City' s Population Letter from Mayor Delaurenti reported the Population Studies Dvn. of the State's Office of Program Planning and Fiscal Management requires the city to conduct a "high-confidence" sample census to determine the city's population for allocation of state-controlled per capita tax funds. The letter noted change in state requirements in January will not allow firefighters to complete. sample census within time as planned and provided in 1977 budget with $2,000 allocation. May Creek Trunk Letter from Deputy .Director of Public Works Bennett recommended Coun- Sewer cil concurrence in the 18 inch diameter of the May Creek Trunk sani- tary sewer and agree to no local (direct) connections to the trunk in lower May Creek area because of limited capacity. The letter • explained that restrictions imposed by EPA and DOE have limited the size of the May Creek trunk to 18 inch diameter when design figures indicate 24 inch diameter, that all agencies, Water Districts 107 and 90, Metro and the City, will continue to work for ultimate pipe size, however, there is a possibility of losing grant monies because of time deadline. The letter also stated the city is being asked not to re- quire Metro to accept all sewage when the line reaches capacity, which will be reached by the year 2,0001. The letter noted because land uses may change and other conditions may alter such as sewage disposal methods or a new route may be used by the year 2,000, the letter recommended granting of requests and Council concurrence, MOVED BY PERRY, SECONDED BY BRUCE, COUNC')IL CONCUR .IN RECOMMENDATION. Upon Council inquiry, Deputy Public Works Director Bennett explained by the year 2000 other measures should be developed to take care of the over flow. MOTION CARRIED. Mt. Olivet Way Letter from City Clerk Mead reported petition has been filed by Street Vacation James R. Colt, President of American Memorial Services, Inc, for street vacation of Mt. Olivet Way located :at the Mt: Olivet Cemetery, and that the required $100 filing fee received. The letter noted the petition has been certified valid by the Public Works Department and that the petition represents 100% of the property abutting the pro- posed street vacation. The letter recommended that the vacation request be referred to the Board of Public Works and Public Services Committee for determination regarding appraisal and 'payment by the abutting property owners and as concerns retention df utility ease- ments. (R-004-77) Dear Mayor and Council Members : Transmitted herewith is above-referenced recommendation which was heard by the Hearing Examiner on January 31 , 1977 and which appeal period has now expired. According to City Ordinance, the action of the Council on the above- referenced rezone, approving, modifying, or rejecting a decision of the Examiner,. shall be final and conclusive, unless within twenty (20) calendar days from the date of the action an aggrieved party or person obtains a writ of certiorari from the Superior Court of Washington for King County, for purpose of review of the action taken. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on January 31, 1977, at 1: 40 p.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were sworn. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record by reference. Gordon Y. Ericksen, Planning Director, summarized the Planning Department report and entered the following exhibits : Exhibit 1: Zoning Map. Exhibit 2: Land Use Site Map. The Planning Director reported that the Planning Department report recommends approval of the application. The Examiner asked for comments from the applicant, who indicated that he had no additions or comments . The Planning Director entered Exhibit 3 , a site scale map which detailed the existing house, driveway, and barn on the property. The Examiner questioned Mr. Spendiff regarding the size of the lot. The applicant reported that the property in the proposed rezone is 80 ' x 180 ' with the remaining property 85 ' x 330 ' . The Examiner noted that the existing driveway is very 'steep and inquired about the access to the abutting property. Mr. Spendiff indicated that access would be the decision of the new property owner, Mr. Green, and the owner would be submitting a request for short plat in the near future . The application for rezone is being submitted by the applicant to allow Mr. Green to submit a request for short plat. The Planning Director briefly summarized the history of the division of the property and indicated that originally the property was one tract owned by Mr. Wilson. The rear portion was platted in 1967 . The Planning Director noted that the reason the request for short plat R-004-77 Page Two was not being reviewed and heard at this time was that the other party was not prepared with his application. No opposing testimony was given. The hearing on Item R-004-77 was closed by the Examiner at 1: 50 p.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS : Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS : 1 . The zoning around the property is primarily single family residential designated by R-1 (7,200 square feet) , S-1 40 ,000 square feet) , and GS-1 (35 ,000 square feet) . 2 . The request is to rezone the existing lot that consists of an area of 14 ,400 square feet to SR-1 , minimum lot size 7 ,500 square feet. The request is made by the applicant to legally enable the adjacent property owner to request a short plat. 3. The rezone request is a part of a total parcel that is 165 ' x 330 ' or 54 , 450 square feet. The requested rezone is a parcel of property that was sold without formally short platting the total site into two areas . 4 . The eventual short plat will now consist of two lots, one 14 ,100 square feet and the other approximately one acre. A house cannot be constructed on the second parcel until the property is rezoned. 5 . Public services are available which consist of water and sewer, curbs, gutters and sidewalks which have been installed, and there are no apparent environmental, natural or social impacts . 6 . Negative Declaration of Non-Significance statement has been issued. 7. The Planning Department report accurately sets forth the issues , findings of fact, applicable policies and provisions and department recommendations in this matter, and this report itself is incorporated into these findings by reference. CONCLUSIONS : 1 . The subject request is compatible with the City of Renton Comprehensive Land Use Plan. 2 . The granting of this request is compatible with the zoning and residential character of the area. 3 . The subject site exceeds the minimum size and dimension requirements of the SR-1 zone.
