The application includes a request for waiver of required off-site improvements. Hearing Examiner Decision: Approval subject to restrictive • covenants. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on February 22, 1979. PUBLIC HEARING: After reviewing .the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the • Examiner conducted a public hearing on the subject as follows: The hearing was opened on February 27, 1979 at 10:20 a.m. in the Council Chambers of the • Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Steve Munson, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Letter to Planning Department from,applicant, dated January 31, 1979, regarding request for ' • • waiver of off-site improvements. Exhibit #3: Letter to Planning Department from applicant, dated January 31, 1979, regarding request for exception for pipestem lot. • Exhibit #4: King County Assessor's Map Exhibit #5: Short Plat Map Exhibit #6: Letter to Hearing Examiner from, Public Works . ' He noted that the purpose of the request is to allow construction of a residence for a member of his immediate family. The Examiner requested testimony in support or opposition to the request. There was no response. He then inquired regarding locations of public hearing notices adjacent to the property. Mr. Carrier clarified that notices were posted on aVacant lot north of the subject site as well as south of the property. . Mr., Carneinquired rega rding arding potential.'impact. of. the Public Works Department recommendation • contained in Exhibit #1. The Examiner reiterated comments contained in the letter which recommend denial .Of the waiver and requirement Of installation of off-site improvements, noting that. the comments did not address the possibility of execution 'of. restrictive , covenants for participation in a.future LID. . The Examiner requested further comments. Since there were none, the.hearing'on File No. Short Plat 302-79, E-303-79 and W-304-79 .was closed by the Examiner at 10:37' a.m. - FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: • FINDINGS: . 1. The request is for approval of a two-lot short ,plat, an exception for a- pipestem, lot • and a waiver of off-site improvements. ' 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this.matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. , , 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , the subject proposal was determined to be exempt from the threshold determination and EIS requirements of SEPA. . ' 4. Plans for the proposal have been reviewed by all city 'departments affected by the impact of this development and, no adverse comment was expressed. 5. There was no opposition 'to the proposal expressed. • 6. All existing utilities are.available and in close proximity; however, a water main ' extension may be required. . . 7. The proposal is 'compatible with the setbacks, lot area and dimension requirements of Section 4-706 (R-1) and 4-729 (G) of Title IV, and Section 9-1108.23. (Subdivision . Ordinance) , Title IX, Ordinance No. 1628, Code of General Ordinances;- except for Section 9-1108.23.F. (3) . (c) (lot width for one pipestem lot) . An exception from , Section 9-1108.23.F. (3) . (c) was requested .(Exhibit #3) . 8. Certification,:per Section 9-1106.3.H is not complete. An affidavit• of ownership was submitted (Exhibit #7) . 9. Off-site improvements do not exist within at least one-half mile from the subject site. CONCLUSIONS: 1. The proposal conforms to the Comprehensive Plan, zoning regulations and the Subdivision Ordinance, except as noted in Finding No. 7. . . 2. Special circumstances exist on the property that preclude development without a . pipestem lot (Section 9-1109.1.A) . The configuration of the proper.ty'does not allow ' two 60-foot wide lots per Section 9-1108.23.F. (3)'. (c) along Talbot Road 'South." An ' existing house on the property raises the issue of building setback compliance relative to other development alternatives. • Other properties in .the.area have been Subdivided into small parcels outside of a- formal final plat (Section 9-1109.1.B) . Detriment to the public or other properties - , • is not apparent (Section 9-1109.1.C) . The pipestem should be approved. 3. Off-site improvements should be waived subject to the agreed" upon restrictive covenants • attesting to,partic"ipation in a Local Improvement District at some .future' date. These improvements do not exist within a reasonable distance from; the subject. site (Section 9-1105.6,B).. The size of the property is large enough that the proposed short plat can be considered a reasonable use of the land . Lots A and B exceed the minimum lot size requirement of the G-9600 zone and the subdivision ordinance . However , the amount of frontage on Talbot Road South is not sufficient to meet the 60-foot standard for each lot . The applicant is therefore proposing Lot "A" with a 77-foot frontage and Lot "B" as a pipestem lot with the required 20-foot minimum width and within the maximum allowed length at approximately 139 feet . • 4 . In addition to the insufficient frontage on Talbot Road South , the existing residence on proposed Lot "A" is located just 35 feet from the present south property line . Thus , strict application of the subdivision ordinance requirements would not permit a short subdivision . Given this situation , it would seem that reasonable justification can be provided for the proposed exception (Section 9-1109 . 1A) . 5 . There are no existing off-site improvements (curb , gutter , sidewalk , and paving ) along Talbot Road South in this vicinity . The Lobe Short Plat (approximately 1 /2 mile to the north ) was granted a deferral of these improvements in July 1977 . Therefore , the establishment of a fully dedicated and improved public street to the site is not desireable at this time . Further , precise profiles and grades are currently undetermined . 6 . Suitable utilities are available to the subject site . However , the Utilities Engineering Division advises that a water main extension will be required and that the existing dwelling may require a utility easement to extend the sewer line . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION : Pursuant to the City of Renton ' s Environmental Ordinance and the State of Washington Environmental Policy Act of 1971 , as amended , RCW 43-21C , this proposal is exempt from the environmental assessment/threshold determination process . The subject proposal is consistent with the Comprehensive Plan which designates the site and surrounding area as single family residential . 2 . The proposal is compatible with adjacent single family residential uses and similar subdivision patterns in the vicinity . 3 . The size of the property is large enough that the proposed short plat can be considered a reasonable use of the land . Lots A and B exceed the minimum lot size requirement of the G-9600 zone and the subdivision ordinance . However , the amount of frontage on Talbot Road South is not sufficient to meet the 60-foot standard for each lot . The applicant is therefore proposing Lot "A" with a 77-foot frontage and Lot "B" as a pipestem lot with the required 20-foot minimum width and within the maximum allowed length at approximately 139 feet . 4 . In addition to the insufficient frontage on Talbot Road South , the existing residence on proposed Lot "A" is located just 35 'feet from the present south property line . Thus , strict application of the subdivision ordinance requirements would not permit a short subdivision . Given this situation , it would seem that reasonable justification can be provided for the proposed exception (Section 9-1109 . 1A ) . 5 . There are no existing off-site improvements ( curb , gutter , sidewalk , and paving ) along Talbot Road South in this vicinity . The Lobe Short Plat (approximately 1 /2 mile to the north ) was granted a deferral of these improvements in July 1977 . Therefore , the establishment of a fully dedicated and improved public street to the site is not desireable at this time . Further , precise profiles and grades are currently undetermined . 6 . Suitable utilities are available to the subject site . However , the Utilities Engineering Division advises that a water main extension will be required and that the existing dwelling may require a utility easement to extend the sewer line .
