HomeMy WebLinkAboutORD 6084CITYOFRENTON,WASHINGTONORDINANCENO.6084ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGFLOODREGULATIONSINSUBSECTIONS4-3-050.G.4.dAND4-3-050.G.4.eOFTHERENTONMUNICIPALCODE,AUTHORIZINGCORRECTIONS,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,theCityseekstoreviseCriticalAreasRegulationstocomplywith2021updatestotheFEMANationalFloodInsuranceProgram(NFIP)CommunityRatingSystem(CRS)voluntaryincentiveprogramrequirementssothatRentonresidentsmaybequalifiedfordiscountedfloodinsurancepremiumrates;andWHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,pursuanttoRCW36.70A.106,onAugust12,2022,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;andWHEREAS,thePlanningCommissionheldapublichearingonSeptember7,2022,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsorarenotexplicitlyrepealedhereinremainineffectandunchanged. ORDINANCENO.6084SECTIONII.Subsections4-3-0S0.G.4.dand4-3-050.G.4.eoftheRentonMunicipalCode(RMC)areamendedasshownbelow.Allotherprovisionsin4-3-050.G.4remainineffectandunchanged.U.SpecificStandards:Inallfloodhazardareas,thefollowingprovisionsarerequired:i.ResidentialConstruction:(a)InAEandA1-30zonesorotherAzonedareaswherethebasefloodelevationhasbeendeterminedorcanbereasonablyobtained,newconstructionandsubstantialimprovementofanyresidentialstructureshallhavethelowestfloor,whichforthepurposesofthissectionincludesincludingbasementorandattachedgarageasdescribedinRMC4-3-050.G.4.d.i.e.4,elevatedonefoot(1’)ormoreabovethebasefloodelevation.Mechanicalequipment,ductwork,andutilitiesshallbewaterprooforelevatedatleastonefoot(1’)abovethebasefloodelevation.(b)NewconstructionandsubstantialimprovementofanyresidentialstructureinanAOzoneshallmeettherequirementsinAppendixA,attachedtotheordinancecodifiedinthisSectionOrdinance5977,orsupersedingOrdinances.(c)NewconstructionandsubstantialimprovementofanyresidentialstructureinanUnnumberedAzone,forwhichabasefloodelevationisnotavailableandcannotbereasonablyobtained,shallbereasonablysafefrom2 ORDINANCENO.6084flooding,butinallcasesthelowestfloorandanyattachedgaragefloorshallbeatleasttwofeet(2T)abovetheHighestAdjacentGrade.(d)Ifbuildingsormanufacturedhomesareconstructedorsubstantiallyimprovedwithfullyenclosedareasbelowthelowestfloor,theareasshallbeusedsolelyforparkingofvehicles,buildingaccess,orstorage.(e)Fullyenclosedareasbelowthelowestfloorthataresubjecttofloodingareprohibited,orshallbedesignedtoautomaticallyequalizehydrostaticfloodforcesonexteriorwallsbyallowingfortheentryandexitoffloodwaters.Designsformeetingthisrequirementmustmeetorexceedthefollowingminimumcriteria:(1)Haveaminimumoftwo(2)openingswithatotalnetareaofnotlessthanone(1)squareinchforeverysquarefootofenclosedareasubjecttoflooding;and(2)Thebottomofallopeningsshallbenohigherthanonefoot(1’)abovegrade;and(3)Openingsmaybeequippedwithscreens,louvers,valves,orothercoveringsordevicesprovidedthattheypermittheautomaticentryandexitoffloodwater;and(4)Agarageattachedtoaresidentialstructure,constructedwiththegaragefloorslabbelowthebasefloodelevation,mustbedesignedtoallowfortheautomaticentryandexitoffloodwaters.3 ORDINANCENO.6084Alternatively,aregisteredengineerorarchitectmaydesignandcertifyengineeredopenings.ii.ManufacturedHomes:(a)AllmanufacturedhomestobeplacedorsubstantiallyimprovedwithinZonesA1-A30,AH,andAEonthecommunity’sFloodInsuranceRateMap(FIRM),shallbeelevatedonapermanentfoundationsuchthatthelowestfloorofthemanufacturedhomeiselevatedaminimumofonefoot(1’)abovethebasefloodelevationandbesecuredtoanadequatelyanchoredfoundationsystemtoresistflotation,collapseandlateralmovement.Mechanicalequipment,ductwork,andutilitiesshallbeelevatedatleastonefoot(1’)abovethebasefloodelevation.(b)ManufacturedhomestobeplacedorsubstantiallyimprovedonsitesinanexistingmanufacturedhomeparkorsubdivisionwithinZonesA1-30,AH,andAtonthecommunity’sFloodInsuranceRateMapFIRMthatarenotsubjecttotheabovemanufacturedhomeprovisionsshallbeelevatedsothateitherthelowestfloorofthemanufacturedhomeiselevatedaminimumofonefoot(1’)abovethebasefloodelevationorthemanufacturedhomechassisissupportedbyreinforcedpiersorotherfoundationelementsofatleastequivalentstrengththatarcnolessthanthirtysixinches(36”)inheightabovegradeandbesecuredtoanadequatelyanchoredfoundationsystemtoresistflotation,collapse,andlateralmovement.Mechanicalequipment,ductwork,andutilitiesshallbeelevatedatleastonefoot(1’)abovethebasefloodelevation.4 ORDINANCENO.6084fc)Ifbuildingsormanufacturedhomesareconstructedorsubstantiallyimprovedwithfullyenclosedareasbelowthelowestfloor,theareasshallbeusedsolelyforparkingofvehicles,buildingaccess,orstorage.iii.NonresidentialConstruction:Newconstructionorsubstantialimprovementofanycommercial,industrialLorothernonresidentialstructureshallmeettherequirementsofsubsectionG4diii(a)orG4diii(b)ofthisSection:(a)Newconstructionorsubstantialimprovementofanycommercial,industrialLorothernonresidentialstructureshallmeetallofthefollowingrequirements:(1)InAEandA1-30zonesorotherAzonedareaswherethebasefloodelevationhasbeendeterminedorcanbereasonablyobtained,newconstructionandsubstantialimprovementofanycommercial,industrial,orothernonresidentialstructureshallhavethelowestfloor,includingbasement,elevatedonefoot(1’)ormoreabovethebasefloodelevation,orelevatedasrequiredbyASCE24,whicheverisgreater.Mechanicalequipmentandutilitiesshallbewaterproofedorelevatedatleastonefoot(it)abovethebasefloodelevation,orasrequiredbyASCE24,whicheverisgreater.(2)IflocatedinanACzone,thestructureshallmeettherequirementsinAppendixA,attachedtotheordinancecodifiedinthisSectionOrdinance5977,orsupersedingOrdinances.(3)IflocatedinanUnnumberedAzoneforwhichaBEEisnotavailableandcannotbereasonablyobtained,thestructureshallbereasonably5 ORDINANCENO.6084safefromflooding,butinallcasesthelowestfloorshallbeatleasttwofeet(2’)abovetheHighestAdjacentGrade.(4)11buildingsormanufacturedhomesareconstructedorsubstantiallyimprovedwithfullyenclosedareasbelowthelowestfloor,theareasshallbeusedsolelyforparkingofvehicles,buildingaccess,orstorage.(5)Fullyenclosedareasbelowthelowestfloorthataresubjecttofloodingareprohibited,orshallbedesignedtoautomaticallyequalizehydrostaticfloodforcesonexteriorwallsbyallowingfortheentryandexitoffloodwaters.Designsformeetingthisrequirementmusteitherbecertifiedbyaregisteredprofessionalengineerorarchitectormustmeetorexceedthefollowingminimumcriteria:(A)Haveaminimumoftwo(2)openingswithatotalnetareaofnotlessthanone(1)squareinchforeverysquarefootofenclosedareasubjecttoflooding;and(B)Thebottomofallopeningsshallbenohigherthanonefoot(1’)abovegrade;and(C)Openingsmaybeequippedwithscreens,louvers,valves,orothercoveringsordevicesprovidedthattheypermittheautomaticentryandexitoffloodwater;and(D)Agarageattachedtoaresidentialstructure,constructedwiththegaragefloorslabbelowtheBFE,mustbedesignedtoallowfortheautomaticentryandexitoffloodwaters.6 ORDINANCENO.6084Alternatively,aregisteredengineerorarchitectmaydesignandcertifyengineeredopenings.(b)litherequirementsofsubsectionG4diii(a)ofthisSectionarenotmet,thennewconstructionandsubstantialimprovementofanycommercial,industrialLorothernonresidentialstructureshallmeetallofthefollowingrequirements:(1)Bedryfloodproofedsothatbelowonefoot(1’)ormoreabovethebasefloodlevelthestructureiswatertightwithwallssubstantiallyimpermeabletothepassageofwaterordryfloodproofedtotheelevationrequiredbyASCE24,whicheverisgreater;and(2)Havestructuralcomponentscapableofresistinghydrostaticandhydrodynamicloadsandeffectsofbuoyancy;and(3)Becertifiedbyaregisteredprofessionalengineerorarchitectthatthedesignandmethodsofconstructionareinaccordancewithacceptedstandardsofpracticeformeetingprovisionsofthissubsectionbasedontheirdevelopmentand/orreviewofthestructuraldesign,specificationsandplans.SuchcertificationsshallbeprovidedtotheofficialassetforthinsubsectionD3aofthisSection;and(4)Nonresidentialstructuresthatareelevated,notfloodproofed,mustmeetthesamestandardsforspacebelowthelowestfloorasdescribedinsubsectionG4diii(a)(5)ofthisSection;and7 ORDINANCENO.6084(c)Applicantswhoarefloodproofingnonresidentialbuildingsshallbenotifiedthatfloodinsurancepremiumswillbebasedonratesthatareonefoot(1’)belowthefloodproofedlevel(e.g.abuildingfloodproofedtothebasefloodlevelwillberatedasonefoot(1’)below).Floodproofingthebuildinganadditionalfootwillreduceinsurancepremiums.iv.RecreationalVehicles:RecreationalvehiclesplacedonsiteswithinZonesA1-30,AH,andAEonthecommunity’sFloodInsuranceRateMapFIRMnotincludingrecreationalvehiclestoragelotsshalleither:(a)Beonthesiteforfewerthanonehundredeighty(180)consecutivedays;(b)Befullylicensedandreadyforhighwayuse,onitswheelsorjackingsystem,attachedtothesiteonlybyquickdisconnecttypeutilitiesandsecuritydevices,andhavenopermanentlyattachedadditions;or(c)MeettherequirementsofthissubsectionGandtheelevationandanchoringrequirementsformanufacturedhomes.e.AdditionalRestrictionswithinFloodways:Floodways,definedinRMC4-11-060,arelocatedwithinfloodhazardareasestablishedinsubsectionDofthisSection.Sincethefloodwayisanextremelyhazardousareaduetothevelocityoffloodwaterswhichcarrydebris,potentialprojectiles,anderosionpotential,thefollowingprovisionsapply:i.IncreaseinFloodLevelsProhibited:Encroachments,includingfill,newconstruction,substantialimprovements,andotherdevelopmentare8 ORDINANCENO.6084prohibitedunlesscertificationbyaregisteredprofessionalengineerdemonstratesthroughhydrologicandhydraulicanalysesperformedinaccordancewithstandardengineeringpracticethat:(a)Encroachmentsshallnotresultinanyincreaseinfloodlevelsduringtheoccurrenceofthebaseflooddischarge;and(b)Therearenoadverseimpactstothesubjectpropertyorabuttingoradjacentproperties;and(c)Therearenohigherfloodelevationsupstream;and(d)Theimpactduetofloodwayencroachmentshallbeanalyzedusingfuturelanduseconditionflows.ii.ResidentialConstructioninFloodways:Constructionorreconstructionofresidentialstructuresisprohibitedwithindesignatedfloodways,exceptfor:(a)Repairs,reconstruction,orimprovementstoastructurewhichdonotincreasethegroundfloorarea;and(b)Repairs,reconstructionorimprovementstoastructure,thecostofwhichdoesnotexceedfiftypercent(50%)ofthemarketvalueofthestructureeither:(1)beforetherepair,reconstruction,orimprovementisstarted;or(2)ifthestructurehasbeendamaged,andisbeingrestored,beforethedamageoccurred.Workdoneonstructurestocomplywithexistinghealth,sanitary,orsafetycodesortostructuresidentifiedashistoricplacesmaybeexcludedinthefiftypercent(50%).9 ORDINANCENO.6084iii.ComplianceRequirements:IfthissubsectionGissatisfied,allnewconstructionandsubstantialimprovementsshallcomplywithallapplicablefloodhazardareasreductionprovisionsofthisSection.iv.BridgesCrossingFloodways:Inmappedorunmappedfloodhazardareas,futureflowconditionsshallbeconsideredforproposedbridgeproposalscrossingfloodways.v.AdditionalProvisionswithinAOZones:ShallowfloodingareasappearonFIRMsasAOzoneswithdepthdesignations.Thebaseflooddepthsinthesezonesrangefromonetothreefeet(1to3’)abovegroundwhereaclearlydefinedchanneldoesnotexist,orwherethepathoffloodingisunpredictableandwherevelocityflowmaybeevident.Suchfloodingisusuallycharacterizedassheetflow.Inadditiontootherprovisionsinthiscode,thefollowingadditionalprovisionsalsoapplyinAOzones:(a)NewconstructionandsubstantialimprovementsofresidentialstructuresandmanufacturedhomeswithinAOzonesshallhavethelowestfloor(includingbasementandmechanicalequipment)elevatedabovethehighestadjacentgradetothestructure,onefoot(1’)ormoreabovethedepthnumberspecifiedinfeetonthecommunity’sFIRM(atleasttwofeet(2’)abovethehighestadjacentgradetothestructureifnodepthnumberisspecified).(b)NewconstructionandsubstantialimprovementsofnonresidentialstructureswithinAOzonesshalleither:10 ORDINANCENO.6084(1)Havethelowestfloor(includinGbacment)elevatedabovethehighestadjacentgradeofthebuildingsite,onefoot(1’)ormoreabovethedepthnumberspecifiedontheFIRM(atleasttwofeet(2’)ifnodepthnumberisspecified);or(2)Togetherwithattendantutilityandsanitaryfacilities,becompletelyfloodproofedtoorabovethatleveldescribedinG4bv(b)(1)ofthissectionsothatanyspacebelowthatleveliswatertightwithwallssubstantiallyimpermeabletothepassageofwaterandwithstructuralcomponentshavingthecapabilityofresistinghydrostaticandhydrodynamicloadsandeffectsofbuoyancy.Ifthismethodisused,complianceshallbecertifiedbyaregisteredprofessionalengineer,orarchitectasdescribedinsubsectionG4diii(b)(3)ofthisSection.(c)Requireadequatedrainagepathsaroundstructuresonslopestoguidefloodwatersaroundandawayfromproposedstructures.(d)RecreationalvehiclesplacedonsiteswithinADzonesonthecommunity’sFIRMeither:(1)Beonthesiteforfewerthanonehundredeighty(180)consecutivedays,or(2)Befullylicensedandreadyforhighwayuse,onitswheelsorjackingsystem,isattachedtothesiteonlybyquickdisconnecttypeutilitiesandsecuritydevices,andhasnopermanentlyattachedadditions;or11 ORDINANCENO.6084(3)MeettherequirementsofsubsectionsG4ev(a)and(b)ofthisSectionandtheanchoringrequirementsformanufacturedhomes(subsectionG4diiofthisSection).vi.AEandA1-30ZoneswithBaseFloodElevationsbutNoFloodways:InareaswithBEEs(whenaregulatoryfloodwayhasnotbeendesignated),nonewconstruction,substantialimprovements,orotherdevelopment(includingfill)shallbepermittedwithinzonesA1-30andAEonthecommunity’sFIRM,unlessitisdemonstratedthatthecumulativeeffectoftheproposeddevelopment,whencombinedwithallotherexistingandanticipateddevelopment,willnotincreasethewatersurfaceelevationofthebasefloodmorethanonefoot(1’)atanypointwithinthecommunity.SECTIONIll.UponapprovaloftheCityAttorney,theCityClerkisauthorizedtodirectthecodifiertomakenecessarycorrectionstothisordinance,includingthecorrectionsofscrivenersorclericalerrors;referencestootherlocal,state,orfederallaws,codes,rules,orregulations;orordinancenumberingandsection/subsectionnumberingandreferences.TheCityClerkisfurtherauthorizedtodirectthecodifiertoupdateanychapter,section,orsubsectiontitlesintheRentonMunicipalCodeaffectedbythisordinance.SECTIONIV.Ifanysection,subsection,sentence,clause,phrase,orwordofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phrase,orwordofthisordinance.12
