THE NATIVE GROWTH PROTECTION EASEMENT (NGPE) ON THE CHELAN CREEK PLAT IDENTIFIES THE CRITICAL
AREA. THE NATIVE GROWTH PROTECTION EASEMENT (NGPE) IS HEREBY GRANTED AND CONVEYED TO THE
CHELAN CREEK P.U.D. HOMEOWNERS ASSOCIATION (HOA). THIS INTEREST SHALL BE FOR THE PURPOSE OF
PRESERVING NATIVE VEGETATION FOR THE CONTROL OF SURFACE WATER AND EROSION, MAINTENANCE OF
SLOPE STABILITY, VISUAL AND AURAL BUFFERING, AND PROTECTION OF PLANT AND ANIMAL HABITAT. THE
NATIVE GROWTH PROTECTION EASEMENT IMPOSES UPON ALL PRESENT AND FUTURE OWNERS AND OCCUPIERS
OF THE EASEMENT AREA ENFORCEABLE BY THE (HOA), TO LEAVE UNDISTURBED ALL TREES AND OTHER
VEGETATION WITHIN THE EASEMENT AREA. THE VEGETATION WITHIN THE NGPE MAY NOT BE CUT, PRUNED,

3. LOTS 1 AND 2 REQUIRED TO ORIENT TOWARD CHELAN PLACE NE, LOTS 3 AND 4 WOULD ORIENT TOWARD THE
NGPE (WEST); LOTS 5 THROUGH 10 WOULD ORIENT TOWARDS THE NPGE (EAST); LOT 11 TOWARD THE NGPE
(SOUTH); LOTS 12 AND 13 TOWARD THE NGPE (SOUTH); AND LOT 14 TOWARD THE ABUTTING PROPERTY TO
THE WEST.
4. THE ROAD AND STORM DRAINAGE SYSTEMS HAVE BEEN CONSTRUCTED ACCORDING TO THE APPROVED PLAN
AND PROFILE ON FILE WITH RENTON DEVELOPMENT SERVICES DIVISION AND ANY DEVIATIONS FROM THE
APPROVED PLANS WILL REQUIRE WRITTEN APPROVAL FROM THE PROPER AGENCY, CURRENTLY RENTON
DEVELOPMENT SERVICES DIVISION.
5. ALL BUILDING DOWN SPOUTS, FOOTING DRAINS, AND DRAINS FROM ALL IMPERVIOUS SURFACES SUCH AS
PATIOS AND DRIVEWAYS SHALL BE CONNECTED TO THE PERMANENT STORM DRAIN OUTLETS AS SHOWN ON
THE APPROVED CONSTRUCTION DRAWINGS R-386901 ON FILE WITH THE CITY OF RENTON. THIS PLAN SHALL BE
SUBMITTED WITH THE APPLICATION OF ANY BUILDING PERMIT. ALL CONNECTIONS OF THE DRAINS MUST BE
CONSTRUCTED AND APPROVED PRIOR TO FINAL BUILDING INSPECTION APPROVAL. FOR THOSE LOTS THAT ARE
DESIGNATED FOR INDIVIDUAL LOT DISPERSION SYSTEMS, THE SYSTEMS SHALL BE CONSTRUCTED AT THE TIME
OF THE BUILDING PERMIT AND SHALL COMPLY WITH THE PLANS ON FILE.

4. AN EASEMENT IS HEREBY GRANTED TO THE CITY OF RENTON FOR SANITARY SEWER PURPOSES OVER
TRACTS "A", AND "C" AS DEPICTED HEREIN. THE CITY OF RENTON SHALL BE RESPONSIBLE FOR THE
MAINTENANCE OF THE SANITARY SEWER FACILITIES CONTAINED WITHIN SAID EASEMENTS.
5. AN EASEMENT IS HEREBY GRANTED TO THE CITY OF RENTON FOR WATER PURPOSES OVER TRACTS "A",
AND "C" FOR WATER MAIN LINE AS DEPICTED HEREIN. THE CITY OF RENTON SHALL BE RESPONSIBLE FOR
THE MAINTENANCE OF THE WATER FACILITIES CONTAINED WITHIN SAID EASEMENTS.
