Ericksen., Assistant Planner James Magstadt. The regular meeting of the Renton Planning Commission was called to order by Acting Chairman Gerald Cordell at . 8 : 00 P.M. It was moved by Racanello, seconded by Bardarson , that the Minutes of the previous meeting of November 10 , 1965 , be approved as written. Motion carried. HEARINGS: 1. REZONES: A. CHARLES SHANE, APPL. NO. R-263-65 , request for rezone from R-3 to B , property on Maple Valley Highway adjacent to and east of Stoneway Dock. Committee report: Recommend approval. Staff report: Recommend approval. Chairman Cordell asked if there were any comments or objections from the audience to the granting of this rezone. Mr. John Day, attorney representing Mr. Edwards , displayed a map of the area in question. He pointed out that the applicant had changed the line of the river bank from its original position by the placement of fill dirt, thus increasing the width of his - property. He stated that according to the previous line shown for the river bank, the property proposed for rezone would be too narrow for development to business., and in..:effect was; atkiivto re- zone property which he did not own. He quoted from State laws. rela tive to the ownership of river banks . Mr. Day also stated he-felt the proposed B-1 zoning would be improper planning for this area , since the area is too narrow to develop in depth, that it is adjacent to apartments on the south, and would create hazardous traffic con- ditions on the already congested Maple Valley Highway. He urged that the proposed rezone be denied at this time. Mr. Stredicke questioned if anything could be done , about the supposed encroachment unless the case would go to court to prove that it is actually State property. He felt that the consideration should be whether or not the proposed rezone is a proper use. Mr. Teegarden felt that some of the points, brought out should be given further consideration, particularly relative to the number of small spot zones in this area. It was then moved by Racanello, seconded by Teegarden, to con- tinue this hearing until the next hearing meeting of December 22 . Motion carried. 0 ENZA ANDERSON, APPL. NO. R-265-65 , request for rezone from R-2 to 1:77 property on Marion Avenue between 3rd Place North and Houser Way. Committee report : Recommend approval. Staff report: Recommend approval . The proposed rezone agrees wit the Comprehensive Plan. The subject property is adjacent to the railroad tracks on the east and a : main arterial to the west. 1- Renton Planning Commission November 24 , 1965 Page 2 1, B, Continued: Vi The Chairman asked if there were any objections or comments from the audience, Mr, Robert Smith, acting for the Applicant, Mrs. Anderson, stated that this proposal is in agreement with the Comprehensive plan, The applicant wishes to rezone this for a business purpose, because the property, is too small to use as R-2 . Mr, Stredicke questioned if setbacks were necessary in the L-1 zone, It was stated that no setbacks were required in an L-1 zone . Some discussion followed relative to a possible realignment of streets coincident with the completion of the North Renton Inter- changes and a possible change of street patterns. Mr. Ericksen stated .that' he was under the impression that all of the property shown on the plot plan had been included in the re- zone proposal , but now it appears that Lots 11 and 12 were not in- cluded, Mr, Mike Potosnick, owner of Lots 11 and 12 , stated that he had no objection to the rezone of Anderson property , but that he had no plans for the rezone of Lots 11.:arid .12 at this time. It was then moved by Teegarden, seconded by Bardarson, that the hearing be closed. Motion carried. It was moved by Teegarden, seconded by Racanello, that the re- zone be recommended to the Council for approval . Motion carried, 2 . VARIANCES: A. KEITH NOBLE , APPL, NO, V-267-65 , request for carport can- opy at 125'25 .ainier Avenue, Committee report: Verbal report was given by Mr. Teegarden, who statethat he did not like the idea of having to approve some- thing after it has already been accomplished. This canopy would project into the setback 9feet. If this is approved then someone else will request further extensions into the setback. Staff report: Recommend the Variance be granted. The can- opy, as proposed would not project into the setback as far as signs on either side of the petitioner. (The staff suggests that the parking arrangement on the eastern side of the building be changed to avoid backing onto Rainier Avenue, ) In the discussion that followed it was noted that the problem of backing on the street was a separate problem, that of enforcement of the code. Mr. Stredicke suggested that the Secretary write letters to the Mayor, the Police Department , and the Building De- partment regarding this matter, Mr. Ericksen stated that no building permit was requested for the carport canopy and a "'stop work" order was placed on the con- struction when the Building Department became aware of it. After further discussion it was moved by Racanello , seconded by Bardarson , to close the hearing. Motion carried, It was moved by Bardarson , seconded by Sterling that the request for Variance be recommended for approval.
