APPLICANT: Paul and Anne Smith FILE NO. Short Plat 130-78 W-131-78 LOCATION: On the southeast corner of Jones Avenue N.E. and N.E. 20th Street. SUMMARY OF REQUEST: Applicant requests approval of a proposed four (4) lot short • plat with a.waiver of the off-site improvement requirements. SUMMARY OF ACTION: Planning Department Recommendation: Approval of short plat ' request with conditions; , denial of waiver in lieu of deferral of off-site improvements. Hearing Examiner Decision: Approval of short plat request with conditions; approval of waiver subject to filing of restrictive covenants. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on February 16, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and. . field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on February 21, 1978 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. • Parties wishing to testify were sworn. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, • and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: • Exhibit #2: King County Assessor's Map • Exhibit #3: Short Plat Map Exhibit #4: Letter to Planning Department from Paul and Anne Smith, dated January 27, 1978, regarding request for waiver. . Exhibit #5: Restrictive Covenants Mr. Smith noted that paragraph 2, Section P: Planning Department Recommendation, of .Exhibit #1 should be revised to include recommendation for denial of the waiver request in lieu of granting an indefinite deferral per the restrictive covenants signed by the applicant in conformance to previously established Council policy. • The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Paul Smith 1916 Jones Avenue N.E. Renton, WA 98055 . Mr. Smith indicated his concurrence in the report and briefly reviewed the justification for a request for waiver of 'off-site improvements. He stated that sidewalks, curbs and underground wiring do not currently exist in the area although sewers are available along Jones Avenue N.E. and proposed along N.E. 20th Street in conjunction with a proposed plat west of the subject site. He noted that approval of the plat would create an improvement in the area and felt that granting the waiver would not jeopardize property rights and privileges enjoyed by other properties in the area or be detrimental to the public welfare. Short Plat 130-78 Page Two W-131-78 The Examiner asked for further testimony in support of the application. Responding was: Joepete McCaslin 17637 S.E. 23rd Place Renton, WA 98055 Mr. McCaslin reported being the building contractor for a proposed residence on Lot D. He indicated that discussion had occurred with the developer of the proposed plat west of the subject site regarding sewer connections for Lots B and C. He encouraged approval of the request which he felt would be a compatible addition to the area. The Examiner asked for further testimony in favor or opposition to the application. There was no response. Mr. Michael Smith clarified a statement made by Mr. McCaslin regarding installation of sewer service and reported that such installation must be accomplished prior to filing the final plat. He suggested that either the Public Works Department or the Board of Public Works be contacted if a deferral request was necessary for the project. In response to the Examiner's inquiry regarding further subdivision of the property, Mr. Smith indicated that Lot D could be divided through a request for exception to the Subdivision Ordinance for a pipestem lot, Lot A could be divided if the location of an existing garage was shifted, but minimum width requirements would preclude further subdivision of Lots B and C. The Examiner asked for further comments. Since there were none, the hearing on Item #Short Plat 130-78 and W-131-78 was closed by the Examiner at 9:35 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a four-lot short plat and waiver of off-site improvements. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, (is uncontested) , and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C, , Gordon Y. Ericksen, responsible official, determined the proposal to be exempt from threshold determination and EIS requirements of SEPA. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and no adverse comment was expressed. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setback, lot dimension and lot area requirements of Sections 4-729 (G) and 4-706 (R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. Certification per Section 9-1106.3.H will be accomplished during or at final approval of the short plat by the Planning and Public Works Departments per Section 9-1105.7 or during filing of the final short plat per Section 9-1105.8. 9. Restrictive Covenants (Exhibit #5) were submitted agreeing to participation in a Local Improvement District for construction of the required off-site improvements per Section 9-1105.6. The required off-site improvements, except for paving, do not exist in the immediate vicinity or adjacent to the property. The Board of Public Works has not granted a deferral per Section 9-1105.6.A. 10. The final short plat map remains to be drawn and submitted to the Planning Department for approval per Section 9-1105.7. 11. The existing residence and accessory structures on Lot A conform to the setback requirements of Sections 4-729 (G) and 4-706 (R-1) . :�• , Short Plat 130-78 Page Three W-131-78 CONCLUSIONS: • • 1. The proposal conforms to the Goals and Policies of the Comprehensive Plan and the Land Use Map. 2. The proposal conforms to applicable zoning regulations and, with the exception of off-site improvements, the Subdivision Ordinance requirements. 3. The proposal conforms to the existing general development pattern of the immediate area.. • 4. Testimony was not given that requiring construction of the improvements within the normal time period would ". . .,deprive the applicant of the reasonable use or development of his. land," (Section 9-1109.1.A.) . Nor'was testimony given that such a requirement would create "undue hardship" for the applicant (Section 9-1109.1) . • In Exhibit #4, the applicant asserted that the ". . .property rights and privileges. . . "' enjoyed by other properties in the vicinity would not be jeopardized by approval of a waiver (Section 9-1109•.1.B) . That the required off-site improvements do not exist within a reasonable distance from the property (Section 9-1105.6.B) was also asserted, and it was claimed that the public welfare or other properties would not be injured (Section 9-1109.1.C) . A waiver would not produce injury to other properties or the public welfare (Section 9-1109.1.C) since the existing adequate conditions would continue. Any hardship (Section 9-1109.1) created for the.applicant by requiring the improvements would be the normal costs incurred during development of land. However, construction of all of the improvements on both sides of both streets at one time through an _ LID would appear to be a reasonable alternative. Otherwise, the applicant would be required to construct half-width streets on both streets, which alternative seems less preferable. The property appears to lack ". . .special physical circumstances or conditions. . ." which ". . .would deprive the applicant of the reasonable use or development of his land." (Section 9-1109.1.A) Off-site improvements can be easily constructed within the public right-of-way due to the absence of physical hazards or unusual conditions. A,few other. properties in the area appear to have been short-platted without installing the improvements. In keeping with this trend would be the granting of the waiver (Section 9-1109.1.B) . However, the property rights of the applicant would continue with or without the waiver since the rights to zoning density and development would remain unaffected. . Therefore, it seems 'reasonable to approve the waiver subject to the restrictive covenants (Exhibit #5) which attest agreement to participating in an LID. At any time the city should be able to form the appropriate LID since at least 50% concurrence would exist adjacent to the applicant's property. But it seems more reasonable to await the concurrence of other properties along the two streets before forming the LID. The timing of the LID rests with the Public Works Department. • DECISION: Based upon the record, testimony, findings and conclusions, the requested short plat (Exhibit #3) is approved subject to filing a final short plat per Section 9-1105.3. , 9-1105.7 and 9-1105.8. Furthermore, the requested waiver of Off-site improvements is approved subject to the submitted restrictive covenants (Exhibit #5) being filed with King County. Lot A = 17 ,220 ± square feet ; Lot B = 8900 ± square feet ; Lot C = 8900 ± square feet ; and Lot C = 20,480 ± square feet . 4. The proposed lots also exceed the minimum dimensional requirements ( lot width and depth) of the zoning and subdivision ordinances . 5 . An existing residence and garage are located on lot A, and conform to the setback requirements of the zoning ordinance . 6 . Sewer is available along Jones Avenue N . Off-site improvements have not been installed along either Jones Avenue N . E . or N . E . 20th Street in the vicinity of the subject site . However , the area along Jones Avenue N . E . ' north of N . E . 24th Street is presently part of an LID process for such improvements due to previous indefinite deferrals and covenants on a large numbe of lots in that area . The applicant has signed the standard covena format agreeing to participate in any future L . I . D . or city initiat action for such improvements . This is an acceptable alternative to granting a full waiver of the requirements . The subject short plat is consistent with the Comprehensive Plan Land Use element which designates the site and general area as single family residential . 2 . The subject short plat is compatible with existing zoning and land uses in the area . 3 . The proposed lots exceed the minimum lot size for the zone in which the site is located (G-7200) . Lot A = 17 , 220 ± square feet ; Lot B = 8900 ± square feet ; Lot C = 8900 ± square feet ; and Lot C = 20,480 ± square feet . 4 . The proposed lots also exceed the minimum dimensional requirements ( lot width and depth ) of the zoning and subdivision ordinances . 5 . An existing residence and garage are located on lot A , and conform to the setback requirements of the zoning ordinance . 6. Sewer is available along Jones Avenue, N . E . and a new sewer line is proposed along N . E . 20th street to Jones Avenue N . E . in conjunction with a proposed plat west of the subject site . Given the lower elevation of lots B and C , it may be necessary to connect to the proposed sewer line in N . E . 20th Street . It may also be possible to locate any houses on lots B and C farther south and thus at a higher elevation to achieve a connection to the Jones Avenue N . E . sewer main . . 7 . Off-site improvements have not been installed along either Jones Avenue N . E . or N . E . 20th Street in the vicinity of the subject site . However , the area_ along Jones Avenue N . E . north of N . E . 24th Street is presently part of an LID process for such improvements due to previous indefinite deferrals and covenants on a large numbe of lots in that area . The applicant has signed the standard covena format agreeing to participate in any future L . I . D . or city initiat action for such improvements . This is an acceptable alternative to granting a full waiver of the requirements . PUBLIC HEARING: After reviewing the Planning Department report; examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as • follows: The hearing was opened on February 21; 1978 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were sworn. It was reported that the Hearing Examiner and.the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department,' reviewed Exhibit #1, and entered the following additional exhibits into the record: • Exhibit #2: King County Assessor's Map . Exhibit #3: Short Plat Map • Exhibit #4: Letter ,to Planning Department from Paul and Anne Smith, dated January 27, 1978, regarding -request for waiver. Exhibit #5: Restrictive Covenants Mr. Smith noted that paragraph 2, Section' P: Planning Department. Recommendation, of Exhibit #1 should be revised to include recommendation for denial of the waiver request in lieu of granting an indefinite deferral per the restrictive covenants signed by the applicant in conformance to previously established Council policy. The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Paul Smith 1916 Jones Avenue N.E. • Renton, WA 98055 • Mr. Smith indicated his concurrence in the report and briefly reviewed the justification • for a request for waiver of off-site improvements. He stated that sidewalks, curbs and underground wiring do not currently exist in the area although sewers are available along Jones Avenue N.E. arid proposed along N.E. 20th Street in conjunction with a proposed plat west of the subject site. He noted. that approval of the plat would create an improvement in the area and felt that granting the waiver would not jeopardize property rights and privileges enjoyed by other properties in the area or be detrimental to the public welfare. kw 'Ilk Short Plat 130-78 Page Two W-131-78 The Examiner asked for further testimony in support of the application. Responding was: Joepete McCaslin 17637 S.E. 23rd Place Renton, WA 98055 Mr. McCaslin reported being the building contractor for a proposed residence on Lot D. He indicated that discussion had occurred with the developer of the proposed plat west of the subject site regarding sewer connections for Lots B and C. He encouraged approval of the request which he felt would be a compatible addition to the area. The Examiner asked for further testimony in favor or opposition to the application. There was no response. Mr. Michael Smith clarified a statement made by Mr. McCaslin regarding installation of sewer service and reported that such installation must be accomplished prior to filing the final plat. He suggested that either the Public Works Department or the Board of Public Works be contacted if a deferral request was necessary for the project. In response to the Examiner's inquiry regarding further subdivision of the property, Mr. Smith indicated that Lot D could be divided through a request for exception to the Subdivision, Ordinance for a pipestem lot, Lot A could be divided if' the location of an existing garage was shifted, but minimum width requirements would preclude further subdivision of Lots B and C. The Examiner asked for further comments. Since there were none, the hearing on Item #Short Plat 130-78 and W-131-78 was closed by the Examiner at 9:35 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a four-lot short plat and waiver of off-site improvements. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, (is uncontested) , and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible official, determined the proposal to be exempt from threshold determination and EIS requirements of SEPA. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and no adverse comment was expressed. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setback, lot dimension and lot area requirements of Sections 4-729 (G) and 4-706 (R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. Certification per Section 9-1106.3.H will be accomplished during or at final approval of the short plat by the Planning and Public Works Departments per Section 9-1105.7 or during filing of the final short plat. per Section 9-1105.8. 9. Restrictive Covenants (Exhibit #5) were submitted.agreeing to participation in a Local Improvement District for construction of the required off-site improvements per Section 9-1105.6. The required off-site improvements, except for paving, do not exist in the immediate vicinity or adjacent to the property. The Board of Public Works has not granted a deferral per Section 9-1105.6.A. 10. The final short plat map remains to be drawn and submitted to the Planning Department for approval per Section 9-1105.7. 11, The existing residence and accessory structures on Lot A conform to the setback requirements of Sections 4-729 (G) and 4-706 (R-1) . - . Short Plat 130-78 Page Three • W-131-78 CONCLUSIONS: 1. The proposal conforms to the Goals and Policies of the Comprehensive Plan and the Land Use Map. 2. The proposal conforms to applicable zoning regulations and; with the exception of off-site improvements, the Subdivision Ordinance requirements. 3. The proposal conforms to the existing general development pattern of the immediate area. 4. Testimony was not given that requiring construction of the improvements within the normal time period would ". . .deprive the applicant of the reasonable use or development of his land," (Section ,9-1109.1.A.) . Nor was testimony given that such a requirement would create "undue hardship" for the applicant (Section 9-1109.1) . In Exhibit #4, the applicant asserted that the ". . .property rights and privileges. . . " enjoyed by other properties in the vicinity would not be jeopardized by approval of a waiver ,(Section 9-1109.1.B) . That the required off-site improvements do not exist within a. reasonable distance from the property (Section 9-1105.6.B) was also asserted, and it was claimed that the' public welfare or other properties would not be injured (Section 9-1109.1.C) . • A waiver would not produce injury to other properties or the public welfare (Section 9-1109.1.C) since the existing adequate conditions would continue. Any hardship (Section 9-1109.1) created for the applicant by requiring the improvements would be the normal costs :incurred during development of land. However, construction of all of the improvements on both sides of both streets at one time through an LID would appear to be a reasonable alternative. Otherwise, the applicant would be required to construct half-width streets on both streets, which alternative seems less preferable. The property appears to lack ". . .'special physical circumstances or conditions. . ." which. ". . .would deprive the applicant of the reasonable use or development of his land. " (Section 9-1109.1:A) Off-site improvements can be easily constructed within the public right-of-way due to the absence of physical hazards or unusual conditions. A few other properties in the area appear to .have been short-platted without installing the improvements. In keeping with this trend would be the granting of the waiver (Section 9-1109.1.B).. However, the property rights of the applicant would continue with or without• the waiver since the rights to zoning density and development would remain unaffected. • Therefore, it seems reasonable. to approve the waiver subject to the restrictive covenants (Exhibit #5) which attest agreement to participating in an LID. At any time the city should be able to form the appropriate LID since at least 50% concurrence would exist adjacent to the applicant's property. But it seems more reasonable to await the concurrence of other properties along the two streets before forming the LID. The timing of the LID rests with the Public Works Department. DECISION: . Based upon the record, testimony, findings and conclusions, the requested short plat (Exhibit #3) is approved subject to filing a final short plat per Section 9-1105.3. , 9-1105.7 and 9-1105.8.
