Mr. Smith indicated that the setbacks were increased to establish protection to adjacent properties, reduce impact, and establish reasonable upgrading of the site. The Examiner inquired about previous applications establishing duration of rezone, and Mr. Smith reported that a condition had been used in the past, e.g. the Stoneway rezone arplication. In light of new information submitted by the Utilities Division, the applicant requested a ten-minute recess to allow consultation with residents in attendance at the hearing. The Examiner called for a ten-minute recess at 10:50 a.m. The meeting was reconvened at 11:00 a.m. Mr. Richard Houghton, Utilities Division, briefly summarized the history of the pumping station located at N.E. Sunset Blvd. and Union Avenue N.E. and stated that the subject station had been redesigned in the late 1960's, but because of recent development of multiple family residential dwellings in the area, the station was presently over capacity and the city had no anticipation of increasing the capacity at this time. He indicated that federal funds for a grant had been requested which would establish a trunk line through May Creek and Honey Creek and would.eliminate the present lift station. However, he reported that the request had not yet been approved. Mr. Smith asked Mr. Houghton if the station would provide suitable water capacity for fire flow in a multiple family development. Mr. Houghton indicated that review of the final plans for the structure would be necessary for that determination, but he could foresee no difficulties for that function at this time. The Examiner asked for comments from the applicant. Responding was: Donald L. Luedke 3916 N.E. 12th Street Renton, WA 98055 Mr. Luedke stated that in view of residential opposition and new information from the Utilities Division, he wished to change his application from a request for multiple family residential zoning to a subdivision or short plat application, and asked if the permit fee could be transferred. The Examiner asked if the application was being formally withdrawn. Mr. Luedke responded affirmatively. Mr. Smith indicated that he would research the matter of transferring the fee and noted that the applicant must provide necessary information to the Planning Department to proceed with the short plat application. Mr. Luedke thanked participants for their aid in the application process. The Examiner asked if the opposition had designated a representative to coordinate with the city on a new application. Responding was: Nick Petruska 1174 Shelton Avenue N.E. Renton, WA 98055 The Examiner asked that Mr. Petruska be notified by the Planning Department of receipt of a new application and that he receive all pertinent data relating to the request. Mr. Smith reported that in view of recent information from Utilities Division and concerns of residents in the area, the Planning Department would recommend denial of the application because of conflict with objectives stated in the Land Use Report, 1965, Policy Statement, Comprehensive Plan, Renton Urban Area, 1965, and because of constitution of spot zoning, but indicated the department's cooperation with the applicant in changing the request to plat the area. The Examiner asked for further comments. R-041-77 LOCATION: 3916 N.E. 12th Street SUMMARY OF REQUEST: Applicant requests rezone from G-7200 to R-2 to allow construction of low density multi-family dwellings in conformance with the Comprehensive Plan for the area. SUMMARY OF Planning Department: Recommend approval with restrictive RECOMMENDATION: covenants running with the land. Hearing Examiner: , Application withdrawn by applicant. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on April 26, 1977. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: Thehearing was opened on May 3, 1977, at 10:20 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were sworn. It was reported that the Hearing Examiner and the! applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, *reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Vicinity Map. Exhibit #3: Site Plan. The Examiner asked Mr. Smith for additional comments or exhibits. Mr. Smith reported receipt of a letter from the Utilities Division which indicated that the existing pumping station located at Union Avenue N.E. and N.E. Sunset. Boulevard is currently at design capacity, and felt the information contained in the letter was significant. At this time, the Examiner requested Mr. Smith to contact a representative from the Utilities Division to attend the hearing and clarify the matter. Mr. Smith indicated a desire to withhold final recommendation on the application from the Planning Department until testimony from residents in attendance was completed, and stated that a petition signed by 225 residents in the area as well as new information on sewer capabilities was a' concern. The Examiner requested Mr. Smith to read the petition into the record and it was labeled Exhibit #4. The Examiner asked Mr. Smith if additional applications had been submitted for rezoning from the property located between the two arterials. Mr. Smith reported that no other applications had been submitted to his knowledge, and the zoning since the time of annexation had been G-7200. The 'Examiner inquired about the city's traditional interpretation of the Comprehensive Land Use Plan. Mr. Smith responded that the map was a flexible document which is general in nature and used as reference in conjunction with other city policies and guidelines. He reported that the subject policies address intrusion into an established neighborhood, but that in this application, the Planning Department felt the subject property was located within a blighted area and the rezone would serve to upgrade the neighborhood. The Examiner inquired about the legal posting requirements for,, the application and conformance to such requirements. Mr. Smith responded that all legal requirements for posting had been accomplished prior to April 24, 1977. The Brentwood single family residence subdivision is located south of the subject site across N. E. 12th Street . SOCIAL IMPACTS: The subject request may result in a gradual upgrading of the existing . blighted area , thereby creating positive social benefit. PLANNING DEPARTMENT ANALYSIS: 1 , The request is consistent with the Comprehensive Land Use Plan designation of low density multiple family for the site and general area north of N . E . 12th Street and south of Sunset Boule- vard . 2 . The subject site is situated between several substantial well -kept single family residences to the east and several residential struc- tures and mobile homes in rather poor condition to the west . This creates a difficult land use question , between creating a spot zone of R-2 within the existing single family residential zone and the possibility of stimulating the upgrading of not only the subject site but also the unsightly area west to the powerline right-of-way. It is the latter of these two questions that appears to be the more reasonable and appropriate for the subject site and area . 3. The R-2 zoning would allow either the subdivision of the subject property into 7200 square foot minimum lots for approximately two to three duplex residential structures or by special use per- mit approximately eight to ten townhouse type dwelling units . 4 . The site has an abundance of natural amenities including interest- ing topography , many significant trees , and much vegetation that should be incorporated into any site development plan . If the R-2 zoning is approved , adjacent single family residences should be protected from possible detrimental impacts through suitable setbacks , landscaping, and screening. 6 . The existing structures on the subject site may deter proper redevelopment of the site. P. PLANNING DEPARTMENT RECOMMENDATION: Recommend approval of R-2 rezone subject to the following conditions to be filed as restrictive covenants running with the land :. 1 . EXISTING STRUCTURES The existing structures located on the subject site shall be removed from the site or remodeled to present Building Code requirements prior to commencement of any new construction . 2 . SETBACKS No building or structure shall be permitted within 30 feet of the south property line , within 30 feet of the east property line for the southerly 150 feet thereof, within 15 feet of the remaining portion along the east property line , and within 10 feet of the west property line . 3. LANDSCAPE PLANS A detailed landscape plan for the entire site development shall be submitted to and approved by the Renton Planning Department at the time of site development plan submittal . 4 . LANDSCAPE AREAS All setback areas except for ingress/egress location shall be suitably landscaped and approved by the Renton Planning Depart- ment . A suitable architectural type screening fence shall be incorporated into the landscaping along the east property line . • 5. SITE PRESERVATION Existing trees and vegetation shall be incorporated into the development plans as much as possible. Site clearing , selective tree cutting , and grading shall be permitted only in conformance with an approved site plan and specific Planning Department approval . 6 . STORM WATER RETENTION Storm drainage plans shall be submitted at the time of site development. Such plans shall include suitable on-site retention to provide for the same runoff rate for a 25-year storm period as is presently experienced on the site , together with suitable oil water separation facilities . 7 . DURATION These covenants shall run with the land and expire on December 31 , 2050. It is further agreed and covenanted by the undersigned that , if a development plan is not submitted to the City of Renton pur- suant to these and other City requirements within two ( 2) years , and substantial construction begun within three (3 ) years of the filing of these covenants , and said construction and development diligently prosecuted toward completion thereafter, the zoning of said property shall without further City action revert back to to the zoning which existed prior to the filing of this document , and these covenants shall become null and void . PLANNING DEPARTMENT ANALYSIS: 1 , The request is consistent with the Comprehensive Land Use Plan designation of low density multiple family for the site and general area north of N . E . 12th Street and south of Sunset Boule- vard . 2. The subject site is situated between several substantial well -kept single family residences to the east and several residential struc- tures and mobile homes in rather poor condition to the west . This creates a difficult land use question , between creating a spot zone of R-2 within the existing single family residential zone and the possibility of stimulating the upgrading of not only the subject site but also the unsightly area west to the powerline right-of-way . It is the latter of these two questions that appears to be the more reasonable and appropriate for the subject site and area . 3. The R-2 zoning would allow either the subdivision of the subject property into 7200 square foot minimum lots for approximately two to three duplex residential structures or by special use per- mit approximately eight to ten townhouse type dwelling units . 4 . If the R-2 zoning is approved, adjacent single family residences should be protected from possible detrimental impacts through suitable setbacks , landscaping , and screening. 6 . The existing structures on the subject site may deter proper redevelopment of the site. P. PLANNING DEPARTMENT RECOMMENDATION: Recommend approval of R-2 rezone subject to the following conditions to be filed as restrictive covenants running with the land : 1 . EXISTING STRUCTURES The existing structures located on the subject site shall be removed from the site or remodeled to present Building Code requirements prior to commencement of any new construction . 2 . SETBACKS No building or structure shall be permitted within 30 feet of the south property line , within 30 feet of the east property line for the southerly 150 feet thereof, within 15 feet of the remaining portion along the east property line , and within 10 feet of the west property line. 3. LANDSCAPE PLANS A detailed landscape plan for the entire site development shall be submitted to and approved by the Renton Planning Department at the time of site development plan submittal . 4 . LANDSCAPE AREAS All setback areas except for ingress/egress location shall be suitably landscaped and approved by the Renton Planning Depart- ment . A suitable architectural type screening fence shall be incorporated into the landscaping along the east. property line . • 5. SITE PRESERVATION Existing trees and vegetation shall be incorporated into the development plans as much as possible. Site clearing , selective tree cutting , and grading shall be permitted only in conformance with an approved site plan and specific Planning Department approval . 6 . STORM WATER RETENTION Storm drainage plans shall be submitted at the time of site development. Such plans shall include suitable on-site retention to provide for the same runoff rate for a 25-year storm period as is presently experienced on the site , together with suitable oil water separation facilities . 7 . DURATION These covenants shall run with the land and expire on December 31 , 2050 . It is further agreed and covenanted by the undersigned that, if a development plan is not submitted to the City of Renton pur- suant to these and other City requirements within two ( 2) years , and substantial construction begun within three (3 ) years of the filing of these covenants , and said construction and development diligently prosecuted toward completion thereafter, the zoning of said property shall without further City action revert back to to the zoning which existed prior to the filing of this document , and these covenants shall become null and void . PLANNING DEPARTMENT ANALYSIS: 1 , The request is consistent with the Comprehensive Land Use Plan designation of low density multiple family for the site and general area north of N . E . 12th Street and south of Sunset Boule- vard. 2. The subject site is situated between several substantial well -kept single family residences to the east and several residential struc- tures and mobile homes in rather poor condition to the west . This creates a difficult land use question , between creating a spot zone of R-2 within the existing single family residential zone and the possibility of stimulating the upgrading of not only the subject site but also the unsightly area west to the powerline right-of-way . It is the latter of these two questions that appears to be the more reasonable and appropriate for the subject site and area . 3. The R-2 zoning would allow either the subdivision of the subject property into 7200 square. foot minimum lots for approximately two to three duplex residential structures or by special use per- mit approximately eight to ten townhouse type dwelling units . 4 . The site has an abundance of natural amenities including interest- ing topography, many significant trees , and much vegetation that should be incorporated into any site development plan . If the R-2 zoning is approved, adjacent single family residences should be protected from possible detrimental impacts through suitable setbacks , landscaping , and screening . 6 . The existing structures on the subject site may deter proper redevelopment of the site. P. PLANNING DEPARTMENT RECOMMENDATION: Recommend approval of R-2 rezone subject to the following conditions to be filed as restrictive covenants running with the land :. 1 . EXISTING STRUCTURES The existing structures located on the subject site shall be removed from the site or remodeled to present Building Code requirements prior to commencement of any new construction . 2 . SETBACKS No building or structure shall be permitted within 30 feet of the south property line , within 30 feet of the east property line for the southerly 150 feet thereof, within 15 feet of the remaining portion along the east property line , and within 10 feet of the west property line. 3. LANDSCAPE PLANS A detailed landscape plan for the entire site development shall be submitted to and approved by the Renton Planning Department at the time of site development plan submittal . 4. LANDSCAPE AREAS All setback areas except for ingress/egress location shall be suitably landscaped and approved by the Renton Planning Depart- ment . A suitable architectural type screening fence shall be incorporated into the landscaping along the east property line . • 5. SITE PRESERVATION Existing trees and vegetation shall be incorporated into the development plans as much as possible. Site clearing , selective tree cutting , and grading shall be permitted only in conformance with an approved site plan and specific Planning Department approval . 6 . STORM WATER RETENTION Storm drainage plans shall be submitted at the time of site development. Such plans shall include suitable on-site retention to provide for the same runoff rate for a 25-year storm period as is presently experienced on the site , together with suitable oil water separation facilities . 7 . DURATION These covenants shall run with the land and expire on December 31 , 2050 . It is further agreed and covenanted by the undersigned that, if a development plan is not submitted to the City of Renton pur- suant to these and other City requirements within two (2 ) years , and substantial construction begun within three (3 ) years of the filing of these covenants , and said construction and development diligently prosecuted toward completion thereafter, the zoning of said property shall without further City action revert back to to the zoning which existed prior to the filing of this document , and these covenants shall become null and void. SOCIAL IMPACTS: The subject request may result in a gradual upgrading of the existing blighted area , thereby creating positive social benefit. However, increased density on the subject site may cause additional social interaction with surrounding properties . L. PLANNING DEPARTMENT ANALYSIS: 1 , The request is consistent with the Comprehensive Land Use Plan designation of low density multiple family for the site and general area north of N . E . 12th Street and south of Sunset Boule- vard . 2. The subject site is situated between several substantial well -kept single family residences to the east and several residential struc- tures and mobile homes in rather poor condition to the west . This creates a difficult land use question , between creating a spot zone of R-2 within the existing single family residential zone and the possibility of stimulating the upgrading of not only the subject site but also the unsightly area west to the powerline right-of-way . It is the latter of these two questions that appears to be the more reasonable and appropriate for the subject site and area . 3. The R-2 zoning would allow either the subdivision of the subject property into 7200 square foot minimum lots for approximately two to three duplex residential structures or by special use per- mit approximately eight to ten townhouse type dwelling units . 4 . The site has an abundance of natural amenities including interest- ing topography , many significant trees , and much vegetation that should be incorporated into any site development plan . If the R-2 zoning is approved , adjacent single family residences should be protected from possible detrimental impacts through suitable setbacks , landscaping, and screening. 6 . The existing structures on the subject site may deter proper redevelopment of the site. P PLANNING DEPARTMENT RECOMMENDATION: Recommend approval of R-2 rezone subject to the following conditions to be filed as restrictive covenants running with the land : 1 . EXISTING STRUCTURES The existing structures located on the subject site shall be removed from the site or remodeled to present Building Code requirements prior to commencement of any new construction . 2 . SETBACKS No building or structure shall be permitted within 30 feet of the south property line , within 30 feet of the east property line for the southerly 150 feet thereof, within 15 feet of the remaining portion along the east property line , and within 10 feet of the west property line. 3. LANDSCAPE PLANSICIAdetailedlandscape plan for the entire site development shall be submitted to and approved by the Renton Planning Department at the time of site development plan submittal . 4 . LANDSCAPE AREAS All setback areas except for ingress/egress location shall be suitably landscaped and approved by the Renton Planning Depart- ment . A suitable architectural type screening fence shall be incorporated into the landscaping along the east property line . • 5. SITE PRESERVATION Existing trees and vegetation shall be incorporated into the development plans as much as possible. Site clearing , selective tree cutting , and grading shall be permitted only in conformance with an approved site plan and specific Planning Department approval . 6 . STORM WATER RETENTION Storm drainage plans shall be submitted at the time of site development. Such plans shall include suitable on-site retention to provide for the same runoff rate for a 25-year storm period as is presently experienced on the site , together with suitable oil water separation facilities . 7 . DURATION These covenants shall run with the land and expire on December 31 , 2050 . It is further agreed and covenanted by the undersigned that , if a development plan is not submitted to the City of Renton pur- suant to these and other City requirements within two (2) years , and substantial construction begun within three (3 ) years of the filing of these covenants , and said construction and development diligently prosecuted toward completion thereafter, the zoning of said property shall without further City action revert back to to the zoning which existed prior to the filing of this document , and these covenants shall become null and void. The term "sub- stantial construction" shall mean the physical alteration of the land for construction pursuant to City approved development plans as per the above mentioned conditions and a valid building permit , PLANNING DEPARTMENT PRELIMINARY REPORT TO HEARING EXAMINER PUBLIC HEARING OF MAY 3, 1977 PAGE FIVE RE : DONALD L . E . 12th Street and south of Sunset Boule- vard . 2. The subject site is situated between several substantial well -kept single family residences to the east and several residential struc- tures and mobile homes in rather poor condition to the west . This creates a difficult land use question , between creating a spot zone of R-2 within the existing single family residential zone and the possibility of stimulating the upgrading of not only the subject site but also the unsightly area west to the powerline right-of-way . It is the latter of these two questions that appears to be the more reasonable and appropriate for the subject site and area . 3. The R-2 zoning would allow either the subdivision of the subject property into 7200 square foot minimum lots for approximately two to three duplex residential structures or by special use per- mit approximately eight to ten townhouse type dwelling units . 4 . The site has an abundance of natural amenities including interest- ing topography , many significant trees , and much vegetation that should be incorporated into any site development plan . If the R-2 zoning is approved , adjacent single family residences should be protected from possible detrimental impacts through suitable setbacks , landscaping, and screening. 6 . The existing structures on the subject site may deter proper redevelopment of the site. P. PLANNING DEPARTMENT RECOMMENDATION: Recommend approval of R-2 rezone subject to the following conditions to be filed as restrictive covenants running with the land : 1 . EXISTING STRUCTURES The existing structures located on the subject site shall be removed from the site or remodeled to present Building Code requirements prior to commencement of any new construction . 2 . SETBACKS No building or structure shall be permitted within 30 feet of the south property line , within 30 feet of the east property line for the southerly 150 feet thereof, within 15 feet of the remaining portion along the east property line , and within 10 feet of the west property line. 3. LANDSCAPE PLANS A detailed landscape plan for the entire site development shall be submitted to and approved by the Renton Planning Department at the time of site development plan submittal . 4 . LANDSCAPE AREAS All setback areas except for ingress/egress location shall be suitably landscaped and approved by the Renton Planning Depart- ment . A suitable architectural type screening fence shall be incorporated into the landscaping along the east, property line . • 5. SITE PRESERVATION Existing trees and vegetation shall be incorporated into the development plans as much as possible. Site clearing , selective tree cutting , and grading shall be permitted only in conformance with an approved site plan and specific Planning Department approval . 6 . STORM WATER RETENTION Storm drainage plans shall be submitted at the time of site development. Such plans shall include suitable on-site retention to provide for the same runoff rate for a 25-year storm period as is presently experienced on the site , together with suitable oil water separation facilities . 7 . DURATION These covenants shall run with the land and expire on December 31 , 2050 . It is further agreed and covenanted by the undersigned that , if a development plan is not submitted to the City of Renton pur- suant to these and other City requirements within two ( 2) years , and substantial construction begun within three (3 ) years of the filing of these covenants , and said construction and development diligently prosecuted toward completion thereafter, the zoning of said property shall without further City action revert back to to the zoning which existed prior to the filing of this document , and these covenants shall become null and void . The term "sub- stantial construction" shall mean .the physical alteration of the land for construction pursuant to City approved development plans as per the above mentioned conditions and a valid building permit , PLANNING DEPARTMENT PRELIMINARY REPORT TO HEARING EXAMINER PUBLIC HEARING OF MAY 3, 1977 PAGE FIVE RE : DONALD L . Such reasonable cause shall include , but may not be limited to , the requirement of an environmental impact statement pursuant to the State Environmental Policy Act of 1971 .
