Brain : The subject short plat was approved by the Hearing Exmainer subject to restrictive convenants on September 20 , 1978, and we have yet to receive the short plat mylar and eight copies for filing with King County. If the plat is not filed within one year of the date of sub- mission. the plat shall be null and void. Upon proper application by the sub- divider, the Planning Department may grant one extension of not more than six (6) months. To revitalize any expired plat, it must be resubmitted. (Ord. 2667, 10-4-71;arnd. Ord. 2823, 1-21-74,eff. 1-30-74) 9-1106: TENTATIVE, PRELIMINARY AND FINAL PLAT REOUIREMENTS: 1. Tentative Plat Requirements. A., as amended: Proposed Plat, Fee. The application . for a Tentative Plat shall be submitted in an original and seven (7) copies to the Planning Department who shall record the date received and assign a file number. The application shall be accompanied by a fee of fifty dollars ($50.00) plus two dollars ($2.00) per acre. (Ord. 3105, 1-24-77,eff. 1-1-77) B. Referrals, Recommendations of Departments. The Planning Department shall transmit two (2) copies of the Tentative Plat to the Department of Public Works, one copy to the Traffic Engineering Department, one copy to the Building Department, one copy to the Health Agency, one copy to the Fire Department and copies to other departments and agencies as necessary for their review and recommendation. One copy shall be retained for the use of the Planning Department. These departments and agencies shall make their respective recommendations regarding the Tentative Plat to the Planning Department and to the subdivider. These departments and agencies shall notify the Planning Department when they have approved the Tentative Plat. C. Revisions. The departments and agencies in accordance with their re- sponsibilities cited in Section 9-1 106, 1.B. may have the subdivider revise his proposed subdivision to conform to the requirements of this Or- dinance.The departments and agencies may require revision of the proposed subdivision to promote public safety and the general welfare .of the City. D. Approval Period. Tentative Plats shall be approved or disapproved within six (6) months from the date of submission. Upon proper application, the Planning Department may grant one extension of not more than three (3) months. E. Expiration Period. Exhibit #5: Memorandum to Hearing Examiner from Public Works Director, dated September. 12, 1978, regarding off-site improvements. .The Examiner inquired if all pertinent information had been received to complete the application file. Mr. Clemens indicated that all material had been received, including . an affidavit of ownership for the property. The Examiner asked the representative for the applicant if he concurred in Exhibit #1. Responding was: John K. Pain P.O. Box 626 Renton, WA 98055. Mr. Pain, legal counsel for Public Hospital District No. 1, indicated his concurrence in the Planning Department report, Exhibit #1, and the proposed restrictive covenants and recommendations contained in Exhibit #4. The Examiner requested testimony in support or opposition to the request. There was no response. Referencing Section 0.3 of Exhibit #1, which states that the proposed short plat will allow the hospital .to purchase the approximate northerly 290 feet of Parcel C from Dr. Brain for future expansion, the Examiner requested clarification of the location of the property. Mr. Clemens designated the location of the northern 290 feet of Parcel C on Exhibit #2. The Examiner inquired if the existing wooded ravine is designated precisely on Exhibit #3'. Mr. Clemens reported that although the location is approximated on the map, the ravine extends through Parcel A and from 75 to 100 feet of the extreme northern end of Parcel C. The Examiner requested further comments. Since there were none, the hearing on File No. Short Plat 213-78 was closed by the Examiner at 9:22 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a three-lot short plat. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible official, has determined that the proposal is exempt from the threshold determination and EIS requirements. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and their comments are contained in Exhibits #1, 4 & 5. 5. There was no opposition' to the proposal expressed. 6. All existing utilities are available and in close proximity. Per Exhibit #5, the Public Works Department requested water and sewer easements on the property. 7. The proposal appears compatible with the required setbacks of Section 4-710.5 (P-1) of Title IV, Ordinance No. 1628, Code of General Ordinances (Exhibit #1) . 8. The file of record contains two affidavits attesting to ownership of the property (Section 9-1106.3.H. (1) ) . 9. Off-site improvements that have not already been installed are required and have not been deferred or waived (Section 9-1106.3.H. (5) ) . 11. A title insurance policy was not submitted per Section 9-1106.3.H. (6) . 12. Certification by the King County Health Department and the King County and City of Renton Finance Departments will occur just prior to, at or immediately following filing of the final short plat with King County (Sections 9-1106.3.H. (4) , (7) and (8) ) . 13. Restrictive covenants were not submitted by the applicant per Section 9-1105.3.B. 14. Each. lot in the short plat contains over 35,000 square feet; therefore, the proposal does not require a storm drainage plan (Section VI, Ordinance No. 3174 - Renton Storm and Surface Water Drainage Ordinance) . 15. A wooded ravine exists along the northerly approximate 75 to 100 feet of the property. 16. The Valley General Hospital and a medical clinic exists on Lot C. Lots A and B are undeveloped. CONCLUSIONS: 1. The proposed short plat conforms to the Comprehensive Plan and zoning requirements. 2. Of principal concern to staff is the natural ravine at the northern perimeter• of the site. Attached to Exhibits #1 and #4 were pertinent excerpts from the restrictive covenants previously imposed upon the northerly abutting property (Site Plan Approval No. 092-77, Exhibit #4, Vallis Investors) . These covenants were imposed as the result of rezoning the property to P-1 (Ordinance No. 2944) and essentially required preservation of the natural ravine by control of clearing, grading and building in that area. Such covenants have not been imposed upon the property currently under review, but the applicant agreed to the same restrictions upon the subject property. It is appropriate that this steep and wooded ravine be protected (Objective No. 2, page 17, Comprehensive Flan, Land Use Report, July, 1965, and Section 9-1108.19.B) . Structures should not be constructed in the ravine area and the existing vegetation should be retained. Compliance with these can be reviewed by the Examiner in review per Section 4-710 of the site plan for development abutting the ravine. 3. Certification per Section 9-1106.3.H must be completed. 4. The Public Works Department request (Exhibit #5) for water and sewer easements on the property appears to relate to future use of the property, not necessarily the short plat. Development proposals were not discussed in the public hearing. At this time it is unreasonable to require beyond the normal compliance with applicable city ordinances and regulations relative to installation of water and sewer services to the three lots and development upon each lot. Justification for additional requirements was lacking. DECISION: Based upon the testimony, record, findings and conclusions, it is the decision of the Examiner to approve the requested short plat (Exhibit #3) subject to: 1. Completion of certification per Section 9-1106.3.H per approval of the Planning Department. 2. Completion of off-site improvements per approval of the Public Works Department, and 3. Restrictive covenants stipulating that. structures are not to be constructed or clearing or grading occur in the existing ravine along the northerly portion of the property except as approved by the Examiner. Off-site improvements including curbs , gutters , sidewalks and storm drains would be a standard requirement on the Talbot Road frontage . In the submittal of this short-platting application, we have been guided by your department as this being probably the most expedient way of short-platting the property. In examining the short plat map, you will note that the hospital intends to acquire practically all the Brain property with the exception of two locations on the Springbrook/Talbot Road, which will be retained by Dr. Brain, and also a lot which will be retained by Dr. Lwai in the exchange. This additional property that is being made .available to the hospital, is sorely needed for the future growth of Valley General and actually is the only property adjoining our site.
