Bartells Building) Applicatio No. SA-614-69 REVISED Gentlemen: The Planning Commisson, as required by City ordinances, reviewed ' the site plan of the Hugh S. Ferguson Company as initially submit-ted on June 25, 1969 at its meeting of July 9, 1969 . Due to in- herent problems, wit specific reference to the parking layout andthelandscapeplan, he application was continued to the meetingofJuly23rd. The P anning Commission, however, at the request of the applicant, reco ended that a partial building permit for: foun- dations only be issued so as not to hold up construction resultinginanyunduedelayfortheapplicant. Such permit was issued on the basis of the pla s presented, allowing the company to move ahead .on constructio At the Planning Comm ssion public hearing meeting of July 23, 1969 , a detailed review of the proposed site plan was made. The site plan provided parking, spaces for 104 vehicles excluding the truck loading area. The present ordinance, however, requires the pro-vision of 145 spaces The proposed plan indicated the acquisition of additional properly (44 feet) at the southerly end of the building. The Commission, upon completion of its review,. 'approved the plan subject to the posti g of a bond guaranteeing the purchase of ad- ditional land with a recommendation that a reduction in the number of parking spaces be allowed in the form of a variance and the re- quirement of minor r-visions to the landscaping plan. The Hugh S. Ferguson Company com lied with the request of the Planning Commis- sion regarding the p sting of the bond and the necessary plan re-visions. A variance reducing he number of parking spaces was granted by theBoardofAdjustmentnAugust20, 1969. At this time, a revised plan was submitted b the Hugh S. Ferguson Company. The Board of Adjustment refused t rule on the acceptability of the revised plan since such plans are subject to approval of the Planning Commission. Mayor and City Council October 20, 1969 Page 2 The revised plan was t en resubmitted to the Planning Commission at its September 10 , 1e69 meeting, and the matter was continued to the September 24th rearing date in order to allow the Commis- sion time to study the revised plan in detail. The revised plan under consideration deleted the acquisition of the additional area previously agreed upon by the Hugh S . Fergu- son Company and indica ed parking in the truck loading area. The parking layout provide) parking spaces for 95 cars in accordance with the variance gran ed by the Board of Adjustment. The appli- cant proposed that he ;•urchase only twelve feet of the additional area south of the building and provide an easement for an addi- tional twelve feet in order to gain access to the required park- ing stalls at the sout erly end of the building. The Commission objecteo to the revised layout since it deleted one tier of parking spaces at the southerly end of the building and allowed parking in the truck loading areas where the access to said parking spaces wo ld be in conflict with truck movements . On July 9, 1969 the Planning Commission approved granting of a. partial building permit for foundations only for the E. Jo Bartells Building being constructed by the Hugh S. Ferguson. Company, subject to compliance with engineering and planning requirements. On July 23, 1969 the Hugh So Ferguson Company presented a performance bond in the amount of $14, 300 guaranteeing purchase ofadditional property to fulfill parking requirements. Planning Commission approval of the site I plan presented at that time was subject to inclusion of a termina- tion date on the- performance bond, the satisfactory acquisition of variance from the Board of Adjustment reducing the parking require- ment (although the additional strip of land would still be needed in order to avoid -parking in the loading -and unloading area) , and the submission of an acceptable landscaping plan. On August 20 , 1969, petition for reduction of number of .parking stalls from 145 to 98 was heard- .by the Board of .Adjustment. The applicant also petitioned the Board to act on several alternate site plans pre- sented at the meeting... The.. .Board of. Adjustment granted' the vari- ance for parking requested, but refused jurisdiction on site plan approval. The Assistant Planning Director displayed both the original site plan approved by the Planning Commission on July 23, 1969 and the revised site plan on which the applicant is requesting approval at this time. It was noted that. only 95 parking stalls were shown rather than the 98 which are required, some of which were located in the truck loading area. The applicant proposes to purchase an additional 12 feet of area along the south property line and acquire an easement for an additional 12 feet of area which would permit some of the required parking stalls. L?:,;.',A ,AT• Renton Planning Commission Meeting September 24 , 1969 Minutes - Page 7 Mr. Keith Baldwin, attorney for the Hugh S. Ferguson Company, spoke on behalf of the -revised site -plan.. He stated that 98 stalls were far in excess of what would be .needed for. employee and visitor park- ing for the use proposed, and that while parking stalls would be lined in the truck loading area, he felt 'they would not actually be used and therefore' no conflict would occur. Mr. Glen Lansing, representing the applicant, spoke on behalf of the revised .site plan. He stated' the requirement of purchase of additional land would work an economic hardship on the applicant, and he felt the revised plan would be- entirely acceptable and workable . r-°r. Hugh S. Ferguson, the applicant, also spoke on behalf of the revised plan. He stated he submitted the performance bond in order to get temporary approval; that he did not wish to purchase the additional 44 feet of property because of the expense involved. He stated that he bid on the construction on the basis of being able to park in the truck loading area and the purchase of addi- tional land did not figure in the bid price. Considerable discussion ensued among Commission members and the applicant and his' representatives. The applicant was asked why he did not voice these objections at the previous Commission hear- ing. Mr. Ferguson stated he felt if he could get temporary approval he could work out the parking problem later either through a vari- ance or by approval of a revised site plan. Commission members stated they felt they had been more than co- operative with the applicant. They had agreed to allow -less park- ing than was required by _ordinance, subject to granting of a variance by the Board of _Adjustment, inasmuch .as a new parking and loading .ordinance in process would cut the requirement for subject use. However, Commission members generally felt that to allow parking in the truck loading and .unloading area was extremely undesirable and- would -downgrade the manufacturing park environment being cultivated. in the area. Mr. Lansing asked if all other buildings in the Earlington In- dustrial Park were denied parking .in. the truck loading area. The Chairman replied that approval was given to one building to park employee cars in such vicinity; however, this arrangement subse- quently proved to be very detrimental. Therefore, the Commission feels that such previous - approval having proved to contain insol- uble problems precluded their granting like approval in the future. Sterling stated that where there are conflicts between passenger cars and trucks, whether it be dented fenders or people having to wait for a truck to move out of the way before being able to enter or leave a parking stall, the end result is that the passenger car is parked in the street, which is exactly 'what the Commission is trying to eliminate in the manufacturing park. environment; also, such on-street parking is contrary to Manufacturing Park Ordinance requirements. Mr. Baldwin and Mr. Lansing again spoke at length in defense of the revised plan with required parking shown in the truck loading and unloading area; their basis for such defense being the fact that the bays are 40 feet apart .which they felt would allow adequate room for car maneuvering. Mola stated he was unable to see where they would be able to fit the additional three required stalls (98 required, 95 shown) . Mr. Lansing worked with the plan briefly and then stated it was an architectural problem, but could be worked out. Upon request, the Assistant Planning 'Director read an excerpt from the Zoning Ordinance, 4-730-040 , 8 . , "Rail facilities or truck loading and unloading spaces shall not interfere with the use of required off-street parking areas" . Secretary Sterling read the letter requesting that the Planning Commission take under advisement their application for building permit and advising that the required variance for parking had been granted by the Board of Adjustment. The Planning Director stated that the Planning Commission had approved a site plan for the Bartells Building subject.. to. their application for a variance for parking, posting of bond guaran- teeing purchase of additional property for parking. purposes, and submission of an approved .landscaping plan. However, at the Board of Adjustment meeting on• the variance, the Hugh S . Ferguson Company presented two alternate site plans and requested Board of Adjustment action. The Board. of Adjustment refused jurisdiction on site plan approval, but .acted. on the variance request before them. The Planning Director displayed a revised site plan presented by the Hugh S. Ferguson Company showing a 24-foot easement of land along its southern property line. Mr . Gene Martenson, architect for 'the applicant, spoke on behalf of the revised, plan. Mr. Lansing, 4227 SW Donovan, Seattle, agent for the applicant, also spoke on behalf of the revised plan. Discussion ensued' among Commission members., the Planning Director and the applicant' s representatives, concerning the merits of each of the parking plans presented. It was .generally felt that inas- much as this request represented an entirely new appliication', ac- tion on the matter should be continued to the public hearing meet- ing in two weeks. Planning Commission. He briefly commented on the I advantages of the new plans - easier manueverability of vehicles, more area for landscaping purposes and the reduction in expense to the owners . ' After discussion with staff members present, the Chairman ruled that the question before the Board was• merely the determination of the number of ' parking stalls to be provided and the formula under which this would be established. Mr. Don Bodner, representative from the Great Northern Railway' Company, '. ', submitted a survey of the parking provided in the Earlington Industrial Park, and the daily usage by employees and visitors. Other speakers pres-, ent who generally verified what Mr. Lansing stated were: Arthur Anderson, ' architect with the firm of Anderson, Bjorstad, and Kane; Don Bodner, Great , '' ' . , .. Campbell ' addressed the Boardwithhispetition. After .a lengthy 'discussion in which all .factors were reviewed, it was the determination of the Board 'that they had no jurisdic-tion under which they could grant Mr. Campbell his request. It was the sug- gestion of the Board that he apply for a rezone of the property. This applies to set- f backs , landscaping requirements and parking. In the past, all f the plans as submitted met the minimum requirements . The staff 1 - is of the opinion that - the standards are not being maintained as there has been a gradual diminishing of efforts by industries in the area not only to install but maintain landscaping required. The ordinance does not contain any penalty clause; the primary i owner does not require maintenance by covenants in its lease agreements , and as requirements are minimal , conditions have worsened. In the particular matter at hand, the staff feels 1 the extent of curb outs proposed exceeds the maximum limits al- lowable by ordinance . Inasmuch as one-way circulation is shown, this could result in piling of traffic on SW 7th Street. In the s staff ' s opinion, this requires re-designing. As submitted , the plan would require the backing of trucks on the public right-of- way In order to meet the minimum parking requirements for the square footage of proposed building proposed., the additional. 40 foot strip of land would have to be acquired. ICommission comments were invited. Racanello asked for clarifica- s tion of the statement regarding backing of trucks on the public right-of-way. The Planning Director stated that while there is sufficient maneuvering room on the property, this space is being utilized to fulfill parking requirements . Upon query by Forgaard, Lyman Houk of the Engineering Department stated he had not had an opportunity to check compliance with engineering requirements . 1 Audience comments were invited . Mr. Andersen of Andersen, Bjorn-- stad and Kane, architects for the applicant , spoke on behalf of the proposed site plans . He stated that the minimum parking re- 1 quired by ordinance for this type of building is far in excess of 1 what the actual requirements should be in terms of numbers of em- s ployees and visitors to the building. Mr. Andersen defended the item of trucks backing on the public right-of-way and stated he did not feel this was any particular problem. He stated also that 1 if the parking requirement were less , there would be more maneu-- j veri_ng room on-site for trucks . Various alternative parking plans were discussed among Commission i members, the Planning Director and Mr. Andersen. s i Sterling stated he felt enough questions had been raised to warrant1continuingthehearingtothemeetingofJuly23rd. Several other I,Commissioners stated they felt that a partial building permit could be authorized for foundations , and that would permit the applicant j to proceed while the parking and traffic circulation problems were being' worked on. Ross asked if the plan does meet minimum requirements , does the Commission have the prerogative of demanding additional require- ments . The Planning Director stated that in cases with unique conditions , the Commission does have the right to require addi- tional requirements for setbacks , landscaping , parking, traffic I circulation plan, etc . Racanello and Ross indicated they would move to allow a partial tbuilding permit for foundations . Gypsum Corporation) is consolidating it ' s Seattle and Portland office and warehouse facility in the Earlington Industrial Park area . We feel that a loss of such a tenant would be a possible detriment to future expansion of the Park . Per the attached letter , we have available the additional property to meet the present parking code for the City of Renton . The balance of the project is per the setbacks and requirements of the Earlington Industrial Park . We will submit , the first of next week , the required plans so as to obtain the Planning Commission ' s approval on this project .
