Plat II: Southeast corner of Sunset Boulevard N.E. and Anacortes Avenue N.E. SUMMARY OF REQUEST: Applicant seeks approval of two proposed short plats. Plat I is for four lots consisting of the shopping center, a satellite commercial parcel and two R-2 lots for future four-plex development. Plat II is for three lots, two of which are for future four-plex development. SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approval with. conditions. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on May 3, 1979. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 8, 1979 at 9:50 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1'. Steve Munson, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Central Highlands Plaza, Plat I with staff comments Exhibit #3: Central Highlands Plaza, Plat II with staff comments Exhibit #4: Central Highlands Plaza, Plat I as submitted Exhibit #5: Central Highlands Plaza, Plat II as submitted The Examiner inquired if the entire subject parcel is developed with the exception of the southerly portion. Mr. Munson responded affirmatively. . The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Steve Kuszeit 12453 164th N.E. Redmond, WA 98052 Mr. Kuszeit indicated his concurrence in the report. The Examiner requested testimony in support or opposition to the application. There was no response. The Examiner inquired if existing and proposed development on the property conforms with conditions of the previously approved rezone. Mr. Munson responded affirmatively. The Examiner requested further comments. Since there were none,, the hearing on File No. Short Plat 330-79 and 331-79 was closed by the Examiner at 9:55 a.m. Short Plat 330-79, 331-79 Page Two FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of two contiguous short plats for a total of seven lots (three lots zoned B-1 and four lots zoned R-2) on property rezoned subject to conditions in 1977, Ordinance No. 3152. The Central Highlands Plaza Shopping Center was recently constructed on the two central and largest of the proposed lots. 2. Based, upon a conversation with the City Attorney's office the subdivision of the property can occur via the short plat process instead of through a formal plat. The property existed as Tract 8 and 9 prior to the enactment of the Subdivision Ordinance; therefore, each tract can be considered separately although contiguous. Each tract can be short platted and considered on its own merits separately from the abutting tract. For the sake of convenience and brevity the Examiner chose to consider both short plats in the same decision. 3. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 4. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , the subject proposal was found to be exempt from the threshold determination and EIS requirements of SEPA. 5. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and no adverse comment was expressed. 6. There was no opposition to the proposal expressed. 7. All existing utilities are available and in close proximity. 8. The proposal is compatible with the requirements of Sections 4-708 (R-2) and 4-711 (R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances. 9. Certification per Section 9-1106.3.H has not been completed except for the affidavit of ownership which was furnished with the file of record. The certification by the King County Health Department and the King County and City of Renton Finance Departments will occur immediately prior to, at or following filing of the final plat with King County. 10. Off-site improvements have been installed. 11. The proposed short plats comply with the requirements of the Subdivision Ordinance. 12. Restrictive covenants were not submitted (Section 9-1105.3.B) . CONCLUSIONS: 1. The proposed short plats conform to the Comprehensive Plan, Subdivision Ordinance and zoning regulations and protects the public health, safety and welfare (Section 9-1101.2) . 2. With staff review and approval certification per .Section 9-1106.3.H can be completed. DECISION: Approval of Exhibits #4 and 5 subject to staff reviewl and approval of completion of certification per Section 9-1106.3.H. HISTORY/BACKGROUND : The subject site was annexed into the City by Ordinance 2498 on May 27 , 1968 . The subject site was within a general area which was the subject of a Comprehensive Plan amendment on March 9 , 1977 , PLANNING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING : C . It was rezoned from "G" to B- 1 and R-2 by Ordinance #3152 dated August 22 , 1977 . D . PHYSICAL BACKGROUND : 1 . Topography : The initial one-third of the site adjacent to Sunset Blvd . is relatively level , although scattered deposits of fill material create certain irregularities in the topography . The southerly two-thirds of the property rises gently and is within the southerly one-third of the site at an elevation of approximately 5 to 15 feet above the level of the front portion of the site adjacent to Sunset Blvd . 2. Soils : Alderwood (AgC ) . Permeability is moderately rapid in the surface layer and subsoil . Runoff is slow to medium , and hazard of erosion is moderate . This soil is used for timber , pasture , row crops , and urban development. The northerly one-third of the site consists. of Shalear Muck (Sm) . This soil is associated with the small drainage creek that runs through this portion of the property from east to west . However , previous filling activity has covered certain portions of the original soil . 3. Vegetation : The northerly 2/3 ' s of the site is covered by asphalt and some landscaping installed as part of the shopping center development . The remainder of the site contains primarily small scrub trees and brush . Several large cedar trees presently exist near Duvall Avenue N . E . at the southerly one-third of the site . 4 . Wildlife : Some habitat may be suitable for birds and small mammals . 5 . Water :. A small stream exists in the northerly 1 /3 of the subject site and flows through a culvert in an east-west direction . This ' stream eventually connects to the Honeycreek/May Creek drainage system. 6. Land Use : There are existing business uses located in the northerly 2/3 of the subject site and across Sunset Blvd . north of the subject site and on the other three corners of the inter- section of Sunset Blvd . and Duvall Avenue NE . Several multi -family residential developments exist west of the site on the north side of Sunset Blvd . Several single family residences exist west of the subject site . The 300± unit Honeydew Apartment complex is located near the southwest corner of the subject site . An existing church is located south of the subject site with several single family residences situated south and west of the church . E . NEIGHBORHOOD CHARACTERISTICS : The area consists of a mixture of land uses . Commercial uses are oriented towards the major intersection of Sunset and Duvall . Multi - family uses are located along Sunset Blvd . and west of the subject site , with low density single family residences interspersed in the general area . The area can be considered in a growth transitional area from single family residence to higher intensity uses , primarily due to the influence of the major arterials . Existing platted single family residential areas are located generally south and west of the subject site . PLANNING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING : C . E . Sunset Boulevard together with a 12" sewer main and 12" storm sewer. 2 . Fire Protection : Provided by the Renton Fire Department as per ordinance requirements . T. Transit : Metro Transit Route #107 operates along Union Avenue NE within 1 /2 mile to the west of the subject site . 4. Schools : The site is within one-fourth mile of Hazen High School , within two miles of McKnight Middle School , and within one mile of Honeydew Elementary School and Sierra Heights Elementary School . 5 . Recreation : The subject site is within one mile of Kiwanis Park and within one mile of the proposed King County park west of Sierra Heights Elementary School . G . Natural Systems : The entire site has been developed or otherwise modified by grading , etc . for future urban use . No further impact on the natural systems is expected . 2 . Population/Employment : The combination of the plats will add 16 new residential units or approximately 56 persons ( 3 . 5 persons/ unit ) . Future employment of the undeveloped satelite shop cannot be determined . 3. Schools : 16 added dwelling units will generate about 8 new students (0. 5 students/dwelling ) . 4 . Social : Future residential development of the 4-plex parcels will generate new social interactions , or expand existing social contact . 5 . Traffic : Development of 16 new dwellings will generate approxi.matel3 100 additional d.ail.y traffic trips (6 . 1/unit) . Future traffic from the satelite shop cannot be determined . Traffic impacts should be minor as compared to the available street system. J . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION : Pursuant to the City of Renton ' s Environmental Ordinance and the State Environmental Policy Act of 1971 , as amended , RCW 43-21C , the subject proposal is exempt from the environmental assessment/threshold determination process . The subject short plats are consistent with the Comprehensive Plan which designates the site and surrounding property as commercial and low density multiple family . 2 . The proposal is compatible with the commercial uses to the north and east . The proposed multi -family use can be considered an appropriate buffer between the commercial uses to the north and east and the single family uses to the south and west . 3. All of the lots in the proposed short plat meet or exceed the minimum requirements of the Subdivision Ordinance for size and frontage . 4. Off-site improvements (curb , gutter , sidewalk , street paving ) have been installed along Sunset Blvd . NE , Duvall Avenue NE and NE 12th Street as part of the Central Highlands Plaza Shopping Center development . 5 . Suitable utilities are available to the subject site . However , the Utilities Engineering Division advises that a water main installation will be required on NE 12th Street. 6. The Fire Department indicates that all hydrants and access shall be installed and operable prior to any building construction . The water main shall be installed as per Water Engineering requirements and all future buildings shall meet the uniform fire code and national fire code requirements for occupancy type . 7 . Sufficient landscaping shall be installed on a 25-foot wide area for the length of all R2 zoned lots to serve as a buffer between the shopping center and the proposed multiple family use . In addition , an architectural -type fence of 6 ' height shall be constructed on the property line separating the R-2 and B- 1 uses to the north . (Ordinance #3152 dated August 18 , 1977 ) . 8. Future development of the R-2 parcels for other than duplex use will require Hearing Examiner approval of a special permit . In discussion with the applicant , 4-plex development is proposed for these lots . Additional comments of other departments are attached for consideration . M . DEPARTMENTAL RECOMMENDATIONS : Short Plat 330-79 and 331 -79 Based upon the above analysis , recommend approval of the requested short plats subject to the following conditions : 1 . Final Utilities Engineering Division approval of plans for installation of the water main noted on L-5 above . 2 . Installation of the fire hydrant and access as per the Fire Department comments . 3.
