SUMMARY OF REQUEST: Pursuant to Section 4-722(G) , Variances, the applicant is requesting a variance from Section 4-711 (A) (7) , which requires that any lumber yard maintain a setback of at least 100 feet to the property line of a residential district. The applicant is specifically requesting enlargement of the outdoor storage yard to approximately 65 feet of an adjacent residential lot . SUMMARY OF ACTION: Building & Zoning Department Recommendation: Denial Hearing Examiner Decision: Denial BUILDING & ZONING The Building and Zoning Department report was received by DEPARTMENT REPORT: the Examiner on February 18, 1982. PUBLIC HEARING: After reviewing the Building & Zoning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on February 23, 1982 at 9:50 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. Roger Blaylock, Zoning Administrator, presented the Building & Zoning Department report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Building 8nd Zoning Department report and other pertinent documents Exhibit #2: Site Plan Responding to the Examiner's inquiry regarding whether sufficient parking space currently exists on the subject site without the proposed expansion, Mr. Blaylock advised that although 30 spaces are required, only 25 appear to be currently provided. The Examiner noted that the language in the Zoning Code refers to specific side lines of residential. districts, and since it appears that the concern is with the front yard property lines of residential districts, a variance for setbacks may not be required for parking purposes. He then requested Mr. Blaylock to designate on the Zoning Map various zoning districts surrounding the subject site. Mr. Blaylock reviewed business/commercial zoning on the three southernmost lots and to the north, and single family residential zoning across the street and to the north of the subject site. The Examiner requested testimony by the applicant. Responding was: Max Fisk Manager, Dunn Lumber Company 120 Factory Avenue N. Renton, WA 98055 Mr. Fisk advised that 29 parking stalls are currently provided on site in addition to the three spaces which are never used proposed for elimination by the applicant. He reviewed uses surrounding the subject site consisting of a real estate office, accounting office, a multifamily dwelling, a vacant lot zoned business/commercial , and single family residences to the north. He explained that relocation of the existing fence would allow additional space in which to operate the business. Mr. Fisk advised that neighbors of the site are in favor of the request , and he felt that the existence of surrounding office use operating in a residential area further supports approval of the application. The Examiner reiterated his concern regarding the definition of side lines contained in the code, and whether the setback is required adjacent to the property rather than abutting from the rear or front, noting that the residential property in question is across the street from the site. Mr. Blaylock clarified that the original special permit required a 100-foot setback from a residential district, and whether that district was adjacent to V-002-82 Page Two or across the street was not an issue, rather, the underlying intent was for purposes of buffering the residential area. Responding in support of the application was: Ed Dunn, President Dunn Lumber Company 120 Factory Avenue N. Renton, WA 98055 Mr. Dunn referenced photographs of the yard area which were submitted with the application, and entered an additional photograph of parking spaces proposed for elimination. The submission was entered as follows by the Examiner: Exhibit #3: Photograph of three parking spaces Mr. Dunn noted that taxes on the subject property have tripled in the past four years, and it appears unreasonable to devote 2400 square feet of yard area requiring three parking spaces never used during the past year and one-half. He advised that over 60% of the required parking spaces on the subject site are now unused. The Examiner asked Mr. Dunn to describe any undue hardship regarding the property other than economic concerns, noting that the triangular shape of the property is quite narrow in the area proposed for expansion. Mr. Dunn advised difficulties for vehicles entering and exiting the site across the existing alleyway, and he indicated that existing planting areas will be retained. Due to current business climate, he encouraged approval of the request to allow continuation of the business as an asset to the community. Responding in support was: Carl Kokko 221 Factory N. Renton, WA 98055 Mr. Kokko, resident across the street to the north of the subject site, supported approval of the variance, noting that the business is beneficial to the community. Responding in support was : Ray Wautlet 1520 Brooks N. Renton, WA 98055 Mr. Brooks, neighbor of the subject site, stated that if every business in the City of Renton maintained their property as well as the applicant, the city would be a better place in which to live. The Examiner requested final comments from the Building & Zoning Department. Mr. Blaylock referenced the previously approved special permit for the site, File No. SP-004-80, and noted that current development does not comply with the site plan as previously approved. He also advised that in that original approval , the Examiner had required a 100-foot setback from residential areas regardless of whether they were to front or adjacent lot lines. Mr. Dunn clarified that parking stalls located on the east side of the northern building have not been counted by staff. Mr. Blaylock stated that the number of stalls had been determined from the applicant 's site plan. Since no further comments were offered, the hearing regarding File No. V-002-82 was closed by the Examiner at 10:09 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The applicant, Dunn Lumber Company, filed a request for a variance from the provisions requiring a 100-foot setback from residential zones for the expansion of its lumber yard. 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , RCW 43.21C, as amended, the subject proposal has been determined exempt from the threshold determination by the Environmental Review Committee (ERC) , responsible official . V-002-82 Page Three 4. Plans for' the proposal have been reviewed by all city departments affected by the impact of this development. 5. The subject property is located at 120 Factory Avenue N. The site is level and contains the existing Dunn Lumber Company buildings and lumber yard. 6. The subject site is zoned B-1 (Business/Commercial ) . Property across the street to the west and north is zoned R-2 (Duplex Residential ) . East of the site along Houser Way the zoning is L-1 (Light Industry) . A B-1 district is located west and south of the subject site. 7. The Comprehensive Plan designates the area in which the subject site is located as suitable for the development of light industrial uses on the east side of Factory Avenue and multifamily residential uses on the west side. 8. The applicant proposes increasing the size of its lumber storage area along the south side of its complex by extending the storage area almost to the west property line while retaining landscaping along the street front. Section 4-711 (A) (7) requires that lumber yards maintain a 100-foot setback from residential districts (See special permit approval , File No. SP-004-80) . The applicant has requested a variance from the above provision pursuant to Section 4-722(0) (3) . 9. East of the subject site is the Burlington Northern Railroad track, and east of the track are a number of commercial uses. South of the site is a real estate office. West of the site are single family homes, commercial uses, vacant property, and a motel , while on the north are single family homes and duplexes. 10. The applicant has need for additional operating space on the site, and the variance would provide additional yard storage area. CONCLUSIONS: 1 . The applicant has failed to demonstrate that it suffers undue hardship as a result of special circumstances other than it needs additional space and it is located in an area of competing and incompatible land uses. The existing land use pattern was fostered by the lack of locational criteria which existed prior to the adoption of the Zoning Code, and by the perpetuation in the current Comprehensive Plan of locating residential uses immediately adjacent to light industrial areas. 2. The fact that the applicant may have or is now outgrowing its site is not an undue hardship which may be considered in a review of a variance. Properties located north of the site and west of the site are not only zoned for low density multifamily residential uses, but are still occupied by such uses. 3. The location of a lumber yard in a B-1 zone is not permitted outright but is governed by stricter standards because it is a more intense use of property. These standards provide for a sufficient buffer between the use and adjacent residential land uses and zones. The requirement is imposed because B-1 zoning is used many times as the buffer or transition zone between residential and more intensive or intrusive uses. Policy 5.A.7 and 8 indicate that commercial areas should be compatible with adjacent areas and buffers should be placed between commercial and single family uses. If the 100-foot buffer policy is too strict or if the imposition of a fixed rather than a variable buffer too unreasonable, then the City Council should be prevailed upon to amend the ordinance to allow a more flexible standard to apply. 4. The variance is not justified under the criteria enumerated in Section 4-722(G) (3) and granting the variance would therefore extend to the applicant a privilege not granted to other applicants, that is , an economic reason for granting the variance. The southerly six lots were zoned B-1 with the adoption of the Zoning Ordinance in 1953, and the northerly five lots were zoned from R-2 to B-1 by Ordinance 2149 in 1965. The site is fully developed with the existing Dunn Lumber Company business. A special permit, SP-004-80, was issued on the subject site on February 22, 1980, to allow the expansion of Dunn Lumber Company in its present configuration. D. LAID USE: Land uses adjoining the subject site , commencing in a clockwise direction from the north, include: two duplexes and single family residences to the north, a variety of businesses and the Burlington Northern Railroad track to the east, real estate office to the south, a motel, single family residence, duplexes, vacant lots and additional single family residences to the west. Attached is a land use map of the vicinity of the subject site. The facility is basically constructed and the variance request would only modify and enlarge an existing yard. The impacts to the natural and human environment would be minor except that it would introduce a storage area closer to an established residential area. This may result in some aesthetic impacts which are hard to evaluate. J. ENVIRONMENTAL ASSESSMENT/S',I,OLD DETERMINATION: Pursuant to the City of Renton' s Environmental Ordinance and the State Environmental Policy Act of 1971, as amended, RCW 43-21C, the project is exempt from a threshold determination. The applicant is requesting a variance from Section 4-711 (A) (7) to allow the placement of the lumber storage yard within 100 ' of a residential lot located in a B-1 , Business Use Zone. 2. The applicant has not supplied justification as to why the variance should be granted. 3. The site plan, as presented for the variance application, does not provide enough parking spaces as originally required for the expansion (SP-004-80) . . A total of 30 parking spaces were required for the original proposal. It appears that the parking located to the east of the northern most structure has been eliminated thus showing only 25 existing spaces. The applicant's request to eliminate 3 additional spaces would drop the complex to 23 parking spaces which does not comply with the code. 4. The applicant has not shown that he suffers any undue hardship from size, shape, topography, location, or surroundings of the subject property, and that the strict application of the zoning code is found to deprive subject property owner of rights or privileges enjoyed by other property owners in the same zone. It would appear that the only reason for expansion is economic. 5. It may appear that the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. However, moving the 8 ' •fence surrounding the lumber yard closer to the residential area could have unknown aesthetic impacts. In addition, elimination of parking, which is required by code, would be detrimental to the public welfare in forcing more cars onto the street for parking. Granting of the variance would, in fact, be a special privilege allowing the applicant to provide for less parking then required by code and intrude upon a residential area. 7. The variance is clearly unnecessary and unwarranted and the applicant should be required to construct the plans as originally approved under Special Permit, SP-004-80. M.
