APPLICANT: Dennis R. Oster FILE NO. Sh. P1. 395-79, E-396-79, W-397-79 LOCATION: Vicinity of 316 Union Avenue N.E. SUMMARY OF REQUEST: Applicant requests approval of a proposed two-lot short plat together with an exception to the Subdivision Ordinance for a 25-foot pipestem lot. A waiver of the required off-site improvements is also requested. SUMMARY OF ACTION: Planning Department Recommendation: Approval of short plat and exception; Denial of waiver. Hearing Examiner Decision: Approval of short plat, exception and waiver subject to restrictive covenants. • PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on August 30, 1979. PUBLIC HEARING: After, reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing On the subject .as follows: The hearing was opened on September 4, 1979 at 9:25 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, , and the report was entered into the record as Exhibit #1. • Roger Blaylock, Associate Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: • • Exhibit #2: Short Plat as submitted . Exhibit #3: Short Plat with staff comments The Examiner requested testimony by the applicant. Responding was: Dennis R. Oster • • 26306 S.E. 192nd • Maple Valley, WA 98038 Mr. Oster clarified Section C. , History/Background, of Exhibit #1, and advised that although the information contained in the report regarding annexation of the site into the city in 1967 is correct, the subject parcel'wasrezoned from G to R-3 in 1975, not from G to •B-1 in 1967 as denoted. Mr. Oster indicated the purpose of the short plat request to enable . • sale of the existing single family residence located on proposed Lot No. 1, and he advised 'that ,no plans currently exist for development of the easterly portion of the property. Due to lack of development plans, he objected to requirements for paving the pipestem road at • ,this time because of future disruption to the roadway upon development of the rear property. Mr. .Oster corrected Section L.2 of Exhibit #1 which states that zoning of the parcel immediately adjacent to the south boundary of the subject.site is business, B-1, and clarified that no B-1 zoning exists on property to the south which is located in King County. Regarding the Planning Department recommendation for denial of the waiver, 'Mr. Oster objected to requirement of installation of sewers, curbs, gutters and sidewalks, and felt they should be deferred until the eastern portion of the property is developed. The Examiner inquired regarding size of existing structures on the site and dimension of existing setbacks. Mr. Oster advised that the existing structure contains 62 feet by 24 feet, front yard setback to the existing front porch is 41 feet, the sideyard setback on the southern side is eight feet, and the sideyard setback on the northern side is 30 feet or five feet from the proposed pipestem road. He also indicated that the distance between an existing detached garage contained in proposed Lot No: 1 and the rear•property line is approximately 10 to 20 feet, and an additional existing accessory building located in the '', eastern portion of the property is situated approximately in the center of proposed Lot No. 2. SAi- Sh. P1. 395-79 Page Two The Examiner requested testimony by the Public Works Department regarding required off-site improvements. Warren-C. Gonnason, Public Works Director, indicated that the applicant will be required to, extend water and •sewer lines in front of the property, and .install curbs, • gutters and sidewalks to provide consistency with existing similar improvements to the north. Mr. Oster advised that to the north of the site, only one property on the eastern side. of the street. containing a recently constructed office building has installed a• 100-foot section of sidewalk. The Examiner explained the city's intent to require off-site improvements as properties are divided and developed to provide consistency in installation of pavin4 and sidewalks. Mr. Oster maintained his opinion that improvements should not be required until development of the property is proposed, and restated that the request for subdivision of the subject site is necessary to facilitate sale of the existing residence. He advised his . intent to construct a duplex or four-plex on the eastern parcel five to ten years from the present, but if off-site improvements are required immediately, economics would require that the existing residence be removed and •a 20-unit apartment building constructed on the site, which he felt would impact existing single family residential uses to the south. The Examiner stated that further development which is compatible with existing zoning on -the site would not require further public hearing, and he expressed concern that•all future concerns be addressed during the subject public hearing. Mr. Oster noted that city codes and regulations must be addressed and reviewed during application for a building permit, and he objected to being forced to remove the existing residence in order to meet requirements for off-site improvements. The Examiner suggested that the applicant apply to the Board of Public Works for a deferral of the improvements. Mr. Oster indicated that a maximum deferral for a period of two years would not be economically feasible. The Examiner requested further comments. Since there were none, the hearing regarding File No. Short Plat 395-79, E-396-79 and W-397-79 was closed by the Examiner at 9:47 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Ex miner now makes and enters the following: • FINDINGS: 1. The request is for approval of a two-lot short plat together with an exception to the Subdivision Ordinance for a 25-foot pipestem lot and a waiver of the required of -site improvements. 2. The Planning Department report sets forth the issues, applicable policies and pr visions, findings of fact, and departmental recommendations, in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. • 3. Pursuant to the City•of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal has been determined exempt from the threshold determination by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. • 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setbacks, lot coverage and height requirements •of Section 4-709A (R-3; Medium Density Multifamily) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The subject property .is located at 316 Union Avenue N.E. The site is'•basically, level. and an existing single family residence is located on the site together with certain , accessory structures. • 9. Pursuant to Section 9-1105, the Subdivision Ordinance, the applicant proposes dividing the subject.parcel into two separate lots. The westernmost lot (Lot No. 1) fronts on Union Avenue N.E. and would be 126.25 feet deep by 73;72 feet wide. The remaining lot (Lot No. 2) would have a'25-foot wide by 126.25-foot long pipestem access onto Union Avenue N.E. , The main portion of Lot No. 2, exclusive of the pipestem, would be , 167.51 feet .wide by 98.56 feet deep. 10. The applicant has requested an exception for the pipestem access pursuant to Section 9-1109 of the Subdivision Ordinance. 11. The applicant has also requested a waiver of the required off-site improvements . Sh. P1. 395-79 Page Three pursuant to Section 9-1105.6.B. • 12. The Comprehensive Plan for the area indicates that the area is suitable for the development Of medium density multi-family housing. The property is currently zoned R-3 which ,permits multifamily development on the site. 13. The property to the south is within the jurisdiction of King County and is zoned for single family residential development. The property to the west which is within the city limits is similarly zoned for single family uses. The lot north of the subject property is zoned'B-1, Business, and is developed with commercial uses. The lot north of that is zoned R-3, the zoning of the subject property. 14. Each of the large lots to the east and south.of the subject property is developed with single family uses. Multiple family and residential uses are predominantly developed to the west and northwest. 15. The area of Lot NO. 2, approximately 1/3 of an acre, would permit the establishment of about nine units if. developed to the permitted density of 30 units per acre. . 16. The relative proportions on the applicant's .submitted map are inaccurate: Exhibit #3 has been corrected to indicate a more accurate scale for the proposed lots. 17. The newly developed commercial lot just north of the' subject property has installed the required off-site improvements over a distance of approximately 100 feet. Off- site improvements have been required of new proposals and projects in the vicinity of the subject property. CONCLUSIONS: 1. The proposed' short plat will create a more than adequate single family lot (Lot No. 1) . in, the R-3 zone. The existing residence is compatible with the uses developed to the south and east of the subject property. They are all large lot residential homes developed just on' the edge of the city limits. 2. The remaining lot (Lot No. 2) though would be subject to possible development as a nine-unit apartment structure with access via a 25-foot roadway directly adjacent to the existing residence. In, addition, while the Comprehensive Plan indicates this area,would be suitable for medium density multifamily development, such possible development would generally be incompatible and unsuited to the surrounding development, large lot single family uses. The map element of the Comprehensive Plan is only a guideline for development and must be used in reference to the actual nature of the neighboring properties. A possible nine-unit apartment is too intense a use of the proposed lot: More in keeping with the area would be a four-plex, which would create a more compatible buffer with the large lot single family residences surrounding the subject site. 3. If the subject property is divided as proposed and Lot No. 2 is limited to the development of no more than four units, the proposal'will serve the public interest . and permit, the subject property to .be put to a higher use which at the same time will not harm or adversely affect- neighboring property. The scaled down potential will have less impact on the single family lots and help preserve property values and not lead to a decline in the desirability Of the large lot residential property immediately adjacent to the proposal. 4: The smaller 'scale of the proposal will also create less potential impact on the existing single family residence by lessening the potential use of the proposed pipestem access to Lot No. 2: The probable effects of nine units using the narrow road would.have ,an adverse effect on this residence and would therefore not qualify for an exception under terms of • Section 9-1109.1:C which provides that the approval of an exception must not have an adverse effect on other property in the vicinity. 5. The exception will permit the applicant to make reasonable use of the subject property under the condition set forth above. Similar pipestem exceptions have been granted to large internal lots which have no other available means of access and therefore the • approval of the exception will not grant the applicant a special privilege. 6. Off-site improvements.have.been required in the vicinity for prior developments, and the proposed subdivision will eventually lead to greater usage of: Union Avenue N.E. Therefore, the. applicant should install off-site improvements but these should be timed to. coincide with, further development. The waiver will therefore be subject to' an agreement to install off-site improvements at the time the subject parcel is further • 11111 Sh. DECISION: • Exhibit #3 is approved subject to the execution of restrictive covenants to limit development on Lot No. 2 to no more than four residential units. The pipestem exception is approved subject to the same restrictive covenants. The waiver is approved subject to restrictive covenants to install the required off-site improvements at the further development of either Lot No. 1 or Lot No. 2 or the initiiation of an LID for the area. HISTORY/BACKGROUND: The subject site was annexed into the City by Ordinance #2308 dated March 16 , 1967. It was rezoned from "G" to B-1 by Ordinance #2317 dated May 23 , 1967. D. PHYSICAL BACKGROUND: 1. Topography : The site is basically level. 2. Soils : Alderwood gravelly sandy loam (AgC) . Permeability is moderately rapid in the surface layer and subsoil and very slow in the substratum. Runoff is slow to medium and the erosion hazard is moderate . Vegetation : Some medium height Douglas Fir are located along., the Union Avenue NE frontage with smaller deciduous trees around the residence in the west portion and some taller deciduous species to the east . Some lawn is present in the westerly portion with the remaining ground cover consisting of • scrub grass. 4. Wildlife: The existing vegetation on the site provides some habitat for birds and small mammals . 5. Water : No surface water was evidenced on the subject site (August 23, 1979) . 6. Land Use : An existing single family residence is located in the westerly portion of the site with several accessory buildings to the east in close proximity. E. NEIGHBORHOOD CHARACTERISTICS : The properties to the east and south of the subject site are principally single family residence in nature with mixed multiple family and light commercial uses to the west and north. F. PUBLIC SERVICES: 1. Water and Sewer: A 16" water main extends north on Union Avenue NE from NE 4th Street for approximately 750 feet while an 8" sanitary sewer runs south on Union Avenue NE from NE 4th for approximately 450 feet. 2. Fire Protection : Provided by the Renton Fire Department as per ordinance requirements. 3. Transit : Metro Transit Route #107 operates along Union Avenue NE within * mile to the north of the subject site . 4. Schools : The subject site is located approximately 2 mile south of the Honeydew Elementary School while McKnight Junioh High School is approximately 1* miles to the northeast and Hazen High School is one mile to the northeast . 5.
