PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the ' Examiner conducted a public hearing on the subject as follows: The hearing was opened on October 24, 1978 at 10:15 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. • It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. David Clemens; Associate Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Short Plat Map Exhibit #3: Vicinity Map • Exhibit #4: Letter to City of Renton from Mr. & Mrs. Thelmer Olson, dated September 7, 1978, regarding request for exception for pipestem • road. The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Thelmer Olson 2142 Union Avenue N.E. • Renton, WA 98055 • Mr. Olson indicated his concurrence in the Planning Department report and inquired regarding requirements for paving of 10-foot width of the pipestem road. The Examiner confirmed the requirements of the ordinance. . The Examiner inquired regarding the location of the northern property line of the subject site. .Mr. Olson reported that surveys of the property had been accomplished in 1949 and 1964 and submitted a copy of. the most recent survey into the record. The document was labeled as follows: Exhibit #5: Survey of Subject Property, dated 1964 Mr. Olson reported infringement of an existing fence on the southern property line of his property. The Examiner advised that establishment of accurate property .lines was not the .subject of the public hearing, but would be required to be privately resolved • ' by affected residents. . Renton, WA 98055 Mrs. Amorim, property owner to.the south of the subject site, indicated that certain discrepancies are reflected on property lines to the north and south of her property which she felt should be resolved prior to approval of the short plat. The Examiner reiterated .previous comments regarding private..resolution of the matter by the affected . parties since it was not a subject of the public hearing." Mrs. Amorim indicated concern regarding installation of three pipestem roadways resulting from subdivision of the applicant's property, her own property and the property to the south due to all lots being landlocked in the rear by development of the Glencoe subdivision, and which would create an unsightly detriment to the neighborhood. She also objected to a pipestem road located seven feet from her house which may cause possible removal.of mature trees and grape orchard. The Examiner clarified that approval of the short plat would not. be delayed by verification of the property boundaries since the proposed • pipestem is currently existing as a driveway on the site. He also indicated that removal of the existing fence on the southern boundary is not a requirement by the Examiner, but is a civil' matter. • Mr. Clemens referred to Mr. Olson's comment relative to paving of the pipestem roadway, and indicated that if the applicant desired, he could pave the roadway in conformance to ordinance standards subject to landscaping of the additional area compatible with existing landscaping in the vicinity. The Examiner referenced Section 9-1108.23 of the Subdivision Ordinance which requires installation of landscaping between pipestem paving and the property line or existing fence. Mr. Olson reported that he maintains ownership.of the fence which was included in the original purchase of the property. He also indicated that conformance to turnaround requirements of the Fire Department would occur since substantial area is available for that purpose. Mr. Clemens advised that a hammerhead configuration in the turnaround area would be acceptable to the Fire Department. The Examiner requested a final recommendation from the Planning Department staff. Mr. Clemens indicated the Planning Department recommendation would remain as submitted with • the modification to Recommendation No. P.2 that the pavement area on the pipestem conform to ordinance criteria and landscaping be provided between the pipestem road and the southern property line. The Examiner inquired if the Planning Department had requested a legal opinion from the City Attorney regarding the Examiner's authority in granting an exception from the Subdivision Ordinance for both pipestem width and length. Mr. Clemens indicated that an opinion had not been requested. The Examiner indicated that clarification would be necessary and would be accomplished within the 14-day period of review. . The Examiner entered the affidavit of ownership included in the short plat file into the record as Exhibit #6. The Examiner requested further comments. Since there were none, the hearing on File No. • Short Plat 230-78 and E-231-78 was closed by the Examiner at 10:45 a.m. FINDINGS, CONCLUSIONS AND DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: • FINDINGS: • 1. The request is for approval of a two-lot short plat and exception from the Subdivision Ordinance, to permit a pipestem lot which is less in width and longer in length than specified or to permit' less than the required lot width. • • 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. • ' 3. Pursuant to the City of Renton's Environmental Ordinance and the State' Environmental Policy Act of 1971, Gordon Y. .Ericksen, responsible official", determined the proposal exempt from the threshold determination and EIS requirements of SEPA. . • • 4. Plans for the proposal hive been reviewed by all city departments affected by the impact of this 'development and no adverse comment was expressed. 5. There was. no opposition to the proposalexpressed. ' • Short Plat 230-78 Page Three E-231-78 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the lot area and dimension requirements of Section 4-706 (R-1) and 4-729 (G) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The proposal does not conform to the minimum lot width dimension of Section 9-1108.23.F. (3) . (b) , proportions of Section 9-1108.23.F. (3) . (c) , and pipestem lot dimensions of Section 9-1108.23.F. (3) . (d) of Title IX, Ordinance No. 1628, Code of General Ordinances. An exception from these requirements have been requested (Exhibit #4) 9. The frontage of the property along Union Avenue N.E. is 76.9 feet. Section 9-1108.23.F. (3) . (b) , (c) and (d) require a frontage of 80 feet. Zoning regulations (Section 4-706; R-1) require a frontage of 70 feet, including pipestem. 10. Additional property is not apparently available for purchase by the applicant. Homes exist in close proximity to the northerly and southerly property lines. 11. An affidavit certified ownership of the property by the applicant (Section 9-1106.3.H. (1) ) . 12. No further dedication of street right-of-way is needed (Section 9-1106.3.H. (2) ) . '13. A survey has not been completed by a licensed land surveyor for this application (Section 9-1106.3.H. (3) ) . . This property was a portion of a survey conducted on March 12, 1964 (Exhibit #5) . 14. Off-site improvements have not been constructed, but the applicant expressed the willingness for their implementation (Section 9-1106.3.H. (5)) . A deferral has not been granted by the Board of Public Works. 15. Certification by the King County Health Department and the King County and City of Renton Finance Departments will occur immediately prior to, at or following filing of the approved final plat (Section 9-1106.3.H. (4) , (7) and (8) ) . 16. A title insurance policy was not provided (Section 9-1106.3.H. (6) ) . 17. Restrictive covenants were not submitted (Section 9-1105.3.B) . CONCLUSIONS: 1. The total property contains almost an acre of area which is proposed to be divided into two parcels. Other properties in the area have been so divided (Section 9-1109.1.B) . Strict compliance with the Subdivision Ordinance would create a hardship by essentially preventing division of the property (Section 9-1109.1) . The physical configuration, of the property is unusual (pan-handle shape) of inadequate frontage on a street to permit easy division (Section 9-1109.1.A) . Detriment to the public or adjacent properties is not apparent (Section 9-1109.1.C) . 2. Section 9-1108.23.F. (3) . (d) requires that pipestem lots be approved as an exception per Section 9-1109 by the Examiner. Within this section is also contained specific criteria for the design of the pipestem. Per a conversation with the City Attorney the Examiner is prevented from deviating from this design criteria and in essence granting an exception from an exception requirement. Pipestem lots can be approved as an exception, but their design is a condition to the exception, not a further matter for review as an exception. Under the circumstances (Conclusion No. 1) the pipestem lot should be approved subject to compliance with other applicable design criteria of the Subdivision Ordinance. • 3. While Section 9-1108.23.F. (3) . (d) requires that the pipestem be 20 feet wide and 150 feet maximum in length, the length must be shorter. Since the residual width of the property becomes 56.9 feet, Section 9-1108.23.F. (3) . (a) requires that the divided lot (Parcel A; Exhibit #2) becomes 8,094 square feet, conforming to the zoning regulations. It appears appropriate for the reasons specified in Conclusion No. 1 for an exception from the lot width requirement of Section 9-1108.23.F. (3) . (c) be granted to allow the 56.9-foot lot width. 4. Unless some other access to the property is provided, further subdivision cannot occur in conformance with the Subdivision Ordinance. 410/1/ Short Plat 230-78 Page Four E-231-78 5. Completion of certification per Section 9-1106.3.H. can be accomplished per review and approval of staff per Section 9-1105.7. DECISION: Based upon the testimony, record, findings and conclusions, it is the Examiner's decision to approve a short plat of two lots for the property subject to revision of Exhibit #2 to: 1. Pipestem of 20 feet by 142.25 feet and compliance with other requirements of Section 9-1108.23.F. (3) . (d) per approval of the Planning Department. 2. A width of 56.9 feet for Parcel A. We want to build a smaller home as we are in our sixties and are nearly ready to retire. This lot has been in our retirement plans before we were annexed to the City of Renton from King County, where the regulations were not so strict. The proposed exception request appears to be the minimum variation from ordinance standards to provide for further development of .the subject parcel which currently exceeds the minimum lot size by approximately five times . 7 . Utilities are available to the subject site . In addition , drainage plans must be approved by the Public Works Depart- ment prior to filing the plat . P .
