Dear Mr. Benoit:
The Boundary Review Board acknowledges receipt of your ietter notifying the Board of City of
Renton side sewer connections for two parcels owned by Mr. Michael W. Jackson. It is our
understanding that one connection was made previously in 1962, that a second connection has now
been approved in response to County Department of Public Health notice of a failed on-site
treatment system, and that both connections are now covered by an agreement with Bryn Mawr-
Lakeridge Water and Sewer District.
As you were informed in our earlier conversations concerning these side sewer connections, this
type of action does not require a formal notice of intention to the Boundary Review Board. RCW
36.93.090 (5) of the Boundary Review Board Act requires a notice of intention for extension of
water or sewer service outside of city corporate boundaries. However, connection of a single
residence to an existing City sewer line, referred to as a side sewer, has not been interpreted as an
extension of service requiring a notice of intention.
We understand that written notice of the connections was submitted in order to satisfy conditions
of your agreement with Bryn Mawr-Lakeridge Water and Sewer District. We appreciate the
thorough explanation provided to the Board. The materials submitted, along with a cover
memorandum and this letter of response, will be distributed to the Board with their May 9, 1991,
meeting agenda packet. For Boundary Review Board purposes, no further information or action
is required.

AGREEMENT FOR SANITARY SEWER SERVICE �

THIS AGREEMENT, made and entered into this -� day of ,
19�, by and between BRYN MAWR-LAKERIDGE WATER AND SEWER DISTRICT,
a Washington municipal corporation, hereinafter referred to as "THE DISTRICT", and the
CITY OF RENTON, a Washington municipal corporation, hereinafter referred to as
"RENTON", both being duly organized and existing under and by virtue of the laws of the
State of Washington,
WITNESSETH:
WHEREAS, RENTON has constructed, and has managed, operated, and maintained
sanitary sewer facilities in the County right-of-way known as 87th Avenue South, between
South 124th Street and the City Limits; and
WHEREAS, THE DISTRICT does not own or have rights to existing sanitary sewer
facilities in 87th Avenue South, between South 124th Street and the City Limits; and
WHEREAS, Parcel B, as described in Exhibit A is currently served by RENTON
sewage facilities; and
WHEREAS, Parcel A, as described in Exhibit "A", has been instructed to connect to
public sewer by the Seattle-King County Health Department; and
WHEREAS, THE DISTRICT agrees that it is logical for Parcel A to connect to
RENTON sewer and has no objection to said property being connected to and served by
RENTON'S sanitary sewer; now therefore,
IT IS HEREBY AGREED by and between the parties hereto as follows:
1. Sanitarv Sewer Service bv RENTON within DISTRICT limits. The property
described in Exhibit "A" shall be transferred to RENTON and is herein released to
RENTON for provision of sanitary sewer service by RENTON at no charge for the
transfer of such service area. THE DISTRICT releases all claim to sanitary sewer
service within the areas described in Exhibit "A" and as shown in attached Figure 1.
2. Rates and Fees. Henceforth, upon approval of this agreement, all fees due and
collectible for the service of disposing of sanitary sewage from Parcels A and B, as
described in Exhibit "A", shall be paid to RENTON.
3. Submittal of A�reement to the Boundarv Review Board. THE DISTRICT supports
and approves the service boundary modification and hereby authorizes RENTON,
for and on behalf of THE DISTRICT, to prepare a submittal to the Washington
State Boundary Review Board for King County, notifying the Board of RENTON's
intention to service outside RENTON's service area. THE DISTRICT and RENTON
agree to provide any support requested or required by King County or the Boundary
Revie�v Board in the review and approval process. RENTON agrees to pay for all
costs involved in the submittal, review and approval process.

4. Failure of Aoproval. This agreement will become null and void if the transfer is
not approved by the Boundary Review Board or by a court, upon subsequent appeal.
5. Sanctitv of Agreement. This agreement constitutes the entire agreement of the
parties, and there are no representations or oral agreements, other than those listed
herein, which vary the terms of this agreement. Future agreements may occur
between the parties to transfer additional, or future, service areas and/or facilities
by mutual agreement.
6. Obli�ation Intact. Nothing herein shall be construed to alter the rights,
responsibilities, liabilities, or obligations of either THE DISTRICT or RENTON
regarding provisions of water or sewer services to the properties described herein, or
other properties, except as specifically set forth herein.

A RESOLUTION OF THE CITY OF RENTON, WASHINGTON,
AUTHORIZING THE MAYOR TO ENTER INTO AN INTERLOCAL
COOPERATIVE AGREEMENT WITH THE BRYN MAWR-LAKERIDGE WATER
AND SEWER DISTRICT TO PROVIDE 5ANITARY SEWER SERVICE TO
PROPERTY LOCATED IN THE COUNTY RIGHT-OF-WAY.
WHEREAS, the City of Renton has constructed, managed, operated,
and maintained sanitary sewer facilities in the County right-of-way
known as 87th Avenue South located between South 124th Street and
the city limits; and
WHEREAS, Bryn Mawr-Lakeridge Water and Sewer District does not
own or have rights to existing sanitary sewer facilities in 87th
Avenue South located between South 124th Street and the city limits;
and
WHEREAS, the City of Renton is currently providing sanitary
sewer service to Parcel B, described in Exhibit "A" which is
attached hereto and incorporated herein as if fully set forth; and
WHEREAS, the Seattle-King County Health Department has
recommended that Parcel A, described in Exhibit "A, " be connected to
public sewer; and
WHEREAS, Bryn Mawr-Lakeridge Water and Sewer District agrees
that it is logical for Parcel A to connect to the City of Renton
sewer and has no objection to said property being connected to and
served by the City of Renton' s sanitary sewer; and
WHEREAS, it would be advantageous for the City of Renton to
enter into an Interlocal Cooperative Agreement with the Bryn Mawr-

Re: Sewer Connection Request
Dear Mr. Jackson:
Your letter, dated December 31, 1990, was read at the Renton City Council meeting of January 7,
1991. Following a presentation by staff, the Council granted your request to connect to City sewers
due to failure of your septic system. Approval was granted subject to the following conditions:
1) The purpose of the connection will be to serve the existing residence or future replacement
residence. No additional connections from either Lot A or Lot B will be made without
Council approval;
2) Mr. Jackson sign and have executed covenants agreeing not to protest annexation for both Lot
A and and Lot B;
3) Mr. Jackson make connection to City sewer consistent with City codes, standards and policies;
4) Mr. Jackson obtain and pay for all required permits, including but not limited to a City side
sewer permit and County right-of-way permit;
5) Mr. Jackson agree to transfer of sewer service for Lot B from the Bryn Mawr-Lakeridge
Water and Sewer District to the City of Renton. By this, he is acknowledging that his sewage
is being transferred by the City's system to Metro and as the District has no involvement in
the process, all appropriate rates and fees rightfully belong to the City of Renton; and
6) Acknowledge as a non-City resident, he is required to pay the utility rate set by the City
Council for non-residents (currently one and one-half the standard rate).

CORRESPONDENCE Correspondence was read from Michael Jackson, 12421 87th Avenue South,
Citizen Comment: Renton, requesting connection of his property to the City's sewer system due
Jackson - Sewer to septic failure, and referring to an enclosed letter from the Seattle-King
Connection, 12421 87th County Department of Public Health stating that this condition must be
Avenue South corrected within 30 days.
Senior Engineering Specialist Mike Benoit explained that Mr. Jackson owns
two lots in the Bryn Mawr-Lakeridge Water and Sewer District (the District).
An investigation of Mr. Jackson's lot at 12421 87th Avenue South (Lot A)
indicated that his septic system was discharging effluent upon the surface of
the ground.
Mr. Benoit reported that the City of Renton owns and operates an eight-inch
sanitary sewer line in 87th Avenue South. Prior to 1962, this line carried the
City's sewage from a portion of the West Hill to the District's system at 124th
Street where it was disposed of by the District. In 1962, a new sewer was
installed by the City to intercept the City's flow at South 124th Street and
route it south on Taylor Avenue where it eventually reaches the Metro
interceptor in Burnett Avenue. Mr. Jackson's property at 12427 87th Avenue
South (Lot B) was connected to the City's sewer prior to 1962 when the line
still flowed into the District's system, and he presently pays utility rates to
the District. Since the lot at 12421 87th Avenue South (Lot A) is the only
property within this portion of the District without sewer service or
availability to service through the District, the City has an adjacent line, and
extension of a sewer main would not provide sewer connection within the
Health Department's time frame, staff recommended that Mr. Jackson be
granted permission to connect to City sewer based on the following
conditions:
1) The purpose of this connection will be to serve the existing residence or
future replacement residence, and no additional connections from Lot A
or B will be made without Council approval.
2) Mr. Jackson sign and have executed covenants agreeing not to protest
annexation for both Lot A and Lot B.
3) Mr. Jackson make connection to City sewer consistent with City codes,

4) Mr. Jackson obtain and pay for all required permits including but not

In response to Councilman Tanner's inquiry, Mr. Benoit explained that Lot B
was connected to the City's sewer in 1962 when the City directed its flow to
Metro; however, Mr. Jackson has been paying the District for this service,
and condition #5 (above) will correct this error.

Request for Connection to City Sanitary Sewer
BACKGROUND•
Mr. Jackson is the owner of two lots in the Bryn Mawr-Lakeridge Water and Sewer
District (the District). On December 18, 1990, an investigation was made of Mr. Jackson's
northern lot (Lot A), addressed as 12421 - 87th Ave. South. The Seattle-King County
Health Department discovered that his septic system was discharging effluent upon the
surface of the ground. The Health Department observed that effective repair would be `
very unlikely and has recommended that Mr. Jackson take whatever steps necessary to
connect to public sewer within 30 days. Mr. Jackson first approached the District, where
it was determined that the nearest District sewer was at S. 124th St.
The City owns and operates an eight-inch sanitary sewer line in 87th Avenue South.
Until 1962, this line carried the City's sewage from a portion of the West Hill to the
District's system at 124th St. where it was disposed of by the District. In 1962, a new
sewer was installed by the City to intercept the City's flow at S. 124th St., prior to the
District's system, and route it south on Taylor Ave. where it eventually reaches the Metro
interceptor in Burnett Ave.
Mr. Jackson's southern lot (Lot B), addressed as 12427 - 87th Ave. So., was connected to
the City's sewer prior to 1962 when the line still flowed into the District's system and that
property has been paying utility rates to the District since.
DISCUSSION:
Lot B is currently connected to the City's sanitary sewer system. The properties south of
Lot B are within the City Limits and thus have the availability of City sewer. The lot to
north of Lot A has District sewer available along S. 124th St.
As Lot A is the only property within this portion of the District without sewer service or
availability to service through the District and the City has an adjacent line, both the
District and City staff feel it would be logical for the City to allow Mr. Jackson a

Furthermore, the time involved in extending a sewer main to Mr. Jackson's property
would not provide a sewer connection within the Health Department's time frame.
RECOMMENDATION:
Staff recommends that Mr. Jackson be granted permission by City Council to connect to
City sewer, consistent with City policy allowing connections outside the City Limits if a
failing septic system exists . This connection will be based on the following conditions:
1) The purpose of this connection will be to serve the existing residence or future
replacement residence. No additional connections from either Lot A or Lot B will
be made without Council approval;
2) Mr. Jackson sign and have executed covenants agreeing not to protest annexation
for both Lot A and Lot B;
3) Mr. Jackson make connection to City sewer consistent with City Codes, Standards,
and Policies;
4) Mr. Jackson obtain and pay for all required permits, including but not limited to a
City Side Sewer Permit and County Right-of-Way Permit;
5) Mr. Jackson agree to the transfer of sewer service, for Lot B, from the District to
the City of Renton. By this he is acknowledging that his sewage is being
transferred by the City's system to Metro and as the District has no involvement in
the process, all appropriate rates and fees rightfully belong to the City of Renton;
and
6) Acknowledge as a non-city resident he is required to pay the utility rate set by
City Council for non-residents (currently one and one-half the standard rate).

to c:onnect to public sewer. Under no cirrumstances should

for a per. i.od of time exceeding 30 days .
Until this si_tuation is corr_ected, it is imperative that
you make every effort to r.educe your. water. consumption and
the.reby the amount of effluent dischar_ging on the ground.
For example, a major reduction can be achieved by doing your
laundry at a laundrymat.
