Since there were none, the hearing on Item Short Plat 124-78, W-125-78 and E-126-78 was closed by the Examiner at 9:50 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a two-lot short plat, waiver of off-site improvements, and exception from the Subdivision Ordinance to permit a pipestem lot. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible official, determined the proposal to be exempt from the SEPA.threshold determination and, EIS requirements. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setbacks, lot area, lot coverage and lot dimensions of Section 4-729 (G) and 4-706 (R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The proposed pipestem conforms to the requirements of Section 9-1108.23.F. (d) . 9. Certification per Section 9-1106.3.H. has not been completed, but can be submitted prior to or during submittal or recording of the final approved short plat map. The Planning and Public Works Departments per Section 9-1105.7 will give final review and approval to the final short plat map. 10. Restrictive covenants were not submitted (Section 9-1106.3.1.) . 11. Improvements have not been deferred by the Board of Public Works per Section 9-1105.6.A. A waiver of off-site improvements were sought per Section 9-1105.6.B. None of the required off-site improvements have been made. Off-site improvements are lacking within Aberdeen Avenue N.E. adjacent to the site and in the block. A septic tank permit (Exhibit #4) has been approved by King" County Department of Public Health. Restrictive Covenants (Exhibit #5) were submitted agreeing to participation in an LID for installation of these improvements. 12. A 12-foot private access easement exists along the southerly boundary of the site to which apparently the applicant does not have rights of useage. 13. The two proposed lots exceed the minimum lot size required (7200 square feet) in the G-7200 zone. Lot 1 contains 20,164 square feet and Lot 2 contains 17,200 square feet. 14. The proposal was found by the Public Works Department to be exempt from the Drainage Ordinance No. 3174. CONCLUSIONS: 1. The proposed short plat conforms to the Comprehensive Plan Goals and Objectives and the Land Use Map. Short Plat 124-78 Page Three W-125-78, E-126-78 2. The proposal exceeds the requirements of the underlying zoning. An existing outside storage shed may require movement to meet setback requirements. 3. Since off-site improvements other than paving do not exist in this block of Aberdeen Avenue N.E. it seems reasonable to permit the installation of these improvements to be delayed until an LID is formed for this portion of the street (Section 9-1105.6.B) . Restrictive covenants have been duly executed and submitted (Exhibit #5) attesting agreement to participating in such an LID. Installation of these improvements would not apparently impact the applicant's "reasonable use or development" of his property (Section 9-1109.1.A.) . All of the other properties in the vicinity have not installed these improvements (Section 9-1109.1.B.) . The public health, safety and welfare or other properties will not be adversely affected by not installing these improvements (Section 9-1109.1.C.) . 4. The staff recommendation for a 25-foot wide pipestem was based primarily upon potential access requirements within this block. This same concern or recommendation was not addressed by the Traffic Engineering Division. Without their analysis and recommendation of the circulation needs and possible alternative patterns for the block being entered into the record, it seems somewhat premature to require this particular applicant to dedicate 25 feet of the necessary 50-foot right-of-way for a possible.street. It appears more appropriate that the circulation needs of. the block should be studied for selection of alternatives that may be applied in future land use decisions. 5. Although sufficient property exists along the northerly portion of the property to dedicate a half-street, a,pipestem configuration appears reasonable at this time and would give the applicant"reasonable use" and development of his property (Section 9-1109.1.A.) . The applicant's rights and privileges would not be affected (Section 9-1109.1.B.) . Injury would not occur to the public health, safety and welfare or other properties (Section 9-1109.1.C.) . DECISION: Based upon the record, testimony, -findings and conclusions, it is the decision of the Examiner to approve the short plat as submitted, the waiver of off-site improvements pending formation of an LID per restrictive covenants (Exhibit #5) and the exception to allow a pipestem lot subject to meeting all other applicable requirements of Chapter 11 and Section 4-729 and 4-706. The proposed pipestem is generally consistent with similar surrounding types of development and access conditions : ( 9-1109. 1 B& C) . However, the matter of potential future access to the interior of the block should be studied fully. Upon reviewing such future access possibilities it is not entirely unlikely that a future access street might be located along the subject pipestem to eventually provide proper access to the subject property and the presently . undeveloped property to the west. Therefore , it may be necessary to require that the pipestem be made 25 feet An width for the proper half street width , with the understanding that a future street might be provided in this location and the subject property contribute its fair share to such improvement. Twenty-five (25 ) feet north of the subject site would be provided by /the adjacent property owner to create a standard fifty (50) foot street. Adjacent , residences appear to be too close to the southerly boundary of the boundary of the subject site to provide a potential future fifty (50) foot road along the south property line. 7 . There is not sufficient lot width given the existing residence to provide a full standard (50 foot) street to the back lot (parcel I ) . (9-1109. 1 . A. ) Sufficient planning and dgvelop- ment have not progressed in the area to a point where we can absolutely define the locations for access streets into and through the subject block bounded by Aberdeen Avenue N . E . , Jones Avenue N . E . , N. E . 20th Street and N. E. 24th Street. The subject site is more than 1 , 000 feet from an existing sanitary sewer line. Section 9-1108. 14. E provides that in such cases a septic tank and disposal field may be utilized upon approval of the King County Health Department and the City of Renton . This section also requires that dry sanitary sewer lines shall be installed in the subdivision according to Public Works Department design approval . 8. An application for individual sewage disposal systems ( septic tank) was approved by King County Health Department on January 17 , 1978 subject to final approval of the proposed subdivision by the City. 9. Off-site improvements (curb, gutter, and sidewalks ) do not exist in the general vicinity of the subject site along , Aberdeen Avenue N . E . Provision of a 148 foot segment of these improvements along a street presently absent of such improvements may be premature. However, a full waiver should not be granted at this time . The applicant has proposed to file restrictive covenants agreeing to participate in an LID or other City initiated action for such improvements . This has been an acceptable means whereby the improvements can be waived for an unknown period of time for proper design and coordination of the street improvements . 10. The proposal is exempt from the requirement of the drainage ordinance for drainage plan submittal . However, drainage plans must be approved by the Public Works Department as part of on-site construction . . The proposed pipestem is 135 feet in length and 20 feet, in width , which conforms to minimum city standards . A minimum ten ( 10) feet of paving is required by ordinance (9-1108.. 23F(3 )d . ) along the entire length of the pipestem ( 135 feet) ; the remaining area that is not paved is to be landscaped . 6. The proposed pipestem is generally consistent with similar surrounding types of development and access conditions (9-1109. 1 B& C) . However, the matter of potential future access to the interior of the block should be studied fully. Upon reviewing such future access possibilities it is not entirely unlikely that a future access street might be , located along the subject pipestem to eventually provide proper access to the subject property and the presently undeveloped property to the west . Therefore , it may be necessary to require that the pipestem be made 25 feet ,in width for the proper half street width , with the understanding that a future street might be provided in this location and the subject property contribute its fair share to such improvement. Twenty-five (25 ) feet north of the subject site would be provided by the adjacent property owner to create a standard fifty (50) foot street. Adjacent residences appear to be too close to the southerly boundary of the boundary of the subject site to provide a potential future fifty (50) foot road along the south property line. 7 . There is not sufficient lot width given the existing residence to provide a full standard (50 foot) street to the back lot (parcel I ) . ( 9-1109. 1 . A. ) Sufficient planning and dvelop- ment have not progressed in the area to a point where we can • absolutely define the locations for access streets into and through the subject block bounded by Aberdeen Avenue N . E . , Jones Avenue N . E . , N. E . 20th Street and N . E. 24th Street. The subject site is more than 1 , 000 feet from an existing sanitary sewer line. Section 9-1108. 14. E provides that in such cases a septic tank and disposal field may be utilized upon approval of the King County Health Department and the City of Renton . This section also requires that dry sanitary sewer lines shall be installed in the subdivision according to Public Works Department design approval . 8. An application for individual sewage disposal systems (septic tank) was approved by King County Health Department on January 17 , 1978 subject to final approval of the proposed subdivision by the City. 9. Off-site improvements (curb, gutter, and sidewalks ) do not exist in the general vicinity of the subject site along Aberdeen, Avenue N . E . Provision of a 148 ' foot segment of these improvements along a street presently absent of such improvements may be premature. However, a full waiver should not be granted at this time. The applicant has proposed to file restrictive covenants agreeing to participate in an LID or other City initiated action for such improvements . This has been an acceptable means whereby the improvements can be waived for an unknown period of time for proper design and coordination of the street improvements . 10. The proposal is exempt from the requirement of the drainage ordinance for drainage plan submittal . The two (2 ) proposed lots consist of approx- imately 20 , 164 square. feet for parcel 1 .and. 17 ,200 square.. feet for parcel 2 . 3 . An existing single family residence is located on proposed parcel 2 . According to the map prepared by the applicant ' s engineer , the existing house meets all zoning ordinance set- back requirements with the short plat as proposed . 4. The proposed pipestem is 135 feet in length and 20 feet in width , which conforms to minimum city standards . A minimum ten ( 10) feet of paving is required by ordinance (9-1108. 23F(3 )d . ) along the entire length of the pipestem ( 135 feet) ; the remaining area that is not paved is to be landscaped . 6. The proposed pipestem is generally consistent with similar surrounding types of development and access conditions (9-1109. 1 B& C) . However, the matter of potential future access to the interior of the block should be studied fully. Upon reviewing such future access possibilities it is not entirely unlikely that a future access street might be ; located along the subject pipestem to eventually provide proper access to the subject property and the presently undeveloped property to the west. Therefore , it may be necessary to require that the pipestem be made 25 feet in width for the proper half street width , with the understanding that a future street might be provided in this location and the subject property contribute its fair share to such . improvement. Twenty-five (25) feet north of the subject site would be provided by the adjacent property owner to create a standard fifty (50) foot street. Adjacent residences appear to be too close to the southerly boundary of the boundary of the subject site to provide a potential future fifty (50) foot road along the south property line. 7 . There is not sufficient lot width given the existing residence to provide a full standard (50 foot ) street to the back lot (parcel I ) . ( 9-1109. 1 . A. ) Sufficient planning and dvelop- ment have not progressed in the area to a point where we can absolutely define the locations for access streets into and through the subject block bounded by Aberdeen Avenue N . E . , Jones Avenue N . E . , N. E . 20th Street and N. E. 24th Street. The subject site is more than 1 , 000 feet from an existing sanitary sewer line. Section 9-1108 . 14. E provides that in. such cases a septic tank and disposal field may be utilized upon approval of the King County Health Department and the City of Renton . This section also requires that dry sanitary sewer lines shall be installed in the subdivision according to Public Works Department design approval . • 8. An application for individual sewage disposal systems (septic tank) was approved by King County Health Department on January 17 , 1978 subject to final approval of the proposed subdivision by the City. 9. Off-site improvements (curb, gutter , and sidewalks ) do not exist in the general vicinity of the subject site along Aberdeen. Avenue N . E . Provision of a 148 foot segment of these improvements along a street presently absent of _ such improvements may be premature. However, a full waiver should not be granted at this time. The applicant has proposed to file restrictive covenants agreeing to participate in an LID or other City initiated action for such improvements . This has been an acceptable means whereby the improvements can be waived for an unknown period of time for proper design and coordination of the street improvements . 10. The proposal is exempt from the requirement of the drainage ordinance for drainage plan submittal . However, drainage . plans must be approved by the Public Works Department as part of on-site construction . . Provision of a minimum twenty five (25) foot wide pipestem with the understanding that a future street to provide permanent access to the subject site and surrounding area may be constructed , and the owner (s ) fronting the subject street will be required to dedicate the twenty-five (25) feet and contribute this fair share to its development. 2. • The pipestem shall be paved a minimum ten ( 10) feet per ordinance requirement and Public Works Department approval . The remaining area shall be landscaped subject to Planning Department approval . 3. Public Works and King County Health Department approval of an individual sewage disposal system and the design and installation of a dry sanitary sewer line per ordinance requirement. It is further recommended that the waiver request of the curbs , gutters , sidewalks , and street be' denied , and an indefinite deferral per established City Council policy be granted subject to the filing of restrictive covenents whereby the owner( s ) agree to participate in any L .
