This office is aware of the fact that Honey Creek was undergrounded and cuiverted in the vicinity of Sunset Boulevard W.E. and Whitman Court N.E. Since I am not aware of any permit issued to allow such action under the provisions of the Mining, Excavation and Grading Ordinance, and am not aware of any environmental determination, I felt that the procedure which permitted the culverting should be indicated, as other land use permits concerning this property have come to this office, and the history of prior actions is unclear. SUMMARY OF REQUEST: The applicant seeks approval of a four-lot commercial short plat . SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approval with restrictive covenants. PLANNING D=PARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on May 5, 1981 . PUBLIC HEAZING: After reviewing the Planning Department report , examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows : The hearin3 was opened on May 12, 1981 at 9: 16 a.m. in the Council Chambers of the Renton Municipal 3uilding. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report. Steve Munson, Planning Department, presented the report , and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Short Plat with staff comments The Examiner requested testimony by the applicant. Responding was : James Dalpay P.O. Box 2436 Renton, WA 98055 Mr. Dalpay submitted an exhibit for the record which designates the existing location and the proposed realignment of Honey Creek, including legal description. The exhibit was entered as follows by the Examiner: Exhibit #3: Easement and Map of Honey Creek Mr. Dalpay advised that as many trees as possible would be preserved on the site. He questioned an Engineering Division staff comment attached to the staff report which refers to new assessments for utilities, noting that assessments had been paid upon annexation of the prcperty. Roger Blaylock, Associate Planner, advised that if latecomers ' fees have already been paid, the condition would probably not be applicable. Responding to the Examiner's inquiry regarding traffic impact on Whitman Court , Mr. Blaylock advised tFat because existing residential development is located to the south of the proposal and traffic from the subject short plat is anticipated to travel to the north, there will be little impact to the residential area. The Examirer requested testimony in support or opposition to the proposal . There was no response. He then invited final Planning Department comments. Mr. Blaylock inquired if Exhibit #: has been legally executed. Mr. Dalpay indicated that the document had been drafted tto years prior through cooperation of city staff, and if execution has not occurred it would to handled expeditiously. Mr. Blaylock stated that prior to execution, the Planning [epartment would recommend provision of landscaping to buffer commercial uses to the north from residential uses to the south. Mr. Dalpay advised that the power line easement creates a natural buffer in itself. The Examirer requested final comments . Responding was: Gary Norris Traffic Engineer Sh. Pl . 042-81 Page Two Mr. Norris requested that the Examiner reserve for the review by the Traffic Engineering Division, the specific number and location of driveways along Sunset Boulevard N.E. , dependent upon the ultimate type of development and use of the site. The Examiner noted the possibility of combining the easements along that arterial to relieve potential congestion from turning movements. Mr. Dalpay concurred in the Examiner's proposal . Since no further comments were offered, the hearing regarding File No. Short Plat 042-81 was closed by the Examiner at 9:32 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The request is for approval of a four-lot short plat of approximately two acres. 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been determined exempt from the threshold determination by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. The subject property is exempt from the sewer moratorium enforced along the Honey Creek/Sunset sewer service area. 7. The subject property is located on the south side of Sunset Boulevard N.E. adjacent to Whitman Court N.E. The site is essentially level and is covered with some significant trees and mostly scrub grass and brush. 8. The subject site was annexed into the city by Ordinance No. 2000 in December of 1962. The site was rezoned to its current B-1 (Business/Commercial) zone by Ordinance • No. 2147 in 1965. 9. Honey Creek which flowed freely through the site has been culverted. 10. The applicant proposes dividing the subject parcel into four lots. Lots A, B and C would each have frontage along Sunset Boulevard N.E. Lot D would have frontage on Whitman Court N.E. Each of the lots exceeds 10,000 square feet. 11 . The subject property is undeveloped. West of the site on Sunset is a service station and an auto body shop. A residential complex and undeveloped property is north of the subject site. To the east are commercial uses and residential uses. The property to the south is proposed for a multifamily apartment complex. 12. The existing curbs along Sunset do not meet the 30-foot width requirements according to the Planning Department and the Traffic Engineering Department. 13. The applicant will have to participate in any latecomers ' agreement for the area in which participation is currently lacking. 14. Off-site improvements are required along both Whitman Court N.E. and Sunset Boulevard N.E. (Sections 9-1105(4) and (6)) . 15. The applicant will have to provide easements appearing on the face of the plat for all utilities, including storm drainage, sewer and water. The Honey Creek culvert will have to be clearly identified. 16. The Comprehensive Plan designates the area in which the subject property is located as suitable for commercial development. L_ 11/1 Sh.. 042-81 Page Three CONCLUSIONS: 1 . The subject short plat appears to serve the public use and interest as conditioned below. The creation of four separate lots for commercial development is compatible with both the zoning of B-1 and the Comprehensive Plan's designation of commercial for the subject property. This area would serve the goal of establishing commercial areas at the node created by major intersections, such as Union and Sunset. 2. The creation of three separate lots with access along Sunset Boulevard will impair the primary purpose of the Sunset Boulevard arterial (Policy 7.C.3. , Comprehensive Plan) . Therefore, to minimize interference with the arterial flow along Sunset, Lot C should be prohibited from access onto Sunset Boulevard and provide access via Whitman Court in a fashion similar to Lot D. 3. The applicant will have to provide the necessary utility easements and these should be indicated upon the face of the plat. Improvements will be necessary along both Sunset Boulevard N.E. and Whitman Court N.E. as required by Sections 9-1105(4) and (6) . These improvements include but are not limited to curbs, gutters, sidewalks and street lighting where there is a deficiency in any of these improvements. 4. The driveways for Lots A and B must be brought up to standards indicated by the Traffic Engineering Division (Section 4-2204(2) (B) ) . There should be no more than one driveway serving each of these lots, again to minimize the impact upon the arterial flow on Sunset Boulevard. 5. Since the Comprehensive Plan indicates that the subject property is potentially suitable for commercial , as opposed to residential , development, the property should be restricted from residential purposes both because of its location along a major arterial and because of the Comprehensive Plan designation. Therefore, the applicant should execute restrictive covenants which either preclude the use of the subject property for residential uses (as was done in the Colasurdo rezone, File No. R-106-80) or provide adequate setbacks to provide residential amenities along a major arterial . Similar setbacks are in effect for the immediately adjacent properties to the south (File No. Short Plat 038-81) . The policies element of the Comprehensive Plan at Sections 4.C.7 and 4.D.2 requires that multifamily development achieve the same basic amenities as are achieved within single family units, and this includes setbacks which promote privacy. A minimum 20-foot setback should be maintained along both Sunset Boulevard and Whitman Court N.E. if residential units were to be constructed on the subject property. In addition, a 20-foot setback should be required along Whitman Court to provide a consistent building line along that street (See File No. Sh. P1 . 038-81) . If residential uses were to be established on the subject properties, the close proximity of such residential units to a major street would not be conducive to residential living and would not serve the public use and interest. In addition, screening and setbacks should be more extensive along arterial streets (Policy 4.D.6) . As indicated, similar restrictions were imposed upon the subdivision to the immediate south, Rainier Crest, and upon the Colasurdo property located along Union Avenue N.E. 6. Due to the close proximity of the proposed residential units to the south, a buffer should be provided along the south property lines of the commercial complex to provide a separation between two dissimilar uses. Section 5.B.3 indicates that buffers and setbacks should be employed between dissimilar uses. To provide the screening, five feet of landscaping should be employed as a buffer which is subject to approval of the city's landscape architect or other appropriate body. DECISION: Exhibit #2 is approved subject to the following conditions : 1 . The creation of utility easements in favor of the city and shown upon the face of the plat. 2. The execution of restrictive covenants which provide for a five-foot landscape buffer along the south property line subject to the approval of the city's landscape architect or other appropriate official . 3. The execution of restrictive covenants providing for a 20-foot setback along Whitman Court N.E. 4. The execution of restrictive covenants providing, a) that the subject property will be restricted to only those commercial uses, as opposed to residential uses, permitted within the B-1 zone as provided in the code and regulations and prohibiting the use of the subject property for residential uses; or b) providing that in the event residential riv Sh. P1 . 042-81 Page Four uses are constructed upon the subject property, such uses will be set back not less than 20 feet from Sunset Boulevard N.E. and Whitman Court N.E. , and such area will be used solely for landscaping. 5. PlYSICAL :PC GROU1ID: 1 . Topography: The subject site is essentially level. 2. Soils : Everett gravelly sandy loam, 5-15% slopes ErC) . This Everett soil is used for timber and pasture and for urban development. Ragnar Indianola association sloping (RdC) . These soils are used for timber. Shalcar muck (Sm) . Permeability is moderate in the organic layers and moderate to rapid in the lower part of the profile. There is a seasonal high water table at or near the sur- face. Runoff is ponded. There is no erosion hazard. This soil is used for row crops and pasture. 3 . Vegetation: Scrub grass is the dominant feature with some small shrubs in the northeast and central portions. Several large Douglas Fir trees are found in the north central section with a few Cedar trees located in the southwest. 4. Wildlife: The existing vegetation provides suitable habitat for birds and small mammals. 5. Water: Some surface water was observed on the subject site (April 24 . 1981 ) . Honey Creek flows through the site from southeast to northwest in the westerly portion of the property. 6. Land Use: The subject site is presently undeveloped. To the west is an auto body shop and service station while the property to the north is undeveloped. To the east are some condominiums, a financial services office and some apartments. In the Althoff rezone to the east (R-272-78) of March 6 , 1979, the Hearing Examiner as a condition of approval recommended the substantial number of existing trees and Honey Creek be retained upon future site development. It would appear that this decision together with the watershed and vegetation objectives cited in H-2 and H-3 above suggest a similar treatment of the subject site. it is advised, therefore, that proposed lots A and B be re-aligned to conform with the banks of Honey Creek as much as possible or Honey Creek be re-aligned to the proposed lots. Furthermore, if the stream remains uncovered, the channel should be a minimum of 20-feet wide with 5-feet landscaping strips including rockery) on both sides. 7. A latecomer ' s agreement for water on Sunset Boulevard will be assessed as well as system development charges for water, sewer as per Utilities Engineering comment. A special assessment area charge for sewer will also apply. 8. All future structures shall meet the Fire Code for occupancy. M.
