AN ORDINANCE OF THE CITY OF RENTON, WASHINGION, CHANGING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY WITHIN THE CITY OF • RENTON FROM GENERAL CLASSIFICATION DISTRICT TO BUSINESS DIS- TRICT (B-1) WHEREAS under Chapter VII , Title IV (Building Regulations) Of Ordinance No. 1628 known as the "Code of General Ordinances of the City of Renton", as amended, and the maps in conjunction therewith, the property hereinbelow described has heretofore been zoned as GENERAL CLASSIFICATION DISTRICT, and WHEREAS, a petition for change of zone classification of said property had been filed with the City Clerk on or about July 6, 1966, which petition was then duly • referred to the Planning Commission for investigation, study and public hearing and a public hearing having been held thereon on or about July 27, 1966, and said matter having been duly considered by the Planning Commission and said rezoning request being in conformity with the City's Comprehensive Plans and all parties having been heard appearing in support thereof or in opposition thereto, NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON AS FOLLOWS: SECTION I: The following described property in the City of Renton is hereby rezoned to Business District (B-1) ; the City Engineer and the Planning Director are hereby authorized and directed to change the maps of the Zoning Ordinance, as amended, to evidence said rezoning,. to-wit: The East 231 feet of the South 220 feet of the North 250 feet of the N.E. 4 of the N.E. 4 of the N.E. 4 of Section 16, Town- ship 23 North, Range 5 E.W.M. ; Except the East 30 feet thereof for County Road. Being the S.W. Corner of S.E. 128th Street and 132nd Avenue S.E. and having minimum lineal dimensions of 201 • feet on S:E. 128th Street and 220 feet on 132nd Ave. S.E. (situated on 4th Ave.N. REZONES , Continued: (1) Ttansamerica, . continued: Portion of Parcel #30 , from R-4 to B-1, property on the NE corner of Puget Dr. and Benson Rd, Parcel #31, from R-4 to B-1, property located on the SE corner of SE 154th and Benson Rd, Parcel #32, from R-4 to B-1, property on Puget Dr. and Benson Rd. Staff comment: The proposed business uses would not be in compliance with the Comprehensive Plan. Committee comments : Recommend approval of the proposed multiple residential areas, and hold the proposed business areas in abey- ance pending re-study of the Comprehensive Plan. Chairman Garrison, in reply to a question by Mr. Countner, stated that the Commission is _:.holding meetings to re-study the Comprehen- sive Land Usei,M� . After the studies have `been completed the Com- mission will//iric hearing meetings on the proposed amendments, after which recommendations will be made to the City Council on the proposed changes. Mr. Garrison estimated that at least two to three months would be required to effect the amendments to the Comprehensive Land Use Map. He stated that the Commission could not give assurance that the proposed B-1 zoning would be granted. The Commission voted to close the hearing and to recommend granting of rezone to R-3 of Parcels #28 and #29 , and that Parcels #30 , #31, and #32 be held pending study of the Comprehensive Plan. Upon the advice of the City Attorney, the following action was taken: ACTION: Moved by Stredicke, seconded by Racanello, to reconsider the former action and reopen the hearing. Motion carried. Moved by Stredicke, seconded by Racanello, to recommend to the City Council that Parcels #28 and #29 be rezonednfrom -.SR41-to:`.R-3, as this is in agreement with the Comprehensive Plan, and that the hearing be continued on,::aPortiohcof #30 , #31, and #32 pending re- study of the Comprhhensive Plan. Staff comment: The proposed service station would be loc- ated across from the existing service station on the north- west corner of the street. Committee comment: Recommend approval. Chairman Garrison invited comments from the audience. Mr. Janecke, representing the applicant, showed a map of the area indicating that the northeast and southeast corners , still in the County, have recently been rezoned to business use. He felt that the proposed use of the applicant:°.s property would be in agreement with the surrounding areas. There being no further comments from the audience, the follow- ing actions were taken ACTION: Moved by Denzer, seconded by Racanello, that the hearing be closed. Motion carried, (3) John Harer, Appl. No, R-337-66 , request for rezone from G to B-1, property located on the south side of SE 128th Street approximately 200 ' west of 132nd Ave, SE. The property ex- tends 805 ' westward with a depth, of 300 ' . The Comprehensive Plan indicates dommercial use and multiple family residential, The proposed use is for a super market and related retail outlets, Staff comment: The Comprehensive Plan indicates future com- mercial use along .:' SEE 128th Street approximately 200 ' in .depth and multiple family residential to the south. Committee comments : Recommend approval. Chairman Garrison asked if there were any objections or comments on this proposed rezone. There being no objections, the follow- ing actions were taken: ACTIONS : Moved by. Stredicke, seconded - by Cordell, that the hearing be closed. Motion carried. Moved by Cordell, seconded by Denzer, that the rezone from G to B-1 be recommended for approval to the City Council, as it is in agreement with the Comprehensive Plan. Motion carried. (4) Amos Huseland, Appl. Noe R-338-66 , rezone from R-1 to R-3 : property located at the SE corner of 116th Ave. SE and 12th Avenue North. The Comprehensive Plan indicates multiple family residential use. The proposed use is for apartments. Staff comments : The property adjoins the recently rezoned R-3 Buck property. The McKnight Junior High School is located across 12th Avenue N. Committee comments : Recommend approval. Chairman Garrison read two protest petitions signed by proper- ty owners in the area, who felt that the proposed property should be developed into single family dwellings, and that the increase in traffic and congestion would be objectionable. Chairman Garrison asked if there were any further comments. There being none, the following actions were taken: ACTION: Moved by Denzer, seconded by Cordell, that the hearing be closed. Motion carried. Moved by Denzer, seconded by Cordell, that the rezone from R-1 to R-3 be recommended to the City Council, since it is in agreement with the Comprehensive Plan.
