Harju FILE NO. Short Plat 380-79, "-- W-381-79 LOCATION: Southwest corner of Taylor Avenue N.W. and N.W. 3rd Street. SUMMARY OF REQUEST: Applicant requests approval of a proposed two-lot short plat together with a waiver of the required off-site improvements. • SUMMARY OF ACTION: Planning Department Recommendation: Approval with restrictive covenants. • • Hearing Examiner Decision: Approval with restrictive covenants. • PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on August 7, 1979. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 14, 1979 at 9:50 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. • It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Roger Blaylock, Associate Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Short Plat as submitted Exhibit #3: Short Plat with staff comments Exhibit #4: Applicant's Survey • The Examiner requested testimony by the applicant. Responding was: Gregory G. Harju 353 Taylor Avenue N.W. Renton, WA 98055 • Mr. Harju indicated that revision of the lot line to comply with the 80-foot depth requirement for Parcel 2 would locate the line in close proximity to an existing abandoned greenhouse on the site. He also noted the existence of a retaining wall which had been part of a previously removed garage within the required.25-foot rear yard setback' of Parcel 1, and inquired regarding city regulations for setbacks. Mr. Blaylock advised that the rear and side yard setback for detached accessory buildings such as greenhouses and garages is three feet, but a minimum six foot-setback is required from the residence. • Responding to the Examiner's inquiry, Mr. Harju indicated his concurrence in establishment of the lot depth of Parcel 2 at 80 feet. David Clemens, Senior Planner, advised that if a problem exists with location of the lot line as it relates to existing accessory structures, the line maybe skewed to arrive at an average depth of 80 feet. The Examiner stated that since the buildings are pre-existing, application for a variance may be made.to the Board of Adjustment as an alternative solution. • The Examiner requested further comments. Mr. Harju inquired if establishment of lot lines ' would be required' prior to review and approval of the short plat. The Examiner indicated that approval of the short plat could be conditioned upon establishment of the lot lines. The Examiner requested further comments in support or opposition to the application'. There . was no response. He then requested final comments from the Planning Department. Since there were no further comments, the hearing on File No. Short Plat 380-79 and W-381-79 was closed by the Examiner at 10:05 a.m. Short Plat 380-79 Page Two FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a two-lot short plat of .46 acres at the southwest corner of Taylor Avenue N.W. and N.W. 3rd Street together with a waiver of the required off-site improvements. 2. The Planning Department report sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal has been determined exempt from the threshold determination by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-706 (R-1, Single Family Residential) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The subject property is located on a relatively steep slope which rises from east to west at approximately a 14% grade. An existing residence is located on the eastern portion of the property and the remaining portion of the subject site is covered with scrubs, fruit trees and some Douglas fir trees. Part of the subject property consists of a portion of vacated N.W. 3rd Street lying between Taylor Avenue N.W. and Maple Avenue N.W. 9. Single family uses are the predominant development type in the area and there are still some undeveloped lots in the vicinity. 10. The applicant provided a copy of a survey (Exhibit #4) which indicated that the , proposed lots can meet the minimum size requirements and that the existing residence would provide a conforming rear yard. The applicant also indicated that an abandoned greenhouse may be located too close to the proposed property line. The applicant was advised of the possibility ofl skewing the property line or applying for a variance. i 11. The Comprehensive Plan indicates that the area in which the subject property is located is suitable for single family residential development. 12. There are no off-site improvements in the area and grades for both Taylor Avenue N.W. and Maple Avenue N.W. have yet to be established. CONCLUSIONS: 1. The applicant proposes to divide the subject property into two lots leaving an existing residence on one of the lots and constructing a second dwelling on the remaining lot. The proposal appears to serve the public interest and makes effective use of the subject property. The proposed subdivision conforms to both the zoning for the subject property and the potential use indicated by the Comprehensive Plan. ' 2. The proposed subdivision is also compatible with surrounding uses and development and will provide an additional lot for the development of needed single family residences. 3. At the present time there are no off-site improvements in the area in which the subject property is located. In addition, final grades have not been determined for Taylor Avenue N.W. or Maple Avenue' N.W. It would therefore be inappropriate to require the applicant to install off-site improvements which may be subject to relocation if the grades in the area are changed. • Short Plat 380-79 Page Three 4. The location of the greenhouse is in question and the applicant may have difficulty locating the property line in such manner as not to create a non-conforming lot. The applicant will be required to provide the required lot depth of 80 feet and the Planning Department may assist the applicant in locating the, line to provide the required lot depth by appropriately skewing the property line. The applicant may also apply for a variance or remove the offending greenhouse. PLANNING DEPARTMENT ANALYSIS : 1, The proposed short plat is consistent with the Comprehensive Plan designation of single family for the site and surrounding area. 2. The proposal is consistent with the existing zoning in the vicinity. In addition, there have been no recent rezones in the area. 3. Both of the proposed lots meet or exceed the minimum lot size requirements of the G-7200 zone. However, R.M.C. 9-1108-23F(3)(b) requires that lots have a minimum depth of 80 feet. Parcel 2 is not in compliance and would have to be modified to comply. This modification could result in the creation of. a non-conforming lot (Parcel 1) in respect to the required rear yard setback of 25 feet. Based on a field investigation, it appears that Parcel 1 will not become non-conforming; however, the applicant has been requested to provide additional data to fix the location of the existing residence in relationship to the proposed lots. 4. The grades for Taylor Avenue N.W. have not been determined by the Public Works Department ; therefore, individual improvements to the street cannot be made at this time. Maple Avenue N.W. is in the same situation. An L. I .D. is a probable solution since it has been placed on the sixth year of the Six-year Street Plan. M. DEPARTMENTAL RECOMMENATION: The staff' recommends that the applicant 's request for a short plat be approved subject to the following conditions : 1.
