen: - The Planning Commission at its administrative meeting of May 8 , 1968 reviewed the application of Mr. Manio Phil- lips and his request for rezone from GS-1 to SR-1. The Planning Commission also reviewed the request of the City Council for a report and recommendation. It was the unanimous feeling of the Planning Commission that due to the circumstances, the usual procedures as previously set by the Planning Commission and the City Council should not be by-passed in the consideration of this rezone request. The applicant' s request for rezone has been published and posted for the Planning Commission public hearing meeting of May 22 , 1968 . Commission Meeting May 8 , 1968 Minutes Page 2 In essence, a preliminary plat is alive for one year only. This is to protect the City against unforeseen changes in sewer requirements , . street improvement requirements, engineering needs , etc. , which would make it undesirable for a preliminary- plat to be inactive longer than one year. BUILDING PLAT APPROVAL IN MANUFACTURING PARK ZONE (b) KEENAN PIPE & SUPPLY CO. , , Appl. No. . SA-467-68 , building plan approval in Manufacturing Park zone; property located north of Northern Pacific RR main line and west. of Stevens (87th Ave. S. ) The Planning Director displayed the building plan noted above which had been submitted for Planning Commission approval as required by ordinance. Mr. Alan G. Buchan of Lambuth, Sill & Sprague, Inc. of Seattle, representing the applicant, was present and had brought with him the landscaping plan for the proposed development. The proper setbacks and landscaping strips required were shown on the plan with the exception of the fence shown on the south line within the required setback area. Height of the fence was not indicated. The Planning Director pointed out that the street abutting the south property line was considered a service roadway but would be developed to City standards. Considerable discussion ensued concerning development of interior 20-foot setback areas. in Manufacturing Park developments; the . desirability of a new zoning designation between the_ Light Industrial and Manufacturing Park zones which would require some setbacks and landscaping not as restrictive as those required in M-P. REZONE APPLICATIONS (c) PHILLIPS, MANIO, Appl. No. R-459-68 , rezone from GS-1 to SR-1; property located in the 600 block of llth Place S. As this item appears later in the agenda (Item 4 (b) ) , the Planning Director stated it would be well to review the case history of this application for the information of the Commission. In March, Mr. Manio Phillips phoned the Planning Department office inquiring about the possibility of dividing a lot into two building sites in the vicinity of 11th: Place S . in the 600 block.. He was advised that the present zoning in that area is GS-1 requiring a minimum lot size of 35 ,000 square feet, and that subdivision would require that each parcel contain at least 35 ,000 square feet or that a rezone appli- cation could be filed for a lesser square footage requirement. A few days later Mr. Phillips came into the office, was supplied the necessary forms , and was advised of the April 3rd closing date for applications to be heard at the April 24th hearing. Mr. Phillips returned with the completed applications on April 16 and was unhappy to find he was too late for the April hearing; however, he filed the applications for the May hearing. On May 3rd, Mr. Phillips submitted a letter to the Mayor and City Council requesting Council action to rezone the property or allow issuance of a building permit; this request being based on the delay resulting from his missing the April public hearing. On May 8th, the Planning Department. received a memo from the City Clerk stating the City Council has initiated a public hearing on the request of Manio Phillips for rezone of his property located in the 600 block of llth Place S. on Talbot Hill. The Council has requested the Planning Commission to submit a re- port and recommendation for this public hearing on May 20 , 1968 . Renton. Planning Commission Meeting May 8 , 1968 Minutes Page 3 The Commission generally felt, after discussion of this matter, that it was unwise policy to disrupt the normal procedures of rezone applications for the convenience of one applicant since the delay was the result of his failure to submit the application by the dead- line date for the April Planning Commission public hearing. Action by the Council would, at best, save the applicant only two weeks in time. Forgaard noted that should SR-1 be granted, that the applicant would lack 500 square feet of having another building site on the property, and he believed the applicant' s plot plan submitted with his rezone application did not indicate the true location of the proposed house but that the house would be set well over , possibly to accommodate another building site which might be acquired by a variance request. Commissioners were interested in this point and felt it would be well to check this out on the field trip. ACTION: Moved by Ross , seconded by Racanello, that the Planning Commission follow the normal procedure on this rezone application of Manio Phillips. Mola stated he felt the Planning Commission could come under unfavorable criticism by allowing normal procedures to be by- passed; that some people had indicated to him they believed the Planning Commission would be showing favoritism toward this ap- plicant. The pending motion carried unanimously. The Chairman stated he would suggest that the Commission communi- cate with the City Council indicating that it was the unanimous feeling of the. Planning Commission that due to the circumstances the usual procedures should not be by-passed; that the Planning Department has published and posted this application for hearing on May 22 , 1968 ; that other publications and postings for a hear- ing on May 20 , 1968 would tend to confuse interested persons ; not to mention the possible legal aspects of this case. Ericksen DATE: May 6 , 1968 FROM:• Harriet Hilder . • SUBJECT: Manio Phillips Rezone Request • Shortly after March 15 , 1968 I received a telephone inquiry regard- ing dividing a lot into two building sites on S. llth Place in the 600 block. I remember the date because I recall quoting to- the caller the April closing date for rezone applications as some two weeks hence. I explained to the caller that the present zoning , GS-1, requires 35, 000 sq. ft. lots , and that subdivision would require either that each parcel contain 35 , 000 sq. ft. or that a rezone be filed for a • lesser square footage requirement. We discussed this at some length • and the caller (Mr. Phillips) pointed out the fallacy of such zoning in the area stating that many homes there were built on less than 35 , 000 sq. ft. I pointed out that this situation does exist in several areas in Renton and that under the present ordinance his only recourse was through rezone procedure . I remember asking him to stop by for a rezone application and mentioned again that the closing date for receiving applications for the April hearing was some two weeks away (April 3) . Several days later, Mr. Phillips came into the office and picked up the necessary rezone application forms. -I marked the application closing date. and the hearing date for April on the instruction sheet. . On April 16 , Mr. Phillips came into the office with the completed rezone application. He was dismayed to learn that he was too late for the April hearing. I asked Mr. Magstadt to . speak with 'Mr. . Phillips, which he did--going over the entire matter again and . reiterating what I had already told Mr. Phillips, on the phone • -. earlier and that day at the counter. Mr. Phillips paid, the rezone filing fee and left the completed application: . • Since then he has come into the office several times concerned • over the fact that his rezone will not be heard by the Planning Commission before May 22 , 1968 . Prosecuting Attorney, submitted draft of a statute regulating the dissemination of indecent material to minors and suggested the City enact *such legislation in Renton as had been done in New York. Moved by Morris, seconded by Perry,* to refer the matter to the Law and Ordinance 'Committee and th.e City . Attorney. for preparation of proper Ordinance. Moved by Perry, seconded by Grant, to include amendment for referral to the Mayorts Youth Guidance Committee. The amendment carried and subsequently, the original motion as amended. • Letter from the Renton Lions Club requested No-Fee Permit for "White Cane" Fund Drive in Renton on May llth to. support sight conservation program. Moved by Shane, seconded by Delaurenti, to refer the request to the Police and License Committee with power to act. The motion carried. • City Clerk Nelson reported receiving applications for Fireworks Stands for the 1968 ' Fourth of July holidays as follows:: The Kennydale Lions Club; .. Nesika Chapter; O.E.S.; Kiwanis Club of Greater Renton; (per Ace Fireworks), Ace Fireworks for themselves; V.F.W. of Renton; Emblem'Club; Renton Jaycees; Explorer Post 493, Boy Scouts and Renton Lions Club. Moved by Shane, seconded by Perry, to refer the applications to the Police and License Committee with power to act. Carried. Letter• from the .Living Memorial Association of Kennydale advised that the membership had voted to' retain the property for community center purposes and the offer of donation to the City for park purposes was hereby being withdrawn. Moved by Barie, seconded by Shane, to refer the. matter to the Park Board and the property •Committee. Carried. • • Petition signed by approximately 250 persons urged the Council to consider opening the City Library. and recreation facilities on Sundays. Rev. Emberg added that. since this is . the day when most people have free time it was felt such services would be utilized if available on Sunday. Moved by Schellert, seconded by Perry, to refer the matter to the Park Department and Library Board to report back. Carried. Letter from the Library Director, J. J. Jones, and Mrs. Fred Hanis, Library Board Pres., requested immediate transfer of funds in amount of $3,000.00 from surplus revenues in the Library Fund, unto Budgetary Account 1610/110 Salaries and Wages to provide funds for an additional typist in the cataloging department. Moved by Delaurenti, seconded by Maxin to refer the request to the Law and Ordinance Committee for proper Resolution. Gillespie, Chief Engineer, Flood Control Division, Office of the King County Engineer, submitted proposed agreement for third phase of Revetment work on Cedar • River bank stabilization program in the vicinity of the library and civic center site. Letter from Mrs. John R. Newell, Clerk for the Session of St. Andrew United Presbyterian • Church, advised of April 28th meeting of the Church and vote to communicate to the City concern and interest in Open Housing for_the City of Renton. Allen Marshall, St. Anthonys Catholic Church, in clarification of press statement quoting Mr. Bob Wray, advised that he had discussed the matter with Mr. Wray and while the church does not get into politics it is very interested in the rights of all people and does. back ,civil rights also backing legislation on it, this also being his personal conviction as well. The Commission also noted, however, that the Zoning Ordi- nance requires a 10-day waiting period on the submittal of recommendations to the City Council, in accordance with Section 4-72 (9_ (2); to allow time for appeals of Plan- ning Commission decisions . Since no opposition was expressed to the rezone request, it is unlikely that an appeal will be filed. Shortly after March 15 , 1968 I received a telephone inquiry regard- ing dividing a lot into two building sites on S. llth Place in the 600 block. I remember the date because I recall quoting to the caller the . April closing date for rezone applications as some two weeks hence. I explained to the caller that the present zoning , GS-1, requires 35, 000 ,sq. ft. lots , and that subdivision would .require either that each parcel contain 35 , 000 sq. ft. or that a rezone be filed for 'a lesser square footage requirement. We discussed this 'at some length and the caller (Mr. Phillips) pointed out the fallacy of such zoning in the area stating that many homes there were built on less than 35, 000 sq. ft. I pointed out that this situation does exist in several areas i -p n Renton and that under the present ordinance his only recourse was through rezone procedure. I remember asking him to stop by for a rezone application and mentioned again that the closing date for receiving applications for the April hearing was some two weeks away (April 3) . Several days later, Mr. Phillips came into the office and picked up the necessary rezone application forms. I marked the application closing date and the hearing date for April on the instruction sheet. On April 16 , Mr. Phillips came into the office with the completed rezone application. He was dismayed to learn that he was too late for the April hearing. I asked Mr. Magstadt to speak with Mr. Phillips, which he did--going over the entire matter again and reiterating what I had already told Mr. Phillips, on the phone earlier and that day at the counter. Mr. . Phillips paid the rezone . filing fee and left .the completed application. .
