OLD BUSINESS Councilwoman Shinpoch announced request of Assistant Attorney Kellogg that an Executive Session be held regarding possible law- suit. Ways and Means Ways and Means Committee Chairman Clymer presented committee report Committee Report recommending Council concur in the request of the Administration Comp Time to pay off the comp time that has been accrued by fire fighters Pay Off with payment authorized no later than 12/31/79 (to be funded from and Policy unanticipated revenues rather than loan from Firemen's Pension Fund) . The Committee further recommended a resolution be drafted stating that future comp time be used within 30 days and may be authorized only by a Department Head. Public Meeting This being the date set and proper notices having been posted, Loma Linda published and mailed according to law, Mayor Delaurenti opened 10% Petition the public meeting to consider the 10% petition to Annex property Letter of Intent to the City of Renton filed by Earl Westlund,, 16530 So. 43rd St. , to Annex to Issaquah, property owner and developer of Loma Linda plat located the City south of Victoria Park between Talbot Rd. S. and the proposed SR-515. Attorney Michael Rodgers, 111 NE 3rd, representing WestPac Development Corp. and Mr. Westlund, presented additional petition for annexation bearing two signatures and claiming 28 acre parcel for annexation. Mn Rodgers requested sewers for the Loma Linda plat, recalling his earlier request to Council (2/26) and explained County approval of the preliminary plat, claiming hardship. City Clerk Mead explained the City had received petition filed by Mr. Westlund, signatures certified by Planning Dept. as 36.89% of assessed value of area; noted need of Legislative body to determine acceptance of the letter of intent, requirement of adoption of Comprehensive Plan, Zoning Ordinance and any pre-existing bonded indebtedness and determination re authorization to circulate 75% petition. Upon inquiry by Councilman Perry regarding acceptance of Comprehensive Plan, Zoning and indebtedness of City, Mr. Rogers explained the Loma Linda plat meets County plat regulations, that lot size includes those of 7,200 sq.ft. (16 of 37 separate lots are 7,200 s.f.) . Upon inquiry Planning Director Ericksen explained the zoning would be determined by adjoining property, Victoria Park being SR-1 with minimum lot size of 7,500 sq. ft. Councilman Stredicke inquired re agenda item of annexation by Cascade Sewer District of area adjacent to the Loma Linda plat, area confirmed by the Public Works Director who noted matter would be referred to him for further study. (See Consent Agenda) Mr. Rodgers, upon questioning by Councilman Stredicke, answered Yes" on behalf of Mr. Westlund for acceptance of City's Comprehen- sive Plan, Zoning Ordinance and any pre-existing bonded indebtedness. Soils : Alderwood gravelly sandy loam (AgC ) , Permeability is moderately rapid in the surface layer and subsoil and very slow in the substratum. Available water capacity is low ; runoff is slow to medium; and the erosion hazard is moderate. This soil is used for timber , pasture , row crops , and urban development . 3 . Vegetation : The site is heavily wooded consisting of various evergreen and deciduous trees and extensive undergrowth . 4. Wildlife : The existing vegetation on the site may provide some habitat for various birds and mammals . 5. Water : There is no surface water evident on the site . 6 . Land Use : The subject site is presently undeveloped . Imme- diately north and west of the site is the existing Leisure Estates Mobile Home Park. DEPARTMENTAL RECOMMENDATION : REZONE Recommend approval to the City Council of this rezone application as being the first rezoning following the Comprehensive Plan amend- ment of September 18 , 1978 , to designate the site for low density multiple family use , and consistent with Section 4-3014 , as iden- tified in the analysis above . N . PLANNING DEPARTMENT ANALYSIS : PRELIMINARY PLAT APPROVAL 1 . The proposed preliminary plat approval consists of 61 mobile home lots primarily of a double-wide mobile home arrangement with interspersed triple-wide lots . 2 . The proposed double-wide lots all appear to conform to the maximum 40% coverage allowance . The majority of the triple- wide lots also appear to comply . There are two triple-wide lots at the extreme northeast corner of the site , which are slightly over the coverage allowance . 3 . The proposed plan extends the lot lines into the existing Central Annex area . Without a detailed plan indicating the existing lot lines , it cannot be determined whether the extension makes the lots coterminous . 4 . The applicant ' s submitted sidewalk details indicate they are 3 . 5 feet in width as opposed to 5 feet as required by ordinance . The sidwalks also do not extend to provide access to all lots . Without benefit of a Board of Adjustment vari - ance , the sidwalks will have to be widened and extended . 5. No detailed landscaping plan is provided at this time , although perimeter landscaping and screening along the east portion of the north property line , along the east line adjacent to the Union Avenue S . E . , and along the south property line is iden- tified but not precisely described . ' A more detailed plan will be provided at the time of final approval . 6. The proposed emergency access to Union Avenue S . E . also provides driveway access to two mobile home lots . The proposed surfacing is a gravelled surface . In order to be consistent with the remainder of the mobile home lots , the portion of the emergency access which also serves as driveway should be paved in a hard surface treatment . 7 . No uses are proposed for the open space area at the southwest corner of the site underneath the powerline easement . Land- scaping or recreational uses should be identified at the time of final plan approval . 8 . The Engineering Division advises that the acquisition of right- of-way and installation of improvements are required along Union Avenue S . E . , including curb , gutter , sidewalk , and pave- ment and subject to specific plan approval by that division . 9. These impacts can be mitigated through proper developmental controls , including adequate storm water retention facilities and reten- tion of existing vegetation in the design and development of the subject site . 2 . Population/Employment : Development of the subject site will generate a population increase and may provide limited employ- ment opportunities for some residents . 3. . DEPARTMENTAL RECOMMENDATION : REZONE Recommend approval to the City Council of this rezone application as being the first rezoning following the Comprehensive Plan amend- ment of September 18 , 1978 , to designate the site for low density multiple family use , and consistent with Section 4-3014 , as iden- tified in the analysis above . N . PLANNING DEPARTMENT ANALYSIS : PRELIMINARY PLAT APPROVAL 1 . The proposed preliminary plat approval consists of 61 mobile home lots primarily of a double-wide mobile home arrangement with interspersed triple-wide lots . 2 . The proposed double-wide lots all appear to conform to the maximum 40% coverage allowance . The majority of the triple- wide lots also appear to comply . There are two triple-wide lots at the extreme northeast corner of the site , which are slightly over the coverage allowance . 3 . The proposed plan extends the lot lines into the existing Central Annex area . Without a detailed plan indicating the existing lot lines , it cannot be determined whether the extension makes the lots coterminous . 4 . The applicant ' s submitted sidewalk details indicate they are 3 . 5 feet in width as opposed to 5 feet as required by ordinance . The sidwalks also do not extend to provide access to all lots . Without benefit of a Board of Adjustment vari - ance , the sidwalks will have to be widened and extended . 5. No detailed landscaping plan is provided at this time , although perimeter landscaping and screening along the east portion of the north property line , along the east line adjacent to the Union Avenue S . E . , and along the south property line is iden- tified but not precisely described . ' A more detailed plan will be provided at the time of final approval . 6 . The proposed emergency access to Union Avenue S . E . also provides driveway access to two mobile home lots . The proposed surfacing is a gravelled surface . In order to be consistent with the remainder of the mobile home lots , the portion of the emergency access which also serves as driveway should be paved in a hard surface treatment . 7 . No uses are proposed for the open space area at the southwest corner of the site underneath the powerline easement . Land- scaping or recreational uses should be identified at the time of final plan approval . 8 . The Engineering Division advises that the acquisition of right- of-way and installation of improvements are required along Union Avenue S . E . , including curb , gutter , sidewalk , and pave- ment and subject to specific plan approval by that division . 9. The Building Division indicates that all lots should be properly dimensioned . 10 . Traffic Engineering indicates that the traffic increase will not be a significant adverse impact . However , subsequent develop- ment of the subject site will disturb soils , increase runoff , and remove existing vegetation on the subject site . These impacts can be mitigated through proper developmental controls , including adequate storm water retention facilities and reten- tion of existing vegetation in the design and development of the subject site . 2 . Population/Employment : Development of the subject site will generate a population increase and may provide limited employ- ment opportunities for some residents . 3 . Social : Certain social impacts may occur due to the resultant increased density in the area . 4. Traffic : The proposed addition will increase traffic in the vicinity by approximately 329 trips per day ( 5 . 4 trips/unit times 61 units ) . Current traffic on Union Avenue S . SUMMARY OF REQUEST: Applicant requests approval of a rezone from "G" ,(General Classification District) to "T" (Trailer Park) , which is the city's designation for mobile home park. A concurrent application for preliminary mobile home park approval on the site has been filed. Approval of these applications will enable the applicant to commence development of a 61-lot addition to the existing Leisure Estates Mobile Home Park. SUMMARY OF Planning Department: Approval. RECOMMENDATION: Hearing Examiner: Approval. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on February 21, 1979. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on February 27, 1979 at 10:40 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. David Clemens, Associate Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Amendment to Comprehensive Plan, File No. 903-77 (by reference) Exhibit #3: Ordinance No. 3253', Amending the, Comprehensive Land Use Designation on the Subject Property by reference) Exhibit #4: Vicinity Map The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: David R. Millard Land Planning & Management 22627 152nd S.E. Kent, WA 98031 Mr. Millard indicated his concurrence in the report. The Examiner inquired if the applicant was familiar with the three findings contained in Section 4-3014, Examiner's Ordinance, which must exist in order to grant a rezone. The findings, which were read into the record, consist of the following: (A) that substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered: at the time of the first area land use analysis and area zoning; (B) that the property is potentially zoned for the reclassification being requested pursuant to the policies set forth in the Comprehensive Plan; and (C) that, since the last previous land use analysis of the area zoning of the subject property, authorized public improvements, permitted private development or' other circumstances affecting the subject property have undergone significant and material change. Mr. Millard felt that Finding C) would apply, and the City Council.had previously agreed that the subject property should be reclassified into low density multifamily designation. He indicated that restrictive covenants had been executed to ensure compliance of development with the R-256-78 Page Two Comprehensive Plan revision. The Examiner requested testimony in support of the application. Responding was: Dean W. Bitney 411 Cedar Avenue S. Renton, WA 98055 Mr. Bitney requested further clarification of Section 4-3014. The Examiner reiterated previous comments and indicated that one or more conditions must exist in order to grant approval of the request. Mr. Bitney reviewed the intent of restrictive covenants which run with the land, preclude apartment development; and allow mobile home development in a "T" zoning category. The Examiner inquired if the restrictive covenants were specifically discussed by the City Council during Comprehensive Plan review of the general area. Mr. Clemens advised that discussion of the covenants occurred during the City Council meeting of September 25, 1978. The Examiner requested further comments. Since there were none, the hearing on File No. R-256-78 was closed by the Examiner at 10:50 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a reclassification of 10 acres from G to T to permit construction of the South Annex of the Leisure Estates Mobile Home Park. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance • has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and no adverse comment was expressed. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the requirements of Section 4-714 (T) and 4-2006.1.A Mobile Home Park Ordinance - site size) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The last land use analysis relative to the subject site and this specific rezone request was completed on October 2, 1978, resulting in an amendment (Ordinance No. 3253) to the Comprehensive Plan Land Use Map to Low Density Multiple Family for the subject site (Sections 4-3014. (A) and (B) ) . Restrictive covenants agreeing to only T zoning on the site have been completed (Exhibit 02) . 9. Since that analysis and amendment, the North and East Annexes have been granted final approval by the Examiner (Section 4-3014. (C) ) . 10. Mobile home .parks are allowed in the T zone (Section 4-714) which is permitted only . in ". . .low, medium and high density multifamily residential and commercial areas as designated on the City's Comprehensive Land Use Plan." CONCLUSIONS: 1. The proposal conforms to the Comprehensive Plan goals and objectives and Land Use Map (Section 4-3014. (B) ) . The proposal was specifically considered by the City Council during deliberations on the amendment to the Comprehensive Plan Land Use Map (Exhibit #2) .
