Nelson FILE NO. Short Plat 359-79, E-360-79, W-361-79 • LOCATION: Vicinity of 3714 Park Avenue North ' SUMMARY OF REQUEST: Applicant requests approval of a ,proposed two-lot short plat together with an exception to the Subdivision Ordinance for a 20-foot pipestem lot and a waiver of the required off-site improvements. • SUMMARY OF ACTION: Planning Department Recommendation: Approval of short plat and waiver; denial of exception subject to conditions. Hearing Examiner Decision: Approval of short plat, waiver and exception subject to execution of restrictive covenants. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on July 16, 1979. PUBLIC HEARING: After reviewing the Planning Department report, examining available 'information on file with the application, and field checking'the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 17, 1979 at 9:00 a:m. in the Council Chambers of the Renton Municipal Building. It was determined by the Examiner that the hearing should be, continued because receipt of Public Works Department staff comments had not occurred prior to the scheduled hearing. The Examiner requested an estimated date of receipt of .comments ,from Paul Lumbert, representative of the Public Works Department. Mr. Lambert indicated that comments could be transmitted in a timely manner to allow continuance for One week. The Examiner subsequently continued the hearing to July 24, 1979 at 9:00 a.m. to be held in the Council Chambers. of the Renton Municipal Building. CONTINUANCE: • The hearing was opened on July 24, 1979 at 9:00 a.m. in the Council Chambers of the Renton • Municipal Building. ' Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. David Clemens, Senior Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Short Plat as submitted • Exhibit #3: Short Plat File No. 078-77; Ernest Coleman (by reference) Exhibit #4: Short Plat with staff comments Referencing the departmental recommendation for dedication of, a 25-foot wide tract to the City of Renton for, future road development along the northern edge of the east half of Tract 99, the Examiner requested information regarding the remaining sideyard width between the dedicated property and the existing residence. Although Mr. Clemens was uncertain of the exact dimension of the remaining sideyard, he indicated that it may be less than the 20 feet required, and therefore may create a non-conforming lot. The Examiner requested'testimony by the applicant. Responding was: William 'T. Cook ' 1018 N. 36th Renton, WA 98055 File No. ollwrt Plat 359-79 Page'Two Mr. COok advised that if a 25-foot dedication on the northern boundary of the lot were required, a minimum 10-foot sideyard would remain between the roadway and the existing residence, and he objected to creation of such adverse impact to the existing resident. Mr. Cook inquired if costs for future construction of the roadway would be required of the existing property owner. Mr. Clemens confirmed that financial responsibility would be borne by the' abutting resident. Mr. Cook expressed his objection to the requirement which he felt would create an excessive hardship. The Examiner requested testimony in support or opposition to the application. There was no response. He then asked the Public Works Director, Warren C. Gonnason, if the department concurred in the recommendation to waive requirements of off-site improvements. Mr. Gonnason advised the department's concurrence. The Examiner noted that approval of the requested waiver would require execution of restrictive covenants agreeing to participate in any future LID in the area. The Examiner requested final Planning Department comments. Mr. Clemens indicated that although dedication and improvement of the roadway may appear to be a financial hardship for the applicant, the recommendation is. consistent with previous action required for future development by the Hearing Examiner in the near vicinity. The Examiner inquired if lots located within the east • half of Tract 99 have been developed. Mr. Gonnason advised that the property has been developed and the roadway constructed. The Examiner noted that new residential construction would not have been subject to a 10-foot sideyard setback. Mr. Gonnason ' advised that the residences are newly developed. The Examiner requested further testimony. Since there was none, the hearing regarding File No. Short,Plat 359-79, E-360-79, and W-361-79 was closed by the Examiner at 9:24 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a two-lot short plat together with an exception to the Subdivision Ordinance for a 207foot 'pipestem lot and a. waiver of the required off-site improvements. 2. The Planning Department report.sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in ' full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended,. the proposal has been determined to be exempt by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments 'affected by the impact of this development. 5. All existing utilities are available and in close proximity. 6. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-729 (G-7200)' of Title IV, Ordinance No. 1628, Code of • General Ordinances. 7. The subject property is located in the vicinity of 3714 Park Avenue North. The lot slopes upward from the west at about an 8% slope. 8. The Comprehensive Plan designates the area in which the subject parcel is located as suitable for single family residences. The zoning requires minimum lot sizes of 7,200 square feet. • 9. There is an existing single family residence located on the eastern portion of ,the subject property. The western portion of the property is undeveloped. The applicant • proposes to subdivide the parcel which would leave the existing house on a separate lot served by a pipestem extension for access to Park Avenue North. Both lots would meet or exceed the minimum lot area requirements. 10. The Planning Department has recommended that the exception for the pipestem lot be denied. • 11. Just north of the subject parcel is a private easement road which connects Park Avenue North and Meadow Avenue North. This easement is 17.5 feet wide and is gravel surfaced. It serves approximately six homes. The view of on-coming, southbound traffic on Park Avenue is obscured by—the crest of a hill. Short rs..at 359-79 Page Three 12. The Planning and Public Works Departments concurred in a recommendation that the applicant dedicate a 25-foot wide right-of-way in lieu of the pipestem extension for eventual road construction at this location. This dedication would then connect with the dedicated right-of-way to the east which is also 25 feet in width except for the extreme eastern portion which remains in private ownership. The objective of the dedication would be to eventually join the easement road north of the subject property and this 25 foot tract to create a public although substandard right-of-way. 13. The existing residence is situated only about ten feet from the proposed right-of-way and therefore this interior lot would become nonconforming as to its front yard if the dedication occurred. • 14. The applicant's.representative indicated objection to the dedication of the right-of- way. They did not want the existing residence to be subjected to the noise of the proposed roadway. The applicant also objected to the probable assessment Of costs of road construction. • 15. There are no off-site improvements in the area. • 16. The prior dedication of right-of-way does not run the entire length between Meadow and Park Avenues.' An existing residence at the east end adjacent. to Meadow Avenue was not involved in the dedication, and, therefore, the entire right-of-way is not available. • CONCLUSIONS: • 1. The proposed short plat. appears to be compatible with the general development trends in the area. The area is designated for single family development and moderate sized lots. The area is zoned for lots of at least 7,200 square feet. The proposed • lots will exceed the minimum requirements of the zone. 2. Public services and utilities are available and can be effectively extended to serve the one additional new dwelling contemplated by the proposed short plat. • 3. The approval of the proposed short plat appears to serve the public interest in that it is compatible with the Comprehensive Plan and the area's zoning and will in addition create a lot which in turn can provide an additional single family dwelling. 4. The issue remains as to whether this property and the general public would be better served by the dedication of additional right-of-way in addition to the already existing private easement to the north, or whether the proposed pipestem access would be better. • The private easement presently serves about six residences to the north.of the subject property and runs between Park Avenue North and Meadow Avenue.North. There has been no indication that this easement will be dedicated to the city soon. The proposed dedication of an additional twenty-five feet south of it would place the road within about 10 feet of the existing residence and create a non-conforming front yard and greatly inconvenience the present occupants and lessen both the quiet enjoyment of their property and the value of it. 5. Further, the rest of the right-of-way is not .entirely 'in city ownership and .would • • have to jog north at the intersection of Meadow Avenue North or the city would have to condemn property at the Meadow Avenue North end of the road, again encroaching on an existing residence. Also, the view at the Park Avenue end of the proposed road does not appear to be adequate for safe turning from the roadway onto Park Avenue North. • 6. The pipestem lot, therefore, appears to provide the better alternative to serve this proposed interior lot. There is no other reasonable alternative, and therefore, • • the property owner would be denied reasonable use of the property if the exception were denied. If required to dedicate right-of-way, the applicant would be denied quiet enjoyment of the existing residence. The private easement road appears to be adequately serving the residences upon it • at its present width. 'Further widening of it would burden other property owners by encroaching upon existing residences which don't have the option of relocating in respect to the proposed road. 7. Since there are. currently no off-site improvements in the area, the approval of a waiver of the required off-site, improvements is justified. In the event that the improvements do become justified in the, area, at some time in the future, the applicant will be, required to execute a covenant to, participate in a future LID initiated in the Short Plat 359-79 Page Four area. DECISION: Exhibit #2 is approved. • The exception for the pipestem lot is approved. The waiver from the required off-site improvements is approved subject to the condition that the applicant execute a restrictive covenant to participate in a future LID. HISTORY/BACKGROUND: The subject site was annexed into the City by Ordinance No. 2531 dated December 24; 1969. D. PHYSICAL BACKGROUND: 1. Topography : The site rises from west to east at approximately an 8% slope. 2. Soils : Indianola Loamy Fine Sand (InC) . Permeability is rapid; available water capacity is moderate ; runoff is slow to medium; the erosion hazard is slight to moderate. This soil is used for timber and for urban development . 3. Single family residences are located on several lots surrounding the sub- ject site. E. NEIGHBORHOOD CHARACTERISTICS : The area is generally single family residential in nature . F. PUBLIC SERVICES : 1. Water and Sewer : 8" sanitary sewers extend north-south on Park Avenue and along the easterly border of the property. A 6" water main runs north-south on Park and 3" mains are located along the northerly and easterly property lines. 2. Fire Protection : Provided by the Renton Fire Department as per ordinance requirements. 3. Transit : Metro Transit Route #142 operates along Park Avenue North within z mile to the south of the subject site and route #240 runs along I-405 with a stop approximately 3/4 of a mile to the southeast of the site. 4. Schools : Kennydale Elementary School is located approximately 3/4 of a mile to the southeast of the subject site and McKnight Junior High School is approximately 1 3/4 miles the same direction while Hazen Senior High School is within 32 miles to the southeast . 5. Recreation : Kennydale Lions Park is approximately one mile to the southeast of the site while the North Highlands Park is 1 3/4 miles southeast and Gene Coulon Memorial Beach Park is approximately 14 miles to the southwest . Topography : The site rises from west to east at approximately an 8% slope. 2. Soils : Indianola Loamy Fine Sand (InC) . Permeability is rapid; available water capacity is moderate; runoff is slow to medium; the erosion hazard is slight to moderate. This soil is used for timber and for urban development . 3.
