SH. PL. 076-81 LOCATION: Vicinity of 421 Union Avenue N.E. SUMMARY OF REQUEST:The applicant seeks approval of a three-lot short plat. SUMMARY OF ACTION: Planning Department Recommendation: Approval with modifications and conditions. Hearing Examiner Decision: Approval of two-lot short plat with conditions. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on October 7, 1981 . PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows : The hearing was opened on October 13, 1981 at 10:35 a.m. in the Council Chambers of the Renton Municipal Building. Because the applicant was not in attendance, the hearing was continued to October 20, 1981 . CONTINUANCE: The hearing was reopened on October 20, 1981 , at 9:55 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. Roger Blaylock, Associate Planner, presented the Planning Department preliminary report , and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Short Plat with staff comments Exhibit #3: Building Site Plan for existing restaurant The Examiner requested testimony by the applicant. Responding was : Drury Pickering 421 Union Avenue N.E. Renton, WA 98056 Mr. Pickering discussed the availability of additional parking space which could be gained through removal of drive-in islands and landscaping which is in excess of city code requirements. He indicated the desire to maintain proposed Lot 1 in its current configuration due to needs of a potential buyer, and if revision is necessary on the plat configuration, it was requested that Lot 2 be modified instead. Utilizing Exhibit #3, Mr. Pickering discussed the availability of alternative modifications to enable provision of 17 additional parking spaces. Responding to the Examiner's inquiry regarding the applicant's objection to creation of only two lots in the short plat which would result in limiting access to Union Avenue N.E. with a minimal amount of curb cuts, Mr. Pickering noted that an excessive amount of property is supported now by the existing restaurant, and subdivision would allow future development. However, if a two-lot short plat is granted, he indicated his preference to dividing off Lot 1 and retaining the remainder of the property as Lot 3, which would also allow expansion of parking area to the north for the restaurant patrons. The Examiner requested testimony in support of the application. Responding was : Gerald Robison 23800 Pacific Highway S. Kent, WA 98031 Mr. Robison, realtor for the applicant, advised that a sale of Lot 1 is pending, and Sh. P1 . 076-81 Page Two A--- ultimat development would include combining that property with property to the westhaving11 access to N.E. 4th Street. Curb cuts on Union Avenue N.E. from that site would therefore be minimized. He reiterated Mr. Pickering' s request to divide the northern 100 feet of the site and retain the remainder in one lot if a two-lot short plat is approved since a sale of Lot 1 is pending. However, he stated that the applicant is able to provide required parking space on the restaurant site, and division into three lots would provide one additional business lot for which a ready sales market exists. The Examiner noted that parking requirements would depend upon proposed uses on the lots. Mr. Blaylock advised the Planning Department recommendation to approve a three-lot configuration if a reservation is placed on the face of the plat to preclude construction on Lot 2 until parking provisions are modified on Lot 3 in conformance with city codes. The Examiner indicated that it appears 30 parking spaces can be adequately accommodated on Lot 3 in response to the applicant's comments. Since no further comments were offered, the hearing regarding File No. Short Plat 076-81 was closed by the Examiner at 10: 15 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The applicant , Drury Pickering, filed a request for a three-lot short plat. 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , RCW 43.21C, as amended, the subject proposal has been determined exempt from the threshold determination by the Environmental Review Committee (ERC) , responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. All existing utilities are available and in close proximity. 6. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-711 (Business/Commercial ) of Title IV, Ordinance No. 1628, Code of General Ordinances. 7. The subject property is located on the east side of Union Avenue N.E. in the vicinity of 421 Union Avenue N.E. , just north of N.E. 4th Street. 8. The subject site is gently sloping from the northwest to the southeast. 9. The subject site is part of the original plat of the city, and the site was reclassified to B-1 from S-1 (Single Family Residential ) in 1955 by Ordinance No. 1510. 10. An existing restaurant, Pick's No. 2, and associated parking lot are located on the subject site. The remainder of the site is undeveloped. The undeveloped portion of the site is generally covered with grasses and there are some Douglas fir trees on the site. 11 . The applicant proposes creating a three-lot short plat of the subject 1 .57 acre site pursuant to Section 9-1105 of the Subdivision Ordinance. 12. The record indicates that the required parking for the restaurant could be provided at the site of the restaurant, proposed Lot 3. 13. The creation of a three lot short plat would increase the number of curb cuts along Union Avenue N.E. , an arterial street, to six curb cuts over a distance of about 350 feet of frontage. 14. The combining of Lot 1 with property to the west, suggested at the hearing, with access to N.E. 4th Street would increase the number of curb cuts on that arterial as well . 15. The applicant indicated that a two-lot short plat would be acceptable if Lots 2 and 3 were combined. 16. The Comprehensive Plan designates the area in which the subject site is located as j .. Sh. Pl . 076-81 Page Three suitable for commercial uses. CONCLUSIONS: 1 . The proposed short plat, if limited to two lots, appears to serve the public use and interest. The division will create smaller, separate lots capable of supporting reasonable commercial development. 2. The Comprehensive Plan indicates that strip development along arterial streets should be avoided. In bolstering that policy, the plan specifies that curb cuts along arterial streets should be minimized so as to limit the interruption of vehicles entering the traffic stream (page six of the Renton Urban Area Comprehensive Plan; Policies 7.B.4 and 7.C.3 and 4 of the Policies Element) . 3. While the limitation to a two-lot plat may limit the potential development somewhat on the resulting lots, small commercial or retail centers using common access and drives are still very possible on the lots. There should be little or no effect on the actual development potential of the subject site by the two lot limitation. At the same time, the purpose of arterial streets will not be impaired. Both N.E. 4th aid Union Avenue N.E. with less driveways will provide for a safe and smooth flow of traffic through the city. DECISION: The short plat as limited above and subject to the appropriate installation of required improvements is approved. ORDERED THIS 30th day of October, 1981 . Fred J. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact , error in judgment or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner' s decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting other specified requirements. Copies of this ordinance are available for inspection in the Finance Department, first floor of City Hall , or same may be purchased at cost in said department. Soils : Alderwood gravelly sandy loam (AgC) . Permeability is moderately rapid in the surface layer and subsoil and very slow in the substratum. Runoff is slow to medium and the erosion hazard is moderate. This soil is used for timber, pasture, berries, rowcrops, and for urban development. 3. Vegetation: Ground cover consists principally of scrub brush and weeds (except for improved areas) while numerous Douglas Fir trees are found throughout the property. 4. Wildlife: The existing vegetation provides suitable habitat for birds and small mammals. 5. Water: No surface water was observed on the subject site (September 25, 1981 ) . 6. Land Use: An existing restaurant is located on the subject site (Proposed Lot #3) . The remainder of the site is undeveloped. E. NEIG M:;1 :4.0OD CHAR CTEISTICS: The surrounding properties are a combination of commercial uses and undeveloped parcels. PUBLIC SERVICES: 1 . Water and Sewer: A 12" water main extends north-south on Union Avenue N.E. adjacent to the subject site and east-west on N.E. 4th Street approximately 150' southwest of the property. City of Renton Utilities Division. 5. City of Renton Fire Department. L. PLANNING DEPARTMENT ANALYSIS: 1 . The proposed short plat is consistent with the Comprehensive Plan and B-1 zoning for the subject site and surrounding area. 2. All of the proposed lots meet the minimum requirements of the Subdivision Ordinance for size and frontage. 3. The proposed short plat divides the existing parking lot for Pick's No. 2 Restaurant. The 3, 021 square foot building would require 30 parking spaces; 43 parking spaces are provided. It would appear from the building plans that the proposed Lot #3 would not be functioning independently from Lot 2. If Lot #3 was expanded to allow minimum required parking per ordinance the lot width would be approximately 195 feet. This would result in the reduction of Lot #1 to 88 feet, which would still comply with the length/width ratio of 21 to 1 . Eventhough there is the possibility of 3 lots under the code requirements, the applicant has not specifically shown how the parking lot will be physically divided. The Engineering Division has required the submission of detailed parking lot plans for approval. Lots 1 and #2 are very limited because of their shape. The applicant has not proven that it is in the public interest to create business lots that are physically constrained. It is recommended that the short plat be reduced to 2 lots instead of 3 lots. 4 . Utility plans for development of the property must be approved by the Engineering Division of the Public Works Department. 5. Future construction will require access approval as per Fire Department standards. 6. A latecomer' s agreement for water will apply as noted by the Utilities Engineering Division.
