Short Plat 193-78 Emmy Lindberg • W-194-78 E-195-78 LOCATION: Vicinity of 3607 Meadow Avenue North SUMMARY OF REQUEST: The applicant requests approval of a proposed two-lot short plat •with approval of an. exception to allow a pipestem exceeding the maximum 150 feet and serving two lots, together with a waiver of the required off-site improvements. • SUMMARY OF ACTION: Planning Department Recommendation: Approval of short plat and exception; denial of waiver. Hearing Examiner Decision: Approval with restrictive covenants. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: . Examiner on July 19, 1978. • PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 25, 1978 at 9:10 a.m. in the Council Chambers of the ' Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported, that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael• Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Short Plat Map • Exhibit #3: Letter to Planning Department from the applicants, dated June 22, 1978, regarding request for exception. Exhibit #4: Letter to Planning Department from the applicants, • dated June 22, 1978, regarding request for' waiver. • Exhibit #5: Restrictive Covenants regarding installation of off-site improvements. • Mr. Smith noted a discrepancy on Exhibit #2, short plat map, which designates a 20-foot pipestem width; and indicated that the previous short plat contained a designated width. ' 'of 27 feet. He stated that a requirement may exist to revise the Planning Department recommendation to include the stipulation either enforced by covenants or agreement that no further subdivision of Lot B in Tract 97 would occur in the future because the situation of adjacent properties precluded the provision of a full street in accordance with ordinance requirements, and also to control density in development. Mr. Smith referenced Section P.1. • of Exhibit #1 and indicated that documentation of the legally established easement would be required, and added that Fire Department approval would be required in addition to Public Works Department approval of the provision of a minimum• 16-foot paved driveway within the 20-foot easement from Meadow Avenue N. to Lot A. He also noted a revision to Section P.4, changing requirement for provision of a joint easement for 20-fOot access to provision of 27-foot access if possible, which would better conform to ordinance requirements for access to the two-lot configuration. The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: • Short Plat 193-78 Page Two • W-194-78 E-195-78 Kurt Agren 8330 Bayshore Drive Clinton, WA 98236 • • • Mr. Agren indicated the applicants' concurrence in the report. He clarified that the designation for a 20-foot pipestem on the short plat resulted from previous approval in 1973 for a 27-foot pipestem although the ordinance requirements allowed a 20-foot pipestem. Therefore, seven feet of the pipestem had subsequently been dedicated to the existing lot abutting Meadow Avenue N. providing the existing configuration for 20-foot pipestem. Mr. Agren advised that sewer assessments are paid, the stub is located in the easement, and Lot A is served by sewer lines. connected to Park Avenue N. The Examiner requested clarification of the width of the pipestem road. Mr. Agren indicated that although the seven-foot strip had been dedicated to the' adjacent lot and was included in tax statements for that lot, the possibility existed to reapportion the strip to the pipestem • to create a width of 27 feet. • • • The Examiner requested testimony in support or opposition to the request. There was no response. Mr. Smith clarified that the lot abutting Meadow Avenue N. remains as an 80- foot wide parcel and the pipestem contains a 27-foot width. The Examiner inquired if documentation exists to verify the dedication of the seven-foot strip. Mr. Agren indicated that documentation did not exist and the dedication was accomplished through an attorney and not through city processes. Responding to Fire Department comments regarding requirements for a turnaround area, Mr. Agren noted that Lot B contains a 200-foot length and suggested that the turning radius could be provided on the west end of that lot. Mr. Smith advised the necessity to include the lot, abutting Meadow Avenue N. with the short plat request if a revision to the configuration width of the pipestem to 20 feet occurred. He also concurred with the applicant's statement that sufficient lot size exists to provide a turnaround on Lot B to meet requirements of the Fire Department. The. Examiner clarified that the width of the pipestem for consideration in the request was 27 feet. Mr. Smith confirmed the Examiner's statement. The Examiner inquired if the five-year period had expired from the last subdivision of the property in accordance with the State Subdivision Act requirements. Mr. Smith responded affirmatively. • The 'Examiner requested further comments. Since there were none, the hearing on File No. Short Plat 193-78, W-194-78 and E-195-78 was closed by the Examiner at 9:45 a.m. FINDINGS, CONCLUSIONS & .RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a two-lot short plat, exceptions to allow a 350-foot pipestem and .less than 50-foot wide access to the two lots, and a waiver of off-site improvements. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible official, determined that the proposal is exempt from the threshold determination and EIS requirements of SEPA. • 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. • 5. There was no opposition to the proposal expressed. • 6. All existing utilities are available and in close proximity. 7. ' The proposal is compatible with the required setbacks, lot area, and lot dimension requirements of Section 4-706 (R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances. • 8. The proposed pipestem is 20 feet in width. The applicant testified that an additional seven feet was included in the pipestem per the previous subdivision of the property . in 1973. Since that subdivision, this seven feet has.been deeded to the abutting property without approval of the City of Renton through the subdivision process. . it was also stated by the applicant that the seven feet could be recovered. Staff stated that a pipestem width of 27 feet eras preferable to 20 feet. 410 Short Plat 193-78 Page Three W-194-78 E-195-78 • 9. Section 9-1108.23.F. (2) requires that all lots in a subdivision front on a dedicated public street. The application is for two lots to access to Meadow Avenue N. via a single pipestem. 10. The file contains affidavits attesting that the applicants are owners of the property (Section 9-1106.3.H. (1) ) . 11. Certification was not provided that a licensed land surveyor had completed a survey `of the property. and set monuments per Section 9-1106.3.H. (3) ) . 12. Certification by the King County Health and Finance Divisions and the City of Renton Finance• Department will occur just prior to, at or during filing of the plat (Section 9-1106.3.H. (4) , (7) and (8) ) . • 13. A title insurance policy was not submitted (Section 9-1108.6. 3.H. (6) ) . • 14. Restrictive covenants (Exhibit #5) were ,submitted (Section 9-1105. 3.B) agreeing to participate in an L.I:D. for off-site improvements in Meadow Avenue N. 15. Off-site improvements of curb, gutters and sidewalks are not located in the adjacent • area of Meadow Avenue N. (Section 9-1105.6.B) . 16. Proposed Lots A and B contain sufficient area to be subdivided again after five years from approval of the subject application. Access to these lots and potential other lots would apparently be limited by existing abutting development to the proposed pipestem, assuming development of the property abutting the south of the site is developed as a traditional single family subdivision with each lot facing and accessing to N. 36th Street: 17. Alternative access to the proposal appears to preclude creation of a public street (50-foot right-of-way) along or abutting the property, except if such dedication were purchased from or granted by the owner of the abutting southerly property. • 18. The.normal 10-foot improvement within a pipestem area for access is not satisfactory to staff since two, instead of the normal one, lots will use the pipestem for access. A 16-foot pavement access was recommended. 19. The applicant stated that a turnaround as requested by •the Fire Department could be provided on Lot B. CONCLUSIONS: 1. The proposed density conforms to the Comprehensive Plan and existing zoning. 2. A pipestem lot configuration is intended to serve only one lot. Otherwise, the pipestem becomes .an access-way for more than one lot, thereby circumventing the requirement of Section .9-1108.23.F. (2) for access via a public street. Therefore, the pipestem area should not be considered as a pipestem but as an easement for access for Lots A and B. The exception then becomes of deviation from Section 9-1108.23.F. (2) and Section 9-1108.7.H. which requires that the public street right- of-way be 50 feet. The pipestem can be widened to 27 feet, which is appropriate in order to lessen the degree of the exception by approaching as much as possible the required 50-foot right-of-way. As a result, slightly more than a half-street could be created, although private streets are not provided for in the Subdivision Ordinance. Staff is not recommending a public street in this case since N. 36th Street is within approximately 100 feet of the location of the access-way. This is unlike the situation further north in the E. Coleman Short Plat No. 078-77, where access . through the block already existed in approximately the mid-block location. It appears most appropriate under the circumstances that the 27-foot access to serve the proposed two lots be a private access easement exclusively for these two lots. This seems a better alternative than the proposed pipestem configuration. Each of the two lots could hold an undivided one-half interest in the 27-foot easement area.' 3. Improvements within the 27-foot easement should be as required by the Public Works and Fire ,Departments. The staff recommendation contained in Exhibit #1, Staff Report, was for 16 feet of pavement. However,, in view of the additional seven feet of easement area this recommendation may require revision. This review should keep in mind the fact that only •two lots will use the easement. Restrictive covenants should be prepared for review and approval of the Planning Department specifying that Lots A and B are not to be further subdivided. This is a reasonable requirement in view of the nonconforming access. Otherwise, too many lots may access to and from the easement. . 5. Regarding the waiver of off-site improvements it was not contested that installing the improvements along Meadow Avenue N. (27-foot easement area) would ". . .deprive the applicant of the reasonable use or development of his land." (Section 9-1109.1.A.) . However, other properties along this street have not constructed these improvements (Section 9-1109.1.B) . No injury _could be seen to the public welfare or other properties (Section 9-1109.1.C.) . The property to the south fronts entirely on N. 36th Street and would most logically be subdivided in the future off N. 36th Street as opposed to a street along its north boundary adjacent to the subject site. The potential for a public street is also restricted along the north side of the subject site because of the close proximity of several existing single family residences, Also the potential for such a street to be extended from Meadow Avenue North to Park Avenue North appears to be quite limited because of the location of existing single family residences. All of the above-mentioned circumstances appear to support the necessary finding of hardship in granting an exception to the subdivision ordinance (Section 9-1109). There does not appear to be a more acceptable alternative. The primary question would be whether 'or not the 20 foot access street should be public or private and what extent the improvements should be. 8. The examiner has granted short plats (i.e. , E. Coleman No. 078-78) in the area which have similar circumstances and do not conform to full City standards (Section 9-1109.1.B). 9. Granting of the short plat and exception will add only one additional house on a large 17,000 square foot lot, and does not appear to create any significant detrimental impacts to other properties in the vicinity (Section 9-1109.1.C). 10. In this particular case it seems reasonable to allow access by a 20 foot private road, as it would only serve two lots now and in the future. Lot B is large enough to be further subdivided. However, it could not be further short platted for five years. A possible covenant restricting further subdivision may be appropriate in this case. 11. Improvements for the length of the pipestem should also be considered relative to the number of lots. Normally a minimum 10 foot paved access driveway is required, the length of the pipestem to serve only one lot. Because of the two lot configuration and additional fire access requirements, a minimum 16 foot paved driveway shoul8 be established from Meadow Avenue North to lot A. Such improvements should be subject to approval of the Public Works Department. 12. The request for waiver of the off-site improvements is for the 20 foot wide portion of the property along Meadow Avenue North. If 16 feet is utilized for driveway, four feet is necessary for curb, gutters, and .sidewalk. This seems unreasonable especially when no similar improvements exist the entire length of Meadow Avenue North. However, if Meadow Avenue North is improved in the future, this 20 foot wide section should be included. Therefore, the applicant should be required to file covenants agreeing to participate in any future comprehensive street improvements, P. PLANNING DEPARTMENT RECOMMENDATION: Recommend approval of the proposed two-lot short plat and exception for 20 foot private access road based upon the above analysis subject to: 1.
