Without any documentation on his withdrawal, Mr. Pham could claim at any point in the future that his appeal is still pending. If Mr. Pham has not emailed a statement expressing his intent to withdraw his appeal by December 23, 2022 I request Ms. Moya to reschedule his appeal hearing in January, 2023 so that his appeal can be resolved. It might have to be rescheduled. I will be sending out an email today or tomorrow to clarify the nature of the cancellation request and how that impacts the disposition of the appeal.
