Schneider are the owners of the following real property in the City of Renton, County of King, State of Washington, described as follows: The west one-half of Tract 234 of C. D. Said improvements shall include but may not be limited to the installation of curbs, gutters, sidewalks, street paving, sanitary sewers, undergrounding of utilities, and street lighting. These covenants are imposed in lieu of Section 9-1105(6) of Title IX of Ordinance No. 1628 of the City of Renton. INSTALLATION OF ON-SITE IMPROVEMENTS The owners of the above described property, their successors, heirs and assigns, hereby agree and covenant to participate in and sign a petition in support of installation of on-site improvements within the easterly one-half cul-de-sac denoted on Exhibit #6, File No. Short Plat 245-78, upon either: 1. Development of more than two lots on the.property; 2. Installation of roadway improvements on the easterly, adjacent properties, roadways or easements; or - 3. Requirement by the City of Renton. DURATION These covenants shall run with the land and expire on December 31, 2025. The Examiner asked the applicant if he' wished to address the findings the ' Examiner must make to grant an exception in accordance with Section 9-1109 of the Subdivision Ordinance. Mr. Schneider indicated that the findings were addressed in Section C.3 through 5 of Exhibit #1 as well as contained in his letter to the Planning Department, Exhibit #3. He reported that due to the physical circumstances of the property, strict application of the ordinance would deprive him of the ability to construct one single family residence and utilize the southern portion for recreational use. He indicated that his request was not unreasonable in view that such rights and privileges had been granted to all adjacent property owners and provision of a full street for access to one single family residence would incur extreme hardship. Mr. Schneider noted that injury to the public welfare would not occur by addition of one single 'family home on the neighborhood. The, Examiner requested a final recommendation from the Planning Department, Mr. Clemens reported that the Planning Department recommendation would remain as submitted in Exhibit ' #1. , The Examiner requested further comments. Since there were none, the hearing.on File No., ' E-265-78 was closed by the Examiner at 9:20 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the • Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a four-lot short plat, an exception to allow three pipestem lots, a waiver of on-site and off-site improvements, and an exception to allow less than a 50-foot wide public street. . 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings Of fact, and departmental recommendations in this matter, , and is hereby attached as Exhibit #1 (including supplement) and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental : Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible official, determined the proposal .to be,exempt from the. threshold determination and . EIS requirements of SEPA. . ' ' . . 4. Plans for the proposal have been reviewed by all city departments affected by 'the impact of this development. ',5. An exception is requested ` to allow the pipestem lots. However, two ,.of these lots do not conform to the pipestem design criteria' of Section 9-1108.23.F, (3Y: (d) ' .9. Development of a common acc.ess•.road is prevented by the location of. . • the existing home on the property and an existing fire hydrant. (Exhibit #3 and testimony) . This common driveway would align with Blaine Avenue. 14. The configuration of the property is narrow (126.3 feet) and long (slightly less than 592 feet) . 15. At 'this time the applicant intends to only develop the northernmost lot (Lot 4) . CONCLUSIONS: • 1. The configuration of the property ,and obstacles to combining access along the ' easterly portion. Of the property •produce difficulty in achieving an easy solution to' subdivision of the property: ' An extension northward of Blaine Avenue N.E. for this access would be possible if .it were not for the existing home on the subject property and an' existing•fire hydrant. This most obvious and practical solution 'is prevented by -these obstacles. . . 2< Section 9-1108.23.F. (3) . (d) contains thecriteria' for pipestem lots -if these' lots . are granted as an exception. ' The criteria is not the subject ,of an exception, but is the minimum standard for the pipestem area,. Therefore, the Examiner is' prevented from deviating ,from this criteria. The'result is that the proposed subdivision. (Exhibit #3) cannot be approved since two of the three proposed pipestem lots do . not meet this criteria. Lots 3 and 4 contain pipestem areas over 150 feet in length.. However, pipestem lots may be necessary due to the .configuration of the property and the Examiner's decision (Section 9-1109.1.A) which may preclude reasonable ' alternatives in order to be similar. to adjacent development (Section 9-1109.1.B)' and not injure the public welfare or 'other properties (Section 9-1109.1.C) . An exception to.allow;pipestem lots should be' granted. ', . 3. Since per the foregoing conclusion the 'Examiner is prevented from approving the proposed short plat (Exhibit #3) , the three; alternatives proposed by staff (Exhibits . ' #5, 6 and 7) 'were presented. The Public Works Department recommended Alternative .A . . (Exhibit #5) which featured a half-street (25 feet) along the western property line to eventually be combined with another half-street from the property west of the . • subject site. This new road would eventually. serve the northerly .properties as . . well. ' - • , . : 'The Planning Department' offered•two other alternatives (Alternative B - Exhibit. #6, • .and'Al:ternative C - Exhibit #7) . Alternative' B is a 290=foot cul-de-sac along the ..easterly property line (the .applicant would be responsible 'for:,half of the street) .' , Alternative C 'is. a' S00-foot cul-de-sac, with the saic►e r,esporieibility of the applicant, . alonhe western.property line. Alternative B appears to be the most reasonable approach. This would combine access • . with easterly abutting properties, possibly alleviate the need for an exception for. pipestem. lots and would align the curb cut with an existing intersection. This,, appears to be the most reasonable alternative since: , a. The westerly abutting property has great flexibility Of access to Aberdeen Avenue N.E. and may. not actually. need access in :combination with the 'subject short plat. _ b. The northerly properties have flexibility of access to N.E. 24th Street and potentially N.E. 22nd Street, thereby not apparently needing southward access in , combination with the subject short plat. c. The property,: could be subdivided into four lots with only revision of the short . plat map (Exhibit #3) . 4. Section 9-1109.23.F. (2) requires that each lot front a public street'or road which. Sections 9-1108.23.A. (5) and 9-1108.7:H. ' exact be 50 feet wide. Since in the previous conclusion ,a cul-de-sac along the eastern property line is required, it appears reasonable that the applicant only be-required to construct one-half of a street. The abutting easterly properties should eventually construct improvements for their half of .the street. 'Under the circumstances of existing easements and homes on these properties less than a',half street can be constructed. Mutual benefit will occur to these properties and the subject site through this common roadway (also see previous conclusion) . Dedicating more than 25 feet of: the subject site seems an.undue requirement in view of the common nature of the 'street (cul-de-sac)' (Section 9-1109.1) . Unusual circumstances (adjacent unimproved.road/driveway(s) and capability of access for , ' westerly abutting property) exist to render 50 feet of right-of-way unreasonable and. damaging to the applicant (Section 9-1109.1.A) . Development in the neighborhood is occurring somewhat similarly (Section 9-1109.1.B) . , Injury to the public or other properties is not evident (Section 9-1109.1.C) . Therefore, the exception for a 25-foot right-of-way dedication should be approved. 5.. Improvements required within the aforementioned cul-de-sac by the Subdivision Ordinance are those improvements found to protect ". . .the public health, safety, welfare and esthetics, and such provisions are intended to provide for wholesome, environmental conditions in the community, adequate public services, and safe and functional streets . and thoroughfares." (Section 9-1101:2 - Purpose) . Complete waiver of the required. improvements appears to contradict this purpose of the Subdivision Ordinance. Hardship created for the applicant by requiring all of these improvements appears . undue when considering the applicant's short.term intent for only One additional building site at this time (Section 9-1109.1) . The,burden of constructing the improvements will probably seriously jeopardize the intent (Section 9-1109,1.A) . Other properties lack these improvements (Section 9-1109.1.B) . The public welfare and other properties will not be harmed (Section 9-1109.1.C) by waiving the ' improvements at this time. In considering the proposal of four building sites, the long term intent of the 'applicant, hardship that is created for the applicant due to requiring these improvements is not undue, but normal pursuant to subdividing the property (Section 9-1109.1) . The reasonable use and development of the property continues (Section .9-1109.1.A) . The majority of other similarly developed properties in the vicinity have installed improvements in some form with development (Section 9-1109.1.8) . The welfare of the future residents of the subdivision is considered, and lack of the improvements may later be found to be detrimental (Section 9-1109a1.C) . . • Therefore, it appears appropriate that the on-site improvements be waived subject to completion of restrictive covenants wherein the applicant agrees to installing the , improvements when: • a. Lots 1 or 2 are developed; b.' Adjacent properties, roadways or easements are improved,, or c. .Required by the City of Renton. ' This may .present a problem to the applicant. The potential issue is'raised ' ,. here for only the purpose 'of appraising the applicant who may- wish to resolve the . issue in the aforementioned restrictive covenants. . 7. Revision of the short plat to two lots (Exhibit #1 - supplement .to staff report, exception hearing) is not 'necessary in order to address the exception. However, the, applicant has the prerogative to continue this revision. Four lots appear .. ' appropriate on the property but the applicant .has the discretion per the Examiner's decision to make. this revision. Since the applicant indicated his long-term intent . for four lots, the Examiner .pursued the most expeditious approach of considering four lots at this time as opposed to a subsequent hearing. -DECISION: Approve,a four-lot short plat subject to: ' 1.. Revision of Exhibit #3 .to reflect the one-half cul-de-sac street of Exhibit #6,' or reasonably proximate thereto. • 2., • Revision of the lot• lines,of Exhibit '#3 as_necessary as:a result of the'easterly one-half cul-de-sac. . The proposed street arrangement of Figure 4 will provide access to this property and at some future time the property to the west. 2 . The applicant has agreed to the lot arrangement and street location as recommended by City staff in the hearing for Short Plat 245-78 . 3 . Due to the narrowness of the subject property , and relatively low overall development potential , a full width public street right-of-way would substantially impact the applicant ' s proposed use (one additional single family residence ) and reduce the development potential of the property by 30% from about 9 lots to 6 lots . 4. The proposal provides public street access to all of the applicant ' s property and the adjoining property whereas similar installations in the vicinity are by private easement only. 5 . No initial improvement of the right-of-way is proposed ,,, however , the applicant can provide access across his southerly lot via a driveway and easement . No adverse impact on the public welfare should occur from this arrangement. Future public street access will further improve this situation . D . I was told by the Building Department that I need a short plat number before they will give me a building permit for my new home which will be located on the last * of the property, north of the old existing house. Also, I am breaking up the property south of the old house at the present time because the cost to do so is the same as it would be to just break off the last And, because I will have to go through this procedure only once, NOW, and NOT AGAIN in the future. I wish to use the entire property for the enjoyment of my family by building a new home and enjoying the trees and plants that are presently on the property and using the rest of the land for pasture and recreational area for my children. My property goes back approximately 590 feet from the street and only fronts approximately 126 feet on the street (NE 20th). I need the pipe stems to be able to meet requirements of all parcels needing access to the street. The pipe stems will allow access to each section. I feel the ordinance deprives me of reasonable use or development of my property. The property (see attached drawing) in the East 2 of block 234 (as well as others in the vicinity) are enjoying the use of their property through the use of JUST ONE access road for all the property in that 2 block. I am giving up much of my land by providing each piece of property to have its own access to the street. I feel the exception is necessary to insure me the rights and privileges enjoyed by other property owners in the vicinity. The granting of the exception will in no way effect the public welfare or be injurious to other property in the vicinity. The City Attorney has previously ruled (Short Plat 230-78 : Olson : October 26 , 1978 ) that although the Hearing Examiner has the right to approve an exception to allow pipestem lots , the Examiner may not modify the exception criteria (maximum pipestem depth 150 ' , pipestem minimum width 20 ' ) . The applicant ' s proposed pipestem lot designs range in length from 147± feet to 450± feet. Only the 147 foot pipestem serving parcel 2 meets the allowable pipestem criteria . Parcels 3 and 4 cannot be approved in the configuration proposed . 5. As a consequence of the applicant ' s lot arrangement not com- plying with the Subdivision Ordinance (definition of Lot 9- 1102-8 and Private Streets and Reserve Strips 9- 1108-23A ( 9) ) , the Engineering Division has recommended that a public street be developed along the westerly property line, the street to consist of right-of-way and improvements for one-half of a 50 foot public street. See Figure 2 . This arrangement would provide access to each proposed parcel in the subject plat and provide for future development of the property located to the west of the subject site which is currently undeveloped . Traffic Engineering also recommended this arrangement , although they have expressed some concern about the off-set of the new street with Blaine Avenue at the intersection with N . E . 20th . 6. An alternate to the Engineering proposal is indicated in Figure 3 which places the new public street along the easterly property line and would serve as an extension of Blaine Ave . The shorter cul -de-sac design would be less costly to develop , would provide partial access to the fire hydrant on Parcel C to the east , improve the Blaine Avenue/N . E . 20th intersection and would provide for future subdivision of Parcels B and C to the east . Depending upon the precise location of residence A , there could be a conflict with the proposed right-of-way , although a visual check appears to provide sufficient area . . One remaining alternative may exist which would call for the site to be divided into two or three parcels with the property lines running north-south . This would require an exception to the width-to-depth ratio ( 9-1108-23-F-3 (a ) ) . 8 . The Engineering Division recommendation of a new street at the west would be more costly to develop by this applicant but would potentially serve eight lots on the parcel to the west in the future . The alternate of the street at the east would be about one-half the cost , but would serve only two potential new parcels to the east , plus partially serving lots B , C , D , and E . The alternate of a two or three lot split would be the least costly but would serve no other adjoining parcels . The applicant has stated his desire to only construct a single home at this time , and it may be appropriate to consider obtaining the required right-of-way at this time and deferring the improvements until further development by this applicant or adjoining property owners . P . PLANNING DEPARTMENT RECOMMENDATION : Approval of the short plat as two lots as shown in attached Figure 4 , and subject to the following conditions : 1 . Dedication of one-half of a 50 foot public street right-of-way as shown on Figure 4 . 2 . Restrictive covenants running with the land providing for improvement of the right-of-way specified in number one above : a . At such time as parcel 2 of this plat is further sub- divided , or b . At such time as development occurs on the property to the west and the westerly half of this street is installed , this property owner will participate in the improvement on an equitable basis . Approval of the requested Waiver 246-78 of the off-site improve- ments on N . E . 20th is recommended on the basis that no similar improvements exist in the vicinity .
