Investment Co. , Inc. - Short Plat 373-79 Dear George: Mayor Charles Delaurenti has requested that I write to you to clarify the situation with regard to short plat 373-79 Walker Mountain, Investment Co. , Inc. As I understand it, the Serras did not object to the dedication of the easternmost 30 feet of the subject property for the future construction of the extension of Monroe Avenue; however, they were concerned about par- ticipating in an L. I .D. for future installation of off-site improvements. The waiver was approved subject to those restrictive covenants, however we do not anticipate an L. I .D. on this portion of Monroe Avenue and; therefore, ho liability for the off-site improvements is anticipated. It .is anticipated that the county and/or the city in conjunction with the county, will construct this portion of Monroe Avenue for access to the county shops and proposed city shops. The only obligation that I could see for future installation of curbs, gutter and sidewalk would .be in the event the Serras- propose to develop their property further and desire to utilize Monroe Avenue as an access point. • I feel that the possibility of an L. I .D. for future installation of off-site improvements is extremely remote and should be of little immediate concern to the Serras. APPLICANT: Walker Mountain Investment Co., Inc. FILE NO. Short Plat 373-79, W-374-79 LOCATION: 3139 N.E. 4th Street. SUMMARY OF REQUEST: Applicant requests approval of a proposed four-lot short plat for commercial uses and a waiver of the required off-site improvements. SUMMARY OF ACTION: Planning Department Recommendation: Approval subject to restrictive covenants. • Hearing Examiner Decision: Approval subject to restrictive covenants: • PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on July 24, 1979. • PUBLIC HEARING: After reviewing the Planning Department report, examining available information On file with the application, and field checking the property and surrounding area, the Examiner • conducted a public hearing on the subject as follows: The hearing was opened on July 31, 1979 at 9:28 a.m. in the Council Chambers of the Renton Municipal Building. . Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. David Clemens, Senior Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: , Short Plat as submitted Exhibit #3: Short Plat with staff comments Referencing Section L.1, Planning Department Analysis, of, Exhibit #1, Mr. Clemens reported that the last sentence of the section erroneously states that because a portion of the . original property was sold in 1975'prior to adoption of the Subdivision Ordinance in 1977, the subdivision.appears legal. He advised that the Subdivision Ordinance, Ordinance No. 2667, was• adopted October 15, 1971, ,and therefore, the parcel previously sold must be included in the subject short plat due to requirement that any division of property subsequent to that date without city approval would violate the Subdivision Ordinance and the requirements of the ordinance must be met to obtain a building permit on any of the parcels. • Mr. Clemens entered the following. letter from the applicant: • Exhibit #4: Letter to Planning Department from George Pasco, Walker Mountain Investment Co. , Inc. , dated July 5, 1979, request for waiver. • Mr. Clemens reviewed the Planning Department recommendation contained in Section M. of Exhibit #1, and corrected it as follows: deletion of Section M.1 which requires receipt of deed or title certificate showing ownership of the east 30 feet of the original parcel; .and revision,of Section M.3 .which recommends granting a deferral of off-site improvements to recommendation for waiver of off-site improvements including installation of sidewalks on N.E. 4th Street and all street improvements on Monroe Avenue subject to execution of restrictive covenants. The Examiner inquired if the owner of Parcel No. 4, the Alexanders, are aware of the revised Planning Department recommendation. Mr.. Clemens advised that revisions had been discussed . He advised that due to impending condemnation by. the city of the existing building, • Alexander's Auction House, the property was purchased under duress by the Alexande 's iwho had been lessees until that time. He indicated that _the complaint had been subsequently dismissed because of subdivision of land and read into the record a t "Dismissal of Complaint" document signed by Public Works Director, Warren C. Gonn$''son, • for the Board of Public Works, dated June 30, 1976. As a result of the dismissalkand purchase of the parcel, the applicant had not included that portion in the proposed three-.lot short plat and he felt that a requirement for dedication of street right-of-way . on property not owned by the applicant was unreasonable. Mr. Pasco advised that compensation for property on the east side of Monroe Avenue was under negotiation by the county, and he felt that similar compensation should be made to the owner of the right- of way property on the west. The Examiner inquired regarding ownership of property included in the requested .short.plat. ' Mr. Pasco reported that the applicant owns Lots . No. 1 through 3 designated on Exhibit #2, and the Alexanders own the 196-foot parcel west of Monroe Avenue. Responding to the 'Examiner's inquiry regarding ownership of the , right-of-way, Mr. Pasco indicated that ownership has not yet been determined, and records do not reveal if the property has already been dedicated to the city or county. .The Examiner requested testimony in support or opposition to the' application. There was no response. He then inquired if the Public Works Department representative could provide information regarding ownership of the parcel proposed for dedication. Paul Lumbert, Traffic Engineering Division, indicated that the department had no information. The Examiner advised the necessity of continuing the public hearing to allow receipt .of a legal opinion from the City Attorney to determine 'legality of the previous short plat, the statute of limitations if subdivision is determined illegal, and whether the applicant' should be required to dedicate property that he does not own. He inquired if parties of record objected to a continuance of one.week. The applicant indicated his concurrence in the request. It was determined that the Planning Department would obtain a legal opinion prior to the next public. hearing date of August 7, 1979. The Examiner also requested all documents from the Public Works Department pertaining to the dismissal of complaint in 1976. • ' The Examiner requested' further comments. Since there were none, the hearing on File No: Short Plat 373-79 and W-374-79 was closed at 9:50 a.m. and continued to 9:00 a.m. on August 7, 1979. CONTINUANCE: The hearing was opened on August 7, 1979 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. • The Examiner inquired if a response regarding legality of the prior subdivision of property had been received from the City Attorney. Mr. Clemens advised that .a response had not been received. The applicant, Mr. Pasco., indicated the possibility of including the property owned by the Alexanders as Parcel No. 4 in the proposed short plat. The Examiner reviewed ownership of parcels included in the application, and advised his preference to continue the public hearing 'for another week to determine the legality of prior sale and subdivision of the property and the effect upon potential dedication of the eastern 30 feet for right- of-way purposes. , Although Mr. Pasco stated the delay was an inconvenience for all parties involved, he concurred in the Examiner's request. Mr. Clemens read and entered the letter from the attorney into the record as follows: Exhibit #5: Memorandum to David. R. Clemens, Planning Department, from Lawrence J. Warren, City Attorney, dated August 8, 1979. The letter indicated that failure to comply with city and state subdivision requirements would preclude, the city from granting appropriate permits to the applicant for future development. Mr. Clemens advised that as a result of the attorney's opinion, an affidavit of ownership had .been received from the parties of ownership indicating the Alexanders as applicants .in the requested short plat. The affidavit and the applicant's revised short plat were entered into the record as follows: Exhibit #6: Affidavit of Ownership by Alexanders • Exhibit #7: Revised Plat as Proposed by Four Applicants Mr. Clemens reviewed the ownership of .the proposed short plat which designates Walker Mountain, Inc. as owners of Lots 1, 2 and 3, and the Alexanders as owners of the area previously owned by them plus 30 feet on the easterly boundary previously owned by.the Serras . He advised that the area contained in the revised plat is 4.25 acres, is bounded on the westerly side by a private access extending north and south to.the King County Health Services building and King County transfer station, and on the east by Monroe • Avenue S.E. Mr. Clemens indicated that the city has obtained a final decree for the easterly 30 feet of right-of-way on Monroe Avenue S.E. , and the Planning Department recommends dedication of the 'eastern 30 feet of the subject short plat for provision of a full public right-of-way on -Monroe Avenue S.E. extending to N.E. 4th Street which will serve proposed commercial uses on the subject site from approximately 40 acres of multifamily residential property to the south. The Examiner requested testimony by the applicant. Mr. Pasco clarified that Lot No. 4 included in the request has two ownerships, and the owners of the 30-foot strip on the easterly boundary, the Serras, intend to dedicate it to the Alexanders, current owner of property containing Alexander's Auction House. He advised that Monroe Avenue S.E. is not designated in city or 'county maps as a city street, and felt that compensation should be made by the city for acquisition of the property. The Examiner requested clarification that proposed lot No.. 4 will contain the 30-foot strip of property currently being dedicated by the Serras to the Alexanders. Mt. Pasco confirmed the Examiner's inquiry, and requested .that the plat be approved subject to future litigation regarding the 30-foot strip of property in question. The Examiner inquired regarding current and proposed use of Lots 1, 2 and 3. Mr. Pasco advised that Lot No. 3 currently contains Eric's Auto Rebuild, Lot No. 2 is not.yet sold, and Lot No. 1 is tentatively sold for the purpose of an automobile-related use in conformance with the allowable L-1 zoning. • The Examiner requested testimony in support or opposition to the request. There was no response. He then requested final comments or recommendations from the Planning Department. Since there was no response, the hearing regarding File No. Short Plat 373-79 and W-374-79 was closed- by the Examiner at 9:23 a.m. FINDINGS, CONCLUSIONS & DECISION: . Having reviewed the record in this matter, the Examiner now makes and enters the following: . FINDINGS: • • 1. The request is for approval of a four-lot short plat consisting of 4.25 acres in the vicinity of 3139 N.E. 4th Street together with a waiver for the required off-site improvements. 2. The Planning Department report sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. • 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971,' R.C.W. 43.21.C. , as amended, the subject proposal has been determined exempt from the threshold determination by Gordon Y. Ericksen, responsible official. • 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this .development. 5. There was no opposition to the proposal expressed. Sho__ 2lat 373-79 Page Four 6. All existing utilities are available and in close proximity. • 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-712 of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The subject property is slightly downward sloping from north to south at about a 3% to 5% grade. The areas' of the site which are not developed are covered with scrub grasses. There are two main structures on the property, one on the eastern-most of the proposed lots, Alexander's Auction, and a smaller -structure on the lot next to Alexanders. • The Puget Sound Power and. Light Company easement runs at an angle across the east central portion of the subject property. 9. A variety of circumstances surrounding the history of the subject property has created the need for an amended short plat. The entire 4.25 acre parcel had been in.single ownership prior to. 1975. The property, without benefit of Renton short plat procedures, was divided into three properties. That short plat was unregistered and unlawful. The applicant in this original proceeding then attempted to short plat one of the illegally divided lots,. ' The City Attorney advised that the city could not take any action on the illegal lots until they were appropriately and legally divided. The applicant then amended the original application to include all owners and all of the property previously sold.or held by the original owner/divider. The applicant is therefore requesting approval of the four lot short plat evidenced by Exhibit #7. 10. The property is zoned L-1 (Light Industry) and the Comprehensive Plan indicates that the area in which the subject property is, located would,be suitable for either extrac- tive industry -or manufacturing. The Planning. Department report determined that the • area was suitable for public or quasi-public development. 11. The'neighborhood is in transition from generally undeveloped and low intensity uses to- a mixture of multifamily, commercial and light industrial uses. The Renton' Vocational Technical Institute is north of the site and automotive repair shop exists to the east. The south is occupied by a gravel pit and the Southeast King County Health District office is West of the site. 12. The property is bounded on the east by the proposed Monroe Avenue S.E. right-of-way. The Planning Department, concurring in the Public Works Department recommendation, requested dedication of the eastern-most 30 feet of the subject property for the Monroe Avenue S.E. right-of-way. The applicant indicated that such dedication is inappropriate and unacceptable to the property owner. The Planning Department indicated that the subject property will benefit by the proposed street because the subject property will be, accessible from 40 acres of expected multifamily development to the south via Monroe Avenue S.E. 13. The proposed lots will be used for the continued operation of Alexander's Auction, and two automobile-related uses and an unspecified commercial use. 14. The Planning Department recommended that the waiver be granted because off-site improvements have generally not been installed in the area. • CONCLUSIONS: , • 1. The subject proposal appears to serve the public interest. It will create four lots, one already occupied by Alexander's Auction, and the others to be developed for uses suitable for the area. The automobile-related uses will be compatible with surrounding uses ,and the L-1 zoning of the subject. property. 2. The proposal, will also permit the development of more diverse uses in the area and, create the .climate for a more stable economy. The subject proposal will also permit the 'subdivision of property which for all intents had previously been treated as subdivided and sold into separate ownerships. 3. Since the area in which the subject property is located has not been improved with the required off-site improvements, it would, be logical to permit the applicant to delay .the installation of off-site improvements until such time as they are required and installed in the area. Because the time frame for such installation is not known it would therefore be appropriate to waive the requirement subject to the execution of a restrictive covenant to participate in an LID for such improvements. • 4. The proposed uses. of the subject property are both an automobile rebuild facility and automobile related facility. In addition, a commercial use is also proposed for the subject property. The existing Alexander's Auction also generates automobile and truck traffic. The subject property,with its proposed and existing uses is located at the intersection of N.E. 4th Street and the proposed Monroe Avenue S.E. right-of-way. Short 373-79 Page Five The uses will generate traffic in the area as well as serve the proposed multifamily uses which are expected to develop south Of the. subject property. Under these circumstances .the subject property will be adding to and burdening the carrying capacity of the intersection and the applicant will be required to dedicate the eastern-most 30 feet of the subject property for the proposed Monroe Avenue S.E. right- of-way. DECISION: exhibit #7 is approved subject to the dedication of the eastern-most 30 feet of the subject property. • The waiver is approved subject to the execution of restrictive covenants 'to participate in an LID for future installation of off-site improvements. The city is required by state law to develop a pro- cedure for the handling of this type of application and this is likewise an ongoing requirement. If one fails to meet the state requirements , and : by implication , the city requirements , they are not permitted to avoid the law. While the law provides for a criminal citation for violation of the law , the normal statutes of limitation would not be applicable. It is therefore my opinion that any person attempting to obtain a building permit or other permit from the city of Renton must first meet the state law with respect to sub-division. Clemens RE : REQUEST FOR ADDITIONAL INFORMATION: HEARING EXAMINER: WALKER MOUNTAIN SHORT PLAT, FILE No. 373-79 At the public hearing held on July 31, 1979, the Hearing Examiner requested further information on the above referenced short plat . The subject plat is a portion of a parcel which was in single ownership until May 28, 1975, at which time Tract A was sold to another party. This parcel left a 30 foot parcel to the east and a larger parcel to the west of Tract A. Subsequently, Walker Mountain Investment purchased the parcel to the west , and this parcel became the requested short plat (to be divided into Parcels 1 through 3 as noted on the attached) . The Hearing Examiner' s question concerns whether the statute of limitations would apply to the short plat application, or whe- ther the entire parcel which was in existence prior to May 28 , 1975, must be included in the short plat . If the statute of limitations applies, does the 30 foot parcel located east of Tract A, but which is noted in the Assessor' s records as being a part of Parcels 1 through 3, also fall beyond the statute of limitations. If the statute of limitations does not apply, it would app'ear that this division, which occurred after adoption of the City ' s Subdivision Code (Ordinance 2667 of October 4, 1971) , would require that the entire original parcel be included in the current short plat application. As such, it would also appear that Section 9-1105,9 prohibiting construction permits would also apply to the parcels in question. We would appreciate your opinion on this matter so that the Hearing Examiner may consider it at the continued public hearing scheduled for August 7, 1979. C. HISTORY/BACKGROUND" The subject site was annexed into the City of Renton by Ordinance No. 2249, dated June 22, 1966. It was rezoned from "G" ' to L-1 by Ordinance No. 2319, dated April 10, 1967. D. ' PHYSICAL BACKGROUND: 1. Topography: The site slopes slightly downward from north to south at approximately a 3% - 5% grade. 2. Soils: Arents, Everett material (Ar) . Permeability is rapid, and available water capacity is low. Runoff is slow, and the erosion hazard is slight. This soil is used for urban development. 3. Wildlife: The existing vegetation may provide some habitat for birds and small mammals. 5. Water: No standing water was evidenced on the subject site. 6. Land Use: The subject site is undeveloped at this time except for an existing building on proposed Lot #3. A Puget Power transmission lines easement traverses the site in a northeast- southeast manner at the southeast corner. The Renton Vocational Technical Institute is north of the site with an automotive repair shop to the east. To the south is a gravel pit and the Southeast King County Health District Office is west of the property. E. NEIGHBORHOOD CHARACTERISTICS: The area is in transition from generally undeveloped and small intensity uses to a mixture of multiple family, commercial and light industrial. F. PUBLIC SERVICES: 1. Water and Sewer: A 16 inch water main and an 8 inch sanitary sewer extend east-west on N.E. 4th Street adjacent to the subject site. 2. City of Renton Fire Department. L. PLANNING DEPARTMENT ANALYSIS: 1. The ±2. 81 acres was originally a portion of a larger ±4. 25 acre parcel owned by Mr. and Mrs. Ben Serra. Approximately ±1.34 acres was sold to Mr. and Mrs. Lester Alexander on May 28, 1975 (Recorded June 2, 1975) . This sale, was the result of a series of health and hazardous building code complaints dealing with the structure housing Alexander's Auction. This contract sale was before the effective date (February 2, 1977) of the Renton Short Platting Ordinance No. 3105, therefore, it appears that the 1975 sale was legal. 2. The 1975 sale appears to have taken a portion out of the middle of the original ±4.25 acre parcel and left two unconnected portions. The small parcel on the east side of Alexander's Auction is actually the right-of-way necessary for Monroe Avenue. However, no documentation can be found that transfers the deed on the property from the Serra's, Alexander's, or Walker Mountain, Inc. to the City of Renton. The assessor's maps show it as being a portion of Tax Lot 52; however, the Assessor' s Micro Fiche specifically excludes it in the legal description of Tax Lot 52. 3. On the west side of the proposed short plat is a private access road owned by King County to service their maintenance shops, gravel pits and solid waste transfer facility. 'The Walker Mountain Investment Company has obtained written permission to access the private road. (See attachment) 4. Street improvements and curbs and gutters are completed on N.E. 4th Street. Sidewalk improvements still have to be completed. M. DEPARTMENTAL RECOMMENDATION: The staff recommends that the short plat be approved and the request for waiver of off-site improvements be denied subject to the following conditions: 1. Receipt of Deed or Title Certificate showing ownership of the east thirty feet of the original parcel. 2. Dedication of that thirty feet if it has not already been dedicated to the City of Renton for street and utility purposes. 3. Granting of deferral of off-site improvements subject to the filing of restrictive covenants running with the land which state that the property owners shall participate in and future L.I.D. for street improvements specifically the construction of a sidewalk. 4.
