Providing a paved pedestrian and bicycle route on the surface under the railroad tracks at the Black River Pump Plant into Fort Dent west from Monster Road. 3. Ed Hayduk, Housing and Community Develop- ment Coordinator, explained the area under the railroad tracks at the Black River Pump Plant is on an existing maintenance road at the back of Fort Dent Park in Tukwila; the park was built by King County and is maintained by Seattle. MOTION CARRIED. One-Half Councilman Stredicke chose not to excercise option to call for Percent reconsideration by Council of the one-half percent sales tax. Optional The hugh (deficit that would result from withdrawal of this tax Sales Ta and the possibility of non-passage of another form of taxation to decrease that deficit prompted Stredicke's action. Councilman Stredicke stressed his feelings had not changed regarding the negative aspects of imposing this tax on Renton (while neighboring communities remained unchanged) and the manner in which this optional tax program had been set up that King County could impose and collect. the tax on the city if the city does not adopt the tax first. McWilliams and recommends that the City Council revere the Hearing Examiner' s decision and grant the rezone to R-3 . The Committee makes this recommendation based upon the folio ing findings : 1 . Finding of Fact No . 10 indicates that the single family homes in the immediate vicinity are stable and likely to remain for the foreseeable future. The Committee finds instead that those homes are in an area which is in transition and are therefore not stable but transitional uses . 2 . However , Conclusion No . 2 and No . 4 would indicate that the Comprehensive Plan designation should be followed. As Conclusion No . 5 indicates . the applicant retains the ability to request a re-classification to R-1 . Budget address stated that in Cont. order, to accommodate decreased revenue receipts, meet our obligations to a growing population and provide sufficient ending fund balances in the four major tax funds to carry the City linto 1983, it is necessary to reduce expenses and to seek a tax increase. Personnel has been reduced by not filling needed positions allowed in the budget and not replacing on a one-for- one basis employees who have retired. The work force is but by 13 1/2 positions. The proposed budget cuts total $467,180. The Mayor asked Council to approve a 1/2 cent sales tax effect- ive October 1 , 1982, explaining sufficient time must 'be allowed for public input, 30-day roll-back time period, and 60 days' notice to Department of Revenue. Persons speaking: John O'Hare, 583 Pierce Ave. SE said no one likes taxes, consumer is at end of chain and that some personnel cuts should be made at the top, that the clerks could do what the supervisors do. Sandy Webb, 430 Mill Ave. S. commented on use of City Funds objecting to the refurnishing of the Mayor's Office and 6th Floor Conference Room and the agreement with Renton School District for construction of the balifieldi Council discussed Initiative 435 (to remove sales tax from food) ! cost of city services, removal of tax next year, cut in service-no growth, waiting for Cities and County to approve the 1/2 per cent sales tax, possible avenues for more revenue; withholding emplloyees' negotiated 7% cost of living and step increases; mandatory days off; B & 0 tax; and the 1/4 of one percent real estate transfer tax. In. review of he appeal applications, no information is provided as to the substance of the appeal. Section 4-3016(A) states as follows: The written notice of appeal shall fully, clearly and thoroughly specify 1 the ubstancial errors in fact or law whicf exists in the record of the 1 proc edings from which the appellant seeks relief." Further, S ction 4-3016(E) states in part: The consideration by the City Council shall be based solely upon the record, the Examiner's report, the notice of appeal and additional submissions by the parties." Based upon the currently. available information, neither appeal conforms to Section 4-3016(A) or 4-3016(E). Having failed to meet the minimum requirements of each of these secti ns, the Policy Development Department finds no basis for modifyingtheExaminer's ecision in either of these cases. Further, t e Policy Development Department in its testimony before the Hearing Examiner o these applications, expressed our-grave concern about the proposal. The Policy Dev lopment Department believes that the Hearing Examiner's decision is fully' consistent ith the Comprehensive Plan, its policies, and the standards set forth by, the City C uncil for review', of a rezone application which are contained in Section 4-3014(C). RECOMME DATION The Planni g and Development Committee should recommend to the City Council that the appeal of McWilliams for both the rezone and preliminary plat be denied. SUMMARY OF REQUEST: The applicant seeks a rezone of the subject site from G to R-3 for future development of a proposed nine-lot preliminary plat with 18 duplex units . SUMMARY OF Building & Zoning Department: Rezone to B-1 with restrictive RECOMMENDATION: covenants prohibiting residential development. Hearing Examiner: Denial . PUBLIC HEARING: After reviewing the Building & Zoning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows : The hearing was opened on June 1 , 1982 at 9:55 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. Roger Blaylock, Zoning Administrator, presented the Building & Zoning Department report , and entered the following exhibits into the record: Exhibit #1 : Application File containing Building & Zoning Department report and other pertinent documents Exhibit #2: King County Assessor's Map Responding to the Examiner's inquiry regarding prior action on the proposal in 1981 , Mr. Blaylock advised that the Environmental Review Committee had made a declarationofenvironmentalsignificanceduetoinsufficientwaterandsewerservicetothesubject site; however, that matter has since been resolved by the Public Works Department. The Examiner requested testimony by the applicant. Responding was: Jerry Buck Triad Associates 11415 N.E. 128th Street Kirkland , WA 98033 Mr. Buck advised his opinion that the conflicts between the Building & Zoning Department recommendation for B-1 and the applicant' s request for R-3 zoning aread as a recommendedsultof interpretation of the Comprehensive Plan. He noted that approval by all departments with the exception of Policy Development, which the in recommendation for denial upon interpretation of the plan. p ande 1981 as well as currently, the proposal complied with the plan in everyrespect , inapheeat felt it important to note that the Comprehensive Plan differs from the Rzoningcmap ne boundary lines are intended to be general and not property specific. Northeast Quadrant Comprehensive Plan adopted in December, 1981 , Mr. Buck indicated that in recognizing the purpose and function of the plan, three quadrants were designated for commercial use, the northeast , northwest and southeast quadrants of Union Avenue N.E. and N.E. 4th Street , and in verbal policy, it is recognized that the northeast quadrant of Duvall Avenue N.E. and N.E. 4th Street are also designated as commercial use. During the writing of the plan, the city perceived the need for only one suitable commercial center and has referenced in the report that the location of such a center hatrthee rt fails northeast quadrant of Union and 4th is currently under review. If any zoning category is determined appropriate, be sensitive to adjoining uses which currently exist; however, substantial evidence R-030-82 Page Three presented both by the city and the proponent indicates that a rezone of the property may be inappropriate altogether. The Examiner stated that as referenced in his letter to the Builaing & Zoning Department, dated May 24, 1982, the public hearing was legally published for a rezone to R-3, and discussion of a rezone to business/commercial , B-1 , category would not be appropriate at the hearing since residents in surrounding areas would not be apprised of the fact that commercial uses are contemplated. He also suggested that the recommendation of the Building & Zoning Department may have included denial . Since there was no further discussion, the hearing regarding File No. R-030-82 was closed by the Examiner at 10:25 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The applicant , Donald E. McWilliams , filed a request for a reclassification of approximately 1 . 88 acres of property from G-1 (General ; Single Family Residential ; Minimum lot size - 35,000 square feet) to R-3 (Medium Density Multifamily Residential ) . 2. The application file containing the application, SEPA documentation, the Building and Zoning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton 's Environmental Ordinance and the State Environmental Policy Act of 1971 , RCW 43.21C, as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC) , responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. The subject property is located on the east side of Union Avenue N.E. between N.E. 4th Street and N. E. 6th Street (extended) . 6. The subject site is generally level . The site is covered with scrub brush , alder and Douglas fir trees. The subject site is vacant. 7. The subject site was annexed into the city in November of 1966 by Ordinance No. 2290. The current G-1 classification was applied at that time. 8. The land use element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of commercial and office park type uses. At this time, the zoning code has not been amended to provide for an office park district. 9. The legal notice for the hearing indicated that the subject of the hearing would be a request to reclassify the subject site to R-3. The Building & Zoning Department has recommended that the subject site be reclassified to B- 1 (Business/Commercial ) . The legal notice indicating a request for R-3 zoning is not sufficient to apprise the public of a possibility that business or commercial zoning might be considered at the public hearing. While parties might not object to medium density multifamily uses being permitted on the subject site which would be permitted under the requested R-3, they might have reacted differently if they had been informed that the more intensive uses permitted under B- 1 zoning might be considered, such as high density multifamily uses , laundries, cleaning and pressing establishments , service stations , restaurants, etc. In addition, the SEPA review was predicated on the R-3 request and did not address the potential of 9-1 zoning. 10. Immediately north of the subject site are four older single family homes. Immediately south of the subject site are an additional three older single family homes. These seven homes are stable and likely to remain for the foreseeable future according to both the applicant and the Policy Development Director. A single family subdivision is located west of the subject site across Union Avenue N.E. There are also vacant properties in the vicinity of the subject site. South of the three single family homes south of the subject site is a twelve-plex constructed on R-3 property. 11 . The zoning districts in the area are generally single family residential to the west, north and east of the subject site. A mix of R-1 (Single Family Residential ; Minimum lot size - 7,200 square feet) and G-1 districts are located adjacent to the subject site. The property along all points of the compass immediately abutting or across R-030-b2 Page Four the street from the subject site is zoned G-1 . South of the twelve-plex's R-3 zone is a B-1 zone straddling the intersection of Union Avenue N.E. and N.E. 4th Street, 12. A reclassification to R-3 would permit approximately 55 units on the just under two acre parcel . Fifty-five units would increase the traffic by about 330 trips per day, increase the school age population by about 14 students , and increase the general population by approximately 115 people. (These figures are derived from general estimates of multifamily units. ) The applicant has proposed developing 18 units in nine duplex structures on the subject site. This would increase the population by about 45, increase the school age population by about four students and increase traffic by an additional 142 trips per day. The subject site would also accommodate seven single family lots under R-1 (Single Family Residential ; Minimum lot size - 7,200 square feet) zoning. The population would he increased by about 25, the school age population would increase by about four Students , and traffic would increase by about 70 trips per day. (These figures are derived from general estimates of single family zones . ) 13. The Northeast Comprehensive Plan indicates that a major shopping center could be located generally in the area of Union and N.E. 4th intersection (with the exception of the southwest corner) or in the area of the northeast corner of the intersection of Duvall and N. E. 4th. The plan indicates generally by its tenor that anticipated demand would favor only one of these locations with exclusion of the other areas after further review. The Plan also indicates that multifamily housing should be encouraged as a buffer between commercial and less intensive uses , and that not every parcel is appropriate for development in the 1990 time frame. CONCLUSIONS: 1 . The proponent of a rezone must demonstrate that the request is in the public interest and will not impair the public health, safety and welfare. In addition, the rezone must comply with at least one of the three criteria listed in Section 4-3014 which provides in part that: a. The subject site has not been considered in a previous area rezone or land use analysis ; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been material and substantial change in the circumstances intheareainwhichthesubjectsiteislocatedsincethelastrezoningofthe property or area. The applicant has failed to demonstrate that the requested reclassification is in the public interest, that the site is potentially designated for the classification sought , or that there have been material and substantial changes in the area. Given the existing development in the area, predominantly single family, and the relatively narrow configuration of the site, a single family subdivision may be more appropriate. 2. While the map element of the Comprehensive Plan cannot be reviewed in isolation, it presumably specifies the most appropriate use for land, if that use is also compatible with nearby or immediately adjacent uses . The designation of the subject site for office park uses by the map element ignores the uses immediately surrounding the subject site. That is , the subject site is only a 132 foot wide finger of property surrounded on the north and the south by both single family zoning and development. There are seven single family homes north and south of the site which have been described as stable by city staff. Single family uses and development are located across the street to the west. 3. The request represents spot zoning that would benefit the property owner tothedetrimentofthegeneralpublicandinviolationofboththemapelementofthe Comprehensive Plan and the goals and policies of the Comprehensive Plan. Policies elements 3.B.3 and 4.C.4 indicate that boundaries of districts should be buffered by uses compatible with each district, and that single family dwellings should be buffered from more intense uses. The twelve-plex south of the subject site already serves this general purpose by buffering the existing single family usesimmediatelyadjacenttothesubjectsitefromtheB-1 zoning located near the intersection of 4th and Union. R-030-82 Page Five Policies elements 3. 6.4 and 5 indicate that new uses should be designed to be compatible with existing uses and be of a harmonious intensity with existing uses. Finally, the implementing policy #2 of the Land Use Objective of the Northeast Comprehensive Plan indicates that not all property is appropriate for development by the 1990 time frame but that the map and plan would represent full development for some time beyond 1990. The establishment of a multifamily zone in the midst of the stable and established single family homes would thwart the various policies and goals of theComprehensivePlanandimposeanintrusiveandinappropriateuseonanexistingsinglefamilyarea. 4. The applicant retains the potential to develop single family uses on the subject site in the form of an approximately seven-lot single family subdivision, and is therefore not denied reasonable use of the subject site. The applicant had the burden of demonstrating that the proposal met the requirements of the zoning code and was consistent and compatible with the Comprehensive Plan. As the U.S. Supreme Court recognized in Board of Regents v Roth, 408 U.S. 564 (1972) , a property right involves more than a unilateral expectation of a benefit. A reclassification of the subject site to R-1 would be the most appropriate use of the subject site and would be more compatible with the existing uses and character of the area. The City Council should deny the requested R-3 zoning. 5. The applicant retains the ability to request a reclassification to R- l . Properties to the south and east were rezoned to R-3 by Ordinance 2302 (1967) , Ordinance 2390 (1968)_ , and Ordinance 2482 (1969) . PRELIMINARY REPORT TO THE HEARING EXAMINER McWILLIAMS, DONALD E. JUNE 1 , 1982 PAGE FOUR 3 . A 12 unit condominium complex has been constructed on a parcel just south of the subject site. This is the only similar development constructed recently in the vicinity. The parcel on which the new condominium site was vacant for 14 years , thus suggesting that it was a premature rezone. 4 . This application for a rezone to R-3 was originally submitted in May of 1981 , at which time the Comprehensive Plan designated the subject site as borderline Medium Density Multiple Family and Commercial. The Environmental Review Committee required the preparation of an EIS. The application was withdrawn and a new application was submitted in March 1982. A declaration of non-significance was issued. In December 1981 , a new Comprehensive Plan for the Northeast Quadrant was adopted by the City Council. This area was specifically reconsidered and designated Office Park and Commercial. 5 . The City is processing a request for a rezone to construct a major shopping center on the northeast corner on N.E. 4th Street and Union Avenue N.E. This request along with past land use actions in this immediate area suggests that the present request for rezoning to an R-3 , Multiple Family classification is inappropriate. In fact the request is untimely because it requests a functional downzoning from its potential designated by the Comprehensive Plan. The intent of the Planning Commission and City Council is very clear. The area is to become a major focal point for office and commercial development in the Highlands . However, rezoning the subject property to B-1 , Business Use does not specifically comply with the intent of the Comprehensive Plan. The B-1 Zone would allow construction of multiple family residences to an R-4 density; therefore, to comply the property should be rezoned bo B-1 , Business Use with restrictive covenants prohibiting residential development. 6. Approval of the rezone request will establish a trend to develop that area south of N.E. 6th Street and north of the proposed shopping center into multiple family residentials. The recent construction of the condominium units south of the proposed site introduces a new variable which is not totally unacceptable to good planning practices. Normally, established single family areas should be buffered from high density commercial areas . In this particular case, the creation of a multiple family zone in the area between the shopping center and the single family located north of N.E. 6th Street would be acceptable and provide the intended buffer. M. DEPARTMENTAL RECOMMENDATIONS: Based upon the above analysis , it is recommended that the Hearing Examiner recommend to the City Council that the request , file R-030-82 , be expanded and rezoned to B-1 , Business Use with restrictive covenants prohibiting residential development . The proposed 18 housing units could add approximately 180 vehicle trips each day to the vicinity road network, based on ITE nationwide average statis- tics . Most of this traffic will likely be coming or going through the Union Avenue/N.E. 4th Street intersection south of the site. For the 21-month period ending in April 1981 , this intersection averaged 2.75 accidents per million vehicles, compared to the state average of 0.9. At this high rate, the statis- tics indicate that the accidents are probably caused by the characteristics of the intersection. In April 1981 improvements were made at this intersection in the forms of left-turn signal phasing of the light and the addition of left-turn pockets. In the three months following the installation of these, there were no accidents at this intersection. William E. Popp Associates , in a traffic study for a separate nearby development, noted that most of the accidents prior to the im- provements involved vehicles turning left from 4th onto Union and that the addition of signal phasing and turn pockets caused a "dramatic reduction in accidents. " (Northward PUD Transportation Impact Analysis , March 1982. ) The pm peak hour level of service (LOS) at this intersection in 1981 was "C" . Another traffic concern in the vicinity includes N.E. 4th west of Union to where it becomes N.E. 3rd and then intersects Sunset Boulevard, which provides the pri- mary access to I-405 for the site and its vicinity. East of Duvall Avenue, 4th become SE 128th St. , and this arterial NE 3rd/NE 4th/SE 128th would be the major distributor of the project's expected 180 ADT. The intersection of NE 3rd and Sunset experienced a large number of accidents (21/year) through July 1981 , but for the volume of traffic this number is not critical . In 1981 this intersection operated at LOS "C" . The City has proposed to widen NE 4th/NE 3rd from Union to Sunset to a continuous five-lane roadway with a two-way left turn lane. This work would also include resurfacing, curbs , gutters , sidewalks and drainage, and it is scheduled to begin in 1982. Traffic from the proposed project (180 ADT) would have no measurable effect on the operations of these roadways and intersections . 16 (d) Sanitary Sewer The proponent intends to install a lift station to pump sewage under Union Avenue to an existing manhole about 250 feet south of the site. The pro- ponent will construct and maintain this lift station. The proponent will also install a "dry" sewer at his front property line that will later be connected to an anticipated gravity system that will flow from about 1500 feet north of the site south past the site and adjacent properties. When this line is com- pleted through to the south, or at least to a connection at N.E. 4th, the devel- oper will abandon his lift station. Completion of the line depends on develop- ment of other nearby property.
