PLANNING DEPARTMENT 'The Planning Department preliminary report was received by. the REPORT: ' ' Examiner on July 3, 1980. PUBLIC.:HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The' hearing.was opened on July 8, 1980 at 11 :15 a.m. in the Council Chambers of the Renton Municipal Building. . Parties wishing to testify were affirmed by the Examiner. It was reported 'that the Hearing Examiner and the applicant had received and reviewed. the, Planning Department report. Roger Blaylock, Associate Planner, reviewed the report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Site Plan as submitted Exhibit #3: Site Plan with staff comments The Examiner requested clarification of the eastern side yard dimension denoted on the plans. Mr. Blaylock advised that a 6-foot, 5-inch setback exists. The Examiner requested testimony by the applicant. Responding was: John Pain 1116 N. 36th Street ,Renton, WA 98055 Mr. Pain, legal counsel for the applicant, addressed the. discussion of. an exception to the ordinance requirements for a 60-foot lot width contained in Sections L.7 and L.8 of the staff report. He advised that in following direction from the Planning Department, a request for variance through the Board of Adjustment was sought to reduce the lot size of proposed Lot 2 prior to requesting approval of the short plat from the Hearing Examiner. He 'indicated that he was not aware of the necessity of application for an exception in addition to the approved variance which he felt encompassed both lot size and width. He requested approval of the exception as recommended by the Planning Department rather than redesigning the plat with the triangular configuration illustrated on Exhibit #3. Referencing the requirement for 'installation of off-site improvements on both Burnett. . Avenue N. and N. 30th Street, Mr. Pain stated that similar improvements consisting of. curbs and gutters do not currently exist within one-half mile of the site., and in an easterly direction, improvements do not exist until the easterly side of FAI-405. Mr. Pain advised that the City Council had approved an LID for improvements to N. 30th Street,.;:• and based upon these considerations, he requested the Examiner to consider a waiver of the. requirements, or alternately, require the applicant to participate in a future LID.: ` The Caminer requested further testimony in support or opposition to the application. There was no response He then invited final comments from the Planning Department staff Mr. Blaylockstated .that the state law appears to be clear regarding platting requirements ;`::;''.. for installation of improvements or posting a performance bond to ensure 'completion at a future date. "He noted that a requirement of restrictive covenants would not be :appropriate in such cases since a time period must be established. Pl . 058-80 Page Two 'Mr. Pain stated that many homes in the general vicinity of the subject site have been 'constructed over old plats on lots 50 feet in width, and such construction is characteristic. of the neighborhood. He also advised that two homes have been recently built on 50-foot lots located immediately to the east of the applicant 's property on N. 30th Street. The Examiner noted that requests for exception or waiver were not filed, possibly due to the fact that the applicant was not aware of the requirements until July 5, 1980 upon receipt of the Planning Department report by mail . The Examiner requested final comments. Also requested is a waiver of the off-site improvements. PLANNING DEPARTMENT The Planning Department supplemental report was received by the REPORT: Examiner on July 31 , 1980. PUBLIC HEARING: After reviewing the. Planning Department supplemental report., examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was reopened on August. 5, 1980 at 9:07 a.m. in the Council Chambers of the Renton Municipal Building. . Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the supplemental Planning Department report. Roger Blaylock, Associate Planner, reviewed the report, and entered the following exhibit into the record: Exhibit #4: Application File for Waiver and Exception Requests containing Planning Department report and other pertinent documents The Examiner requested confirmation that a number of double and triple lots exist in this area. which have not been previously subdivided. Mr. Blaylock advised that the possibility of resubdividing most of the larger lots exists, but on established lots, readjustment of lot lines could occur through the building permit process. He also noted that approximately 50 lots currently exist within a 20-block radius of the site which would allow single family residential development, but because the lots will be developed individually, street improvements normally required through the platting process would not be required. Referencing the Planning Department recommendation to grant approval of the waiver subject to execution of restrictive covenants, the Examiner stated that restrictive covenants have been found to be ineffective, and the waiver, if approved by the Examiner, would be granted outright. The Examiner requested testimony by the applicant. Mr. Pain referencedi his letter attached :, to the Planning Department report, which states the applicant's position in the matter; The ; letter justifies the request for exception due to inability to subdivide the property into ,two `60-foot,; lots because of the location of the residence on the subject site which disallows provision of required side yard setbacks; and typically, homes in the area are located on50-foot lots. The letter also states that the waiver is justified because of location of the property in the Kennydale area in which off-site improvements do not exist. . P1 . 058-80 Page Three FINDINGSt CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The request is for approval of a two-lot, +12,750 square foot short plat together with an exception to the Subdivision Ordinance for a lot of less than 60 feet in width and a waiver of the •required off-site improvements. 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 , and Exhibit '#4. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, the subject proposal has been determined exempt from the threshold determination by. the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. All existing utilities are available and in close proximity. 6. The subject property is located on the northeast corner of Burnett Avenue North and N. 30th Street• in the Kennydale area of the city. 7. The site is generally level . A single family residence is located on the westerly portion of the site. The remainder of the site is vacant and covered with lawn grass and some trees and shrubs. ' 8. The Board of Adjustment granted the applicant a variance from the lot size requirements of the Zoning Code in order to permit the applicant to apply for this short plat. Section 4-729 (G; General ; Single Family Residential ; Minimum lot size - 6,000 square feet) requires a lot. area of 6,000 square feet. The applicant proposes dividing the subject parcel into two lots of 7,650 square feet (Lot 1 ) and 5,100 square feet (Lot 2), respectively. As proposed, the application requires an exception from. Section 9-1108.23(F) (3) (c) which requires a 60-foot lot width. The applicant proposes providing a 50-foot lot width. . 9. The applicant has also requested a waiver of the required off-site improvements for both Burnett Avenue N. and N. 30th Street pursuant to Section 9-1105.6(6) . 10. The subject request first was heard by the Examiner on July 8, 1980. The hearing was reopened after it was determined that applications for both the exception and waiver were required to accompany the subject proposal . 11. The Comprehensive Plan designates the area in which the subject property is located as suitable for the development of single family dwellings.. 12. The area is almost exclusively single family residential in character. Lot sizes vary from those meeting the minimum 6,000 square foot requirements of the G-6000• zone to large double and triple size lots up to 18,000 square feet in area. 13. The placement of the existing residence on the subject parcel would leave a 6-foot, 5-inch side yard on Lot 1 as proposed by the requested short plat. 14. ' There are generally no curbs or sidewalks in the area in which the subject site is located. An LID proposed for the area was defeated by a petition of about 682 of the area residents on July 28, 1980. CONCLUSIONS:' 1 .:' The short plat request appears to serve the public use and interest. The proposal.. is consistent with the Comprehensive Plan which designates the area for single family uses. Schools and park facilities are located within one to two miles of the site. 2. ;'While the proposal•. is not consistent with the zoning requirements of minimum 6,000::: :, squarefoot: lots, prior platting and preexisting development on the subject parcel ,prevent equal division of the subject property. Further, the Board of Adjustment has Issued a variance for substandard lot size for this parcel . The corner lot, though , perm1tsthe. parcels as proposed to take advantage of the spaciousness associated‘':.wiah.,'' ' large side yards as well as larger rear yards and therefore avoid the feeling ,'Of, ,;,;.;'::`.:';;. The exception request is justified because other reasonable means of subdividing this lot in conjunction with the variance issued by the Board of Adjustment would create . irregular lot configurations and/or further decrease the side or rear yards or both'. • of Lots 1 and 2. Development, both proposed and existing, will meet the other zoning requirements for yard sizes and percentage of developed lot area. 4. There is no evidence of other off-site improvements in the area surrounding the subject site. The residents of the area have just petitioned to defeat a proposed LID in the vicinity. Therefore, it would not serve any useful purpose to improver just the corner of Burnett Avenue and N. 30th Street absent such improvements in the area and absent prospects for similar installations in the near future. DECISION: Exhibit #2 i,s approved. The exception to allow a lot of less than 60-foot frontage on a public right-of-way is approved. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the. record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting other specified requirements. Copies of this ordinance are available for inspection in the Finance Department, first floor of City Hall , or same may be purchased at cost in said department. SUMMARY & PURPOSE 1W REQUEST: The applicant seeks approval of a two-lot short plat along with an exception to the Subdivision Ordinance to allow the creation of a 50-foot wide lot . The applicant also seeks a waiver of off—site improvements . The short plat was heard by the Hearing Examiner and continued to allow sufficient time for submission of applications for an exception and a waiver . B . NOTIFICATION: The applicant was notified in writing of the hearing date . Notice was properly published in the Seattle Times on July 23 , 1980 and posted in three places on or near the site as required by City Ordinance on July 17 , 1980 . C . PLANNIMIC DEPARTMENT AALYSIS: 1 . The proposed short plat is consistent with the Comprehensive Plan designation of single family for the site and surrounding area . 2 . The proposal is compatible with the existing single family uses adjacent to the subject site . 3 . Total area of the subject site is 12 , 750 square feet , the minimum lot size required in this zone is 6, 000 square feet . The plat as proposed by the applicant results in Lot #2 totaling 5 , 100 square feet . Due to this fact , the applicant sought and was granted a variance from the Board of Adjustment on January 17 , 1980 for reduced lot size . 4 . Planning staff comment on the variance application of number 3 above sought additional information regarding the precise location of the existing residence on proposed Lot #1 . This information has been submitted. 5 . The fifty foot lot width as proposed is insufficient and an exception has been requested to . Section 9-1108-23F3 (c ) which requires a minimum sixty foot lot width . 6 . All the lots in the vicinity are a standard of 50 feet in width . C .D. Hillman ' s Lake Washington Garden of Eden Subdivision - Division No . 1 covers approximately a twenty block area bounded by Lake Washington Blvd . on the west to Park Avenue North on the east and North 28th Street on the south and North 36th Avenue on the north . The applicant has requested a waiver from off-site improvements for street , curbs , gutters and sidewalks Eby citing that the area (Kennydale) is a "long established residential area that does not have . . . off-site improvements . " An L . I . D. to improve the area failed before the City Council on Monday might by a majority vote of 68 per cent . Since further subdivision is improbable in. the area (Lake Washington Garden of Eden, Division #1) the require- ment of improving this small stretch of street would appear totally out of place . However, the residents in the area should not consider it the responsibility of the City to improve their present situation . D . Topography : The site is generally level . 2 . Soils : Alderwood gravelly sandy loam (AgC) . Permeability is moderately rapid in the surface layer and subsoil and very slow in the substratum. The proposed short plat is consistent with the Compre- hensive Plan designation of single family_ for the site and surrounding areas. 2. The proposal is compatible with the existing single family uses adjacent to the subject site. 3. Total area of the subject site is 12, 750 square feet. the minimum lot size required in this zone is 6, 000 square feet. The plat as proposed by the applicant results in Lot #2 totaling 5, 100 square feet. Due to this fact, the applicant sought and was granted a Variance from the Board of Adjustment on January 17, 1980 for reduced lot size. 4. Planning staff comment on the Variance Application of number 3 above sought additional information ;regarding the precise location of the existing residence on proposed Lot #1. This information has been submitted. 5. The fifty foot lot width as proposed is insufficient and no exception has been requested. (Section 9-1108- 23F3 (c) requires a minimum sixty foot• lot width. 6. In order to meet the average minimum lot width of 60 feet; an additional 1,020 square feet for Lot #2 is required. This can be achieved in one of two ways: (a) 17 foot x 60 foot rectangle (b) 29 foot x 70 foot triangle (see Short Plat map) PLANNING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING: KATHLEEN KELLERHER, Short Plat 058-80 JULY 8, 1980 PAGE FOUR 7. Several factors would appear to support an exception from the sixty foot width and the approval of the Short Plat. The subject site is a small parcel with an existing residence whose location ,precludes equal division of the site, despite the fact that there is sufficient area for two lots. Therefore, it would seem to be a reasonable request for the Examiner to exercise his authority and consider the proposal. 8. The Examiner' s authority to review the application without a specific request for an exception is not fully clear. The ordinance language (9-1109 Exceptions) in conjunction with the approval provisions (9-1104 (1) ) would appear to grant the Examiner sufficient latitude to "approve, MODIFY, or disapprove" (9-1104 (1) ) the short plat and to "prescribe conditions desirable for the public interest" (9-1109 (1) ) . It should be further noted that the public interest would appear to have been broadly considered in that two hearings will have been held on the plat (Board of Adjustment and Hearing' Examiner) . • 9. The Engineering Division recommend Off-site improve- ments on both Burnett Avenue North and North 30th Street. Due to the traffic flows on both streets and the critical nature of this intersection the widening, lighting and other improvements will substantially improve the public health, safety and welfare. 10. Additional comments of other departments are attached for consideration. M. BACKGROUND: The applicant is requesting a reduction in the minimum lot size from the requested 6,000 square feet to 5,000 square feet to G-6000 zone. ANALYSIS: 1. The information submitted by the applicant does not show the location of the residence in relationship to the proposed lot. It is pos- sible that the requested variance is not necessary to allow the creation of two lots. Lot #1 is 7,650 square feet and lot #2 is 5,100 square feet. If lot #2 could be increased by 900 square feet, it would con- •form to the minimum lot size required in the G-6000 zone. RECOMMENDATION: It is recommended that the application be continued so that adequate information can be submitted con- cerning the location of the residence to Lot #1.
