Citizen Comment Kolby - Correspondence was read from Frank Kolby and Sen Kolby, 16427 Benson
Emergency Sewer Hook- Rd. S., Renton, 98058, requesting emergency hook-up to the City's sewer
uP system as their septic system has failed.
�� -t`t"—d�� David Christensen, Engineering Specialist, asked that, given the urgency of
this matter, Council consider this request tonight rather than refer it to the
Utilities Committee. Mr. Christensen explained that the Kolby property is
located in King County adjacent to Renton's city limits. It is also adjacent to
two of the City's sewer lines. Staff recommends that the Kolbys be allowed
to connect to Renton's sewer system, with conditions, as follows:
1. Execution of a restrictive covenant agreeing to support any
annexation that includes this property;
2. Connection must be made consistent with City codes, standards and
policies;
� 3. All required permits must be obtained and paid for; and
4. Payment of one and one-half standard utility rate for non-residents.
Councilman Edwards concurred with Council President Stredicke that maps
showing the location of the property being considered, including City limits
and adjacent properties, should be provided for Council's information in
reviewing these types of requests. .

APPROVE STAFF'S RECOMMENDATION TO ALLOW SEN KOLBY, 14627
BENSON RD. S., RENTON, 98058, TO CONI�IECT TO THE CITY'S SEWER
SYSTEM WITH CONDITIONS. CARRIED. Council President Stredicke
asked that his "no" vote be recorded.
OLD BUSINESS Planning and Development Committee Chair Keolker-Wheeler presented a
�lanning & Develooment report recommending that the Purpose Statement of the Convenience
Committee Commercial (CC) Zone be amended to remove the limitation of a one-half
Comprehensive Plan: mile market area about the zone for retail and service establishments. The
Convenience Commercial Committee further recommended adding language stating that uses serving a
(CC) Zone Amendment larger area may be appropriate providing they serve the immediate area and
fit the scale and character of the neighborhood. The Committee further
. recommended that the ordinance regarding these matters be presented for first
and second reading. MOVED BY KEOLKER-WHEELER, SECONDED BY
SCHLITZER, COUNCIL CONCUR IN THE COMMITTEE REPORT.
CARRIED. (See page 379 for ordinance.)
Utilities Committee Utilities Committee Chair Schlitzer presented a report recommending
Utility: Sewer Hook-up, concurrence with the Planning/Building/Public Works Department's staff
Maplewood Heights recominendation that the City allow Renton School District No. 403 to connect
Elementary School the Maplewood Heights Elementary School to the City's sanitary sewer system
with the following conditions:
1. The School District will engineer and construct the sewer extension so that
it may service the entire area that this extension would logically serve.
2. The School District will pay all engineering and construction costs.
3. The sewer system witl be built to meet current City standards at the time
of construction.
4. The School District will pay non-resident sewer rates.
5. The School District shall pay for all permits and fees, City and other
agencies, required for the sewer extension.
6. The School District, at the time of application for.permit, executes and
records a covenant agreeing to support any annexation that includes the
Maplewood Heights Elementary School parcel (if the City Attorney

Dear Mr. Kolby:
At the regular Council meeting of Septernber 12, 1994, the Renton City Council
approved your request to connect the residential property owned by Sen Kolby at 16427
Benson Road South to the City of Renton sewer system subject to conditions
recommended by staff. These include:
1. Execution of a restrictive covenant agreeing to support any annexation that includes
Mrs. Kolby's property;
2. Connection must be consistent with City codes, standards and policies;
3. All required permits must be obtained and paid for,
4. Payment of one and one-half standard utility rate for non-residents.
A copy of the staff report is attached for your information.

Per your recent telephone conversation with Dave Christensen, this memo includes
information to assist you in bringing this matter forward at the Council meeting on
September 12th. Mr. Kolby is expected to submit his letter requesting service to the
Clerk by Thursday (9/8/94) to ensure its inclusion as a correspondence item at the
meeting of the 12th. Staff has spoken to Mr. Kolby regarding the four conditions
included in this memo and he has no objections to any of them. Dave will be attending
the meeting of the 1 2th if you have any questions :that night. If you need to discuss
anything prior to the meeting, please call him at 277-6212. Thank you for your
assistance in this matter.
ISSUE:
Frank Kolby on behalf of his mother, Sen Kolby, has requested permission from the

system is failing and is discharging effluent upon the surface of the ground.
RECOMMENDATION:
Staff recommends that Mrs. Kolby be allowed to connect to Renton's sanitary sewer
system with the following conditions:
1) Mrs. Kolby sign and have executed a covenant agreeing to support any
annexation that includes her parcel;

4) Mrs. Kolby acknowledges that, as the property is located outside the Renton
City limits, the occupant is required to pay the utility rate set by the City
Council for non-residents (currently one and one-half the standard rate).
DISCUSSION:
Mrs. Kolby owns the house at 16427 Benson Road South. She has been having
problems with her existing septic system: Upon inspection, the Seattle-King County
Health Department found the property to be in non-compliance with their regulations.
The City owns and operates an eight inch sanitary sewer line in Benson Road South
that is adjacent to the Kolby property as well as an 8-inch line that is located behind
her property in Cedar Avenue South (plat of Victoria Hills). Under the Health
Department's regulations, the property must be connected to public sewers if within
330 feet, provided the sewer utility permits the connection. If we do not allow
connection, the property owner's alternative is to replace the system.

Dear Renton City Council,
I would like to formally request a permit for Renton sewer hook up as a King
County resident.
Our septic system is no longer functional, and raw sewage is currently draining
into the back yard. The Seattle-King county Department of Public Health
inspected the property on August 30, 1994. A copy of the letter is enclosed.

Dear Ms . Kolby:
On August 30, 1994, an investigation was made of your property at
16427 Benson Rd S (Pcl# 0087000007) . At that time, your sewage
disposal system was discharging effluent upon the surface of the
ground.
A licensed septic system installer hired by you must make
application for a permit to re.pair this system and effect the
repair as soon as possible. Under no circumstances should this
discharge of sewage effluent be allowed to continue for a period of
time exceeding 14 days from the above date.
If your residence is within a local sewer district and public sewer
is available to your property, you must connect to the sewer at
this time.
If you have questions not answered by this letter, please telephone
me at 296-9736, Tuesday through Friday, from 7 :30 to 9 : 00 a.m.

Dear Sewer Department,
I am writing on behalf of my mother regarding the enclosed application. She
would like to be hooked in to sewer because, after years of chronic septic
problems, she was told that her septic system was shot and that she needed a
new drain field. Raw sewaQe is currentiv draininq out into the back vard.
The toilet is frequently backed up and the smell of raw sewage is in the
bathroom and in the back yard.
As these conditions are unhealthy, we would appreciate your assistance as soon
as possible.
