AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, CHANGING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES WITHIN THE CITY OF RENTON FROM RESIDENTIAL DISTRICT (R-3) TO"APARTMENT HOUSES AND MULTIPLE DWELLINGS" (R-4) WHEREAS under Chapter VII, Title Iv ARegulations) of Ordinance No. 1628 known as the "Code of General Ordinances of the City of Renton", as amended, and the maps adopted in conjunction therewith, the property hereinbelow described has heretofore been zoned as Residential District (R-3j, and WHEREAS a proper-. petition for change of zone classification of said properties has been filed with the City Clerk on or about January 26, 1966, which petition was then duly referred to the Planning Commission for investigation, study and public hearing, and a public hearing having been held thereon on or about February 23, 1966, all pursuant to notice of hearing duly published and posted as provided by law; and said matter having been duly considered by the Planning Commission, and said rezoning being in conformity with the City's Comprehensive Plans and all parties having been heard appearing in support thereof or incpposition thereto, NOW THEREFOPE B3 IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE 'CITY OF, RENTON,AS FOLLOWS: SECTION I: The following described properties in the City of Renton are hereby rezoned to 'Apartment House and Multiple Dwellings" (R-4 District), the City Engineer and the Planning Director are hereby authorized and directed to change the maps of the Zoning Ordinance, as amended, to evidence said rezoning, as follows: (a) A tract of land situated in the southwest quarter of section 20, township 23 north, range 5 east, W.M. , in King County, Washington, more particularly described as follows: Commencing at the point of intersection of the south boundary line of said section 20 with the easterly line of the Benson County Road; thence northerly along the easterly line of said County Road 395.64 feet; thence north 87°31'41"east 772.44 feet; thence south 0°13'18" west 345.83 feet to the south boundary line of said section 20; thence along the last described line south 85°12'12" west 617.94 feet to the point of beginning; EXCEPT the following described portion thereof; Commencing at the point of intersection of the south boundary line of said section 20, with the easterly line of the Benson County Road; thence northerly along the easterly line of said County road 360.64 feet to the point of beginning; thence northerly along the easterly line of said County Road 35 feet; thence north 87°31'41" east 55 feet; thence south- westerly to the point of beginning. The proposed use of this property is for an automotive service station. The Comprehensive Plan in- dicates this area as multiple family residen- tial use. The location, however, appears to be a logical business use area. The Planning Commission recommended approval of the rezone request , contingent upon the change of the Comprehensive Plan to reflect the proposed business use . ( 3) I . E. St . Clair, Appl. Discussion followed relative to the advisability of changing the Comprehensive Plan to allow the proposed use. ACTION: Moved by Denzer, seconded by Teegarden that the hearing be closed. Motion carried. Moved by Denzer, seconded by Cordell, to recommend to the City Council the rezone to B-1 contingent upon the change of the Comprehensive Plan map to reflect this use. Motion carried. The Comprehensive Plan shows the area as poten- tial multiple family use. Slides of the area in question were shown." After discussion on the proposed use, the following actions were taken: ACTION: Moved by Stredicke , seconded by Denzer, that the hearing closed. Motion carried. Moved by Stredicke , seconded by Cordell , that this re- zone be recommended to the City Council for approval , as the proposed rezone is in agreement with the Comprehensive Plan. Motion carried. Mr. Racanello , abstained from voting on this matter. 6) BENSON PROPERTIES , APPL, NO. R-290-66 , request for rezone from R-3 to R-4 , property located on Benson Highway south of Puget Drive. Committee report : Recommend approval , as the proposed zone is in agreement with the Comprehensive Plano Staff report : The Comprehensive Plan indicates this area as suitable for multiple family residential use. The R-4 classification would allow a higher land density than-;"the R-3 and would permit a maximum height, of 6 stories or 95 ' . Chairman Garrison asked if there were any comments from the audience. Mr. Merlino , representing the owners , stated that the owners propose to develop luxury type apartments three stories in height , and he felt that the development of the property wouldibe an asset to the community. ACTION: Moved by Denzer, seconded by Cordell , that the hearing be closed. Motion carried. Moved by Denzer, seconded by Stredicke , to recommend to the City Council approval of the rezone as requested, as the proposed rezone agrees with the Comprehensive Plano Motion carried. ( 7) WALT DRAGIN, APPL0 NO. R-271-66 , from R-4 to L-1 , continued from Jan. 26 meeting . The property is located at 539 a 541 . Williams St. North. Mr. Ernie Coleman , representing the applicant , stated that it had been his understanding that this area was previous- ly. recomemnded for L-1 use , and he felt that this area with its close proximity to the industrial area could reasonably be zoned L-1. Mr. Ericksen stated that the proposed L-1 would not be in compliance with the Comprehensive Plan, which shows high density residential use for this area. He felt that business use might be more feasible at this time. Mr. Coleman stated that B-1 would be acceptable if the Com- _mission felt that this was the best use for the property. ACTION: Moved by Teegarden, seconded by Denzer, that we recommend to the City Council 'the rezone to B-1, provided the Comprei hensive Plan is changed to permit this use. Motion carried. 3. VARIANCE APPLICATIONS : (1) RAYMOND BROWN, APPLO NO. V-291-66 , request for variance on minimum lot size. The property is located at 11225 1/2 112th Avenue SE. Staff report : The proposed use of the lot would be for single family residential use. The property is presently zoned G-7200 , minimum lot size 7200 sq. ft. . The proposed lot size would be 4480 sq. ft. Due to a portion of the lot being taken by the State Highway for the North Renton Interchange right of way, it is felt that the variance request is reason.. able. Mr. Teegarden stated that the Committee in looking at. Lr). this felt that this was a hardship case , and that a Variance - could be granted on this property.
