He concluded by stating that, unfortunately, complaints from residents about loop activities are traded for complaints from parents and youth regarding heightened enforcement efforts. Mayor Shi`npoch added that she was the recipient of many phone calls this date complaining about loop enforcement activities. She indicated that suggestions offered by several callers were. those which have already been incorporated by the City and are being used or have been discarded. Chief Wallis stated that he is currently reviewing ordinances from other states and assessing suggestions to determine whether they are applicable. Concern has been expressed regarding allowable density of 35 units per acre in R-4 zone, which may be incompatible with the character and environment of the City. Hearing Examiner Decision: Approval with conditions. • PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on May '24, 1979, • PUBLIC HEARING: After. reviewing the Planning Department report, examining available information on file with .the application, and field checking,the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: .The hearing was opened on May 29, 1979 at 10:15 a.m. in the Council Chambers of the Renton Municipal Building.' • Parties wishing to testify were affirmed by the Examiner. • ' It was reported that the Hearing Examiner and' the applicant- had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Steve Munson, Planning Department, reviewed Exhibit #1, and entered the following additional exhibit into the record: - Exhibit #2: . Site Plan with staff comments The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: • John Strawbridge' • David Evans & Associates ' 200 S.W. Market Street Portland, Oregon 97201 • Mr. Strawbridge indicated concurrence in the report. He explained that Lot 1 is a remainder parcel to development currently occurring in Lot 2 of the parcel, and the request for short plat and exception for lot width to length ratio had been made to allow ' flexibility in conveyance of that property at a later date. • The Examiner requested the applicant's proposal regarding the greenbelt area along the Green 'Rivet. David Clemens, Senior Planner, indicated that because the greenbelt area is • located east of the railroad tracks, the area is consequently divided from the site. The • Examiner requested clarification of the request for exception which must be approved on the basis of evidence of physical conditions unique to this property. Mr. Strawbridge • noted that'the major portion of Lot 2 currently under development has a large proportion of building coverage and parking area and although there is an developed portion of Lot 2 ' located 'easterly of Lot 1, if Lot 1 were platted any 'deeper it would go beyond the guidelines of the exception request. He submitted the following plan into the record to illustrate the proposal: • a,. Exhibit #3: Site Plan for Lots' l 'and 2 • • The Examiner inquired if' Lot 1 could be shortened. • Mr. Strawbridge advised that shortening ?: the lot was feasible, but the proposed use would require the extra depth. ' .He also indicated his understanding that the area to the extreme east' of the site is unsuitable for parking lot use and due to setback requirements it is doubtful if structures could be located there. He also noted that standing water which exists on the extreme eastern portion of the site precludes use of the land for building purposes. . his F' 1 _a �. He then requested a final recommendation from the Planning Department • representative. Mr. Munson noted that a copy of the applicant's letter of request for exception had been inadvertently omitted from Exhibit #1 and the letter was entered into the record as follows: Exhibit #4: Letter: to Planning Department from applicant, dated May 3, 1979, regarding request for exception The Examiner requested further 'comments. Since there were none, the hearing on File No. Short Plat 346-79 and E-353-79 was closed by the Examiner at 10:26 a.m. FINDINGS, _CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters ,the following: FINDINGS: • 1. The request is for a two-lot short plat and an exception for lot width to length ratio. 2. The Planning Department report sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental • Policy Act of 1971, R.C.W. , 43.21.C. , as amended, the subject proposal was determined to be exempt by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal 'have been reviewed by all city departments affected by the • impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. . The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-730 of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The subject property is located on the east side of the West Valley Road about 450 feet north of S.W. 43rd Street. The site is zoned as M-P and is designated as Manufacturing Park and Greenbelt in the Comprehensive Plan: 9. The subject property was annexed into the city by Ordinance No. 1745, dated April 14, 1959. • The site is covered with grasses and some shrubs and a few deciduous trees. 10. Proposed Lot 1 is approximately 200 feet by 646 feet, or +3 acres. The area for proposed Lot 2 is 8.96 acres, an "L"' shaped parcel. Lot 1 depth is more than two arid one-half 'times, its width and therefore an' exception from the provisions of Section 9-1108.23. (F) 3. is required. 11. The construction which has occurred on' the original parcel 'was confined to what would be hot 2 under the proposed subdivision leaving the remaining parcel, Lot 1, undeveloped. 12. The proposed use is consistent with both the zoning and Comprehensive Plan designation Of the site as Manufacturing Park. It is also consistent with the adjacent land uses to the north and south. • 13. The off-site improvements required by the original site approval are awaiting the construction and completion of an LID along the West Valley Road. CONCLUSIONS: 1. The short plat' is compatible with surrounding uses, zoning and the Comprehensive Plan • designation for the area. The plat will permit the further development 'of the subject site in conformance with the .goals and objectives of the Comprehensive Plan, and the Green River Valley Comprehensive Plan in that it mill promote industrial growth and h -broaden the economic base of the Green River. The requested exception from the Subdivision Ordinance will permit the applicant to develop the subject site to its fullest potential. Because of the pre-existing construction on a portion of the subject site (Lot 2) the applicant would suffer undue hardship if not permitted the requested exception. 3. The Renton Urban Area Comprehensive Plan on page 7 states that industrial developments cannot be adapted to just any site. Exceptions are sometimes required to accommodate the site demands of industry. They can be granted if there will be no detrimental effects on adjoining property. The proposed subdivision and the exception will not cause any adverse effect. 4. The granting of the exception will permit the applicant to use this property for industrial .development and will not grant the applicant a special privilege. The exception will permit the applicant to use his property as other property owners in the vicinity have used theirs. DECISION: The short plat is approved subject to no further subdivision of either of the two resulting lots prior to constructing an interior public street to serve any new resulting lot. Land Use: The ,site itself is basically undeveloped. To the east is located the P-1 Drainage Channel and to the south are a few single family residences. To the west is the West Valley Road and the Green River. North of the subject site a new building is under construction. E. NEIGHBORHOOD CHARACTERISTICS: • The area is presently in a slow transition from undeveloped pasture land and filled land to commercial and manufacturing park uses. F. PUBLIC SERVICES: 1. Water and Sewer: There is an existing 12 inch water main situ- ated along the ,Puget Sound Electric right-of-way, along the easterly boundary-of the subject site. An existing 8'-inch sewer main is located along the same right-of-way. Storm sewer lines are not available; however, there is a drainage ditch east of the subject site. 2. It - is the staff' s belief that these contentions are -reasonable and that the granting of the exception would not be detrimental to the public's health, safety, or welfare. 5. Off-site improvements were required as part of the site approval. However, they have not been installed pending construction and completion .of an L.I.D. along the West Valley Road. 6. Clemens, Associate Planner City of Renton Municipal Building 200 Mill Avenue South Renton, ' WA 98055 SUBJECT: Exception Request for T & W Equipment/Howco Short Plat Dear David: As we discussed, this is to request an exception be granted from requirement (a) of paragraph 23 , F, 3 , Section 9-1108 , Chapter 11 , Renton Subdivision Ordinance. The subject property lies within an existing industrial area, and industrial uses require much more flexibility in lot size and shape than residential uses. We are of the opinion that the above mentioned requirement was intended for residential lots and should not apply to the subject short plat. There are physical circumstances affecting the subject pro- • perty in that existing buildings and appurtenances already cover most of the area contained in lot 2 of the short plat, and lot 1 becomes a remainder parcel. The proposed exception is necessary to insure the subject pro- perty rights and privileges enjoyed by other properties in the vicinity, and in our opinion will not be detrimental to the public welfare or injurious to other property in the vicinity.
