HomeMy WebLinkAboutLUA65-270k_ OFT ORDINANCE NO. 2 6(1 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, CHANGING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY WITHIN THE CITY OF RENTON FROM SUBURBAN RESIDENCE DISTRICT (S-1) TO RESIDENTIAL DISTRICT (R 3) WHEREAS under Chapter VII, Title IV (Business Regulations) of Ordinance No. 1628 known as the "Code of General Ordinances of the City of Renton", as amended, and the maps adopted in conjunction therewith, the property hereinbelow described has heretofore been zoned as Suburban Residence District (S-1) and WHEREAS a proper petition for change of zone classification of said property has been filed with the City Clerk on or about November 29, 1965, which petition was then duly referred to the Planning Commission for investigation, study and public hearing, and a public hearing having been held thereon on or about December 22, 1965, all pursuant to notice of hearing duly published and posted as provided by law; and said matter having been duly considered by the Planning Commission, and said rezoning being in conformity with the City's Comprehensive Plans., and all parties having been heard appearing in support thereof or in opposition thereto, NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON AS FOLLOWS: SECTION 1: The following described property in the City of Renton is hereby rezoned to Residential District (R-3); the City Engineer and the Planning Director are hereby authorized and directed to change the maps of the Zoning Ordinance, as amended, to evidence said rezoning, as follows: Lots 5, 6, 7, 8, 9, 10, 11 and 12,' Block 19, Latimer's Lake Park Addition,, according to plat recorded in Vol. 18 of Plats, Page 63, in King County, Washington; property located on 90th Avenue South between South 128th and South 127th Streets, SECTION II: This Ordinance shall be in full force and effect from and after its passage, approval and legal publication. Continued: City Engineers ' letter was read stating that in the review of plan submitted by Pacific Coast Railroad for development of proper- ty in the Earlington Flats area, the following objections were rais- ed: 1) Proposed plan does not include the extension of 87th Avenue South from 7th Avenue South to Grady Way as shown on the City' s adopted Arterials and Streets Plan. 87th Avenue was cited as an important part of the circulation pattern in the development of the industrial area. 2) Also , the plan indicates a lack of circulation for emer- gency access needed for good fire and police protection. Further, the deadends shown do not make provision for turn- arounds . Planning Director Ericksen stated that the request is two-fold : rezoning and platting, and should be considered separately. The points raised in the City Engineer' s letter was a matter related to platting. Mr. Eckart , Railroad official present , requested that the Com- mission give consideration to both of the problems at this meeting. The Commission discussed both the original plan and the revised development plan. Mr. Ericksen stated his objection to the revised plan which showed no connection with Grady Way and that a through street should ' be provided , to the overpass of the Freeway. He felt that the original plan would be more feasible. Planning Commissioners were in general agreement that the rezone proposed was in accordance with comprehensive planning for this area. It was then moved by Stredicke, . seconded by Denzer, that the hearing on the rezone be closed, and that hearing on the plat be con- tinued. Motion carried. Mr. Stredicke then moved , seconded by Racanello , that the rezone from G to M-P be recommended to the City Council for approval. Mo- tion carried. Mr. Busch voted no. It was moved by Denzer, seconded by Stredicke, that a meeting be held between the Commission, the Planning Director, City Engineer, and the Pacific Coast Railroad officials relative to the platting development plan, and the hearing be continued to January 12 on this matter. Motion carried. C. CHARLES MATTAINI AND E. R. COLEMAN, APPL, NO. R-270-65 , re- z ne rom S-1 to R-4 , property located on 90th Avenue S . between Sou h 128th and South 127th Streets. Committee report: Recommended that this property is not suit- able for development to R-4 , but could be recommended for R-3 . Staff report : Mr. Ericksen stated that he felt that the only problem in the R-4 classification would be the height limit. Since the area across the street is a good single family residential area, the R-4 might be detrimental, but R-3 would be feasible. Mr. Coleman, one of the applicants present, stated that they have no intention to build to 90 ' , as they would not wish to obscure the view from surrounding properties , or to endanger property values, but in view of mounting property values , the Commission should give consideration to the allowance of more coverage of land in the Renton central area. He stated that the property is 20 ' below the Planning Commission December 22 , 1965 Page 3 1, REZONES : C. Continued : street grade , and a height allowed by R-3 (40 ° ) would not be detrimental to the properties across the street . Chairman Garrison invited comments from the audience. Mr. Wilson, property owner to the south of the subject property, stated he was in agreement with R-3 zoning for the subject prop- erty, Mr. Rouse, property owner immediately above the subject property property expressed concern relative to parking if the R-3 is approved , and also questioned if 91st would be improved . Mr. Coleman stated that in connection with the proposed de- velopment of the property , 91st Avenue ,which now deadends at the property,would be extended and improved to standards necessary to serve the apartments , who would be the only users of the ex- tended street. Relative to parking , building permits could not be secured without an adequate ingress and egress and parking plan. The applicant was questioned if R-3 zoning would be accep- table, Mr. Coleman stated that they would prefer R-4 , but would accept the R-3 zone if this is the recommendation of the Commission. It was then moved by Bardarson, seconded by Denzer, that the hearing be closed. Motion carried. It was moved by Denzer, seconded b Racanello that the Com- mission recommends to he City Council the rezone ofhet proertpy from S-1 to R-3 . Motion carried. 2 , VARIANCES : KEITH NOBEL, APPL, NO, V-267-65 , continued hearing on request for arport canopy to wit in of_. required 20 ' setback at Rainier Avenue, Committee report: Mr. Teegarden stated that he still objec- ted to e projecion of the canopy into the setback in that it is more of a permanent structure than a sign, and that he felt the Commission should hold the line on this. Staff re ort : Recommendation was the same as at the Nov, 24 meeting ; w is was that the Variance be granted , since accord- ing to the Ordinance compliance with the 20 °- setback need not be complied with if more than 60 percent of the existing build- ings within the block have maintained less than 20 ° , Mr, Ericksen stated this is the case here. Relative to the question of parking arrangement on the east- ern side of the building,raised at the last -hearing meeting, a letter was read from Del Bennett , Traffic Engineer, Mr, Bennett stated that the present arrangement , whereby cars back over the sidewalk onto Rainier Avenue from the Drive-in, creates a hazardous condition and interferes with traffic circulation within the Drive-in. He has suggested to Mr. Noble that the two stalls on the east end of the building be posted for two wheeled vehicles only.
