It does have some minor corrections as noted in writing. The Hearing Examiner must now sign off on all short plats and there is no longer a Planning Department, it is the Building and Zoning Department. The short plat must be completed by a licensed surveyor. Please submit the mylar along with two copies. A Short Plat Certificate from a title company is also required and it would be helpful to attach the computer tape of the surveyor's calculations for closure. The letter noted agreement reached on these proposals: (1 ) If the first phase of the P-1 Channel becomes a reality in its present location; (2) If the Channel is either not excavated at all or such excavation is delayed until after Metro desires to expand the use of its property. Cable TV Stredicke called attention to newspaper article from John Welch, Lynnwood Ave. , noting the City had referred complaint to Lon Hurd, 3-H Management, City' s TV consultant, that satisfactory service had been received from cable company. Councilman Reed noted requests have been received for cable service to Rolling Hills and Tiffany Park area. Garbage Contract Stredicke noted in near future garbage could have high value for energy production and inquired if contract allows for City to receive value rather than contractor. Clemens Policy Development Director RE: EATON SHORT PLAT 080-81 The applicant argues that the City Council should reverse the Examiner's deci- sion because of: 1. Non-conformity of the Renton ordinance to other cities' . 2. Septic tank systems in the area work well. 3. Late-comer repayment is unlikely. 4. Cost. 5. L.I.D. unlikely to be feasible. 6. Staff recommendation in favor of variance. It should be noted that the Examiner concluded that the record failed to support the required finds of: 1. Special physical circumstances. 2. Insure property rights. 3. Will not be detrimental to the public welfare. Further, the Examiner states in his conclusion that in light of the lack of justi- fication required by ordinance, only a change in Council policy will resolve the situation. This department has reviewed the record and cannot determine any special circum- stances or adversely affected property rights. Any property similarly located 600 feet from a sewer connection would be identically affected. Second, the applicant has failed to present any errors in fact (The evidence in the appeal is substantially the same as the original testimony. ) or law (The applicant agrees in the appeal that the requirement is valid, but costly. ) . Section 4-3016 requires the applicant to demonstrate an error in fact or law exists and prohibits the Council substituting its judgment for the Examiner's. RECOMMENDATION: Find the appeal in this matter is not supported by errors in fact or law and deny the appeal. If the Council deems the distance established by ordinance inappropriate, the ordinance should be given adequate review to determine its merit or lack thereof. A check with other valley cities indicates that their ordinances require a sewer line extension for up to 200 feet from an existing sewer line. 2. None of the residents fronting the proposed sewer addition are willing to participate in its cost and because of the excellent soil in the area (sandy loam) the drainfields have worked very well for many years and most likely will continue to do so. 3. Because the drainfields work so well in this area, the possibility of Mr. Eaton being able to recoup some of the original sewer main installation costs in a late comer agreement are almost non-existant in the allowable time period . 4. Bids for the installation of the proposed main extension obtained by Mr. Eaton range from 320,000.00 to $30,000.00 which creates a very severe strain on Mr. Eatons ability to short plat this property which he has owned for 40 years . 5. Discussions with the Public Works Department indicate that problems have not been experienced with drainfields in this area and the feasibility of a L.I.D. for a sanitary sewer main extension in the area is quite remote. 6. SUMMARY 0= REQUEST: The applicant seeks approval of a two-lot short plat together with variances for a pipestem lot, deferral of installation of sewer, and a waiver of the required off-site improvements. SUMMARY 0 " ACTION: Planning Department Recommendation: Approval subject to conditions and execution of restrictive covenants. Hearing Examiner Decision: Approval of short plat , pipestem variance and waiver; Denial of sewer variance. PLANNING [ EPARTMENT The Planning Department preliminary report was received by REPORT:the Examiner on October 21 , 1981 . PUBLIC HEARING: After reviewing the Planning Department report , examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on October 27, 1981 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. Roger Blaylock, Associate Planner, presented the Planning Department staff report , and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2 : Short Plat with staff comments showing property layout Mr. Blaylock advised that the Planning Department questions whether the division of property would separate the existing septic tank drainfield on Lot 1 . Although no "as built" plans are availatle for the drainfield, it appears that the field has a 10-foot buffer adjacent to all other lots and proposed Lot 2 . He also noted that a letter of certification from the Seattle-King County Department of Public Health to allow a variance to defer installation of sewer pipe has not yet been received, but pre-evaluation of the subject site by that division appears to be positive. The Examine- requested testimony by the applicant . He also requested that the applicant ' s comments address the criteria which must exist to allow approval of a variance: that the applicant s.iffers undue hardship because of special circumstances on the site due to topography, size, shape or surroundings of the subject property; that such approval will not be mate-ially detrimental to the public welfare; or that approval shall not constitute a grant of ,pecial privilege. He clarified that variance approval is unconditional and not subject to execution of restrictive covenants to participate in a future LID. Responding was : Mary Seabrands 20219 S.E. 344th Auburn, WA 98002 Mr. Seabrancs indicated the applicant 's willingness to sign restrictive covenants for future participation in an LID for installation of streets and sewer line, and to comply with the Planning Department recommendation for removal and relocation of the existing garage on the site to provide access to the second lot. He noted that costs of extension of the sewer line a distance of 600 feet would be exhorbitant , in excess of $20,000, for pavement restoration and extension of the line. Sh. Pl . 080-81 Page Two The Examiner advised that justification for granting a variance does not include economics, and he cited Section 9-1108. 14 of the Subdivision Ordinance which requires provision of a complete sanitary sewer system at no cost to the city providing a public sewer main is located within one thousand feet or less of the nearest property line of the proposed subdivision. Mr. Seabrands stated that as far as gravity flow, there are no restrictions which would preclude connection of the sewer line, and the Comprehensive Plan designates installation of a line at that location. The Examiner requested testimony in support or opposition to the proposal . There was no response. He then advised that the record would remain open to allow submission of the report from the Seattle-King County Department of Public Health certifying that the site is adequate for on-site sewage disposal . Since there was no objection, the hearing regarding File No. Short Plat 080-81 was closed by the Examiner at 9:24 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The applicant, Emmett Eaton, filed a request for a two-lot short plat together with a variance for a pipestem access, a variance to provide a septic system rather than sewered sanitary waste disposal , and a waiver of the required off-site improvements. 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton' s Environmental Ordinance and the State Environmental Policy Act of 1971 , RCW 43.21C, as amended, the subject proposal has been determined exempt from the threshold determination by the Environmental Review Committee (ERC) , responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. The subject property is located in the vicinity of 1324 Aberdeen Avenue N.E. An existing single family home and detached garage are located on the west side of the property on proposed Lot 1 . 6. The subject site was annexed into the city in March of 1960 by Ordinance No. 1822 at which time the existing G-7200 (Single Family Residential ; Minimum lot size - 7,200 square feet) zone was established. 7. The subject site is essentially level and is covered with lawn grass and trees and shrubs. 8. The area is predominantly developed with single family uses. 9. Schools and recreational facilities are located no further than one and one-quarter mile from the site. 10. The subject .57 acre lot is 252.3 feet deep by 100 feet wide. The applicant proposes creating an 80 foot wide by 150 foot deep lot (proposed Lot 1 ) fronting on Aberdeen Avenue N.E. The remaining interior lot (proposed Lot 2) would have a 20 foot wide, 150 foot long pipestem with the main body being 100 feet wide by about 102 feet deep. 11 . The streets are paved but there is no evidence of other off site improvements in the subject area. 12. The nearest sewer line is about 600 feet to the southeast along N.E. 12th Street. 13. Pursuant to Section 9-1108(23) (F) (3) (d) , pipestem access not to exceed more than 150 feet in length and not to be less than 20 feet in width may be approved by the Hearing Examiner. 14. The applicant proposes providing a septic system for the disposal of sewage. Pursuant to Section 9-1108(22) (14) , any subdivision within 1 ,000 feet of a public sewer main must provide a hookup to that main. Therefore, the applicant has requested a variance from this provision. 15. The variances have been requested pursuant to Section 4-722(G) . 16. The applicant has requested a waiver of the required off-site improvements pursuant to Section 9-1105(6) (B) . Sh. P1 . 080-81 Page Three 17. Pipestem access has been permitted in the vicinity at 2201 Aberdeen Avenue N.E. and at 2218 N.E. 20th Street. 18. Percolation tests performed on the subject site indicate that the property is potentially suitable for a septic installation. The King County Department of Health concurred. The Building Department indicated that proposed Lot 2 must be a minimum of 12,000 square feet to prevent the city from being responsible for the septic system maintenance. Lot 2 is over 13,000 square feet with the pipestem extension. 19. This area of the city is served by private septic tanks and drainfields. No problems have been reported. 20. The Planning Department indicated that the variance for sewer be granted subject to a condition to take part in an LID if one is initiated for the area. Variances are granted unconditionally based on unique property conditions and are not subject to revocation. A variance can only be conditioned in some manner as to make the proposal compatible with the area as in a modification of bulk, distance or size. 21 . The site can be served by a gravity sewer line. CONCLUSIONS: Short Plat) 1 . The two lot short plat appears to serve the public use and interest. The subject parcel will be divided into two lots which each substantially exceed the minimum 7,200 square feet needed to comply with the underlying G-7200 foot zoning. 2. The lot division will also create an additional buildable lot in a developed single family area permitting in-filling in already developed areas of the city rather than forcing additional development further out of the city. 3. The short plat will also increase the tax base but will not measurably increase the burden on existing city services. The payment of a systems development charge will help offset impacts of the proposal . Variance for Pipestem Access) 4. The large size of the lot and the lack of any method of providing public access to interior portions of this and other superblocks places an undue hardship on the applicant. 5. Other similar variances to allow pipestem access to large, interior lots have been granted, and therefore approval of the subject variance will not create a precedent in favor of the applicant. 6. The access will be twenty feet wide and should not adversely interfere with neighboring properties any more than a typical driveway access. Variance for Septic Installation) 7. The applicant has failed to demonstrate that undue hardship results from the size, shape, topography or location of the subject site. While the site is 600 feet distant from the sewer main and an extension will entail a considerable expense, the ordinance, in fact, requires a hookup for all subdivisions within 1 ,000 feet of a sewer main. A variance request not justified under the variance criteria is rather a question of policy, and a policy the Council has previously determined in favor of sewer hookups when a sewer main is located within 1 ,000 feet of a proposed subdivision. 8. The King County Department of Health has indicated that the percolation rate for the site is adequate to support a septic system. The lot size is larger than 12,000 square feet, and therefore the city would not be responsible for the maintenance of the system. If the variance were granted, it would not now adversely affect the public health, safety or welfare. 9. The approval of the variance would negate the effect of Section 9-1108(14) since there is no special justification to grant the variance in this instance. If the variance were granted in this instance, it would prove difficult to hereafter deny variances from the sewer requirements. The granting of the variance would result in a special privilege for the applicant and set precedent to waive sewer requirements for any subdivision. (See the Michael Baker Short Plat application wherein a request for an Sh. P1 . OB0-81 Page Four 1 exception from the sewer requirements was denied; Short Plat 417-79.) 10. While the applicant has failed to demonstrate that a variance should be granted in this instance, the City Council might wish to review the distance requirement as it relates to future applications. Under the current criteria, and courts will not permit economics as a justification in any event, absent clear topographical or physical hardship, a variance may not be granted. Waiver of Off-Site Improvements) 11 . The absence of improvements other than roadway pavement in the surrounding area justifies granting the requested waiver of the required off-site improvements . The relatively short length of sidewalk will not add appreciably to the safety of pedestrians in the area and would be incongruous with the general character of the area. DECISION: The short plat, Exhibit #2, is approved. The variance for pipestem access is approved. The variance for septic installation is denied. Soils : Indianola loamy, fine sand, 4-15% slopes InC) . Permeability is rapid. Available water capacity is moderate. Runoff is slow to medium, and the erosion hazard is slight to moderate. This soil is used for timber and for urban development. 3. Vegetation: Lawn grass is the dominant feature with some scattered deciduous and evergreen trees. 4 . Wildlife: The existing vegetation provides suitable habitat for birds and small mammals. 5. Water: No surface water was observed on the subject site (October 9, 1981 ) . 6. Land Use: An existing single family residence is located on proposed Lot #1 of the requested Short Plat. Similar uses are found on the parcels to the south, west and north. The property adjacent to the east remains undeveloped. E. EIGHBO.c:OOD CHARACTERISTICS: The surrounding properties are principally single family residential in nature. F. PUBLIC SERVICES: 1 . Water and Sewer: A 6" water main extends north-south on Aberdeen Avenue adjacent to the subject site while an 8" sanitary sewer runs east-west on N. E. 12th Street approximately 600' to the southeast. 2. Fire Protection: Provided by the City of Renton as per Ordinance requirements. 3. Transit : METRO Transit Route #242 operates along Edmonds Avenue N. E. approximately 1/4 mile to the east of the subject site. 4. Schools : The Kennydale Elementary School is approximately 1 1/4 miles to the northwest of the subject site while McKnight Junior High School is within 1/4 mile to the east and Hazen Senior High School is approximately 1 1/4 miles east. 5. City of Renton Utilities Division. 5. City of Renton Fire Department. L. PLANNING DEPARTMENT ANALYSIS: 1 . The proposed Short Plat is consistant with the Comprehensive Plan and zoning designations of single family for the site and surrounding area. 2. The proposal is compatible with the existing .single family uses on the adjacent properties. 3. Both lots of the proposed Short Plat exceed the minimum lot size requirement of the G-72000 zone and the Subdivision Ordinance. However, there is insufficient frontage (100 ' ) along Aberdeen Avenue N.E. for more than 1 lot (Section 9-1108-23F3c requires a minimum lot width of 60 feet) . Strict application of this standard would not permit a short subdivision. The applicant has, therefore, applied for a Variance to permit a 20 ' pipestem lot. Similar Variances were approved in the vicinity in 1978 at 2201 Aberdeen Avenue N. E. (Collins) and 2218 N.E. 20th Street (Slavick) . Given these and the lot area available it would appear that reasonable justification can be supplied for the proposed Variances (Section 9-1109-1A) . 4111 PRELIMINARY REPORT TO THE HEARING EXAMINER EATON, EMMETT E. OCTOBER 27 , 1981 PAGE FOUR 4 . Community facility connection charges for water and sewer will apply as well as en extension for sanitary sewer as noted by the Utilities Engineering Division. Regarding the later, the applicant has applied for a Variance (V-083-81 ) to defer installation of this pipe. A letter of justification (September 17, 1981 ) referring to percolation sites said to conply with Seattle-King County Department of Public Health requirements for on-site sewage disposal accompanies the application. This particular request may be acceptable to the City provided it does comply with the Seattle-King County Department of Health standards and the property owner consents to signing an agreement to participate in an L. I. D. for sanitary sewer in the vicinity. 5. The applicant is also seeking a Waiver of the required off-site improvements based upon the contention that these improvements do not generally exist in the vicinity. Field investigation of the site shows this to be so. Paved Aberdeen Avenue is the only real improvement. On the Collins and Slavick Short Plats cited in #3, similar Waivers were approved. 6. A concrete structure appears to be located in the area designated for the pipestem access to proposed Lot #2. This structure will have to be removed prior to construction of the pipestem road. M. DEPARTMENTAL RECOMMENDATIONS Based upon the above analysis recommend approval of the Short Plat request. subject to removal of the concrete block garage. It is also recommended that the Variances for a pipestem lot be approved. The Variance request to defer installation of sanitary sewer pipe should be approved subject to agreement by the applicant to participate in an L. I.D. for the area.
