Topography : The property rises from west to east at approxi ately a 5% grade . 2. Soils : Alderwood Gravelly Sandy Loam (AgC ) . Permeability is moderately rapid in the surface layer and subsoil and very s ow in the substratum. Runoff is ,slow to medium and the erosion hazard is moderate . DEPARTMENTAL RECOMMENDATIONS : Based upon the apparent access difficulty that exists , R-.3 zoning may be approved only if appropriate direct public access is . assured. This can be accomplished by the applicant providing dedication and improvement of a public street with' 36 ' curb-to-curb w-idth . including: Curb ,.' gutter, `sidewalk , street paving , storm- dr-ainage', and street .lighting ' at a location to 'the 'approval :.of the Planning and Public Works Departments . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION : Pursuant to the City of Renton' s Environmental Ordinance and the State Environmental Policy Act of 1971 , as amended , RCW 43-21C•, a negative declaration of environmental impact has, been prepared ' or rezone only, and subject to, further environmental review at the time of site development.. The ,proposed:,rezoneto R-3is . consistent with most of the l : nd use element of the Comprehensive Plan ,..except' for the greenbelt portion in the westerly section of the' site corresponding to the po erline right-o.f-way bisecting the site . 2.'. -The: proposal is generally consistent with existing ' zoning and land uses in the vicinity (i .e . R-3 , B-1 zone , newly const ucted apartment complex and existing business uses to the. north) , 3. .: The , Stone Property immediately adjacent to the north was r=zoned to R-3 by Ordinance #3247' of' September 22 , 1978 . The' •Wehr an property to the northwest and the Swanson property to the orth wer( rezoned to B- 1 at the same time . The Examiner' s conclusio s and recommendations are attached . , 4. Although the proposal is consistent with the Comprehensive Plan Map Element, the Comprehensive Plan Land Use Report , Residential , Page 11 , states that "convenient access to major arterials and highways is important. " The purposes and objectives of the , comprehensive plan , streets and arterials also stat- s that street patterns compatible with and complimentary to the !eneral land use plan . . " should be considered . The only apparent access to the site is an unimproved 30-foot wide road exte ding westerly from Union Avenue NE. This would not. meet City o Renton requirements for direct public access .. The applicant has nit addressed this matter in the application . In R-165-78 the Examiner stressed in Conclusion #1 that "Adequate access to the site per applicable city requirements must be. provided . " In his recommendation , the Examiner made 'this one of his 'conditions of approval for the rezone. It would seem reasonable , th- refore, that this and the other conditions would be appropriate for the subject request given the . close:::prox'imi ty to and simi l ari oy of circumstances to the Stone rezone , 5. It is unclear as to how utilities will be provided to the site . If they are to be provided from NE 4th Street , they will ave to be extended the entire distance across the apartment complex 1. The proposal generally Forms to the Comprehensive Pla Section 4-3014. (B) ) except for access. Adeeuace access should be provided t ne site prior to development of the site. Perhaps the most appropriate and expeditious solution would be to incorporate this needed access into the development of adjacent properties. However, access becomes critical relative to actual development,' not the reclassification. Adequate access to the site per applicable city requirements must be provided. This can be reviewed during review by the Examiner of the development site plan. 2. The area immediately surrounding the property 'is undeveloped despite the B-1 zoning to the north. ' Low -density single family: zoning, (G) directly abuts the B-1 zone without benefit of buffer or. transition. Some transition or buffer is necessary between the two zones at the subject site. This would be the appropriate use of land use principles. . ." and the' ". . .coordinated development of undeveloped areas." (Summary, page 9, Comprehensive Plan, Renton Urban Area, July, 1965) . Otherwise, potential multi-family and/or commercial development might be ". . .of incompatible uses which would. . .prevent the development of orderly growth patterns." Objective No. 1, page 17, Comprehensive Plan, Land Use Report, July, 1965) . . R-165-78 Page Three ' It was stated that the B-1 property north of and adjacent to. the site is proposd for development of 220+ multiple family dwelling units. The development plans were not submitted or .required, but Section 4-711 (B-1) and 4-709.B (R-4) allow a building height of.'six stories "or 95 feet. If such height is not in fact proposed, even the density above requires transition to the low density single family G property. iMedium density multi-family '(R-3) can. provide this transition if appropriate restrictions 'are placed upon the rezone. The R-3 conforms to the Comprehensive Plan Land Use .Map designation for the subject site. The property south of and abutting the site is. also, des'ignated .to possibly be R-3; however, until it is developed •beyond the existing single .family• use, it should be considered as single family (G) property. 3. The adjacent andeasterly. city-owned property (undeveloped). is compatible with R-3 zoning. Buffering is not required along this portion_of the subject site. Normally the R-3 zone rear yard setback is 20 feet and side' yard setback is five feet (Sections 4-709.A. , B.-, and D. ) :' This appears insufficient when the abutting property is G. ' The setback along the south and west portions .;of the site should therefore be .enlarged to 30 feet. Furthermore, the building height should be reduced from 60 feet to 35 feet, that height for single family ,development, in- order to complete the transition and buffering. Mr. Munson indicated that removal of vegetation on the easterly portion of the site would be subject to Planning Department review and approval. The applicant referenced Section I.3 (Impact on the Natural or Human Environment,- Schools) and stated that due to the existing power line easement on the site, proposed density would be much less than estimated in the Planning Department report which would subsequently reduce the impact upon school population. The Examiner inquired regarding proposed plans for facilities which will be developed under the transmission easement. Mr. Wolf advised that final plans have not been completed. The Examiner requested testimony in support of the application. Responding was: Dave Homer 13706 139th Avenue S.E. Renton, WA 98055 Mr. Homer indicated that dedication to the city of sanitary sewer lines located under the transmission easement would be completed by the end of the week. He also advised his understanding that the intersection located at N.E. 4th Street and Union Avenue is proposed for improvement to provide channelization for left turn movements. Mr. Clemens confirmed the proposal contained in the first year of the Six Year Street Program to alleviate current traffic congestion in the area. The Examiner requested further testimony in support or opposition to the application. There was no response. He then requested final comments from the Planning Department staff. Since there were no further comments, the hearing on File No. R-342-79 was closed by the Examiner at 10:45 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a reclassification of +3.13 acres from General (G) District to R-3 District for the future development of multi-family residential units. 2. The Planning Department report, as modified, sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the. State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. All existing utilities are available and in close proximity. 7. The subject site is located approximately 750 feet south of N.E. 4th Street. The property was annexed into the city by Ordinance No. 2249, dated June 22, 1966, and it was at that time that the present G zoning was applied. 8. Except for a single family residence in the southeast portion of the property, the site is mostly undeveloped. The site is traversed in an approximate north-south direction by a BPA transmission line easement. There is a significant stand of trees in.the easterly portion of the site. 9. The land use in the area consists of the Greenwood Cemetery to the west; Leisure Estates Mobile Home Park to the south; and scattered single family homes to the east. A large apartment complex lies to the north along N.E. 4th Street. This general area has been in transition from undeveloped and scattered homes to commercial and apartment uses. 10. The Comprehensive Plan's map element indicates that this area would best be developed as a mix of commercial, medium density residential and greenbelt. PUBLIC HEARING:After reviewing the•Planning Department report, examinin', available information on file with the application, and ield checking the property arid surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 22, 1979 at 10:30 a.m. in the Council Chambers of th- Renton Municipal Building. Parties wishing to testify-were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and revie ed the Planning Department report, and the report was entered into the record as Exhibit #1. Steve Munson, Planning Department, reviewed Exhibit #1, and entered the following additional exhibit into the record: Exhibit #2: King County Assessor's Map David Clemens, Planning Department, corrected Sections I.2 and I.5 of Exhibit #1 •o state that the- proposal will contain 94 units .and will increase traffic in the area by approximately 570 trips 'per day. Mr. Wolf asked Mr. Munson to identify on Exhibit #2 the location o R-342-79 Page Four 4. There have been some recent rezones in the area immediately adjacent to the subject property and a number of new developments have been built both north and south of the subject property. There are also some proposals for other properties in the vicinity in the development stage. Therefore, it is timely to consider this rezoning application for the subject property. 5. The properties to the north have been subject to certain development conditions to permit a smooth transition between the more intense uses along N.E. 4th Street and the remaining G zoning. This property should also be required to balance its proposed uses with existing conditions such as the mobile home park on the south and the G zoning along the west. To facilitiate this transition the subject site should limit both the height of the development and the setbacks. The 35-foot height limitation is reasonable for a transition between the existing uses and a 30-foot setback would create a reasonable buffer between the proposed uses and the existing uses. Development of this property subject to the enumerated conditions should permit the development of uses which are compatible with surrounding development and provide much needed housing in the eastern portion of the city. RECOMMENDATION: It is the recommendation of the Examiner that the City Council approve the reclassification from G to R-3 subject to: 1. Provision of adequate access to and from the property per applicable city ordinances and regulations. 2. Retention of the existing vegetation, with the approval of the Planning Department before any trees are removed. 3. Approval of the Planning Department of all site and landscape plans. 4. Building height is not to exceed 35 feet. 5. Building setbacks along the southern and western boundaries should be not less than 30 feet. 6. Participation in any future LID to improve access to the property; including but not limited to Union Avenue S.E. and N.E. 4th Street. 7. The applicant stated at the hearing that by various ag,eements the subject site will be able ,to use the .proposed new street. 13. Both the mobile home park and the apartment complex were recently developed. cross N.E. 4th Street a proposal exists to develop a commercial office complex. CONCLUSIONS: 1. The proponent of a rezone must demonstrate compliance with at least one of the three . . criteria of Section 4-3014 which provides in part' that: a. The site has not been considered in a previous area wide rezone; b. The subject site is potentially zoned for the new classification per the Comprehensive Plan; or c. There have been demonstrated changes in the area since the last rezoning a tion. The applicant and Planning Department have demonstrated that the necessary cri eria to permit a rezone of' the subject property have been met. 2. The G classification which the property is now zoned was automatically applies to the site when it was annexed, into the city. The procedure is followed whenever a . annexation occurs (Section 4-729: (B) ) . The G classification is basically a pr•tective classification which enables the city to study the area in question at a late Lime to determine the area's appropriate use. The Comprehensive Plan is the only action besides the annexation which dealt ith the area in which the subject site is located. No Other actions have considered the area's potential since annexation. 3: The Comprehensive Plan generally' indicates that the area in which the subject property is located is suited for the classification for which the applicant has applied. The property is divided by the transmission line.and this area is designated as g een belt. Also a part of the area appears to have been potentially designated for comme cial use. The Comprehensive Plan though is not an absolute indicator of a specific site s use - zoning accomplishes that purpose. The classification which an area is zoned .hould depend on the adjoining area's classifications as well as the best use for th- subject property. The zoning applied for appears to meet the objectives of the Comprehensive Plan to provide medium density residential zoning in the area. The R-3 zoning would se compatible with surrounding uses, as .they exist, and proposed uses of adjoini g areas. To the north the B-1 zoning is used almost exclusively for multi-family apart ents. The mobile home park to the south provides the amenities of single family dwellings and would be compatible with the probable use of this property for medium density residential development. The subject property does suffer from the lack of adequate access which the Comprehensive Plan indicates as necessary for the proposed use of this land. "Convenient .ccess to major arterials and highways is. important" and "street patterns compatible w'th and complimentary to the general land use plan" are desirable when proposing residential development (Comprehensive Plan, Land Use Report, Residential; page 11) . The applicant concedes that access is necessary and maintains that it will b= provided via the property to the north. In order to insure appropriate access to the property, such access should ,be•made a condition of approval. The condition should no' foreclose the applicant's potential development scheme and therefore it will not require a particular method or location for the access. The Comprehensive Plan as previously noted showed that the transmission• line easement was appropriate for the provision of green belt and such use of the easement is . reasonable. Therefore, the applicant should make provision for open space/recreational use of this area. Also, along similar lines, the applicant should preserve Js much of the natural character of the property as possible (Comprehensive Plan, page 1) and therefore, per the Planning Department's recommendation, the stand of trees •n the easterly portion.of the property should be preserved. 'The proposal generally brills to the,Corhprehensive Pla ection 4-3014. (B) ) except for access. Adequate access should be provided site prior to development of the site. Perhaps the most appropriate and expeditious solution would be to incorporate this needed access into the development of adjacent properties. However, access becomes critical relative to actual development, not the reclassification. Adequate access to_the' site per applicable city requirements must be provided. This can be reviewed during review by the Examiner of the development site plan. : . 2. The area immediately surrounding the property .is undeveloped despite the B-1 zoning to the' north._ Low density tingle family zoning (G) directly abuts-the B-1 zone without benefit.of,buffer or transition. Some transition or buffer is necessary between the two zones at the subject site. .,This would' be the appropriate use of land use principles.,. ." and the ". . .coordinated'development'of undeveloped areas." (Summary, page'9; Comprehensive Plan, Renton Urban Area, July, 1965) . Otherwise, potential multi-family and/or commercial development might be ". . .of incompatible uses which would. ..prevent the development of orderly growth patterns." Objective No. 1, page 17, Comprehensive Plan, Land Use Report, July, 1965) . R-165-78 Page Three It was stated that the' B-1 property north of and adjacent to the site is proposed for development of 220+.multiple family dwelling units. Three development plans were not submitted or required, but Section 4-711 (B-1) and 4-709.B (R-4) allow a building height of six; stories or 95 feet. If such height, is not in fact proposed, even the density above' requires transition to the low density single family G property. Medium density multi-family (R-3) can provide this transition if appropriate restrictions are placed upon the rezone. The R-3 conforms to the Comprehensive Plan Land Use Map designationfor •the subject site. The property south of and abutting the site is also _designated to possibly be R-3; however, until it is developed beyond the existing single family use, it should be considered as single family (G) property. 3. The adjacent and easterly city-owned property (undeveloped) is compatible with R-3 zoning. Buffering is not required along this portion of the subject site. Normally the R-3 zone rear yard setback is 20 feet and side yard setback is five feet (Sections 4-709.A'. ,. B. , and D.) . This appears insufficient .when the abutting property is G. The setback along the south and west portions 'of the site should therefore be enlarged to- 30 feet. Furthermore, the building height should be reduced-from 60 feet to 35 feet, that height for single family development, in order to complete the transition and buffering. Review of the site plan by the Examiner in a public hearing is appropriate for final, review of compliance with this and other conditions. 4. Existing vegetation', particularly the substantial trees, should be retained as much as possible to contribute towards resolution of storm drainage problems. Drainage and vegetation retention can be reviewed with specific development plans. RECOMMENDATION: Based upon the record, testimony, findings and conclusions, it is the recommendation of the Examiner that the City Council approve the reclassification from G to R-3 subject to: 1. Provision of adequate access to and from the property per applicable city'ordinances and regulations. 2. Retention of existing, vegetation as much as possible. 3. Building setbacks of, 30feet along the southerly and westerly boundaries of the property. 4. Building .height of 35 feet. 5. Review of the development site plan `by the Examiner in a public hearing for compliance with the aforementioned conditions. In R-165-78 the Examiner stressed in Conclusion #1 that "Adequate access to the site per applicable city requirements must be provided . " In his recommendation , the Examiner made this one of his conditions of approval for the rezone . It would seem reasonable , therefore , that this and the other conditions would be appropriate for the subject request given the close proximity to and similarity of circumstances to the Stone rezone. 5. It is unclear as to how utilities will be provided to the site .
