OLD BUSINESS Public Safety Committee Chairman Reed presented a report Public Safety indicating that the Committee has met with the Citizens' Committee Committee on Cruising in Renton (referred 4/2/84) and other Cruising in interested citizens to discuss and more fully understand the Renton situation and concerns of all those involved. The Citizens ' Committee has held several meetings to share ideas and formulate a lengthy report (on file with the City Clerk' s office) . The Public Safety Committee recommends that the City Council adopt the report of the Citizens' Committee on Cruising. Moved by Reed, Seconded by Keolker, Council concur in the Committee Report. I-405/Lake Transportation Committee Chairman Trimm presented a report Washington recommending acceptance of the proposed drainage improvement Boulevard V. project along Lake Washington Boulevard, east of 1-405 at Gypsy Creek North 44th Street which will be joint funding construction Drainage by State DOT and the City for a second large storm drain Upgrading under 1-405 to eliminate flooding on City streets. The City cost of 570,000 would be funded by the one-half cent gas tax funds, which can be budgeted in the 1985 budget. The Committee recommends acceptance of the proposed drainage improvement, and further recommends the Mayor be authorized to sign the City/State Interlocal Agreement upon legal review. CASTERLINE, and RICHARD ROLLER are the owners of the following real property in the City of Renton, County of King, State of Washington: lots 1 through 12, inclusive, Lots 14 and 15, and Lots 46 and 47, all in Block 22, C.D. Group W Cable Councilman Stredicke referenced correspondence from Group W Commercial Rates Cable Business Manager regarding exemption of commercial rates from regulation by the franchise; and requested research by the Administration into the matter. Mayor Shinpoch indicated the matter would be referred to Lon Hurd, cable consultant retained by the City. ADMINISTRATIVE Mayor Shinpoch recommended to Council that marine patrol services REPORT be contracted with Mercer Island for a one-year period at a cost Marine Patrol of approximately $16,000. She indicated that although King County has offered the same service at approximately the same cost, due to uncertainty regarding boat tax revenue in the future which may reduce levels of service, the Administration has recommended executing a contract with Mercer Island. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on January 24, 1984, at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following were entered into the record: Exhibit #1: Yellow file containing the application for R-062-83, staff report, and other pertinent documents relative to posting and publication. Roger Blaylock, Zoning Administrator, presented the staff report and revised Final Declaration of Non-significance. He stated the reason for the revision to the Declaration was due to the addition of a fourth property owner, Mrs. Sylvia Casterline, to the group of adjacent property owners who have joined together in one rezone application and the resulting revised site size. Responding to the Hearing Examiner, Mr. Blaylock indicated that the property still includes the four legal addresses as follows: 317 S.W. 13th Street, 325 S.W. 13th Street, 401 S.W. 13th Street, 40.I S.W. 13th Street, and 1307 Maple Avenue S.W. He advised that the applicants are seeking an L-1 zone to allow for future industrial development, but at present it is unknown whether that development will be in one development or in phases by each property owner, or subsequent purchasers. Mamie Swales R-062-83 February 7, 1984 Page 2 The character of the site was described, including a vacant parcel in the northeast corner. Responding to the Examiner concerning access, he advised that residences along S.W. 13th have direct access, and the residence in the farthest southwest corner, belonging to Mrs. Sylvia Casterline, has a 15-foot access easement provided by the State. Noting potential burden by more intense uses, the Examiner requested information as to whether the easement was limited to single family residential use. Mr. Blaylock further advised that the Environmental Review Committee had issued a Final Declaration of Non-significance on the original proposal, but it had been subsequently revised to reflect the modified proposal to include conditions requiring participation in area-wide improvements at the time of building permit issuance, provision for positive storm drainage outfall, and to note possible necessity to fill the site to reach the one hundred year flood level, requirement for storm water detention, and latecomer's agreements for extension of sewer lines onto Maple Avenue. He continued with discussion relative to application of the setback requirements of the Comprehensive Plan designation of Manufacturing Park on development in the vicinity due to the small lot character of the general area (Grady Way to S.W. 16th) and noted the trend toward minimum setbacks. The involved property owners within this block recognize that they are situated in a transitional area and have the basic intent of light industrial redevelopment some time in the future. Therefore, side yard setbacks have not been suggested, and specific review of each development, if phased, or total site development through site approval plans is recommended. In reply to the Examiner, Mr. Blaylock advised that there is no side yard setback requirement in the light industrial zone. The Examiner called on the applicant or representative for testimony. Responding was: Larry Brown 13975 Interurban Avenue South Seattle, WA 98168 Noting basic concurrence with the staff's report, Mr. Brown referred to review comments from the Policy Development Department indicating an area known as "the triangle area" should be included within this rezone area. He noted unfamiliarity with the area and inquired if it is intended to be included at a subsequent time, which could result in delay of this rezone process, and requested that it be excluded from this consideration. Noting the early date of those comments, Mr. Blaylock indicated that the suggestion had been incorporated to include the Casterline property. Referring to the Environmental Review Committee's declaration regarding a "benefit district" for traffic improvements, Mr. Brown indicated a determination has been made of approximately 43 per square foot for the properties involved and that that cost is to include a breakdown of different improvements, i.e., a traffic light at the corner of Maple and Grady, widening of Grady Way, street lights, etc. He requested that the record reflect that, should any of those improvements be eliminated from the traffic plan, consideration be given to reducing any potential benefit district charges to these individual properties. It was suggested by the Examiner that those concerns be addressed to the Environmental Review Committee and Traffic Engineering, particularly, now that this office has no jurisdiction regarding those conditions as the appeal period for the Declaration has lapsed. Mr. Brown requested site plan approval as a fixed footage figure be the governing factor for setbacks between the individual parcel areas in view of the four different property owners with the potential for different times of development to allow more flexibility in design and landscaping. He also inquired concerning the residence at 313 S.W. 13th, which appears to fall within the 20-foot setback area along S.W. 13th Street and asked, because of the encroachment into that area, would there be any restrictions with respect to remodeling or expanding this particular improvement in the future as opposed to the other properties which fall outside of the proposed setback areas. Offering to respond, Mr. Blaylock advised that, if the structure is considered to be an existing nonconforming structure even under the R-1 classification, it would not be allowed to expand unless it is expanded in conformance with the requirements of the underlying zone within the 13 feet. The Examiner observed that at this point, in view of the requirement of a 20-foot setback in the R-1 zone, it is currently a legal nonconforming use. With regard to the easement mentioned earlier concerning the parcel adjacent to FAI-405, Mr. Brown stated that he would research the question and advise the Hearing Examiner's office. 1he Examiner indicated that the record would be kept open until this question can be answered. Mamie Swales R-062-83 February 7, 1984 Page 3 Further testimony in support of the application was invited by the Examiner. Responding was: Emilio Pierotti 17034 S.E. 184th Renton, WA 98055 Mr. Pierotti expressed his support of the requested rezone but noted some opposition to the method recommended for approval. While indicating that he is not opposed to a requirement to fill the site to the 100-year flood level, he inquired about the number of feet of fill that would be required and the existing elevation of the site. It was explained by Mr. Blaylock and the Examiner that the Declaration by the Environmental Review Committee provides an informational note" only concerning fill due to the tentative status of the figure that is safe above the flood zone on flood maps being issued by the Federal Emergency Management Agency. The Examiner then suggested that Mr. Periotti review the existing maps in the Engineering Division with the assistance of Mr. Blaylock. Mr. Pierotti indicated his feeling that the assessment stipulated for the improvement of Grady Way was unfair for this property. Mr. Blaylock noted that there had been two opportunities, in October and December, for an appeal of the assessment and advised concerning the basis for the assessment which includes a new traffic signal. Responding to the Examiner's inquiry regarding the total benefit area of 6,000 square feet and proposed assessment, Mr. Blaylock indicated that the Anderson-Minietta property was assessed $6500 on that same benefit area, and this is the second application in that vicinity since that benefit area was determined with an estimated cost. The Examiner then suggested to Mr. Pierotti that he take this matter up with the City Council, as the conditions imposed by the ERC are not subject to appeal at this hearing, he has no jurisdiction over the assessment matter, and the City Council has final authority over the finalization of street improvements in the area. The Examiner called for further testimony in support of the application. There was none. The Examiner then called for testimony in opposition of the application. Responding was: Barbara Casterline 13900 S.E. Fairwood Blvd. Renton, WA 98056 Mrs. Barbara Casterline, daughter-in-law of the property owner of the triangular-shaped parcel in the corner containing a single family home (Sylvia Casterline, 407 S.W. 13th, Renton, WA 98055), indicated Sylvia Casterline is not interested in the proposal to develop into light industrial but wants to live there. Noting amenities associated with her mother-in-law's home, she corrected the record to indicate that she had not been a part of the initiation of this application, that it had been initiated by the City. She inquired concerning the imposition of the assessment and whether it is to be imposed at the time of rezone or site development. The Examiner explained that the ERC had indicated that approximately $20,000 for street improvements would be required, that it had been modified, and it would be required when each site is developed. Mr. Blaylock confirmed that the assessment would be due at the time of development of her site. The Examiner asked regarding Mrs. Casterline's joining in this application. Mrs. Sylvia Casterline indicated her initial refusal and subsequent receipt of a letter from the Building and Zoning Department that advised that she would be included regardless. Responding to questioning from Mr. Kaufman concerning the process for obtaining Mrs. Sylvia Casterline's participation, Mr. Blaylock advised that since the other parcels involved completely surround her site, except for the Freeway, the Environmental Review Committee felt it would be more appropriate to rezone the entire block. At that point, he consulted the City Attorney to determine if the City could initiate action to rezone the entire property. He then wrote Mrs. Syliva Casterline a letter stating that the City would initiate such action, or she could join in the existing rezone request. He noted that Mrs. Casterline, after investigating the proposal personally at the department, agreed to join the property owners. Mr. Blaylock advised that she had informed him that she had no intention of moving or developing the property in her lifetime, however, and that it would be only for future development. Mamie Swales R-062-83 February 7, 1984 Page 4 Responding to the Examiner's request for further comments, Mrs. Barbara Casterline indicated that part of the reason she had signed was that her mother-in-law wanted to cooperate but, on the other hand, she did not want to pay for any improvements to the property which would not be to her benefit. In clarification, Mr. Blaylock indicated that was one of the specific intents for changing the conditions in the Declaration of Environmental Non-significance, that improvements were to be required at the building permit stage, and that the improvements could be phased until the actual time of redevelopment. The Examiner then called for further testimony in support. Responding was: Richard Roller 14915 S.E. 143rd Place Renton, WA 98056 Mr. Roller, owner of the lot on the northwest corner of the site, requested clarification concerning basis for the imposed assessments and the context of the word "develop" as it relates to change of ownership. He was advised by the Examiner and Mr. Blaylock that the assessment for improvements would be based on square footage and that development is not affected by change of ownership, but that remodeling could be a consideration. The Hearing Examiner further advised the group of owners concerning Fire Code requirements should there be a change of use or ownership. The Examiner called for further testimony in support. There was none. He then invited further comments from the Zoning Administrator. Mr. Blaylock submitted a letter dated December 6, 1983, to Mrs. Sylvia Casterline into the record as Exhibit #5. He also requested modification of Building and Zoning's recommendations to provide in the covenants for a method of possible revision concerning the 20-foot setback from Maple Avenue S.W. He explained that there was potential for vacation of Maple Avenue S.W., as it is a deadend street adjacent to the subject property; and, should this occur, then the 20-foot setback would not apply because it would be a side lot rather than a property line abutting a public right-of-way. There being no further testimony, the hearing was closed by the Examiner at 10:05 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Mamie Swales, filed a request for approval of a reclassification of approximately 1.3 acres of property from Ft-1 to L-1 (Light Industrial). 2. The application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents, was entered into the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. The subject site is the block located between I-405 on the south, S.W. 13th Street on the north, Maple Avenue S.W. on the east, and Lind Avenue S.W. (as extended) on the west. The site consists of five parcels which themselves consist of many smaller legal lots. The properties are owned by four different parties. 6. The essentially level site contains five separate older single-family homes. One parcel is undeveloped. Mamie Swales R-062-83 February 7, 1984 Page 5 7. The construction of I-405 resulted in the closing of Lind Avenue and further resulted in both S.W. 13th Street and Maple Avenue S.W. becoming dead end streets. The most southwesterly parcel (Casterline) has been cut off from direct access to a public street and is served by an easement with access to S.W. 13th Street. 8. The subject site was annexed into the city by Ordinance 1745 in April of 1959, as amended by Ordinances 1764 and 1928. The property was reclassified to G-6000 by the latter ordinance in May of 1961. A change in designation in 1982 resulted in the site being designated R-1 (Single-Family Residential; Minimum lot size - 7,200 sq. ft.). 9. The Casterline property, the southwesterly parcel, was not included in the original request for reclassification. The city determined for consistency that the property should be included in any rezone, as the parcel is served by easement over property which would have been rezoned to L-1 if the rezone had been approved. Mrs. Casterline joined the petition at the city's urging, but intends to preserve the single-family character of her house. 10. The immediate area in which the subject site is located has been in transition to more intensive uses in the last number of years as a result of the construction of I-405. Numerous rezones have occurred both north and south of I-405 in the areas west of Rainier Avenue. In addition to the rezones, new construction of commercial, warehousing, and light industrial uses have been authorized and completed in the vicinity of the subject site. 11. Approval of the proposed rezone, coupled with construction of light industrial uses, could generate additional employment and would generate approximately 69 additional daily vehicle trips. Construction of some type of commercial use could conceivably generate up to approximately 313 additional vehicle trips. 12. The Comprehensive Plan designates the area in which the subject site is located as suitable for the development of manufacturing park type uses. 13. Since the late 1970's, a large number of smaller parcels between Grady Way and S.W. 16th Street have been reclassified to B-1 and L-1. The rationale for B-1 and L-1 rather than M-P was based upon the limited lot areas which could not accommodate the large setbacks required in M-P (Manufacturing Park) zones. The zoning which was granted, imposed, by restrictive covenants, setbacks generally larger than otherwise required in either B-1 or L-1 zones, but substantially smaller than required in the M-P Zone. CONCLUSIONS: 1. The proponent of a rezone must demonstrate that the request is in the public interest, will not impair the public health, safety, and welfare, and in addition, is in compliance with at least one of the three criteria found in Section 4-3010 which provide in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been a material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. Subject to the conditions imposed below, the request to reclassify the subject site should be approved. 2. The site, while designated for manufacturing park uses, consists of a relatively small parcel of property, especially in depth, and imposition of the setbacks required in an M-P Zone would unreasonably burden development of the site; whereas an L-1 designation, which incorporates lesser setbacks, would allow reasonable redevelopment but be in harmony with the Comprehensive Plan. The effects of adjacent I-405 have limited the long-term residential character of the subject site and reclassification to some more intense zoning classification would be in keeping with the developing character. L-1 would permit uses which need proximity to I-405 and the arterial system which serves the subject site. 4. At the same time, the city must protect the enduring single-family homes in the area while permitting the transition to more intense uses. The Casterline property should not be unduly burdened by encroaching development and without instigation from the city, would not have joined in the rezone effort. The owner occupied site continues to provide affordable housing to a long-time resident and senior citizen who maintains the house and garden for her own use and sustenance. 5. Therefore, in keeping with the goals and policies of the Comprehensive Plan and generally with public policy, buffers should be established which maintain light and air and afford a measure of privacy. Therefore, in addition to the 20-foot setback from streets which has been required for other properties in the area, protection of the side and rear yard of the Casterline property will be required while it remains owner-occupied. Since the area is designated in the Comprehensive Plan for open spacious campus-like manufacturing parks, such setbacks would reasonably accomplish this end. Covenants requiring 10-foot setbacks from the Casterline property line should be required to protect the residential character. Such setbacks remain a reasonable method of providing some loyalty to the manufacturing park designation of the Comprehensive Plan which requires setbacks along all property lines which are to be landscaped. 6. Further, the Council should again consider the impacts of small lot rezones in the general vicinity of the subject site since these small parcels cannot hope to achieve the campus-like setting envisioned in the Comprehensive Plan. The alternatives are to continue to approve individual rezones which will permit small, relatively poorly separated warehouse-type structures, or to require consolidation of these smaller lots into larger parcels in which the goals and policies of campus-like, aesthetically pleasing and landscaped complexes can be carried out. 7. Subject to the foregoing conclusions and conditions, the City Council should approve the rezone of the subject site from R-1 to L-1. RECOMMENDATION: The City Council should approve the reclassification of the subject site from R-1 to L-1, subject to the following conditions: 1. The execution of restrictive covenants requiring: a. Twenty feet of landscaped setback from any public right-of-way. b. Ten foot setbacks along property lines abutting the Casterline property. 2. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. HISTORY/BACKGROUND: The subject site was annexed into the City of Renton by Ordinance #1745 of April 14, 1959, which was later corrected by Ordinance #1764 of May 19, 1959 and Ordinance #1928 of December 12, 1961. Upon adoption of Ordinance #1928, the subject property was zoned G- 6000. This zoning classification was later changed to the R-1 designation with the adoption of the new zoning map by Ordinance 3634 of June 13, 1982. This soil has been modified by disturbance of the natural layers with additions of fill material several feet thick to accommodate large industrial and housing installations. The erosion hazard is slight to moderate. No capability or woodland classification. 3. Vegetation: Vegetation for the site consists of urban vegetation (ornamental vegetation, trees, and lawn). 4. Wildlife: The existing vegetation provides suitable habitat for birds. 5. Water: No water was observed on the site. 6. Land Use: Five single family residences, together with some accessory buildings, are located on the subject property. E. NEIGHBORHOOD CHARACTERISTICS: The property surrounding the subject site consists of vacant, single family, office, and light industrial. The general area is in transition from a single family residential area to one of commercial/light industrial uses. F. PUBLIC SERVICES: 1. Utilities: a. Water - A 12-inch water line extends north-south along Maple Avenue S.W. by the subject site. b. Sewer - An 8-inch sanitary sewer line extends east-west approximately 500 feet north of the subject site. c. Storm Water Drainage - The applicant is required to provide a storm water retention/detention system on site and to participate in the cost of a storm drainage system being installed in Maple Avenue S.W. 2.Fire Protection: Provided by the City of Renton as per ordinance requirements. 3. Transit: Metro Transit Route #912 operates along S.W. Grady Way approximately 700 feet north of the subject site. 4. Schools: Not applicable. 5.Recreation: Not applicable. G. Natural Systems: Minor since the property has already been utilized for residences. 2.Population/Employment: The proposed rezone itself will not have an impact on employment in the Renton area. But a light industrial use developed in the future will have some impact. The impact can not be determined until redevelopment of the site is proposed for industrial purposes. 3. Schools: N/A. 4. Social: N/A. 5. Traffic: Development of the subject s'te for light industrial purposes will generate approximately 69 average daily trips (based on 52.4 trips per acre for light industrial uses). (Note: A worse case situation might arise if the site were developed entirely into general office use in which case the number of trips would increase to approximately 313 average daily trips (based on 240.1 trips per acre for general office uses). ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended, RCW 43-21C, a final declaration of non-significance was issued by the Environmental Review Committee on October 5, 1983. L. DEP.ARTMENT ANALYSIS; 1.Four adjacent property owners have joined together in one rezone application request on +1.3 acres from G- 1, General Use, to L-1, Light Industrial. The ultimate development of the site is unknown. 2. The Environmental Review Committee conditioned the declaration of non-significance upon: a. Providing a positive storm drainage outfall, and b. Participation in street improvements on Grady Way between Maple Avenue S.W. and Rainier Avenue South for additional capacity. Based upon a fractional share of acreage, the amount charged the subject property will be $20,554.26. This amount is due to the City at the time the building permit is issued. The amount due may be prorated if the site is developed in stages. 3. The Land Use Hearing Examiner must review four specific criteria under Section 4-3014(C) to determine that the circumstances surrounding the rezone request are adequate to recommend approval of the reclassification. The following evidence clearly demonstrates the rezone request is appropriate. a. That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last area land use analysis and area zoning. I P ELIMINARY REPORT TO THE HEARING EXAMINER M MIE SWALES: R-062-83 J NUARY 10, 1983 P ge 4 The subject site was annexed into the City in 1959 and corrected in 1961. Both the city-wide Comprehensive Plan adopted in 1965 and the Green River Valley Comprehensive Plan adopted in 1975 clearly show the area as designated for Manufacturing Park activities. The R-1 classification was applied in 1982 as a result of combining the then G-6000 classification of the subject site with several other single family residential classifications. No rezone request has been considered since annexation. b. That the property is potentially classified for the proposed zone being requested pursuant to the policies set forth in the Comprehensive Plan and the conditions have been met that would indicate the change is appropriate. The proposed rezone request to L-1, Light Industrial Use, is not specifically in conformance with the Comprehensive Plan Land Use Element designation of Manufacturing Park for the subject site. However, the City has approved a number of rezones in the general area to both B-1, Business Use, and L-1, Light Industrial Use, as a result of the hardship resulting from the strict application of setback requirements in the Manufacturing Park Zone upon small lots. Actual imposition of these requirements would preclude the functional development of these small lots and blocks. The result has to be imposed with restrictive covenants establishing minimum setbacks for buildings and specific landscaping areas. This policy has been utilized since the late 1960s, with the most recent application under Ordinance 3732 in the Anderson/Minietta Rezone (R-013-83). c. That since the last previous land use analysis of the area zoning of the subject property, authorized public improvements, permitted private development or other circumstances affecting the subject property have undergone significant and material change. Since 1975, the general area has begun a transition from older single family residential development and vacant land to commercial and industrial activities. Development of this type has primarily concentrated along Grady Way, but during the last two years use changes have been occurring south of Grady Way but north of I-405. This subject site is within that general area of change. Timeliness: d. The final test to determine whether a rezone request is appropriate is to address the question of timeliness. The subject property is not the next incremental parcel to be developed from the north going to the south. In fact, the site may remain undeveloped for several years awaiting other developments of vacant land within the area. However, the joint rezone would allow one developer the opportunity to come in and negotiate with the different parties for one development. Considering the general rate of growth of business and commercial activities in this area, it would not be untimely to rezone the property now because general infill would be approximated to occur within the next five years. Major public improvements to Grady Way, Lind Avenue S.W., and public utilities in the area support the potential for actual development. Thus, it would appear timely to allow the rezoning of the subject site. PRELIMINARY REPORT TO THE HEARING EXAMINER MAMIE SWALES: R-•062- 83 JANUARY 10, 1983 Page 5 4.Departmental comments are attached for the Examiner's and public's review. Most of the comments from the Public Works Department point to the requirements of off- site improvements and participation in specific system development charges in the area at the time of development. The Policy Development Department does suggest that the property be covenanted to require specific setbacks consistent with the other rezones in the general area. This would primarily point to the twenty (20) foot setback adjacent to City streets and would not necessarily apply to Interstate 405 or Lind Avenue, because Lind Avenue at this location is under the limited access control of the State of Washington. The Policy Development Department has also recommended that any future development of the site be reviewed under site development approval. Internal setbacks of the subject property between the four participating parcels should not be imposed as typically would be considered. The applicants have agreed that the property will ultimately be light industrial in nature, and the issue of buffering should be considered inappropriate because of the applicants' understanding and desire to have their adjacent properties zoned light industrial instead of retaining the residential zoning. Therefore, the typical requirement of a six (6) foot setback for adjacent properties should not be imposed in this specific case. The Building and Zoning Department does agree that specific review should be conducted of each development, if phased, or total site development through site approval plans. M. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the Hearing Examiner recommend to the City Council approval of the rezone request, R-062-83, subject to tl,.e condition that restrictive covenants be imposed on the properties which would require a twenty (20) foot setback from Maple Avenue S.W. and S.W. 13th Street along with site plan approval. Area charges cover all of the remaining estimated project costs, i .e. , signalization, street lighting, etc. 3. Total area within the benefit district = 635,250 sq. ft. According to your calculations, the property owners affected would be required to pay $ 24 , 514 . 25 to the City for 1 . 3 acres of either land or land with old rental houses . I believe this to be very unfair for the following reasons: 1 . The property owners involved have no plans to develop the parcels in the foreseeable future . Their names are Swales , Pierotti , Roller and Casterline . 2 . Two of these parties are on fixed incomes and would most likely be required to sell their property and home in order to pay their pro-rated share . 3 . It is our understanding that the City has plans to install a traffic light at Grady Way and Maple Avenue S .W. and widen Grady Way for a right-turn only lane at Rainier. We believe the timetable for these improvements is very tentative and the need for them equally dubious . Those actually building or expanding are the owners most able to pay and most likely to garner benefits early in the process. 5 . We would like to see some other method of handling this situation , such as deferral , waiver , LID, bonding or a letter from the owners agreeing to participate at time of resale or development.
