PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on July 10, 1981 . PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 14, 1981 at 9: 10 a.m. in the Council Chambers of the Renton Municipal Building. It was noted for the record that the applicant was not in attendance. Staff members wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner had received and reviewed the Planning Department report. Roger Blaylock, Associate Planner, presented the report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Short Plat Map Exhibit #3: Revised Road Alignment for Edwards Avenue Responding to the Examiner's inquiry regarding whether the new road alignment would eliminate Parcel 3, Mr. Blaylock advised that the parcel would not be entirely eliminated, and utilizing Exhibit #3, he explained the proposed roadway configuration. The Examiner noted that the new alignment would require vacation of certain portions of the right-of-way by the City Council . The Examiner requested testimony in support or opposition to the proposal . There was no response. He then invited staff comments. Responding was: Gary Norris Traffic Engineer Mr. Norris added that the location of driveways for the subject parcels should be subject to Traffic Engineering discretion and that they comply with all sight distance requirements and standards. He also noted that landscaping requirements should be overridden by sight distance concerns. Responding to the Examiner's inquiry regarding the maximum distance from the railroad trestle the driveway on Parcel 1 can be located and if safety concerns can be mitigated, Mr. Norris explained the proposed location of the driveway at the second curve from the north to S.W. 7th Street, and he noted that safety concerns can be mitigated if sight distance requirements are met. He also indicated that the existing landscaping on the original alignment had caused impaired sight distance which would have required removal . The Examiner requested final comments. Mr. Blaylock clarified that certain types of landscaping can be installed which would not impair sight distance such as low ground cover and shrubs or tall canopy trees. Since no further comments were offered, the hearing regarding File No. Short Plat 057-81 was closed by the Examiner at 9:25 a.m. i Sh. Pl . 057-81 Page Two FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The request is for approval of a three-lot short plat of approximately 5.38 acres. 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been determined exempt from the threshold determination by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. Utility services will have to be extended to the subject lots. 6. The subject property is located in the vicinity of 50 S.W. 7th Street, just south of the Burlington Northern Railroad right-of-way. 7. The subject site was annexed into the city in 1959 by Ordinance No. 1745. The current B-1 (business/commercial ) zoning was applied in May of 1961 by Ordinance No. 1884. 8. The Comprehensive Plan designates the area in which the subject site is located as suitable for the development of business and commercial uses. 9. The applicant proposes dividing the subject parcel into three lots. Lots 1 and 2 would meet the minimum standards of the Zoning and Subdivision Code. Lot 3 would stand alone on the east side of a newly dedicated street right-of-way of Edwards Avenue S.W. Lot 3 would be substandard, and the Planning Department recommended that the lot be combined with the property immediately adjoining the lot. 10. The Traffic Engineering Department indicated that the potential sight lines of driveways serving Lot 1 could create a problem and that the ultimate driveway configuration be left to that department 's final determination. The railroad trestle is immediately abutting Lot 1 . 11 . The alignment of the newly dedicated Edwards Avenue presents a double "S" curve and the Planning Department and the Traffic Engineering Department recommended that the curve be modified to permit safe vehicular movement on Edwards Avenue south of the railroad trestle. The new alignment would require a further small dedication of right-of-way and possible concommitant vacation of small portions of the already dedicated roadway. Such vacation is the province of the City Council . The applicant's engineer waived responsibility in drafting the current roadway alignment. CONCLUSIONS: 1 . If the conditions recommended by the Planning and Traffic Engineering Departments are imposed, the proposed short subdivision will serve the public use and interest. 2. The current roadway configuration is unsafe, and the applicant' s engineer and the city' s Traffic Engineer indicate as much. The alignment proposed and represented in Exhibit #3 will provide a safer alignment and is necessary as a matter of public safety. 3. Lot 3 would not meet the minimum standards of the Subdivision Ordinance, and should therefore be incorporated into the adjoining property. 4. The land is zoned B-1 , and therefore the subdivision will enable the development of reasonably sized commercial lots in this still developing commercial area. The Sears Shopping Center is immediately north of the subject site and the proposed Earlington Woods commercial PUD is proposed for a site northwest of the subject property. 5. The close proximity of the railroad trestle to Lot 1 may create sight distance problems associated with a driveway location for that lot. In order to avoid any potential sight clearance problem, the driveway for proposed Lot I should be subject to the approval of the Traffic Engineering Division and landscaping should also be carefully reviewed. DECISION: Sh. P1 . 057-81 Page Three Exhibit #2 should be approved subject to the following: 1 . The realignment of the roadway as presented in Exhibit #3. 2. PLANNING DEPARTMENT Tile Planning Department preliminary report was received by the REPORT: Examiner on July 10, 1981 . PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 14, 1981 at 9: 10 a.m. in the Council Chambers of the Renton Municipal Building. It was noted for the record that the applicant was not in attendance. Staff members wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner had received and reviewed the Planning Department report. Roger Blaylock, Associate Planner, presented the report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Short Plat Map Exhibit #3: Revised Road Alignment for Edwards Avenue Responding to the Examiner' s inquiry regarding whether the new road alignment would eliminate Parcel 3, Mr. Blaylock advised that the parcel would not be entirely eliminated, and utilizing Exhibit #3, he explained the proposed roadway configuration. The Examiner noted that the new alignment would require vacation of certain portions of the right-of-way by the City Council . The Examiner requested testimony in support or opposition to the proposal . There was no response. He then invited staff comments. Responding was: Gary Norris Traffic Engineer Mr. Norris added that the location of driveways for the subject parcels should be subject to Traffic Engineering discretion and that they comply with all sight distance requirements and standards. He also noted that landscaping requirements should be overridden by sight distance concerns. Responding to the Examiner' s inquiry regarding the maximum distance from the railroad trestle the driveway on Parcel 1 can be located and if safety concerns can be mitigated, Mr. Norris explained the proposed location of the driveway at the second curve from the north to S.W. 7th Street, and he noted that safety concerns can be mitigated if sight distance requirements are met. He also indicated that the existing landscaping on the original alignment had caused impaired sight distance which would have required removal . The Examiner requested final comments. Mr. Blaylock clarified that certain types of landscaping can be installed which would not impair sight distance such as low ground cover and shrubs or tall canopy trees. Since no further comments were offered, the hearing regarding File No. Short Plat 057-81 was closed by the Examiner at 9:25 a.m. Sh. Pl . 057-81 Page Two FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now ma es and enters the following: FINDINGS: I . The request is for approval of a three-lot short plat of approximately 5.38 acres. 2. The application file containing the application, SEPA documentation, the Planning Dep:rtment report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pur.uant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been det-rmined exempt from the threshold determination by the Environmental Review Com ittee, responsible official . 4. Pla s for the proposal have been reviewed by all city departments affected by the imp:ct of this development. 5. Utility services will have to be extended to the subject lots. 6. The subject property is located in the vicinity of 50 S.W. 7th Street , just south of he Burlington Northern Railroad right-of-way. 7. The subject site was annexed into the city in 1959 by Ordinance No. 1745. The current B-1 ' (business/commercial ) zoning was applied in May of 1961 by Ordinance No. 1884. 8. The Comprehensive Plan designates the area in which the subject site is located as sui able for the development of business and commercial uses. 9. The applicant proposes dividing the subject parcel into three lots. Lots 1 and 2 wou d meet the minimum standards of the Zoning and Subdivision Code. Lot 3 would sta d alone on the east side of a newly dedicated street right-of-way of Edwards Ave ue S.W. Lot 3 would be substandard, and the Planning Department recommended tha the lot be combined with the property immediately adjoining the lot. 10. The Traffic Engineering Department indicated that the potential sight lines of driveways ser ing Lot 1 could create a problem and that the ultimate driveway configuration be lef to that department ' s final determination. The railroad trestle is immediately abu ting Lot 1 . 11 . The alignment of the newly dedicated Edwards Avenue presents a double "S" curve and the Planning Department and the Traffic Engineering Department recommended that the cur e be modified to permit safe vehicular movement on Edwards Avenue south of the rai road trestle. The new alignment would require a further small dedication of rig t-of-way and possible concommitant vacation of small portions of the already ded cated roadway. Such vacation is the province of the City Council . The applicant's engineer waived responsibility in drafting the current roadway alignment. CONCLUS ONS: 1 . If , he conditions recommended by the Planning and Traffic Engineering Departments are imposed, the proposed short subdivision will serve the public use and interest. 2. The current roadway configuration is unsafe, and the applicant' s engineer and the cit'' s Traffic Engineer indicate as much. The alignment proposed and represented in Exhibit #3 will provide a safer alignment and is necessary as a matter of public safety. 3. Lot 3 would not meet the minimum standards of the Subdivision Ordinance, and should therefore be incorporated into the adjoining property. 4. The land is zoned B-1 , and therefore the subdivision will enable the development of rea•onably sized commercial lots in this still developing commercial area. The Sears Sho•ping Center is immediately north of the subject site and the proposed Earlington Woos commercial PUD is proposed for a site northwest of the subject property. 5. The close proximity of the railroad trestle to Lot 1 may create sight distance pro. lems associated with a driveway location for that lot. In order to avoid any pot:ntial sight clearance problem, the driveway for proposed Lot 1 should be sub ect to the approval of the Traffic Engineering Division and landscaping should als. be carefully reviewed.
