Box .`9 Renton, WA 98057 RE: Subdivision of Lot 4 of Rucker Short Plat File: Short Plat 064-83) Dear Ms. Webb: We have finished reviewing your request in a letter dated May 28, 1985, concerning the subdivisior of Lot 4 of the Hazel Rucker short plat. The question you requested us to review was whether or not a piece of property could be platted without an applicant going through the City's formal short plat process. State law does provide for "division made by testamentary provisions, or the laws of descent" [RCW S8.17.040(3)]. This section has been attached for your review. Thus, the division of Lot 4 of the Hazel Rucker short plat does not need to go through the City of Renton formal short plat process. Deeds reflecting the division of Lot 4 as provided in Mrs. Rucker's will should be filed with King County. We would also appreciate copies of the recorded deeds for our records so that any questions that arise in the future can be answered. He indicated the Comprehensive Plan designation for this subject site is commercial office park; that the proposed structures would comply with the setback requirements and all lots would comply with the minimum lot size standards; further, that the area is in transition at the current time, with duplexes and condominiums abutting the subject site. Mr. Blaylock also stated the proposed lots #1, 2 and 3 would be developed into multiple family housing and that lot #4 would be retained for the use of two single-family residences for the present time. He noted that sidewalks and lighting will have to be installed along Union Avenue and N.E. 5th and that an additional dedication will have to be provided along Union Avenue to provide for adequate width of that street. Mr. Blaylock stated the staff recommends approval of the rezone subject to the following condition: 1. The rezone not be approved for a maximum of 25 units per acre. Further, Staff recommends the short plat request be approved, subject to the following: 1. Approval of the rezone by the City Council. 2. Dedication of the western ten (10) feet of the subject site for street purposes. 3. Modification of the plat to include easements for sanitary sewer extension from the northwest corner of the subject property to the southeast corner of the subject property. The Examiner called on the applicant or representative for testimony. Responding was: John Newell Room 200, 231 Williams Avenue S. Renton, WA 98055 Mr. Newell indicated he was representing Sigi Ullrich at today's hearing and they have no concerns over the staff report, although they would ask for the maximum allowable 25 units per acre, even though they may not develop that many units. He stated at the present time, they have not proceeded with an architectural design and they probably will not get the 25 units because of the parking requirements, but would like the opportunity to work within the R-3 zone as It is specified Mr. Newell also questiored the need for a 10" sewer line and indicated they would like to have the opportunity to evaluate this requirement during design. The Examiner called for further testimony in support of the application. There was none. The Examiner then called for testimony in opposition to the application. There was none. The Examiner called on the Bob Bergstrom, Engineering Supervisor, to elaborate on the difference between 10" and 8" sewer line and whether the entire sewer line was adequate to handle this development. Mr. Bergstrom reported the proposed project will be served by an interim pumping station at the corner of N.E. 5th and Union Avenue; the ultimate system is to provide gravity flow south to N.E. 4th Street and the proposal is to run a line down along the lot line between Lots 1, 2, and 4 to get to the southeast corner of this plat. Whether an 8" or 10" sewer line is necessary depends upon the slope of the land and the city staff will work with the developer to see what would bi! required of them; further, there is adequate sewer capacity to serve this development. The Examiner called for further comment. Mr. Jof.n Newell asked for an explanation of the storm drainage fee. Roger Blaylock stated that was a $65 fee payable at the time of rezone approval and is a one-time fee. There being no further testimony, the hearing was closed by the Examiner at 9:35 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDIIN:GS: 1. The applicant, Sigi Ullrich, filed a request for approval of a reclassification of approximately 1.59 acres of property from G-1 (General; Single-Family Residential) to R-3 (Medium-Density Multifamily), together with a request for approval of a 4-lot short plat. The application file containing the application, the State Environmental Policy Act SE:?A) documentation, the Building and Zoning Department Report, and other pertinent documents was entered into the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. The subject proposal met with no opposition from the public. 6. The subject site is located at 520 Union Avenue N.E., approximately one block north of N.E.. 4th Street. The site is located on the west side of Union in this location. 7. The subject site is level and currently contains two single-family homes which would remain for an indefinite period if the request were to be approved. 8. The Comprehensive Plan designates the area in which the subject site is located as sul':able for the development of office park uses. The site lies within an area which could best be described as transitional between office pack uses, commercial uses and medium and low-density multifamily uses. 9. North and south of the subject site are multi-family developments on R-3 properties. West of the subject site the zoning is G- 1, that of the subject site, and R- 1 Single-Family Residential; minimum lot size - 7,200 sq. ft.). The Safeway store is located on the corner of 4th and Union and is zoned B-1 Business/Commercial). 10. Multi-family apartment complexes were constructed on the northern and southern properties within the last few years. The Safeway Store recently opened and Union Avenue N.E. has been widened, sewer extensions have been provided, and an LID has been proposed for N.E. 4th Street. 11. The applicant proposes to subdivide the subject site if the rezone is approved. The four lots would contain respectively, approximately 13,000 sq. ft. (Lot 1); 11,000 sq. ft. (Lot 2); 21,780 sq. ft. (Lot 3); and 24,000 sq. ft. (Lot 4). 12. Lots 1 and 4 would have frontage along Union, while Lots 2 and 3 would front on the newly developed N.E. 5th Street. 13. Tle land is situated in such a fashion that a lift facility is necessary to pump sewage into the trunk line serving the subject site. 14. The maximum development which the proposed zoning would accomodate would be approximately 40 dwelling units capable of accomodating 100 residents, approximately 10 school age children, and generating approximately 244 average daily vehicle trips. 15. The Public Works Department requires an easement for sanitary sewers along the western property line of Lot 1, turning along the northern property line of Lot 4 and then southerly along the eastern property line of Lot 4. 16. The dedication of 10 feet of the westerly-most property of the subject site is required for the general alignment of Union Avenue. C ONC I.USIONS: 1. The proponent of a rezone must demonstrate that the request is in the public interest, will not impair the public health, safety and welfare, and in addition, is in compliance with at least one of the three criteria found in Section 4-3010, which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or Sigi Ullr:.ch R-063-83; Sh. P1.-064-83 November 17, 1983 Page 4 b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been a material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. The applicant has demonstrated that the request is in the public interest and should be approved. 2. Mile the site is located in an area generally designated for an office park in the Comprehensive Plan, the site is situated such that it straddles a transitional area. The properties to its north and south were reclassified to R-3 within the last two or three years and have been developed with multi-family units. Therefore, it would be inappropriate to be strictly governed by the Comprehensive Plan. Rather, the developed land uses should guide the reclassification of the subject site. 3. In addition to the new multi-family units is a new Safeway store. Union Avenue has also been recently improved to accomodate greater traffic demands. 4. The reclassification of the subject site will permit new development, infilling an area convenient to arterial streets and shopping, and appears to be in the public interest. Therefore, the City Council should reclassify the subject site to R-3. SHORT PLAT 5. The short plat proposed by the applicant will serve the public use and interest. The plat will complement the rezone and permit infilling of an area of growing amenities including shopping and transportation. 6. The plat will also allow phased development of each of the parcels or sale to separate owners who may develop each lot as the demand for additional multi-family housing inc reases. 7. The pump station for sewers will eventually be phased out and a permanent gravity line will serve the site. In order to accomodate the line, the site will need an easement in which the sewer line can be placed to permit gravity flow. Therefore, the applicant will have to provide an easement subject to the approval of the Department of Public Works. 8. Similarly, in order to accomodate the increased traffic generated by the subject site and other surrounding properties and to fill out the right-of-way for Union Avenue N.E., the applicant will have to dedicate 10 feet of right-of-way for the widening of Union. RECOMMENDATION: The City Council should approve the reclassification of the subject site. DECISION: The short plat is approved, subject to the following conditions: 1. The dedication of an easement for sanitary sewer as approved by the Department of Public Works. 2. The dedication of the westerly 10 feet of the subject site right-of-way for the widening of Union Avenue N.E. 3. The approval of the reclassification of the subject site by the City Council. The Environmental Review Committee has issued a declaration of non-significance subject to the participation in the Down Stream Storm Water Management Control Fund basically established under the GM Associates Rezone (R-018-82). In addition, the Environmental Review Committee has informed the applicant that with actual development of the property that a ten (10) foot dedication along Union Avenue N.E. will be required to meet urban arterial standards. Union Avenue N.E. is designated as a secondary arterial and under Table 1. Minimum Design Standards for Public Right-of-Way, Subdivision Ordinance, Section 9-1108(7)(H) - community arterials are required to have seventy (70) feet of right-of-way. 4 The application is actually divided into two issues. The first is the rezone from G-1, General Use, to R-3, Multiple Family Residential and the second is that of subdivision. REZONE 5. The Land Use Hearing Examiner must review four specific criteria under Section 4-3014(C) to determine that the circumstances surrounding the rezone request are adequate to recommend approval of the reclassification. The following evidence clearly demonstrates the rezone request is appropriate. PRELIMINARY REPORT TO THE HEARING EXAMINER SIGI ULLRICH: R-063-83, SHORT PLAT-064-83 NOVEMBER 8, 1983 PAGE 4 a. That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last area land use analysis and area zoning. The subject site was annexed into the City in 1966 and which time the G-1 classification was applied. It has not been considered in any areawide land use analysis for area zoning except those of the Comprehensive Plan amendments in 1981 for the Northeast Quadrant. b. That the property is potentially classified for the proposed zone being requested pursuant to the policies set forth in the Comprehensive Plan and conditions have been met which would indicate the change is appropriate. In 1981, the Northeast Quadrant Amendment to the Comprehensive Plan specifically designated the area as Office Park or Commercial Use. Prior to that time, a land use trend had been started with the development of the Union 500 condominiums, which is immediately to the south of the subject site. In 1982, under the McWilliams rezone, R-030-82, the adjacent 1.88 acres immediately to the north of the subject site was rezoned to R-3. It appears that the transitional development to multiple family residential instead of Office Park was begun just prior to the formal inactment of the Northeast Comprehensive Plan. At this point, it appears that there is a conflict between what the Comprehensive Plan Map designates as potential Office Park, and the Residential Goals and Polices. The comparison only occurs as a result of the existing land uses on both the north and south side of the subject property. In fact, the residential goal and neighborhood objective is to create a sound viable neighborhood that should be created and/or maintained and a declining neighborhood should be revitalized. Introduction of an office complex in between two established multiple family residential complexes would appear to actually divide the residential neighborhood that is in general development. Therefore, it would appear generally consistent with the Comprehensive Plan to designate the subject site as R-3, Multiple Family Residential. c. That since the last previous land use analysis of the area zoning of the subject property, authorized public improvements, permitted private development or other circumstances affecting the subject property have undergone significant and material change. In 1980, the Union 500 condominium complex to the south was constructed. In 1982, the Union 600 complex was developed along with N.E. 5th Street by the same developer. During the last five years, public improvements have included the extensions of sewer and street improvements on Union Avenue N.E., while other private improvements include the new super Safeway store and commercial development on the northeast corner of Union Avenue N.E. and N.E. 4th Street within 300 feet of the subject site. d. Timeliness: The final test to determine whether a rezone request is appropriate is to address the question of timeliness. The subject site is the next incremental parcel to be developed in the residential buffer area adjacent to the commercial area to the south. This area has been in transition for the last three years from undeveloped single family residential to both multiple family and commercial uses. Thus, it would appear appropriate to recommend the rezoning of the subject site to R-3, Multiple Family Residential. PRELIMINARY REPORT TO THE HEARING EXAMINER SIGI UL__RICH: R-063-83, SHORT PLAT-064-83 NOVEM 3ER 8, 1983 PAGE 5 SHORT PLAT 6.The applicant is seeking a four lot short plat of the 1.59 acres to allow immediate development of lots #1 thru #3 into multiple family residential. All of the proposed lots comply with the minimum lot size requirement (7200 square feet) and the lot width and length requirements. The original request did not comply with the length-width ratio requirement and has been modified to comply in the present proposal. The structures existing on proposed lots #1, #2 and #3 will be removed. The structures on lot #4 will remain and be occupied. All of the structures comply with the minimum setback requirements for front yards, rear yards and side yards. Lot #4 is also in the request for rezone to R-3 and so the specific setback requirements for buffering will not be imposed around lot 4. Lot #4 will be occupied by the present owner, Hazel Rucker, with full knowledge of the development proposed by Mr. Ullrich. 7. Full physical improvements including curbs, gutters, sidewalks, street lighting and sewer extensions are anticipated by the developer. A new sidewalk will have to be constructed along the southern edge of N.E. 5th Street along with the addition of one (1) street light approximately in the middle of the northern property line on proposed lot #2. The Public Works Department advised that the sewer will have to be extended from the northwest corner of proposed lot #1 along the western property to the southern property line, and then eastward to the western property line of proposed lot #3, and then along the western property line of lot #3 to the southern property line and then along the southern property line eastward to the southeast corner of the proposed short plat. This would be a construction of a new ten-inch sanitary sewer along with necessary easements for maintenance. 8. The Environmental Review Committee advises the applicant that it would be necessary to dedicate the western ten (10) feet of the subject site as the time of development. The proper time would be at the point of subdivision to meet the minimum requirements for a major arterial as required under the Subdivision Ordinance [Section 9-I 108(7)(H)]. 9. Department comments are attached for both the Hearing Examiner and the public's review. The applicant should be informed that a late corner's fees are applicable for water, and systems development charges will be applied in both water and sewer. M. UNIC ON 2 il Prose 111• 11, 110 SITE SP REZONE PLAT 411/ JUSTIF [CATION FOR REZONE The rezone request from G-1 to R-3 conforms to the Multiple Family land use designation imposed on the subject site by the Comprehensive Plan. Both the objectives for the establishing of residential neighborhoods and housing density (pages 8-9 of the 1981 Comprehensive Plan Goals and Policies) are supported by the proposal . The site is easily accessable by a major arterial , is compatible with the Union 600 (Duplex) to the north and with the Union 500 Condominiums to the south, and the site can be served by adequate city utilities. Both the Comprehensive Plan Map and the Goals and Policies support the rezone request. The site has not been specifically considered for rezone since it was annexed into the city. This would support the second criteria that requires that a reclassification has not been considered since the last time of land use analysis. The general area is undergoing significant transition from a vacant undeveloped state to a mixture of commercial and residential uses. The commercial uses are concentrating approximately 800 feet to the south with the construction of a new Safway grocery store. Other private developments in the immediate vicinity includes single family residential development to the northwest, duplex development to the north, and rultiple family developments to the south. Sewer service has been extended along Union Avenue N.E. to the subject site. A twelve-inch water main already exists in Union Avenue as a result of the imprevements to the streets in the late 1970' s. the requested rezone to R-3 is timely since the parcel lies between parcels currently zoned R-3. 7' 01132, 091 rill?
