Looation:: 12th Ave. No. between 0 St. and N Place. Desoription: Tract 1, West 1101 of N 240.021 (as measured along W. Line) of the W2 of the Ei of the NIfi of the NE4, Section 9, TWP 23 North, Range 5 EVM, in King County, Washington. Less North 301 thereof for road. Tract 2: The S 841 of the N 324.021 (as measured along W Line) of TWP 23, North, Range 5 EWM, in King County, Washington. Less W 301 thereof for road: and less E. 20' thereof for alley. The signers of this petition are resident home owners living in the adjoining vicinity of the area being proposed for rezoning. We feel that the proposed rezoning, if permitted will be detrimental to the best interest of the publio and oommunity as a whole. The Charac- teristics of the property in question are as follows: Total Area--19,200 square feet • Proposed Use--Apartments (R-3) Principal. (d) Continued Mr. Sven Johnson, Director of the Building Department, stated that the applicant would be required to develop off-site improvements on his property only. Planning Director Ericksen stated that the Comprehensive Plan indi- cates multiple-family use for this area (of medium density R-3 type) . Ball, Sr. , 3505 12th Avenue N. , who stated he was the applicant and presented a letter amending his application to include only a 70 ' frontage on 12th Ave. N. by 130 ' deep along 0 Street to be rezoned to R-3. His letter stated that his plan calls for the construction of one 4-unit apartment build- ing and he didn' t need the balance of the property rezoned. Chairman Cordell acknowledged receipt of two petitions in opposi- tion to th'e proposed rezone bearing a total of 242 signatures. Planning Director Ericksen stated that this rezone application is not in agreement with the Comprehensive Plan, which shows single- family residential use for this area. He noted further that the applicant was advised of this prior to his making application for the rezone. Mr. Stredicke noted that the area is a good single-family residential area with newly constructed and well-kept homes. Mr. Gerald Nichols of 1118 N Street spoke in opposition to the pro- posed rezone citing increase of traffic, loss of privacy which present home owners had anticipated would be theirs when they purchased their homes in what they had assumed would be maintained as a single-family residential area. Mr. Leroy Atwood of 1115 N Place N. spoke in opposition to the re- zone stating that the construction of apartment houses in single- family residential areas brings many problems of noise, traffic density, etc. , which he had purchased his home in the area to avoid. It was moved by Stredicke, seconded by Denzer, that the hearing be closed. Motion carried unanimously. Action: It was moved by Stone, seconded by Denzer, that the application for rezone be denied as it does not conform to the Comprehensive Plan, Menton Planning Commission Meeting March 1, 1967 Minutes ' Page 5 3. (e) Continued the area is primarily single-family residential, and granting of the rezone would be spot zoning. An- amendment was added to the motion, and seconded, that the Commission recommend to the City Council that the appropriate zoning classification of the property should be SR-1. Motion carried unanimously. The applicant was advised that he could appeal this decision to the ' City Council within ten days. At this point, 9 :45 P.M. , the Chairman announced a five-minute recess. The Commission reconvened at 9 : 50 P.M. (f) WELHELM SCHWARTZENBERGER, Appl. No, R-377-67 , rezone from G to R-4, property located on Shattuck Street between 6th and 7th Avenues. The Planning Director pointed out the location of the property on the zoning map and indicated that while the area is zoned G, there are non-conforming apartments and business uses in the area. He stated that directly to the east the property is zoned R-4 and to the north and south the zoning is L-1. It was felt by the Planning Department that the request for R-4 zoning was a logical one; that the property under discussion is presently the site of a non-conforming apartment building; that the applicant proposes to add an additional story on the structure. There being no comments from the audience, it was moved by Denzer, seconded by Stone, that the hearing be closed. Motion carried unanimously. Action: It was moved by Stredicke, seconded by Stone, that the rezone be granted as it complies with the Comprehensive Plano Motion carried unanimously. (g) LINDY ALIMENT, Appl, No, R-378-67 , rezone from R-1 and BP to L-1, property located at 414 Tobin Street between Logan and Shattuck Streets. The Planning Director pointed out the location of the property on the zoning map and indicated that a portion of the property is presently used for business parking and the other part is zoned R-1. The re- quest for rezone includes the entire lot to be rezoned to L-1, approxi- mately 18 ,375 square feet. Mr. Ericksen stated further that the Comprehensive Plan indicates light industrial use for this area. He said that in view of the existing industrial development in the area that the request for rezone appears to be a logical one. He felt that some detrimental effects might result from the rezone, but that they could be reduced substantially with proper site development and screening. The Chairman called for comments from the audience. Mrs. Margaret Laws of 406 Tobin Street spoke in opposition to the rezone. She stated that she and her husband had lived in the area for many years in a modest home, that all the neighbors were senior citizens living on social security and small pensions; that none of them drove and that they needed to be within walking distance of shopping and other facilities. Discussion followed regarding this and other churches in Renton, their development, parking facilities,. etc. Mr. Ericksen stated that the appli- cant, Seventh Day Adventist Church, does not have the required number of off-street parking spaces, but have submitted a letter from the Lutheran Church across the way granting them the right to use their parking facilities on their Saturday meeting days on a reciprocal basis for the Lutheran Sunday meetings. Mr. Ericksen stated further that the Seventh Day Adventist spokesman said that should the Lutheran Church decide to build on their parking lo`t' in the future, that the Seventh Day Adventist Church would provide the necessary parking in an alternate location. It was' decided that a field trip would be scheduled to view the property. REZONE APPLICATIONS (b) ISAAC CAPELOUTO, Appl. No. R-373-67, rezone from R-2 to R-3 , - property located at 1343 and 1345 K Street. The Commission recalled that they had rezoned an adjacent piece of property owned by the applicant from R-2 to R-3 with a restrictive covenant stating that no construction would commence prior to complete removal of an existing duplex. In his present application, Mr. Capelouto indicated informally that he would' be willing to sign a similar restrictive covenant. Mr. Stred- icke suggested that the Planning Department should contact Mr. Capelouto before the March 1 Public Hearing Meeting and advise him that he should submit a formal statement regarding his agreement to a restrictive covenant,. complete with legal description of the property involved. It was decided that a field trip would be scheduled to view the property. (c) WESLEY BUSCH, Appl. No. R-374-67 , rezone from R-2 to R-3 , property located on H Place between 12th Ave. N. and 13th Ave. N. Mr. Ericksen pointed out the location of the prop- erty on the zoning map and said the applicant indicated his desire to build an apartment house on the site if granted the rezone. Mr. Johnston has accepted a position en the King County Arts Commission where he hopes to be able to do more for Renton by representation, predicting that within a few years the Renton Commission will be a vital part of City Government and the County will be working hand in hand to coordinate the endeavors. PUBLIC HEARING: Ray H , Ball appeal of Planning Commission decision denying R-3 as zoning on property at 12th Avenue North between 0 St.-N Place. \ This being the date set, the hearing was declared open. Communication was read from Panning Director Ericl:cen reporting Planning Commission action which was based upon considerations that subject area is the site of two single family residential dwellings surrounded on the North, East, and West by single family residential development end requested R-3 zoning does not comply with Single- Family Residential zoning indicated on the Comprehensive Plan. The Commission opinion was that S_'-1 woaiu be the appropriate zoning classification for this property and R-3 was not a o oved. A Petition containingi 243 signatures was presented objecting to R-3 zoning of the property. Upon inquiry it was pointed out that the entire area originally included in the rezone -request was 19,200 ft. which had subsequently been revised to include 9,100 sq. ft. Audience amrnsnt was invited and Mr. Ball stated that his property had been purchased 25 years ago with the plan in mind that part of it would be used for futare retirement income and that he wished now to build a 4-plex on part of it 100 x 70' . IIe had cows at one time and had to get rid of them because dogs and children chased and scared them and now the neighbors don't want to be crowded by four units which he and his wife wish to build for retirement security. With R-3 only 3 doors away Mr. Ball felt he should be allowed the R-3 for his 4-plex or otherwise would feel he is being subjected to discrimination. Opposing the rezone, Mr. Gerald Nichols, 1118 "N" Street, stated neighboring homes had built in good faith that the area would be single family residences the other multiple dwellings having been built prior to there being a Comprehensive Plan, the projects coming in one after another and if allowed this time it would be like cancer since people would not want to build residences behind they would say there is an apartment there now co why not more. Apartments bring high density and the residents of the area now desire to maintain reslential use for single families only in that area. -1- Minutes - Renton City Council Meeting 4-3-67 HEARING: Ray H. Atwood, 1115 N Place North, pointing out that the Comprehensive Plan should be observed and the highlands area retained as isi a: residential area. He . cited his experience in a 62 unit ap:tment and problems of parking, noise, traffic restricted play area for children and overcrowding of schools and facilities. Mrs. Margaret Hansen, 3418, 10th Ct. No. remarked that the present spot zoning occurred because the residents weren't aware the construction was going on and that any future owner of this property would not feel he was restricted if this were allowed now. Also, others are waiting for this approval and will appeal their applications for specific zonings that have not been granted. Mr. Ralph Evans, 3309 - 10th Place North added that should this be rezoned no offer would be made on the balance of the property for single family use and as far as the residents are concerned such zoning would be a foot in the door. Schellert inquired as to whether Mr. Ball would be receptive to the SR-1 zoning proposed by the Planning Commission which is the best and highest use for the property and Mr. Ball said he cared not for SR-1 zoning. It was noted that the present apartments were built prior to adoption of the City's Comprehensive Plan and since there was no " further comment at this time, it was moved by Delaurenti, seconded by Poli,that::the hearing be closed. The, motion was carried and the hearing declared closed with further Council action invited. Moved by Delaurenti, seconded by Morris, in view of the Comprehensive Plan, that the decision of the Planning Commission denying the R-3 zoning of this property be upheld. Inquiry was made by Dale Olsen as to whether the SR-1 recommendation of the Planning Commission was implemented by this action and it was pointed out that this was not before the Council only appeal of the decision to deny R-3 and any other zoning would require application to be filed by the property owner. The motion carried. PRELIMINARY MEETING WITH PROPERTY OWNER: Wood-Eidson annexation - Property located East of 132nd Avenue S.E. and South of S.E. 120th Place. Mr. Ted Thorsen was present to represent the property owners and inquiry was made by Councilman Schellert whether owners were willing to accept proportionate share of the pre-existing bonded indebtedness of the City in event of annexation. Mr. Thorsen 'stated he had been authorized to reply in the affirmative to the inquiry. Mrs. Hansen inquired regarding existing trailers on the property for which King County had given a six months approval. Upon inquiry, City Engineer Wilson reported that the land under consideration for annexation is only the West 180 ft. of this 5 acre tract and does not include any portion where trailers are located. Moved by Schellert, seconded by Delaurenti, that petitioners be authorized to circulate a proper petition containing statement of willingness to assume their pro rata share of the pre-existing bonded indebtedness as stipulated and that the annexation pro- posal be favorably accepted. Carried. COMMUNICATIONS: Letter from James H. Hartwig, M. D. City of Renton Health Officer, reported regarding sewage problems in the Kennydale-Lake Washington lakefront area,at site of proposed sanitary sewer L.I.D., that tests made in the area from repirts submitted by City Engineer Wilson corroborated the need of establishing a sewer system to serve the area as soon as is feasible. On February 27th survey of houses on Mountain View Drive and on Ripley Lane revealed no evidence of a septic system at 9521 Mt. View Drive. At 9209 septic sewage had broken through to the surface and dye tests performed March 8th sub- stantiated this observation. At 9145 like septic drainage was corroborated by dye tests on the same date. A 9017 Lake Wn. Blvd. no indication of Septic Tank was revealed and it was suspected the effluent may possibly discharge directly into the lake. Trailer evidently discharges into the lake at this address also. At 8657 sewage broken through to surface of front yard and was lying on the surface at the North side of the house at 8463. On Ripley Lane very swampy ground conditions were noted at 7411, 7229, 7065 and 7023, with evidence of sewage on the ground at North side of the latter residence. This report was a follow-up on previous investigations of the area as requested, confirming existing conditions sanitarily of detriment. Moved by Pedersen, seconded by Poll:, to refer the communication to the Engineering Department.
