No. R-386-67; request for rezone from G to R-4; property located at 9418 - 108th Place S.E. Gentlemen and Mrs. Dahlquist: The rezone application in question was considered by the. Planning Commission at its April 26 , 1967 , Public Hearing Meeting. The property has the following characteristics: Total Area--app. 6. 5 acres Existing Zoning--G and GS=1 Access--108th Place S.E. Proposed Use--multi-family residential Comprehensive Plan--multi-family and single family residential The property in question is located off S.E. 94th Street and easterly of 108th Place S.E. , across from the Kennydale Elementary School. The property extends to the east and then northerly into the May Creek area. Approximately one-third of the property is hillside area and unusable for building purposes. The property is presently being used as the site of a single family residence. The property was recently annexed to the City of Renton. Prior to annexation, the front portion of the property fronting on 108th Place S.E. approximately 100 feet in depth was zoned for multi- family residential use (RM-900) by King County. The Planning Commission in its review of the property felt that a low density multiple zoning for the upper portion of the property was feasible; and in the discussion with the Commission the .appli- cant was asked if he would accept R-2 zoning, which would permit low density multi-family residential use. The applicant indicated, how- ever, that he desired R-4 zoning. Therefore, his application was denied by the Commission. The Commission based its denial of the rezone application on the following factors: 1. The extent. of the proposed high density development would exceed the practical limitations of the prop- erty. The construction of 300 units on the buildable area available would result in approximately 80--100 units per acre on the upper portion of, the property. Mayor Custer and City Council May 15 , 1967 Page 2 2 . The development of the property for multi-family use is considered: somewhat premature due to the lack of sewers to serve the: property. 3. The problem of access and the increased traffic result- ing from the proposed development would compound an already critical traffic situation on 108th Place S.E. and S.E. 94th' 'Street. 4. The inclusion of that portion of the property located in May Creek was not -considered .feasible. The Planning Commission, however, further recommended to the City Council that the property in question would be suitable for R-2 zoning at this time, but excluding the northeasterly 310 feet of the property which extends into the. Since Mr. Ernie Coleman, representing vacation petitioner„ arrived, it was moved by Pedersen, seconded by Poli, that the matter of the public hearing on the proposed vacation of alley per petition of George and Claudine Ames, be taken from the table. Carried. The hearing was declared continued and since the Clerk reported that no additional communications had been received, audience comment was invited. Mr. Ernie Coleman advised that Standard Service Tire Company was the party interested in the vacation since it anticipated expansion of facilities which would require the additional property which lies between their site and the one they plan to acquire. They cannot utilize the lot if it remains separated however and it was noted that this alley is used very little and the property contains a dilapidated run down facility and the im- provement as proposed would be an asset to the City. If the City insists that there be an alley in the proximity through to 2nd it was proposed that the alley be allowed to run on the Westerly side of Lot 5 which would provide the same as now exists, their feeling being however that it has nevEr served any purpose presently being covered over with brush and rose bushes and practically impassable. It was noted that the alley is to no avail without a turn around which might be a hammerhead type which could be pro- vided within a 40 ft. radius or the circular type which would require 60 ft. diameter. It was suggested this matterrhould be resolved and the alley moved at the time the building proposal was submitted to the Building Department. Mr. Coleman . added that if , when working with the City Engineer it was felt the City absolutely had to have such an alley, arrangements would be made for the relocation, a hammerhead being more desirable than backing out, if such provision is to be !-e^*1i_ed. The property cannot be utilized as it presently exists. Mr. Colin Radford, Realtor, speaking on behalf of the Ames Family and Estate, who originally opposed the vacation, advised that relocation of the alley to the Easterly boundary of their property wi11.'remove their objection and they will go along with the vacation. Upon legality inquiry regarding relocation of an alley, City Attorney Shellan advised that an alley can legally be vacated if there is a show that no one is denied access and the City policy requiring 100% ownership to sign is met. In this case there would be a vacation and rededication by a deed from the owner of lot 5, dedicating the westerly 16 ft. of lot 5. A public hearing would need to be held because this is re- locating of an alley and when the quit claim deed is executed the City would be free to vacate and relocate the alley. Moved by Pedersen, seconded by Gianini, that the hearing be closed. Carried. The heating was declared closed. Moved by Car eLt, •that r p^t tioner be advised if willing to dedicate the 16 ft. alley on the west side of Lot 5, the Council, upon receipt of dedication document would vacate the portion requested and relocate the alley, following proper public hearing. Moved by Poli, seconded by Delaurenti, to refer the payment to the Auditing and Accounting Committee. Carried. Application from 0. A. Maloney, owner of Pat's Tavern, 917 - 3rd Street, requested that American Shuffleboard Sales Corporation be granted required license to operate a coin device pool table. Moved by Poli, seconded by Schellert, to refer the application to the Police and License Committee with power to act. Carried. Letter from Gene . L. Coulon, Park Director, reported recommendation of the Park Board and himself that the low bid of Ricardi Construction Company in sum of $23,012.00 be accepted for construction of the Talbot Hill Park Shelter Building. Moved by Hulse, seconded by Schellert, to concur in the recommendations. Carried. Letter from J. D. Sweazey appealed ruling of the Planning Commission in denras. of application for rezone of property located at 9418 - 108th Place S.E. from G to R-4. Moved by Schellert, seconded by Hulse, that the date of May 15th be set for hearing on the matter. Carried. A letter from the Renton Historical Society, Frank Storey, Chairman, requested Council consideration in location of temporary quarters for a museum with Liberty Park Community Center and the present Council Chambers being suggested as future possibilities. Moved by Delaurenti, seconded. by Morris, to refer the request to the Park Board. Carried. -2- • Renton Planning Commission Meeting April 26, 1967 Minutes Page 3 Stredicke asked inasmuch as a change in the Comprehensive Plan to show P-1 areas as public or quasi-public uses would have to be made, could the Commission consider this rezone. The Planning Director stated that it was virtually impossible- to predict with any degree of accuracy where a church or private school might locate and that to designate P-1 zones on the Comprehensive Plan would not be feasible. Teegarden stated that as the applicant proposes to put a lodge hall on the second floor and commercial offices on the first floor which would be rented out, he felt that these offices would be commercial operations incompatible with the residential area and in conflict with the Compre- hensive Plan. He stated further that he did not think the Commission could act favorably on the rezone request. There being no further comments, it was moved by Stredicke, seconded by Sterling, that the hearing be closed. Motion carried with Racanello dissenting. ACTION : It was moved by Stredicke, seconded by Stone, that the rezone application of St. Andrews Lodge be denied as it is not in agreement with the Compre- hensive Plan. Motion carried with Racanello dissenting. Upon further discussion regarding recommending to the City Council the Commission' s opinion of the best possible zoning for the property, it was moved by Teegarden, seconded by Racanello, that the Commission forward to the City Council a recommendation of R-1 zoning on the subject property. Motion carried unanimously. The Chairman advised the applicant that he had the right of appeal of the decision of the Planning Commission by letter to the City Council within 10 days. (c) SWEAZEY-WERSTIl1K ENTERPRISES, APPL. NO. R-386-6.7; REZONE FROM G TO R-4; PROPERTY LOCATED AT 9418 - 108TH PL. S . E. The Chairman described the rezone application, and the Planning Director pointed out the location of the property on the zoning map. Prior to annexation of the property to the city of Renton, a strip of land front- ing on 108th P1. S.E. , 100 feet in depth, was zoned by the county for multi-family residential use. The Planning Director stated that the use of the property as shown on the Comprehensive Plan was subject to inter- pretation. It was felt that multi-family use is somewhat questionable at this time due to lack of sewers, but that the use might be feasible in the future. Slides of the property were shown. The applicant, Mr. J. D. Sweazey, spoke on behalf of the proposed rezone, stating that it was his hope to develop 300 multi-family residential apartments utilizing a natural green belt area. Mr. Racanello asked the applicant if he would accept R-2 zoning on the property which would permit low-density multiple construction, townhouses, etc. Mr. Sweazey replied that he would prefer R-4 zoning. There being no further comments , it was moved by Teegarden, seconded by Cordell, that, the hearing be closed. Motion carried with Stredicke dissenting. ACTION: It was moved by Stredicke, seconded by Sterling, that the rezone applica- tion of Sweazey-Werstiuk Enterprises for R-4 zoning be denied inasmuch as the applicant would not consider other zoning. Motion carried unanimous- ly. Some discussion then ensued concerning recommending to the City Council the proper zoning for the property in question. • Renton Planning Commission Mepting .April 26,_ .1967 Minutes Page 4 It was moved by- Racanello, seconded by Sterling, that the Planning Com- mission forward to the City Council -a recommendation that the property - is suitable for R-2 zoning at this time with the exception of the northeasterly 3-10 feet which should remain in the G classification. Motion carried unanimously. The Chairman advised the applicant that he had the right of appeal to . the City Council by written notice within ten days. Stredicke led some discussion regarding problems of building multiple units on small lots with particular reference to parking and traffic problems. Mrs. Ella Siegfried, in the audience, spoke on behalf of the rezone as being a logical development of the area and in agreement with the Comprehensive Plan. - There being no further comments, it was moved by Stredicke, seconded byRacanello, that the hearing be closed. Motion carried -unanimously. ACTION : It was moved by Stredicke, seconded by Cordell, that the application for rezone to R-4 by North. The Planning Director pointed out the location of the property on the zoning map and stated there were some problems to be resolved concerning the existing street and its extension to S. 92nd Avenue inasmuch as Edwards Street is under private ownership. Mr. Robert Edwards, the applicant, spoke on behalf of the rezone and indicated that he had tried to dedicate Edwards Street to the city of Renton some years ago, but as it was not developed tothe satisfaction of the city it was not accepted, as a city street. Mr. Stone stated that the staff comments regarding the questions of street right of way and access could be resolved before the granting of a building permit. It was moved by Stredicke, seconded by Racanello, that the hearing be closed. Motion carried; Teegarden abstaining. ACTION : It was moved by Stredicke, seconded by Brower, that the rezone applica- tion of Robert L. Edwards be approved as it agrees with the Comprehen- sive Plan.
