SUBJECT: Request for sewer service outside the City limits by Stewart, Mano, and
Creegan
ISSUE
Th� City received requests for sanitary sewer service from John Stewart and Josh Mano on May
17, ? 994 and Michael Creegan on June 27, 1994. They are requesting that the City allow them to
extend samtary sewer service to their properties which lie in the unincorporated portion of King
County (Skyway/West Nill area of Renton). The attached map shows the specific parcels involved.
The area which they are requesting service for is insufficient in size and valuation to support an
annexation at this time. in addition, there does not exist sufficient propert�es in their general
vicinity which have existing covenants to annex that could assist them in an annexation request.
DISCUSSION
These properties are located in the West Hill/Skyway area west and north of the current City limits.
The area is comprised of partially developed mid-size lots all on existing on-site sewage disposal
systems. The parcels in question are outside of Renton's current City Limits but are within the
future service area boundary as defined by the interlocal agreement recently executed with Skyway
VVater and Sewer District (CAG-94-065). The Wastewater Utility has no objections to providing
sewer service to these parcels with the usuaf conditions (i.e. covenant to annex, the property
o�vners extend the sewers for their use, meet City standards for sewer service, pay all appiicable
f2es, and pay the non-resident rate).
What is of more concern to the City are the land use actions that wili be taken if sewer service is
granted and what the potential positive and negative impacts the action may have on Renton's
future growth area. These parcels are currently under consideration, before the Council, as
comprehensive plan amendments. It is, therefore, staff's opinion that it would be in the best
interests of ail parties if this issue was discussed at the same time and in front of the same
cemmittee that is considering the comprehensive plan amendments.
RECOMMENDATIC7N
Staff recommends that the Utilities Committee refer the issue of granting sewer service to these
parcels to the Committee of the Whole for August 16th so that it may be considered in
concurrence with the decision to revise the comprehensive plan designation of those particular
parcels.

item, it was MOVED BY TANNER, SECONDED BY SCHLITZER,

UTILITY BILLING CYCLE CHANGE. CARRIED.
Finance Committee Finance Committee Chair Tanner presented a report recommending changing
Utility: Billing Cycle the current utility billing day composition (collect cycle) from due in 30 days
Change with a 15-day grace period to due in 25 days with a 20-day grace period and
• deletion of interest charges associated with delinquent charges. MOVED BY
TANNER, SECONDED BY EDWARDS, COUNCIL CONCUR IN THE

Responding to Council President Stredicke, City Attorney Warren agreed it is
difficult to establish the existence of an illegal duplex as the burden is on the
City to provide evidence of the violation, and probable cause is required
before a search warrant can be obtained for inspecting the premises.

Executive Assistant Jay Covington offered to report on any legislative efforts
that would make it easier for jurisdictions to investigate allegations of illegal
duplexes. Planning and Technical Services Director Mike Kattermann agreed
to respond to Councilman Tanner's question regarding whether the City is now
required by State law to allow accessory units (mother-in-law apartments) in
single family areas.

Utility: Sewer Hook-up Utilities Committee Chair Schlitzer presented a report recommending that the

Utility: CBD Sewer Utilities Committee Chair Schlitzer presented a report recommending
Replacement, King concurrence in the staff recommendation to: 1) approve the CBD Sewer
Construction, CAG-93- Replacement project and final pay estimate in the amount of $2,164.00; 2)
075 approve the release of retainage, if after thirty (30) days, no liens or claims
are filed against the project; and 3) transfer $80,000 from the Park Avenue
North Sanitary Sewer Interceptor project to the CBD Sewer Replacement
project. MOVED BY SCHLITZER, SECONDED BY TANNER, COUNCIL
CONCUR IN THE COMMITTEE REPORT. CARRIED.
WSDOT: I-405 S-Curve Summarizing a memo from Planning/Building/Public Works Administrator
Project Gregg Zimmerman regarding the Cedar Avenue staircase, Councilmember
Keolker-Wheeler stated that the Washington State Department of
Transportation (WSDOT) has said it will construct the alternative staircase off
of Renton Avenue at a cost of $194,000. Saying that the State does not
appear eager to construct the alternative staircase, given its seemingly high
cost estimate, Mrs. Keolker-Wheeler explained that Community Services
Administrator Sam Chastain has indicated that if Public Works and Parks
Department staff cooperated to design the Renton Avenue staircase, the City
could then build this facility at an estimated cost of only �75,000.
Adding that WSDOT is offering a $35,000 credit for deleting the Cedar
Avenue staircase, which may come in the form of a'credit for funds owed by
the City to the State for Mill Street improvements, it was MOVED BY
KEOLKER-WHEELER, SECONDED BY CORMAN, COUNCIL DIRECT
THAT THE $35,000 CREDIT BEING OFFERED BY WSDOT FOR NON-
COMPLETION OF THE CEDAR AVENUE STAIRCASE ON RENTON
HILL BE OBTAINED AND THAT THE CONSTRUCTION OF AN
ALTERNATIVE STAIRCASE OFF OF RENTON AVENUE, IN
CONJUNCTION WITH THE NARCO SITE TRAIL IMPROVEMENTS, BE
APPROVED UP TO A COST OF $75,000.*
Councilman Edwards clarified that Council must direct WSDOT to proceed
one way or another lest the City run the risk of incurring additional costs for
the Cedar Avenue staircase, should this facility be built. The deadline given
by the State for a final Council decision on this issue is August 12th.
Responding to Mr. Edwards, Mrs. Keolker-Wheeler suggested that the
remaining $40,000 needed to construct the Renton Avenue staircase could be
obtained either from funds that might be available depending on the final cost
of the Narco trail system bid, or, alternatively, these monies could be taken
out of the $1.1 million WSDOT will expend next year for landscaping the I-
405 S-Curve project. .
Councilman Tanner was concerned that the memo from the State on this
subject specifically states that "Federal aid participation in the stairway
construction would be limited to . . . �35,000. There would be no . . . Federal
participation in any throw-away . . . costs." He suggested this meant that the
Federal government would not participate in any costs incurred should the
Cedar Avenue stairway not be completed.

SUBJECT: REQUEST FUR SEWER SERVICE OUTSIDE OF WEST CITY LIMIT
BOUNDARY.
We are owners of �roperty west of the city boundary on Renton
Avenue South. We have signed covenants not to oppose annex—ation
when the area interest becomes positive to the idea . At the
present time there is not enough desire among the neighborhood
households .
We are presently served by the Renton water department . This takes
us out of the Skyway water and sewer district service area.
The area surrounding our properties have recently been tested for
failing septic systems . This was done by the King County Public
Health department . At the time of testing, the soil condition was
very dry and the results did not show an immediate danger. Past
history of area has shown a very high failure rate and it is
anticipated that most of the systems will fail in the near future .
A stream in the area that flows along Renton Avenue to the area of
Rainier Avenue has shown a very high E. Coli bacteria content .
A septic system at 8223 South 132nd Street was last repaired on
10/17/89 under KC permit #43605 .
It is anticipated that once the main sewer line� are installed in
the area, residents will desire to connect as septic systems fail .
At the same time we feel that the area residents will seek to
annex to the city of Renton.
We feel that this request is consistant with the growth management
objectives that are now being considered.
We thank you for your consideration on this matter. We will be
happy to work with Mr . Christensen of the utilities department
with the approval of the council .

Dear Mr. Clymer:
This letter is a petition to the City of Renton from the
Skyway Water and Sewer District in support of extending sewers to
serve the Mano/Stewart property. This action should be done in
the most expeditious manner possible without requiring that the
properties first annex into the City of Renton.
The District has just completed a boundary agreement with
the City of Renton which left portions of unincorperated King
County outside the District boundary. This was done with the
understanding that the newly enacted State Growth Management
Policies mandate that, when feasible, cities extend utility
services to urbanized areas beyond their corporate limits. We
are aware that the City of Renton has extended service east of
the Renton city limits without requiring annexation.
