FILE NO. SH. PL. 040-82 LOCATION: 2300-2400 block of Edmonds Avenue N.E. SUMMARY OF REQUEST: The applicant seeks approval of a two-lot short plat. SUMMARY OF ACTION:Building & Zoning Department Recommendation: Approval with conditions . Hearing Examiner Decision: Approval . BUILDING & ZONING The Building & Zoning Department report was received by the DEPARTMENT REPORT:Examiner on June 15, 1982. PUBLIC HEARING: After reviewing the Building & Zoning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows : The hearing was opened on June 22, 1982 at 9: 17 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. Roger Blaylock, Zoning Administrator, presented the Building & Zoning Department report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Building & Zoning Department report and other pertinent documents Exhibit #2: Short Plat Map The Examiner advised receipt of a letter from Richard Houghton, Public Works Director, dated June 21 , 1982, which states Mr. Houghton 's disagreement with the departmental report recommendation for compliance with improvement standards of the Subdivision Ordinance. If that interpretation is enforced, every future lot line adjustment would require full improvement based on that ordinance, and it was his belief that was not the intent of the lot line adjustment procedure. Mr. Blaylock noted that a previously approved three lot short plat for the subject site had lapsed since the applicant chose not to exercise its approval . Responding to language in Section L.5 of the departmental report, the Examiner stated his belief that the city would not have approved a lot line adjustment if it created a non-conforming lot. In response to the staff recommendation that the Examiner determine that a lot line adjustment must comply with both the dimensional and improvement standards of the Subdivision Ordinance, the Examiner advised that he did not have jurisdiction over lot line adjustments , and additionally, if certain improvements are required under Section 9-1108 of the Subdivision Ordinance, a recommendation to impose them at this time would be appropriate. Mr. Blaylock indicated his assumption that they were imposed at the time of lot line adjustment, but he would recommend that those requirements be reimposed at this time on the entire 8.2 acre parcel . The Examiner corrected a reference to Section 4-1104(5) in Section L.5 of the staff report, noting that the correct section should be denoted as Section 9-1104(5) . Mr. Blaylock reiterated his concerns that upon issuance of a building permit for all 280 units in the proposal , the entire length of Edmonds be improved and extended through. The Examiner requested testimony by the applicant. Responding was: William Snell Haggard, Tousley & Brain 1700 Daon Building 720 Olive Way Seattle, WA 98101 Mr. Snell corrected the staff report to reflect the owner of the property as U. S. Homes and the applicant as Homecraft. He noted that the only reason for submission of the application relates to financing and the need to divide' the subject parcel into two lots. He asked the Examiner to take note of other applications and appeals regarding the subject site and enter them into the record by reference. The following files were entered by Sh. H . 040-82 Page Two referenc : File No. AAD-011-82; Homecraft Land Development, Inc. File No. SA-010-82; Homecraft Land Development, Inc. File No. ECF-013-81 ; Homecraft Land Development, Inc. Responding for the applicant was : Gary Warner Stepan & Associates 930 S. 336th Street Federal Way, WA 98003 Mr. Warner clarified that another lot was not created by the lot line revision since two lots had always existed on the site; however, lot lines had been manipulated to conform to phasing requirements of the owner. He also advised that the previous short plat had not been recorded due to expiration of the approval period while appeals were filed and heard regarding improvement requirements. All off-site improvements have been identified by the Board of Public Works , and bonds posted to assure completion of Edmonds Avenue prior to occupancy of Phase I ; and plans conform to parking, which is contained on individwal lots , and setback requirements. Responding to the Examiner's inquiry regarding the acr4age contained in each lot, Mr. Warner advised that each parcel contains 2.8 acres of prop-rty. Mr. Sne 1 stated that creation of the subject short plat does not add any substantial impacts, and it is not clear in the staff report the conditions being imposed upon the plat as a result of its approval since staff has referenced the issue of the lot line adjustm-nt and other past actions. He concurred in the Examiner's determination that he does not have jurisdiction over the matter of lot line adjustments, noting that administrative opinions are subject to appeal to the Hearing Examiner. The applicant disagr=es with Mr. Blaylock's assumption that certain requirements were imposed upon approv- 1 of the lot line adjustment, and a written opinion to that effect was never transmitted to the applicant. Mr. Sn; ll advised that the lot line adjustment was approved on March 16, 1982, and Ordina ce No. 3622 regarding imposition of requirements for installation of traffic signal - was not approved until May 23, 1982. Therefore, the requirement denoted in the ordina ce should not be applied to approval of a lot line adjustment. Two legal argume is support his case, he noted, the first that of collateral estoppel since the issue as been litigated in administrative proceedings of the city, and the city is now ba -red from reimposing the same requirement. Secondly, adoption by the legislature of Chapter 49, Laws of 1982, Section 5, places limitations upon the type of conditions which can be imposed on plat approvals , and precludes imposition of charges denoted in Ordinance No. 3622. Since the aforementioned legislation will be effective on July 1 , 1982, Mr. Snell noted that the period allowed for processing the application and the following two week appeal period would extend the approval date of the short plat beyond July 1st. The Examiner requested final comments. Mr. Blaylock indicated that the city is not imposing requirements of Ordinance No. 3622, but rather, it is imposing requirements of Section 9-1108(3) of the Subdivision Ordinance adopted in January of 1974. Mr. Snelljhad no objection to Mr. Blaylock's position which clarifies the issue in this case. Sincelno further comments were offered, the hearing regarding File No. Short Plat 040-82 was closed by the Examiner at 9:45 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now mbkes and enters the following: FINDINGS: 1 . The applicant, Homecraft Land Development, Inc. , filed a request for approval of a two-lot short plat on approximately 5.6 acres . 2. The application file containing the application, SEPA documentation, the Building and Zoning Department report , and other pertinent documents was entered into the record as Exhibit #1 . 3. While a short plat is exempt from environmental procedures , an Environmental Impact Statement was prepared for the multifamily development on the site. 4. plans for the proposal have been reviewed by all city departments affected by the impact of this development. I Sh. P1 . 040-82 Page Three 5. The subject property is located on the west side of Edmonds Avenue N.E. (extended) between N.E. 3rd Street and N.E. 4th Street and the Puget Power transmission line forms the western boundary. 6. The total area of the subject property is approximately 5.6 acres . The parcel is irregularly shaped. The site slopes downward from the northeast to the southwest at grades varying between 5% to 16.5%. The vegetation on the site is mainly scrub brush and weeds . The site is currently undeveloped. 7. The subject site was annexed into the city in June of 1956. The property was rezoned from R- 1 (Single Family Residential ; Minimum lot size - 7,200 square feet) to R-4 High Density Multifamily) in 1963. A previously approved short plat (Sh. Pl . 095-80) for portions of the subject site expired without being recorded by the applicant. 8. The applicant proposed dividing the subject property into two lots, each of which would contain approximately 2.8 acres. Parcel 1 is located on the northeast corner of the site on N.E. 4th and its intersection with Edmonds Avenue N.E. (as extended) . Parcel 2 is located at the northwest corner of the subject parcel along N.E. 4th Street. 9. The subject property is currently zoned R-4 (High Density Multifamily Residential ) . East of the subject property are large tracts zoned GS-1 (General ; Single Family Residential ; Minimum lot size - 35,000 square feet) , SR-1 (Single Family Residential ; Minimum lot size - 7,500 square feet) and a large R-1 zone (Single Family Residential ; Minimum lot size - 7,200 square feet) to the north. 10. There are a variety of land uses in the area. East of the subject site is the Vantage Point Condominium development and undeveloped state-owned property. The Puget Power transmission line is west of the subject site. Windsor Hills Subdivision and the Highbury Park Subdivision are located north of the subject property, and the Windsor Hills Park is northeast. 11 . The Arterials and Streets Element of the Comprehensive Plan indicates that N.E. 3rd Street is designated as a major arterial/parkway, while N.E. 4th Street is a major arterial . 12. A lot line adjustment changed the configuration of the property lines of the subject site. Questions were raised as to whether such procedure required the installation of standard improvements. The Public Works Director indicates that no such impression was held by the Public Works Department. There was no appeal of the action of the Board of Public Works to approve the lot line adjustment. Accordingly, since no appeal was filed, this office has no jurisdiction to entertain any questions concerning that action nor is this office empowered to give advisory opinions outside the context of a public hearing. 13. The subject site, along with a parcel immediately south of the site, will be developed as a phased multifamily housing complex (See site approval , File No. SA-010-81) . CONCLUSIONS: 1 . The approval of the short plat does not appear to have any adverse consequences on the public welfare or adjoining property, and therefore appears to serve the public use and interest. 2. The subject site, along with a third parcel immediately south of the subject site, will be developed as a multifamily housing complex, and a number of issues have been settled in the site review hearing and both administrative and environmental appeal hearings. 3. The property is subject to all city codes and regulations. DECISION: The short plat is approved. ORDERED THIS 1st day of July, 1982. Fred J. Homes I have just finished reading the Building and Zoning Department recommendation for the above referenced project. I can not agree that they be required to comply with the improvement standards of the sub-division ordinance. Every future lot line adjustment would require full improvement based on the sub-division ordinance. I do not believe this was the intent of the lot line adjustment. A lot line adjustment is a minor occurrence which does not create any additional lots and should not be burdened by the extra expense of the other improvement. S. HOMES JUNE 22, 1982 PAGE TWO 4 . HISTORY/B CKGR OUND: The subject site was annexed into the City by Ordinance No. 1549 of June 14 , 1956. It was rezoned from R-1 to R-4 by Ordinance No. 2029 of May 13, 1963. 4 . PHYSICAL BACKGROUND: 1 . Topography: The subject site slopes downward from northeast to southwest at grades between 5 and 16. 5%. 2. Soils : Everett Gravelly Sandy Loam, 15-30% slopes EvD) . Runoff is medium to rapid, and the erosion hazard is moderate to severe. Most of the acreage is used for timber. Urban Land (Ur) is soil that has been modified by disturbance of the natural layers with additions of fill material several feet thick to accommodate large industrial and housing installations. The erosion hazard is slight to moderate. 3. Vegetation: The site consists principally of scrub brush and weeds overlayering a sand and gravel surface with a few short to medium growth deciduous shrubs and trees present. 4. Wildlife: The existing vegetation may provide some habitat for birds and small mammals . 5. Water: No surface water was observed on the subject site (June 1 1 , 1 982) . 6. Land Use: The subject site is undeveloped at this time. To the east are the Vantage Point Condominiums and some undeveloped State property, while to the south the property is also vacant. The Puget Power transmission line right-of-way is adjacent to the west, while to the north is the approved Highbury Park final plat. E. NEIGHBORHOOD CHARACTERISTICS: The surrounding properties are a mixture of undeveloped, multiple family and single family uses. F. PUBLIC SERVICES: 1 . Water and Sewer: Sixteen-inch water mains run north-south on Edmonds Avenue N. E. and east-west on N.E. 3rd Street adjacent to the subject site, while an eight-inch sanitary sewer extends northeast- southwest on Bronson Way N.E. within 1000 feet to the southwest. 2. Fire Protection: Provided by the City of Renton as per ordinance requirements. 3. Transit: METRO Transit Route #107 operates along N.E. 4th Street within 3/4 of a mile to the northeast of the subject site. 4 . Schools : The Highlands Elementary School is within 3/4 of a mile to the north of the subject site, while McKnight Middle School is approximately 11/4 miles north and Hazen School is within 24 miles to the northeast. The propserty owner filed the Record of Survey on March 16, 1982. 5. An interpretive question arises over the application- of Section 9-1108 (3) of the Subdivision Ordinance. The Hearing Examiner in reviewing the application for the short plat needs to determine whether Section 9-1108 (3) applies to the present application or whether it was imposed upon the lot line adjustment. HOMES JUNE 22, 1982 PAGE FOUR All requirements of the Zoning and Subdivision Ordinance must be met to allow a lot line adjustment under Section 4-1104 (5) . It would appear for a lot to be considered "conforming" under the Subdivision Ordinance that it must comply with both the dimensional standards and the improvement standards. The Building & Zoning Department and Policy Development Department have taken the position that the applicant agree to fully comply with the Subdivision Ordinance and install necessary improvments at the time he voluntarily filed the Record of Survey on March 16 , 1982. 6. It should be pointed out that the Administration has cooperated with the applicant' s desire to modify property lines. In fact, this is the second lot line adjustment request processed. The original was done in January 1981 (LLA-002-81 ) . The applicant' s actual intent is unknown and suggests 'an.'attempt:. to circumvent the general purpose of the State of Washington Subdivision Laws and Subdivision Ordinance of the City of Renton. 7. Department comments are attached for the public ' s and Examiner ' s review. Both the Fire and Policy Development Departments are concerned about the disposition and resulting access to the subject site without the apparent construction of Edmonds Avenue N.E. between N.E. 3rd and N.E. 4th Streets. The Fire Department also advises that all water mains and hydrants are required to provide fire flows prior to building. 8. The Public Works Department advises that approval is subject to installation of all off-site improvement after plan approval and relates the specific costs for late comers agreements for water and sanitary sewers. 9. The Building Division advises that each lot must comply with the City' s Codes specifically regarding parking. They question the need for special cross access easement as a result of the present building plans designed for all 3 lots. M. DEPART RECOMMENDATION; Based upon the above analysis, it is recommended that the short plat request, file 040-82, be approved.
