for this project is generated from the general fund and does not include

Public Works: Co., requesting revision to the sewer moratorium exemption granted to
Northward/Orchards the Orchards development in 1990 to authorize enlargement of sanitary
Sewer Moratorium sewer pipe. Refer to �tilities Committee. .
Exemption UC-90-008�
Upon Council inquiry, Engineering Specialist Dave Christensen stated that
the original moratorium resolution allowed exemption to a number of
projects. The Orchards development was one of the projects, and they
have received exemption from a system that includes a pumping station
and temporary bypass flow. Northward Construction Co., developer of
the Orchards, intends to phase the development and rather than put in an
interim system, they will connect to the existing system, upsize a few
segments of the sewer line, and thus be able to provide the necessary
capacity.

Exemption from Sewer Moratorium
Dear Mayor Clymer:
On July 2 , 1990, the Renton City Council concurred in the
recommendation of the Utilities Committee to approve the
interim sanitary sewer improvements proposed for The Orchards
development as described in the document entitled
"Preliminary Design Report for a Sanitary Sewer Interbasin
Transfer from the Upper Heather powns Basin to the Lower
Maplewood Basin. " Since that time, Northward has been
processing the rezone and site plan application for The
Orchards, which was approved by the City Council on August
1�60 140th Ave.N.E. 10� 19 9 2 .
�""eloo The City of Renton has recently placed flow meters in the
ti�u���u�,WA�Boo� sanitary sewer system to determine the carrying capacity of
�206)747-17z6 the system. As a result of this monitoring and conversations
��.(20�)747-415i with Dave Christiansen of the Public Works Department, it has
been determined that the capacity of the Heather powns sewer
system can be increased through the enlargement of specific
sections of pipe to the point that several phases of The
Orchards development could utilize this system.
As a result, Northward is hereby requesting that the City
Council allow Northward (and the developer of the Forrest
Creste development if he so desires) to work with the City' s
Public Works Department in enlarging these sections of pipe
in a phased manner. As per the attached chart, we are
proposing to first enlarge three sections of pipe to allow
the construction of the equivalent of 60 single family homes
and 31 townhouses starting in 1993 with occupancy in early
1994 . If the proposed interceptor is constructed at this
time, these flows and future flows would be routed to the
interceptor. If for some reason the interceptor is delayed,
we would like to be able to enlarge additional sections of
pipe to carry the flows from the next phase of construction.
It should be noted that the enlargement of these sections of
pipe is preferred by the staff in that these are permanent
improvements to the City' s system, rather than interim
improvements in the form of a lift station. Yet, we need to
leave both options (lift station versus enlargement) open at
this time due to cost considerations and the unknown schedule
for the proposed interceptor. It should also be noted that

under either scenario, the sewer flows from The Orchards will
be routed to the interceptor when it is extended to the site
and connection fees will be paid to .the City.
The flexibilty to work with the Public Works Department in
the phasing of these improvements is needed due to several
factors:
1. The question as to the funding and schedule for the
actual construction of the proposed interceptor.
2 . The cost considerations of the alternative improvements,
which are difficult to determine at this stage.
3 . The question as to the construction schedule for the
Forrest Creste development and the impact this may have
on the downstream system.
We hope that you and the City Council will consider this
request and grant us a revision to the exemption granted in
1990. Our goal is to provide a quality neighborhood that
fits into the area and meets the housing market needs of the
City of Renton. Please call with any and all questions or
comments. We look forward to being able to discuss this
matter with you and the City Council in the near future.

Dear Mr. Krueger:
At the regular Council meeting of July 2, 1990, the Renton City Council concurred in
the recommendation of the Utilities Committee to approWe the referenced request to
proceed with the interim sanitary sewer system improvements as proposed in the
"Preliminary Design Report for a Sanitary Sewer Interbasin Transfer from the Upper
Heather powns Basin to the Lower Maplewood Basin." As noted in the attached report,
the Committee required two conditions:
1. The improvements be accomplished, per the report, to provide the capacity to
service the Orchards, Forrest Creste, and Bakke developments.
2. Northward sign and execute a Developer Extension Agreement to participate in the
construction of the East Renton Tnterceptor.

Public Works: Sanitary Utilities Committee Chairman Nelson presented a report stating that the
ewer rv�ce or Committee met to consider sanitary sewer service for the
ort war rc ar s Northward/Orchards property and concurred with the Public Works
Property Department's recommendation that Northward be allowed to proceed with the
interim sanitary sewer system improvements as proposed in their "Preliminary
Design Report for a Sanitary Sewer Interbasin Transfer from the Upper
Heather powns Basin to the Lower Maplewood Basin" (Dodds Engineers, Inc.,
May 1990).
The recommended improvements include construction of a lift station at the
south side of the Bakke property and rerouting the flows from the Orchards
and Windsor Place Apartments (the latter being an existing complex) from the
Heather powns Basin to the Maplewood Basin. To accomplish this interbasin
transfer, 5250 linear feet of 6" force main, 490 linear feet of 8" PVC sewer
pipe, and 360 linear feet of 24" ductile iron sewer pipe would be installed.
The Committee further concurred with the Public Works Department's
recommendation that if Northward proceeds with the above-mentioned
interim improvements, the following occur:
1) The improvements be accomplished, per the report, to provide the
capacity to service the Orchards, Forrest Creste, and Bakke
developments.
2) Northward sign and execute a Developer Extension Agreement to
participate in the construction of the East Renton Interceptor.

THE COMMITTEE REPORT.*
Councilman Stredicke asked for clarification of the effect this report has on
the sewer moratorium. Utility Systems Manager Richard Anderson explained
that these properties were covered in the original sewer moratorium and were
given consideration for exemption; it is consistent with the sewer moratorium
and the City's proposals for serving that area; and is an interim measure and
not intended to be a permanent solution to the moratorium. *MOTION
CARRIED. Upon further inquiry, Mr. Anderson advised that the sewer
comprehensive plan and schedule for the East Renton Interceptor project will
be presented to Council very shortly.
Library: Service to Councilwoman Zimmerman cited a letter to the editor which appeared in the
Renton Hill Residents Valley Daily newspaper on July 2, I990, regarding the Council's action to
provide library service to North Soos Creek residents and suggesting that the
City consider providing its services to other non-city residents. Further, she
mentioned that she has been asked why Renton library services are being
considered for North Soos Creek area residents only. Moved by Zimmerman,
seconded by Tanner, Council refer this matter to Community Services
Committee for review and recommendation.* Councilwoman Keolker-
Wheeler suggested that this should be referred to the Library Board prior to
going to the Committee.

PlanninQ & Develooment Ptanning and Development Committee Chairman Tanner presented a report
�ommittee stating that on March l2, 1990, the City Council passed Resolution No. 2787
Planning: Shoreline regarding proposed Shoreline Master Program amendments. Those
Master Program amendments were sent to the State Department of Ecology, as required. On
Amendments May 16, 1990, Nora Jewett, of the Department of Ecology, suggested two
minor changes. On June 28, 1990, the Committee met with staff to review
the suggested changes and found them to be minor, another purpose was
added to the purpose section, and commercial and industrial docks will be
limited to 12 feet in width as are recreational docks, unless a variance is
granted by the hearing examiner.
The Committee recommended that the Council authorize the administration to
send a letter to notify the State Department of Ecology that the City
concurred in the changes, with the exception that "Recreation" needs to be
left in the title of Section 7.12.07 to allow recreational docks up to 12 feet in
width. Anticipating approval by the State Department of Ecology, the
Committee also recommended this matter be referred to the Ways and means
Committee for the preparation of appropriate legislation.

SUMMARY OF ACTION:
Northward will provide a detailed design report for interim sewer improvements to the lower
Maplewood Basin to allow three developments to proceed: *The Orchards, Bakke property, and Forrest
Creste. These interim improvements will provide sewer service until such time as the East Renton
Interceptor is constructed. Similar exemption requests will be submitted by developers of Bakke and Forrest
Creste.
*The Orchards: Duvall Avenue NE between NE 6th and NE 8th Streets, 696 multifamily units and 17
single family homes. (An alternative plan is currently being developed by Northward for an additional 17
acres on either side of Duvall Avenue for development of single family homes, townhomes, apartments and
commercial offices.)
Bakke property: south of NE 4th Street and east of Union Avenue NE, 111 multifamily units.
Forrest Creste: east of Duvall Avenue NE, north of SE 124th Street, 200 multifamily units.
Total units: 1007 multifamily and 17 single family, plus potential development of an additional 17 acres.

Northward Properties is hereby requesting an
exemption from the sewer moratorium which was
enacted on July 17, 1989 as Resolution 2764 . This
exemption is for our development known as Renton
East or "The Orchards" on the West side of Duvall
Avenue between N.E. 6th and N.E. 8th Streets.

sewer improvements to be made to the Lower
(206)747-t7z6 Maplewood basin. These improvements will allow our

Forrest Creste developments, to be provided with
sewer service until such time as the East Renton
Interceptor is constructed. At that time, our
sewer service will be re-directed to the East
Renton Interceptor.
Our consultants have been working closely with the
City staff and their consultants, RH2 Engineering,
to prepare this report and respond to all comments
and recommendations. On May 29, 1990 we met with
Mr. Jim Bakke of the Bakke Property and Mr. George
Berry of Dominion Developments (proponents for
Forrest Creste) to discuss the report, the routing
and the associated costs. At that time, both
groups expressed an interest in participating in
these interim improvements. I am assuming that you
will be receiving similar exemption requests from
them.

Dear Ms. Myer,
; Northward Properties is hereby requesting that the
application for rezone, site plan and E.I.S.
addendum for the current proposal for The Orchards
�- be placed on hold at the City of Renton. Our staff
and consultants are currently creating an
i alternative plan for the 44 acres of The Orchards,
� plus an additional 17 acres on either side of
Duvall Avenue to incorporate a wide range of uses
including single family detached houses, townhomes,
apartments and commercial offices.

S,,,tt t�� We will be submitting this alternative plan for
[i�n���,�,WAy�oos technical review by City staff in the near future.
Based on the results of this review, we will then

soon as possible.
�� In regards to the sewer issue, Northward Properties
� has always viewed the rezone and sewer proposals as
being separate from one another, yet on parallel
courses. As a result, we would like the sewer study
to continue through its review by the City Council.
The study can be quickly revised if the alternative
plan is put in place.
