SUMMARY OF REQUEST: The applicant requests approval of a two-lot short plat together with a variance for access by pipestem road and a waiver of required off-site improvements. SUMMARY OF ACTION:Planning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approval with conditions. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on August 5, 1981 . PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 11 , 1981 at 10:08 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner had received and reviewed the Planning Department report. It was also noted for the record that neither the applicant nor his representative was in attendance at the hearing. Roger Blaylock, Associate Planner, presented the report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Short Plat Map Mr. Blaylock discussed the original requirement for a 30-foot pipestem in lieu of 20 feet for eventual construction of a standard roadway in coordination with the adjacent property owner, but development of that property had resulted in location of residences close to the property line, and the 30-foot pipestem is no longer necessary for future road construction. The Examiner requested testimony in support or opposition to the proposal . Since there were no further comments, the hearing regarding Short Plat 062-81 was closed by the Examiner at 10: 16 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The request is for approval of a two-lot short plat together with a variance for pipestem access and a waiver of the required off-site improvements. 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been determined exempt from the threshold determination by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. SH. F 062-81 Page Two 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-729(D) (2) ; G-7200 (General ; Single Family Residential ; Minimum lot size - 7200 square feet) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The subject property is located in the vicinity of 1317 N. 34th Street. The +.95 acre lot is generally level . An existing single family home is located on the soiuthernmost"portion of the lot. 9. The applicant proposes dividing the subject parcel into two parcels. The northerly lok would contain about 8,077 square feet and the southern parcel would contain in excess of 33,000 square feet. 10. The parcel is approximately 100 feet wide by about 300 feet deep. To provide access to the rear portion which would be the southerly lot, the access method proposed is the creation of a 30-foot pipestem for which a variance is necessary (Section 9-1108 23) (F) (3) (d) ) . 11 . The subject site is located in Kennydale in an area which is developed exclusively with single family homes. Lot sizes vary among the homes in the area with some lots below the required 7,200 square feet required in the G-7200 zone and other lots meeting or exceeding those minimum standards. 12. The site was annexed into the city in December of 1969 by Ordinance No. 2531 . The G-7200 zoning was applied at that time. 13. The subdivision will create an additional lot with potential for single family development. The impact of the additional single family home on population, schools and traffic is small . 14. With the exception of improved road surfaces, there are few other off-site improvements in the area surrounding the subject site. Waivers of off-site improvements have been granted to property immediately to the east (File No. Sh. Pl . 107-80, Ray Brown Short Plat) and for property located one-half mile to the south (File No. Sh. P1 . 058-80, Kathleen Kelleher Short Plat) . 15. The Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single family uses. 16. A latecomers fee for water applies to development on the subject property. CONCLUSIONS: 1 . The proposed short plat appears to serve the public use and interest. The plat is compatible with the Comprehensive Plan which designates property in the area as suitable for the development of single family uses. 2. The proposal is also compatible with the G-7200 zone in which the property is located. The applicant proposes two lots, the smaller lot is in excess of 8,000 square feet while the larger lot is more than four times the minimum 7,200 square feet required in the zone. 3. The additional lot will not tax essential services in the area and will provide a suitable site for an additional single family home. Variance 4. The applicant has applied for a variance to provide access to the rear portion of a lot which, if undivided, would be over five times the minimum required lot size. The pipestem provides a reasonable method of allowing the applicant to make reasonable use of the subject site. The only other option available would create two rather long, narrow lots which would still need a variance since the length of the lot would exceed the lot width by more than two and one-half times. 5. The 30-foot wide pipestem will not materially harm neighboring properties. The driveway can be located away from the east property line and not impact the eastern neighboring properties. 6. The pipestem will only be about 80 feet long and will not adversely affect the public welfare. The Fire Department will not be impacted by the length of the property access. I SH. Pipestem access is a much used method of providing access to rear lots in an area such as Kennydale where the existing street pattern does not provide access to the interior portions of the formerly large lots. Waiver 8. The general absence of off-site improvements in the area would make the installation of such improvements adjacent to the subject site unreasonable and virtually useless. Similar waivers have been granted to other properties and such waiver will not adversely affect the public welfare nor other properties in the area. DECISION: Exhibit #2 is approved. The variance for pipestem access is approved. The waiver of off-site improvements is approved. ORDERED THIS 14th day of August, 1981 . t3 Fred J. Wildlife: The existing vegetation provides suitable habitat for birds and small mammals. 5. Water : No surface water was observed on the subject site (July 27, 1981 ) . 6. Land Use: Single family residences are located on the subject site and on all of the adjacent properties. E. NEIGHBORHOOD CHARACTERISTICS: The surrounding properties are principally single family residential in nature. F. PUBLIC SERVICES: 1 . Water and Sewer : 3" and 8" water mains extend east-west on North 34th Street adjacent to the site while a 12" main runs north-south along Meadow Avenue North within 200 feet to the east of the property. An 8" sanitary sewer is located on North 34th Street. 2. Fire Protection : Provided by the City of Renton as per ordinance requirements . 3. Transit : Metro Transit Route 142 operates along Park Avenue North within 1/4 mile to the south of the subject site and Route 240 operates along I-405 with a stop approximately 1/4 of a mile to the southeast of the subject site. 4 . Schools : Kennydale Elementary School is located approximately 1/4 mile to the southeast of the subject site, while McKnight Middle School is approxi- mately 11 miles the same direction, and Hazen High School is within three miles to the southeast. 5. The proposed short plat is consistent with the Comprehensive Plan and zoning designations of single family for the site and surrounding area. 2. The proposal is compatible with the existing single family uses adjacent to the subject site. 3. The size of the property is large enough that the proposed short plat can be considered a reasonable use of the land. Lots 1 and 2 exceed the minimum lot size requirement of the G-7200 zone and the Subdivision Ordinance. Although the amount of frontage on North 34th Street is sufficient to meet the 60-foot standard for each lot, the applicant is seeking a variance to permit a 20-foot pipestem configuration on proposed Lot 2 due to the fact that standard 60-foot lots would exceed the 21 foot (width x length) standard of Section 9-1108-23F3a) . Strict application of the Subdivision Ordinance would, therefore, not permit a short subdivision. Givon these circumstances, it would seem that reasonable justification can be supplied for the proposed variance (Section 9-1109. 1A) . 4 . A waiver of the required off-site improvements has been sought by the applicant based upon the contention that no improvements exist in the vicinity other than asphalt paved streets. In addition, an attempt to establish an LID in the area failed on July 28, 1980. Other efforts have met similar fates. Also, on August 6, 1980, the Hearing Examiner granted a similar waiver request in the Kathleen Kelleher Short Plat at North 30th Street and Burnett Avenue North within one-half mile to the southwest.
